REPORT OF AREA PLAN COMMISSION February 23, 1968 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached rezoning petition of Arthur Demby was legally advertised under date of February 10 and 17 and given public hearing on February 20, 1968. The following action was taken: After due consideration it was moved, seconded and unanimously carried that the ordinance and site development plan be recommended favorably to the Common Council. REGULAR MEETING- FEBRUARY 26 1968 REPORT OF AREA PLAN COMMISSION February 20, 1968 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached ordinance originated by the Area Plan Commission was legally advertised under date of February 10 and 17 and given public hearing on February 20, 1968. The following action was taken: After due consideration it was moved, seconded and unanimously carried that the ordinance and accompanying maps be recommended favorably to the Common Council. ORDINANCES, THIRD READING ORDINANCE NO. 4982 -68 AN ORDINANCE APPROVING A CONTRACT BETWEEN THE WATER WORKS OF THE CITY OF SOUTH BEND, INDIANA, AND INLAND CHEMICAL CORPORATION, SOUTH BEND, INDIANA, FOR THE PURCHASE OF AN ASSORTMENT OF CHEMICALS FOR USE FROM FEBRUARY 7, 1968 TO FEBRUARY 7, 1969 IN THE AMOUNT OF $16,056.50 The Ordinance was given third reading and passed by a roll call vote of 6 ayes, (Councilmen Laven, Craven, Reinke, Grounds, Wise and Palmer), 3 nays, (Councilmen Allen, Szymkowiak and Zielinski), 0 absent. Councilmen Allen, Szymkowiak and Zielinski prefaced their votes with the statement that inasmuch as the ordinande'ipproves a contract for purchase of hydrofluosilicic acid as well as liquid chlorine, it was necessary that they vote negative. Although they were in favor of the use of chlorine, the fact that the two chemicals were included in one ordinance necessitated the negative votes. ORDINANCES, THIRD READING ORDINANCE NO. 4983 -68 AN ORDINANCE FOR AN ADDITIONAL APPROPRIATION TO ACCOUNT G -726, "OFFICE EQUIPMENT ", IN THE AMOUNT OF $456 AND THE TRANSFER OF SAID SUM FROM ACCOUNT G -52, "RENTS ", IN THE OFFICE OF CITY ATTORNEY AND IN THE GENERAL FUND. The Ordinance was given third reading and passed by a roll call vote of 8 ayes,(Councilmen Laven, Allen, Craven, Grounds, Szymkowiak, Wise, Palmer and Zielinski), 1 nay, (Councilman Reinke), 0 absent. ORDINANCES, THIRD READING ORDINANCE NO. 4984 -68 AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN THE (1) MUNICIPAL BONDS OF 1962 - $8,165.90 (2) MUNICIPAL BONDS OF 1965 $2,479.40 - (3) MUNICIPAL BONDS OF 1967 - $361,121.23 The Ordinance was given third reading and passed by a roll call vote of 9 ayes, (Laven, Allen, Craven, Reinke, Grounds, Szymkowiak, Wise, Palmer and Zielinski), 0 nays, 0 absent. Councilman Szymkowiak made a motion that the Ordinance be set for public hearing on March 11, 1968. Councilman Grounds seconded the motion. Motion carried. ORDINANCES, FIRST AND SECOND READING AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 40 OF THE MUNICIPAL CODE OF SOUTH BEND, INDIANA (Location: 805 -811 North Michigan St.). The Ordinance was given first reading by title and second reading in full. Councilman Szymkowiak made a motion that the Ordinance be given public hearing on March 11, 1968. Councilman Reinke seconded the motion. Motion carried. ORDINANCES, FIRST AND SECOND READING AN ORDINANCE TO REGULATE AND RESTRICT THE LOCATION OF TRADES, CALLINGS, INDUSTRIES, COMMERCIAL ENTERPRISES,.AND THE LOCATION OF BUILDINGS DESIGNED FOR SPECIFIED USES; TO REGULATE AND LIMIT THE HEIGHT OF BUILDINGS HEREAFTER ERECTED OR ALTERED;, TO REGULATE AND DETERMINE THE AREA OF YARDS AND OTHER OPEN SPACES ABOUT BUILDINGS; TO REGULATE AND DETERMINE THE DENSITY OF USE OF LAND AND LOT AREAS, AND FOR SAID PURPOSES TO DIVIDE THE CITY INTO DISTRICTS AND PRESCRIBE PENALTIES FOR THE VIOLATION OF ITS PROVISIONS AND TO PROVIDE FOR ITS ENFORCEMENT AND A BOARD OF ZONING APPEALS. WHEREAS, THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, DEEMS IT NECESSARY, IN ORDER TO CONSERVE THE VALUE OF PROPERTY IN THE CITY AND TO THE END THAT ADEQUATE LIGHT, AIR CONVENIENCES OF ACCESS AND SAFETY FROM FIRE AND OTHER DANGERS MAY BE SECURED, THAT CONGESTION OF THE PUBLIC STREETS MAY BE LESSENED OR AVOIDED, AND THAT THE PUBLIC HEALTH, SAFETY, COMFORT, CONVENIENCE, MORALS AND GEN- ERAL WELFARE MAY OTHERWISE BE PROMOTED IN ACCORDANCE WITH A WELL CONSIDERED AND COMPREHENSIVE PLAN FOR THE USE AND DEVELOPMENT OF ALL PROPERTY THROUGHOUT THE CITY, AND WHEREAS, THIS ORDINANCE IS SUBSTANTIALLY SIMILAR TO ORDINANCE NO. 3702 OF THE CITY OF SOUTH BEND, INDIANA, COMMONLY KNOWN AS THE ZONING ORDINANCE OF SAID CITY, WHICH SAID ORDINANCE WAS ADOPTED ON JUNE 13, 1949, AND WHICH SAID ORDINANCE IS HEREBY REPEALED. The Ordinance was given first reading by title. Councilman Wise made a motion that second reading of the Ordinance be waived. Councilman Grounds seconded the motion. Motion carried. Councilman Szymkowiak made a motion that the Ordinance be set for .public hearing on March 11, 1968. Councilman Craven seconded the motion. Motion carried. REGULAR MEETING FEBRUARY 26, 1968 ORDINANCES, FIRST AND SECOND READING ORDINANCE AN ORDINANCE APPROVING A CONTRACT BETWEEN THE WATER WORKS OF THE CITY OF SOUTH BEND, INDIANA, AND PATTEN INDUSTRIES, INCORPORATED, HAMMOND, INDIANA, FOR THE PURCHASE OF AN INDUSTRIAL TRAC- TOR WITH BACKHOE IN THE SUM OF $11,197.00. The Ordinance was given first reading by title and second reading in full. Councilman Grounds made a motion that the Ordinance be set for public hearing on March 11, 1968. Councilman Szymkowiak seconded the motion. Motion carried. ORDINANCES, FIRST AND SECOND READING ORDINANCE AN ORDINANCE AMENDING SECTION 36 -6, RATES OF FARE, OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, 1962, SAID ARTICLE BEING COMMONLY KNOWN AS THE TAXICAB ORDINANCE The Ordinance was given first reading by title and second reading in full. Councilman Palmer made a motion that the Ordinance be set for public hearing on March 11, 1968. Councilman Szymkowiak seconded the motion. Motion carried. RESOLUTION RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA WHEREAS, THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF SOUTH BEND, DID ON THE 21st DAY OF FEBRUARY, 1968, ADOPT A RESOLUTION ACCEPTING AND APPROVING A FEASIBILITY STUDY FOR MUNICIPALLY OPERATED PARKING PROGRAM PREPARED BY AREA PLAN COMMISSION OF ST. JOSEPH COUNTY, IND., AND HARLAND BARTHOLOMEW AND ASSOCIATES OF MEMPHIS, TENNESSEE FILED WITH SAID BOARD ON NOVEMBER 27, 1967, CONTAINING RECOMM- ENDATIONS ON THE LOCATION, SIZE AND CHARACTER OF AND THE PROBABLE COST OF ACQUIRING AND DEVELOPING CERTAIN LAND AND THE CONSTRUCTION THEREON OF SEMI - ENCLOSED DECK, SELF PARK TYPE STRUCTURES WITH ATTENDANT PAY BOOTHS FOR MUNI- CIPAL PARKING. The Resolution was given first readin-g by title and second reading in full. Councilman Reinke made a motion that the Resolution be given public hearing on March 25, 1968. Councilman Allen seconded the motion. Motion carried, 8 ayes, (Councilmen Allen, Craven, Reinke, Grounds, Szymkowiak, Wise, Palmer and Zielinski), 1 nay (Councilman Laven), 0 absent. President Laven welcomed members of Dr. Bartholemew's Government class from the University of Notre Dame, and invited them to attend future Council meetings. OLD BUSINESS President Laven reported that the Ordinance Committee has been meeting with various interested groups with regard to the proposed fair housing ordinance. He further stated that due to the great deal of interest shown by various groups it may be several weeks before final reading is given the ordinance. NEW BUSINESS Councilman Allen requested that the Clerk communicate with the Sanitation Department inquiring as to the feasibility of planting regular grass seed along with the rye seed, when seeding land at the landfill site. Councilman Szymkowiak complained about stray dogs throughout the City, and expressed hope that the Humane Society would patrol streets and catch the dogs, relieving property owners from reporting them. Councilman Szymkowiak also stated that he had counted many junk cars on the City streets, and appealed.to the Police Department to issue citations when such autos are detected. There being no further business to come before the Council, Councilman Wise made a motion to adjourn. Councilman Reinke seconded the motion. Motion carried. Time: 9:40 P.M.
