HomeMy WebLinkAbout10-14-68 Council Meeting MinutesREGULAR MEETING OCTOBER 14, 1968 Be it remembered that the Common Council of the City of South Bend, Indiana met in the Council Chambers in City Hall on Monday, October 14, 1968 at 8:40 P.M., eight members present, one absent. The meeting was called to order by President Robert 0. Laven, who presided. ROLL CALL PRESENT: Councilman Laven, Allen, Craven, Reinke, Grounds, Szymkowiak, Palmer, and Zielinski. ABSENT: Wise REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend, Indiana: Your Committee on the inspection and supervision of the minutes would respectfully report that they have examined the minutes of the previous meeting of the Council and found them correct. REPORT OF COMMITTEE OF THE WHOLE Your Committee of the Whole to whom was referred "AN ORDINANCE ANNEXING TERRITORY TO THE MUNICIPAL CITY OF SOUTH BEND, INDIANA." (Located Near Ironwood and Edison) Respectfully report that they have examined the matter and that in their opinion the Ordinance go to the Council as favorable. /s/ William W. ORDINANCES, FIRST AND SECOND READING ORDINANCE AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702. (Located: Lincolnway and Sheridan) The Ordinance was given first reading by title and second reading in full. Councilman Allen made a motion the Ordinance be set for public hearing on October 28, 1968. Councilman Grounds seconded the motion. Motion carried. ORDINANCE AN ORDINANCE AMENDING CHAPTER 25, ARTICLE VI, SECTION 25 -80 OF ORDINANCE NO. 4608 -63, BEING THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, 1962, REDEFINING TRUCK ROUTES. The Ordinance was given first reading by title and second reading in full. Councilman Szymkowiak made a motion the Ordinance be set for public hearing on October 28, 1968. Councilman Reinke seconded the motion. Motion carried. ORDINANCE AN ORDINANCE FOR AN ADDITIONAL APPROPRIATION TO ACCOUNT Q -262, "MEDICAL, SURGICAL AND DENTAL' IN THE FIRE DEPARTMENT IN THE AMOUNT OF $3,000.00 AND THE TRANSFER OF SAID SUM FROM ACCOUNT Q -11, "SERVICES PERSONAL" IN THE FIRE DEPARTMENT, ALL BEING WITHIN THE GENERAL FUND. The Ordinance was given first reading by title and second reading in full. Councilman Zielinski made a motion the Ordinance be set for public hearing on October 28, 1968. Councilman Palmer seconded the motion. hin4-4 nn nnrri crl REGULAR MEETING continued) OCTOBER 14, 1968 ORDINANCES, FIRST AND SECOND READING ORDINANCE AN ORDINANCE APPROVING A CONTRACT BETWEEN THE WASTEWATER TREATMENT PLANT OF SOUTH BEND, INDIANA, AND WORTHINGTON CORPORATION, CHICAGO, ILLINOIS, FOR LABOR AND PARTS NECESSARY TO REPAIR A MODEL 42MC -1 WORTHING- TON PUMP IN THE TOTAL AMOUNT OF $5,554.87. The Ordinance was given first reading by title and second reading in full. Councilman Reinke made a motion the Ordinance be set for public hearing on October 28, 1968. Councilman Grounds seconded the motion. Motion carried. ORDINANCE AN ORDINANCE PROVIDING FOR THE RECEIVING AND CONVEYING OF A GIFT OF REAL PROPERTY TO THE CITY OF SOUTH BEND, INDIANA. The Ordinance was given first reading by title and second reading in full. Councilman Craven made a motion the Ordinance be set for public hearing on October 28, 1968. Councilman Szymkowiak seconded the motion. Motion carried. RESOLUTIONS RESOLUTION NO. 195 -68 A RESOLUTION FOR AN ADDITIONAL APPROPRIATION IN ACCOUNT E -215, "TRANSPORTATION ALLOWANCE" OF THE OFFICE OF CITY JUDGE, IN THE AMOUNT OF $250.00, AND THE TRANSFER OF THE SAME FROM ACCOUNT E -213, "TRAVELING EXPENSES ", ALL IN THE SAME CATEGORY, AND WITHIN THE GENERAL FUND. WHEREAS, certain extraordinary conditions have developed since the adoption of the existing annual budget, so that it is now necessary to appropriate more money than was appropriated in the annual budget for the various functions of city government to meet such extraordinary contingencies; and WHEREAS, additional funds to pay the Bailiff and the Probation Officer in the Office of City Judge, for mileage required in serving subpoenas and obtaining witnesses to assure its ability to properly perform its function and the sum of $250.00 is needed forthwith, and WHEREAS, a surplus exists in another account where it is not presently needed; and more specifically as follows, to -wit; $250.00 in Account E -213 designated as "Traveling Expenses ". NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, that the sum of $250.00 be transferred from Account E -213 designated as "Traveling Expenses ", to Account E -215 designated as Transportation Allowance ", both of said accounts being in the same category "Services Contractual" and being within the General Fund. /s/ Walter M. Allen asked if.this amount would be enough to last the rest of the year. Councilman Allen moved the Resolution be adopted by a roll call vote. Councilman Szymkowiak seconded the motion. Motion carried. The Resolution was adopted by a roll call vote of 8 ayes, Councilmen Laven, Allen, Craven, Reinke, Grounds, Szymkowiak, Palmer, and Zielinski. 0 nays, one absent, Councilman Wise. UNFINISHED BUSINESS Councilman Laven asked Dr. Bartholomew's Government Class, from Notre Dame University, to stand, and thanked them for coming to the meeting. Councilman Janet S. Allen read the following report from the Special Committee on Rules. COMMITTEE REPORT October 14, 1968 TS the Common Council of the City of South Bend, Indiana: Your Special Committee on Rules to whom was referred the establishing of a time for the hearing of citizen's requests (petitions, complaints) miscellaneous matters, respectfully report that they have examined the matter and that in their opinion the order of business as set out in The Municipal Code of South Bend, Article II, Section 2 -13, provides an established time, following the reading of the minutes for Communications, consider- ation of claims, petitions, remonstrances and memorials. Therefore your committee recommends the present agenda be utilized with the following provisions: a. A limit of one -half hour shall be available at any one session of the Council for communications, consideration of claims, petitions, remonstrances and memorials, unless extended by majority vote of members present. b. Motion carried. r1lo I, REGULAR MEETING (continued) OCTOBER 14, 1968 NEW BUSINESS Councilman Walter M. Szymkowiak suggested the Council direct a letter to John Brademas, Third District congress - man., for his efforts in obtaining Model City planning funds for South Bend. Councilman Reinke felt the Council should wait until official notification had been made. There being no further business to come before the Council, Councilman Palmer made a motion to adjourn.
