;OMKITTEE OF THE WHOLE MEETING MARCH 11. 1968
Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Committee of the
Whole in the Council Chambers of City Hall on Monday, March 11, at 8:00 P.M., with all members present.
The Invocation was given by Reverend Stanley M. Dodgson, First Baptist Church. The meeting was called to
order by Chairman William W. Grounds, who presided.
ORDINANCE
AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702
(Location: West side Phillipa Street, in 1600 block)
This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were
given an opportunity to be heard thereon. Councilman Wise made a motion that the Ordinance go to the
Council as favorable. Councilman Palmer seconded the motion. Motion carried.
ORDINANCE
AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 40
OF THE MUNICIPAL CODE OF SOUTH BEND, INDIANA
(Location: 805 -811 North Michigan St.).
This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were
given an opportunity to be heard thereon. Councilman Allen made a motion that the Ordinance go to the
Council as favorable. Councilman Szymkowiak seconded the motion. Motion carried.
ORDINANCE
AN ORDINANCE TO REGULATE AND RESTRICT THE LOCATION OF TRADES,
CALLINGS, INDUSTRIES, COMMERCIAL ENTERPRISES, AND THE LOCATION
OF BUILDINGS DESIGNED FOR SPECIFIED USES; TO REGULATE AND LIMIT
THE HEIGHT OF BUILDINGS HEREAFTER ERECTED OR ALTERED; TO REGULATE
AND DETERMINE THE AREA OF YARDS AND OTHER OPEN SPACES ABOUT
BUILDINGS; TO REGULATE AND DETERMINE THE DENSITY OF USE OF LAND
AND LOT AREAS, AND FOR SAID PURPOSES TO DIVIDE THE CITY INTO
DISTRICTS AND PRESCRIBE PENALTIES FOR THE VIOLATION OF ITS
PROVISIONS AND TO PROVIDE FOR ITS ENFORCEMENT AND A BOARD OF
ZONING APPEALS.
WHEREAS, THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA,
DEEMS IT NECESSARY, IN ORDER TO CONSERVE THE VALUE OF PROPERTY IN
THE CITY AND TO THE END THAT ADEQUATE LIGHT, AIR CONVENIENCES OF
ACCESS AND SAFETY FROM FIRE AND OTHER DANGERS MAY BE SECURED,
THAT CONGESTION OF THE PUBLIC STREETS MAY BE LESSENED OR AVOIDED,
AND THAT THE PUBLIC HEALTH, SAFETY, COMFORT, CONVENIENCE, MORALS AND GEN-
ERAL WELFARE MAY OTHERWISE BE PROMOTED IN ACCORDANCE WITH A WELL
CONSIDERED AND COMPREHENSIVE PLAN FOR THE USE AND DEVELOPMENT OF
ALL PROPERTY THROUGHOUT THE CITY, AND
WHEREAS, THIS ORDINANCE IS SUBSTANTIALLY SIMILAR TO ORDINANCE
NO. 3702 OF THE CITY OF SOUTH BEND, INDIANA, COMMONLY KNOWN AS
THE ZONING ORDINANCE OF SAID CITY, WHICH SAID ORDINANCE WAS
ADOPTED ON JUNE 13, 1949, AND WHICH SAID ORDINANCE IS HEREBY
REPEALED.
This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were
given an opportunity to be heard thereon. Councilman Wise made a motion that the Ordinance go to the
Council as favorable. Councilman Szymkowiak seconded the motion. Motion carried.
ORDINANCE
AN ORDINANCE APPROVING A CONTRACT BETWEEN THE
WATER WORKS OF THE CITY OF SOUTH BEND, INDIANA,
AND PATTEN INDUSTRIES, INCORPORATED, HAMMOND,
INDIANA, FOR THE PURCHASE OF AN INDUSTRIAL,TRAC-
TOR WITH BACKHOE IN THE SUM OF $11,197.00.
This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were
given an opportunity to be heard thereon. Councilman Reinke made a motion that the Ordinance go to the
Council as: favorable. Councilman Laven seconded the motion. Motion carried.
ORDINANCE
AN ORDINANCE AMENDING SECTION 36 -6,
RATES OF FARE, OF THE MUNICIPAL CODE OF
THE CITY OF SOUTH BEND, INDIANA, 1962,
SAID ARTICLE BEING COMMONLY KNOWN
AS THE TAXI CAB ORDINANCE.
Mr. Laven made a motion that the Ordinance be withdrawn in compliance with a request of Mr. F. J. Nimtz,
Attorney; and that a new Ordinance be submitted. Councilman Allen seconded the motion. Motion carried.
There being no further business before the Committee of the Whole, Councilman Laven made a motion that the
members of the Committee rise and report to the Council, and that a recess be held at that time. Councilman
Allen seconded the motion. Motion carried. Time: 8 :50 P.M.
