Home My WebLink About08-12-68 Council Meeting MinutesREGULAR MEETING AUGUST 12, 1968 Be it remembered that the Common Council of the City of South Bend, Indiana met in the Council Chambers in City Hall on Monday, August 12, 1968 at 10:35 P.M., nine members present, (Counilman Laven, Allen, Craven, Reinke, Grounds, Szymkowiak, Wise, Palmer and Zielinski). The meeting was called to order by President Robert 0. Laven, who presided. ROLL CALL PRESENT: Councilmen Laven, Allen, Craven, Reinke, Grounds, Szymkowiak, Wise, Palmer, and Zielinski. ABSENT: None REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend, Indiana: Your Committee on the inspection and supervision of the minutes would respectfully report that they have examined the minutes of the previous meeting of the Council and found them correct. REPORT OF COMMITTEE OF THEWHOLE To the Common Council of the City of South Bend, Indiana: Your Committee of the Whole to whom was referred "AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS TO ACCOUNT Q -221, "ELECTRIC SERVICE" IN THE AMOUNT OF $1,100.00 AND TO ACCOUNT Q -222, "GAS SERVICE" IN THE AMOUNT OF $1,600.00 AND THE TRANSFER OF SAID SUMS FROM ACCOUNT Q -11, "SALARIES" IN THE FIRE DEPARTMENT BUDGET, ALL BEING WITHIN THE GENERAL FUND." Respectfully report that they have examined the matter and that in their opinion the Ordinance go to the Council as favorable. /s/ William W. REPORT OF COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole to whom was referred "AN ORDINANCE FOR AN ADDITIONAL APPROPRIATION TO ACCOUNT MVH -43, "REPAIR PARTS" IN THE AMOUNT OF $9,000 AND THE TRANSFER OF SAID SUM FROM THE FOLLOWING ACCOUNTS: ACCOUNT XVH -11, "SERVICES PERSONAL" $4,200; ACCOUNT,MVH -422, "SALT" $2,800 AND ACCOUNT MVH -722, "MOTOR EQUIP- MENT" $2,000 AND ALL ACCOUNTS BEING IN THE MOTOR VEHICLE HIGHWAY FUND." REGULAR MEETING AUGUST 124-1968 REPORT OF COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole to whom was referred "AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS FROM THE GENERAL FUND IN THE AMOUNT OF $58,000.00 TO VARIOUS ACCOUNTS WITHIN THE GENERAL FUND, ". Respectfully report that they have examined the matter and that in their opinion the Ordinance go to the Council favorable, as amended. /s/ William W. REPORT OF COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole to whom was referred "AN ORDINANCE AMENDING CHAPTER 20, ARTICLE I, OF THE SOUTH BEND, INDIANA, MUNICIPAL CODE, 1962, (BOCA Basic Housing Code)." Respectfully report that they have examined the matter and that in their opinion the Ordinance be referred to the Ordinance Committee for further study and brought back out for third reading August 26, 1968. There being no objection, the report was accepted as read, and placed on file. REPORT OF COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole to whom was referred "AN ORDINANCE DESIGNATING A COMMUNITY ACTION AGENCY FOR THE CITY OF SOUTH BEND, INDIANA ". Respectfully report that they have examined the matter and that in their opinion the Ordinance go to'the Council as favorable. /s/ William W. REPORT OF AREA PLAN COMMISSION August 7, 1968 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached rezoning petition of Albert and Betty Hans was legally advertised under date of July 27 and August 3, 1968 and given public hearing on August 6, 1968. The following action was taken: After due consideration it was moved, seconded, and unanimously carried that the ordinance and site development plan be recommended favorably to the Common Council. REGULAR MEETING AUGUST 12 1968 ORDINANCES, THIRD READING ORDINANCE NO. 5025 -68 AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS FROM THE GENERAL FUND IN THE AMOUNT OF $58,000.00 TO VARIOUS ACCOUNTS WITHIN THE GENERAL FUND, AS AMENDED. The Ordinance was given third reading and passed by a roll call vote of 8 ayes, (Councilmen Laven, Allen, Reinke, Grounds, Szymkowiak, Wise, Palmer, and Zielinski). 1 nay (Councilman Craven), 0 absent. ORDINANCES, THIRD READING ORDINANCE NO. 5026 -68 AN ORDINANCE DESIGNATING A COMMUNITY ACTION AGENCY FOR THE CITY OF SOUTH BEND, INDIANA The Ordinance was given third reading and passed by a roll call vote of 9 ayes, (Councilmen Laven, Allen, Craven, Reinke, Grounds, Szymkowiak, Wise, Palmer, and Zielinski). 0 nays, 0 absent. ORDINANCES, FIRST AND SECOND READING ORDINANCE AN ORDINANCE AMENDING THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA -1962, SECTION 40 AS AMENDED AND GENERAL ORDINANCE NO. 4990 -68, AND THE ACCOMPANYING MAP THERETO, GENERALLY KNOWN AS THE SOUTH BEND ZONING ORDINANCE BY CHANGING THE CLASSIFICATION OF THE USE DISTRICT FOR A CERTAIN PARCEL OF LAND. (Michigan and Woodside) The Ordinance was given first reading by title and second reading in full. Councilman Szymkowiak made a motion the Ordinance be set for public hearing on August 26, 1968. Councilman Allen seconded the motion. Motion carried. ORDINANCES, FIRST AND SECOND READING ORDINANCE AN ORDINANCE FOR AN ADDITIONAL APPROPRIATION TO ACCOUNT M -252, "REPAIRS OF EQUIPMENT" IN THE AMOUNT OF $150.00 AND THE TRANSFER OF SAID SUM FROM ACCOUNT M -722, "MOTOR EQUIPMENT" IN THE BUILDING DEPARTMENT, ALL BEING WITHIN THE GENERAL FUND. The Ordinance was given first reading by title and second reading in full. Councilman Szymkowiak made a motion the Ordinance be set for public hearing on August 26, 1968. Councilman Reinke seconded the motion. Motion carried. NEW BUSINESS Councilman Grounds said he had recieved many complaints from the residents in the Pin Hook Lagoon area about rowdy behavior in the park during late hours. He also said, the Park Board was to put up a fence but nothing has been done as yet. Councilman Allen stated that this problem came up several years ago but the problem seems to Cefy _correction:. She suggested the sale of propeyty to the residents might help solve the situation. Mr. Taylor, City Engineer, said this is a public right of way and the Park Department owns five feet of the property and the city owns thirty feet. There being no further business to come before the Council, Councilman Palmer made a motion to adjourn. Councilman Wise seconded the motion. Motion carried. Time: 10:52 P.M.
