FEBRUARY 14, 1972
Be it remembered that the Common Council of the City of South Bend, Indiana met in the Council
Chambers of the County -City Building on Monday, February 14, 1972 at 8:02 p.m. The meeting was
called to order by President Peter J. Nemeth who then asked everyone to stand and give the
Pledge of Allegiance to the flag.
ROLL CALL
PRESENT: Councilmen Serge, Szymkowiak, Miller, Parent, Taylor, Kopczynski, Horvath,
Newburn and Nemeth.
ABSENT: None
RESOLVE INTO THE COMMITTEE OF THE WHOLE
Council President Nemeth entertained a motion to resolve into the Committee of the Whole.
Councilman Parent so moved seconded by Councilman Miller. Motion carried.
COMMITTEE OF THE WHOLE MEETING

of the Whole in the Council Chambers of the County -City Building on Monday, February 14, 1972
at 8:04 p.m. with nine members present. The meeting was called to order by Chairman Odell
Newburn, who presided.

AN ORDINANCE AMENDING AND SUPPLEMENTING
ORDINANCE NO. 4990 - CHAPTER 40 OF THE
MUNICIPAL CODE (FORMERLY ZONING ORDINANCE
NO. 3702). (4001 and 4015 SOUTH MAIN STREET)
This being the time heretofore set for public hearing on the above ordinance, proponents and
opponents were given an opportunity to be heard thereon. Mr. Douglas Carpenter, representing
the Area Plan Commission, reported that th4s site is to be used for a Post Office Sub - Station
and that the Area Plan Commission was recommending its approval. Councilman Parent made a
motion that the Ordinance go to the Council as favorable, seconded by Councilman Taylor.
Motion carried.
ORDINANCE
AN ORDINANCE AMENDING AND SUPPLEMENTING
ORDINANCE NO. 4990 -68, CHAPTER 40 OF THE
MUNICIPAL CODE OF THE CITY OF SOUTH BEND,
INDIANA, FORMERLY REFERRED TO AS ZONING
ORDINANCE NO. 3702, AS AMENDED. (18389 EDISON ROAD)
This being the time heretofore set for public hearing on the above ordinance, proponents and
opponents were given an opportunity to be heard thereon. Mr. Douglas Carpenter, of the Area
PlAh Commistion, reported that this site is located at Edison Road and Indiana #23 and is
presently being used as a barber shop and a residence and that the owner is requesting this
change. Councilman Taylor made a motion that the Ordinance go to the Council as favorable
seconded by Councilman Parent. Motion carried.
There being no further business to be considered before the Committee of the Whole, Chairman
Newburn entertained a motion to rise and report to the Council, so moved by Councilman Taylor,
seconded by Councilman Szymkowiak. Motion carried. Time 8:10 p.m.

REGULAR MEETING - RECONVENED
Be it remembered that the Common Council of the City of South Bend, Indiana reconvened in the
Council Chambers in the County -City Building on Monday, February 14, 1972 at 8:11 p.m., Council
President Peter J. Nemeth presiding.
REPORT OF THE COMMITTEE ON MINUTES
Your committee on the inspection and supervision of minutes would respectfully report that they
have inspected the minutes of the January 24, 1972 regular meeting of the Council and found
them correct. They, therefore, recommend that the same be approved.

Upon motion made by Councilman Taylor, seconded by Councilman Newburn, and carried, the report
was accepted as read and placed on file.
CITIZENS REQUESTS - MISCELLANEOUS MATTERS
Mrs. Lee Swan, 2022 Swygart Street, spoke to the Council about the loss of federal funds to the
city and questioned whether the inspection of homes mandated by HUD was one instance where the
city had failed to meet federal requirements. Councilman Newburn explained that the-inspection
of homes was made through Code Enforcement not HUD and that the possible loss of federal money
was because there is not enough representation of minority groups in the skilled building trades.
Mrs. Frederick Mutzl, 320 Parkovash, a member of the Fair Tax Association, asked if it would be
possible to obtain a list of city -owned property. City Attorney Charles Sweeney, Jr. explained
that the Legal Department is now in the process of compiling a list of city -owned property which
will be filed with the Board of Public Works and will be available for inspection when completed.
Mrs. Ann Wlodarski, 1869 Riverside Drive, a member of the Fair Tax Association, inquired whether
the fact that there were investigations going on in Model Cities Areas has any bearing on the
withdrawal of federal funds. Councilman Newburn explained that this had no bearing on the loss
of federal money. Mrs. Wlodarski also asked about employees of the city who had been involved
in the Model Cities trash hauling program and about the sale of a bulldozer to St. Joseph
County. City Engineer William Richardson replied that the employees who had been involved in
the Model Cities trash removal program had been terminated and were on the waiting list for
other city employment and that the bulldozer had been appraised by a private concern and the
city was given $20,000 credit for dumping at the county landfill for it.

A report relating to the zoning of property located at 4001 -4015 South Main Street was read as
follows:

to zone property located at 4001 -15 South Main Street.
The attached zoning ordinance originated by the Area Plan Commission of
St. Joseph County was advertised for public hearing on December 11 and 18, 1971
and a public hearing was held on Tuesday, December 21, 1971 at which time the
following action was taken:
After due consideration, a motion was made, seconded and unanimously
carried to recommend this proposed ordinance for approval to the
Common Council of the City of South Bend.
Excerpts from the minutes of the Area Plan Commission meeting are attached.

The attached zoning ordinance originated by the Area Plan Commission of
St. Joseph County was advertised for public hearing on December 11 and 18, 1971
and a public hearing was held on Tuesday, December 21, 1971 at which time the
following action was taken:
After due consideration, a motion was made, seconded and unanimously
carried to recommend this proposed ordinance for approval to the
Common Council of the City of South Bend.

and Nemeth). 0 nays.

This ordinance was given first reading by title and second reading in full. Councilman Serge
made a motion, seconded by Councilman Taylor, that the ordinance be set for public hearing on
February 28, 1972. Motion carried.

AN ORDINANCE APPROVING A CONTRACT BETWEEN THE
WATER WORKS OF THE CITY OF SOUTH BEND, INDIANA
AND INLAND CHEMICAL CORPORATION, SOUTH BEND,
INDIANA FOR THE PURCHASE OF CHEMICALS FOR USE
FROM FEBRUARY 7, 1972 TO FEBRUARY 7, 1973 IN
THE AMOUNT OF $6,811.50.
This ordinance was given first reading by title and second reading in full. Councilman Horvath
made a motion that the ordinance be set for public hearing on February 28, 1972. Seconded by
Councilman Kopczynski. Motion carried.

AN ORDINANCE APPROVING A CONTRACT BETWEEN THE
WATER WORKS OF THE CITY OF SOUTH BEND, INDIANA
AND BADGER METER MANUFACTURING COMPANY, MILWAUKEE,
WISCONSIN FOR THE PURCHASE OF AN ASSORTMENT OF
WATER METERS FOR USE FROM FEBRUARY 7, 1972 TO
FEBRUARY 7, 1973 IN THE AMOUNT OF $210,212.36.
This ordinance was given first reading by title and second reading in full. Upon motion made
by Councilman Newburn, seconded by Councilman Szymkowiak, and carried, the ordinance was set
for public hearing on February 28, 1972.
REPORT FROM CIVIC CENTER COMMITTEE
Councilman Miller read the following report from the Civic Center Committee:
"Your committee on the Civic Center, to whom was referred the task of
developing-an initial study report as to the relationship of the
Morris Auditorium to the development of a Cultural Center in our
community, respectfully report that they have examined the matter and
that, in their opinion:
1. Immediate steps should be taken for the installation of a
heating and air conditioning system in the Morris Auditorium.

2. South Bend cannot afford both Morris Auditorium and a 700
seat theater in the proposed cultural center.
3. South Bend should commit itself to either:
a. construction of a new 2500 seat auditorium as part of a
cultural center and eventual abandonment of Morris
Auditorium upon construction of a new theater; or
b. remodeling and refurbishing of Morris Auditorium and
abandonment of plans for a 700 seat theater in
cultural center.
4. If part 3a is the choice, then the Palais Royale should be
eliminated from consideration as a possible convention center.
At any rate, a decision should be made before the city makes any more commitments
in the matter.

Councilman Miller requested that all civic agencies or interested individuals get a report to
the Civic Center Committee of the Council on land needs, building space, and the number of
people that might be served by the cultural center. Council President Nemeth said that
completion of the project is many years in the future and that some definite decisions should
be made before we spend any more money. Councilman Newburn introduced some students from
Indiana University who were in the audience and invited them to attend future meetings.
There being no further business, unfinished or new, to come before the Council, Councilman
Taylor made a motion to adjourn, seconded by Councilman Kopczynski. Motion carried. Time 8:40
