This is EXHIBIT K, consisting of 3 pages, referred to in and part of the Agreement between Owner and Engineer for Professional Services dated August 19, 2026. AMENDMENT TO OWNER-ENGINEER AGREEMENT Amendment No. ___2__ 1.Background Data: a.Effective Date of Owner-Engineer Agreement:February 6th, 2026 b.Owner:City of South Bend, Indiana, by and through its Board of Public Works c.Engineer: Hanson Professional Services Inc. d.Project:Tri-Day Site Development 2.Description of Modifications: a. Engineer shall perform or furnish the following Additional Services: Advance the design of the Tri-Day Site Development to 100%. 0.0 Project Management: Coordinate the Project, Provide Status reports and various meetings. 5.6 Permits: CSGP Application: Prepare a Construction Stormwater General Permit (CSGP) application due to one or more acre of land disturbance by the project. This application includes a Construction/Stormwater Pollution Prevention Plan (SWP3) and a Notice of Intent (NOI). The SWP3 will be submitted to the St. Joseph County Soil and Water Conservation District. Prepare and submit IDEM water main extension and sanitary sewer construction permits. 8.1 Design Roadway and Civil: Complete the design for the roadways and sidewalks within the right-of-way (ROW), including a final top of ground surface model within the ROW. This work shall include the design and layout of storm sewer structures and piping. Hanson will coordinate with the developer’s civil engineer to finalize building pad finished floor elevations, sidewalk connections at the ROW, pavement connections to driveway entrances, and site drainage connections to the storm sewer. Preparation and submittal of plans, contract documents and Opinion of Probable Construction Cost (OPCC) for 60%, 90% and 100% (Issued for Bid). As-built record drawings will be submitted in .pdf format. 10.1 Traffic Design: Complete the review of traffic flow and finalize the layout of pavement markings and signage. Review and finalize sidewalks, roadway crossings, and curb ramps for ADA compliance. 11.1 Lighting Design: Coordinate with local utility company for a new electrical service. Provide photometric calculations to determine the proper spacing of the light poles and fixtures based on IES RP8 standards. Prepare site lighting plan, detail sheets, schedules, circuit diagrams, special provisions and summary of quantities. 17.5 Detention/Storm Sewer Hydraulic Design: Complete detention and storm sewer models and design for the proposed detention basin and site storm sewer system Infiltration test results provided by the geotechnical subconsultant will be utilized in the design of the detention basin utilizing HydroCAD software. It is assumed that detention without discharging to the surface can be provided for the 100-yr storm event and located on the property and within the green space south of the proposed development. The design and modeling of alternative options for detention (e.g. alternative locations, underground detention, etc.) is not included in this scope and would be considered an additional service. StormCAD will be utilized to simulate a storm sewer layout and aid in the design of the pipe parameters. Model results will be coordinated with the design team to implement the parameters into the design plans. 20.1 Bidding and Construction Phase Service: Preparation of contract document addenda. Shop drawing reviews. Review and preparation of responses to contractor requests for information (RFIs). 25.4, 25.5 Water Main and Sanitary Design: Complete the design for the proposed water main and sanitary sewer main to service the development. The design of services to proposed buildings is not included in this scope, but Hanson will coordinate with the developer’s engineer to accommodate these services. The proposed design includes the “taps” for this Tri-Day development and design of the water and sewer services to the back of the right of way. The proposed water and sanitary sewer will connect to the city’s existing water and sanitary sewer infrastructure located at the north end of Foundation Drive. The city is responsible for acquiring the necessary easement for the proposed alignment and connection. b. The amendment does not include engineering services for the following: 1) Negotiation of any easements or preparation of plats or easements documents. 2) Preparation of any permit applications or supporting documentation not specifically identified above. 3) Review and permit fees, if required, are not included. 4) Landscape design and/or preparation of a landscape plan. 5) Design of site retaining walls, if any. 6) Design or layout plans of gas, telephone, cable TV or network/fiberoptic utilities. 7) Utility Coordination with existing utilities. 8) Design of a sewage ejector pump system or sewage lift station. It is assumed that a gravity flow connection can be made to the existing city infrastructure at the north end of Foundation Drive. 9) Pavement design calculations or recommendations. The plans will reflect the typical pavement sections outlined in the City of South Bend Indiana Construction Standards & Specifications, latest edition. 10) Design of storm water quality or underground storm water detention systems. 11) Bidding and construction phase services not stated above. 12) Construction layout and staking. 13) Preparation of exhibits or figures for promotional material or presentations.
