HomeMy WebLinkAbout08-12-68 Council Committee of the Whole Meeting MinutesCOMMITTEE:OF THE WHOLE MEETING AUGUST 12, 1968 Be it. remembered that the Common Council of the City of South Bend, Indiana, met in the Committee of the Whole in the Council Chambers of City Hall on Monday, August 12, 1968 at 8:08 P.M., nine members present, (Councilmen Laven, Allen, Craven, Reinke, Grounds, Szymkowiak, Wise, Palmer, and Zielinski). None absent. The Invocation was given by Councilman Robert 0. Laven. The meeting was called to order by Chairman William W. Grounds, who presided. ORDINANCE AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS TO ACCOUNT Q -221, "ELECTRIC SERVICE" IN THE AMOUNT OF $1,100.00 AND TO ACCOUNT Q -.222, "GAS SERVICE" IN THE AMOUNT OF $1,600.00 AND THE TRANSFER OF SAID SUMS FROM ACCOUNT Q -11, "SALARIES" IN THE FIRE DEPARTMENT BUDGET, ALL BEING WITHIN THE GENERAL FUND. This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Speaking for the Ordinance was Fire Chief Cecil McHenry who ex- plained the need for the appropriation was because Station 4 and Station 7 were open until June which was not budgeted. City Engineer Lloyd Taylor said in the 1968 Budget this account was reduced on the basis of the closing of the stations. Councilman Palmer made a motion the Ordinance go to the Council as favorable. Councilman Reinke seconded the motion. Motion carried. ORDINANCE AN ORDINANCE FOR AN ADDITIONAL APPROPRIATION TO ACCOUNT MVH -43, "REPAIR PARTS" IN THE AMOUNT OF $9,000 AND THE TRANSFER OF SAID SUM FROM THE FOLLOWING ACCOUNTS: ACCOUNT MVH -11, "SERVICES PERSONAL" $4,200; ACCOUNT MVH -422, "SALT" $2,800 AND ACCOUNT MVH -722, "MOTOR EQUIPMENT" $2,000 AND ALL ACCOUNTS BEING IN THE MOTOR VEHICLE HIGHWAY FUND. This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Speaking for the Ordinance was Street Commissioner Richard Gartner who explained that the money was needed for repairs to equipment and for other materials. The rebuilding of an asphalt refiniser cost $8,O00,which was not counted on in the budget, and three sweeper brooms were needed. Virginia Guthrie, executive secretary of the South Bend Civic Planning Association, questioned if perhaps it would not have been better to get new equipment. Mr. Gartner said a new refinisher would cost approximately $26,000. Councilman Wise asked how long before new equipment needed repairs and was told about three years. Councilman Szymkowiak made a motion the Ordinance go to the Council as favorable. Councilman Laven seconded the motion. Motion carried. ORDINANCE AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS FROM THE GENERAL FUND IN THE AMOUNT OF $58,000.00 TO VARIOUS ACCOUNTS WITHIN THE GENERAL FUND, This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Speaking for the Ordinance was Richard J. Duck, Superintendent of the Municipal Services Facility. He said that when the budget was drawn up for the Municipal Services Facility there was nothing for them to base their figures on. Virginia Guthrie questioned the additional $25,000 for gasoline and said the police mileage was up fifty percent. Mr. Duck explained the police were patrolling more and the price of gasoline had increased. Councilman Laven made a motion to amend item E. Section II to read $500.00 in Account U -37 "Other Supplies ". Councilman Allen seconded the motion. Motion carried. Councilman Laven made a motion the Ordinance go to the Council favorable as amended. Councilman Wise seconded the motion. Motion carried. ORDINANCE AN ORDINANCE AMENDING CHAPTER 20, ARTICLE I, OF THE SOUTH BEND, INDIANA, MUNICIPAL CODE, 1962. (BOCA Basic Housing Code) This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. City Building Commissioner Forrest R. West said South Bend has a Minimum Housing Standard Ordinance and this would be replaced with the Boca Housing Code, which is a nationally recognized code. Speaking against the Ordinance was Councilman Janet S. Allen who felt there were many things in the present code that were not covered in the Boca Housing Code. She also questioned the right of inspection given to the city officials in the proposed code. Councilman Wise moved the Ordinance be referred to Committee for further study. Councilman Allen seconded the motion. Motion carried. Mr. Howard Bellinger, executive director of the South Bend Redevelopment Commission, then told the Council that the new code was essential to recertification of the city's urban renewal programs by federal agencies, and the recertification was now pending until the new code was passed. Councilman Wise made a motion to amend the original motion to read "referred to Committee for further study; >and brought out of Committee for third reading August 26, 1968 ". Councilman Laven seconded the motion. Motion carried. ORDINANCE AN ORDINANCE DESIGNATING A COMMUNITY ACTION AGENCY FOR THE CITY OF SOUTH BEND, INDIANA This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. City Attorney Arthur Frisk will represent South Bend Community, Attorney Wyatt Mick, the Mishawaka Community, and Mr. Keith Klopfenstein, County Commissioner, St. Joseph County. Mr. Frisk said that leaders of all three political bodies, the county and two cities had agreed to designate ACTION Inc. and that the necessary notices had been given. The designation was the result of the so- called 1967 Green amendment to the 1964 Economic Opportunity Act, which provides that governmental agencies can gain some say in the poverty war. The units must designate a private agency and this can be done by executive order or legislative action.. _. COMMITTEE OF THE WHOLE (continued AUGUST 12. 1968 City Attorney Arthur Frisk said that application will be made to the federal Office of Economic Opportunity, and that necessary notices had been given. Mr. James Gentry, fiscal officer for ACTION Inc., explained the $20,000 county contribution represented the local share of the cost of central administration, and that until now that share had been supplied through the services of the United Community Services. Mr. Jesse Dickinson said this program has to have contributions from the community and South Bend has not participated. Once it is passed the city is then involved and this will give the local government a hand in it. Mr. Reinke questioned where they secured the figure of $20,000 and Mr. Klopfenstein said there had been several meetings held with Mayor Margaret Prickett of Mishawaka, Mayor Lloyd M. Allen, and several from Chicago and the board felt this figure was what was needed. Councilman Allen giiestioned_ why it was a Private Non Profit Agency, and was told this is the term used in the Federal Government Guidelines. Councilman Laven moved the Ordinance go to the Council as favorable. Councilman Craven seconded the motion. Motion carried. There being no further business before the Committee of the Whole, Councilman Laven made a motion to rise and report to. the Council. Councilman Craven seconded the motion. Motion carried.
