ROLL CALL PRESENT: Council Members Serge, Szymkowiak, Beck, Taylor, Kopczynski, Crone, Voorde and McGann ABSENT: Council Member Dombrowski REPORT FROM THE SUB- COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your sub - committee on the inspection and supervision of the minutes would respectfully report that it has inspected the minutes of the January 7, 1980 meeting of the Council and found them correct. The sub - committee, therefore, recommends that the same be approved. /s /Lewis A. McGann /s /Beverlie J. Beck Council Member Serge made a motion that the minutes of the January 7, 1980 meeting of the Council be accepted and placed on file, seconded by Council Member Kopczynski. The motion carried. SPECIAL BUSINESS Council Member McGann announced that Council Member Serge had been reappointed to the Area Plan Commission. Irene Gammon, City Clerk, swore Council Member Serge into the Commission. Council President McGann announced that Joan Weber had resigned from the South Bend Energy Commission. He indicated that Ann Seckinger, was willing to assume her duties. Council Member Taylor made a motion to appoint Ann Seckinger to the Energy Commission, seconded by Council Member Kopczynski. The motion carried. Council President McGann announced that the Council had two appointments to the Century Center Board of Managers. Council Member Taylor made a motion to appoint Terry Miller and Beverlie Beck to the Board, seconded by Council Member Serge. The motion carried. Council Member Taylor made a motion to reappoint Algie Oldham to the Police Merit Board, seconded by Council Member Crone. The motion carried. Council Member Taylor made a motion to resolve into the Committee of the Whole, seconded by Council Member Kopdzynski. The motion carried. REGULAR MEETING JANUARY 14, 1980 COMMITTEE OF THE WHOLE Be it remembered that the Common Council of the City of South Bend met in the Committee of the Whole on Monday, January 14, 1980, at 7:05 p.m., with eight members present. Chairman Szymkowiak presiding. BILL NO. 199 -79 A BILL APPROVING THE FORM AND TERMS OF TRUST INDENTURE AND USER AGREEMENT, REAL ESTATE MORTGAGE AND INDUSTRIAL DEVELOPMENT REVENUE BONDS, AND AUTHORIZING THE EXECUTION THEREOF.AND APPROVING RESOLUTION NO. 40 -79 OF THE SOUTH BEND ECONOMIC DEVELOPMENT COMMISSION RELATING TO THE SAME COSSMAN AND VIRGINIA COSSMAN PROJECT. This bing the time heretofore set for public hearing on the above bill, proponents and opponent: were given an opportunity to be heard. Mr. Kenneth Fedder, attorney for the Economic Developmel Commission, made the presentation for the bill. He indicated this $320,000.00 bond issue would be used for acquisition of real estate and construction of a building located at 2326 Edison Road. He indicated this would be a car wash operation , creating approximately five new jobs in the Community. Council Member Taylor made a motion to recommend this bill to the Council favorable, seconded by Council Member Kopczynski. The motion carried. Council President McGann indicated he had received a letter requesting that the next two bills be continued until the January 28, 1980 meeting of the Council. BILL NO. 148 -79 A BILL DESIGNATING AND ESTABLISHING AN HISTORIC LANDMARK UNDER ORDINANCE NO. 5565 -73, AMENDING ORDINANCE NO. 4990 -68, AS AMENDED, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND (NORTH PUMPING STATION.) BILL NO. 149 -79 A BILL DESIGNATING AND ESTABLISHING AN HISTORIC LANDMARK UNDER ORDINANCE NO. 5565 -73, AMENDING ORDINANCE NO. 4990 -68, AS AMENDED, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND (MORRIS CIVIC.) Council President McGann made a motion to continue public hearing on these bills until January 28, 1980, seconded by Council. Member Kopczynski. The motion carried. BILL NO. 200 -79 A BILL APPROPRIATING $24,000.00 FROM THE FEDERAL ASSISTANCE GRANT, COMMONLY KNOWN AS GENERAL REVENUE SHARING, TO FUND THE POSITION OF SAFETY BOARD ASSISTANT, TO BE ADMINISTERED BY THE CITY OF SOUTH BEND THROUGH ITS DEPARTMENT OF LAW. This being the time heretofore set for public hearing on the above bill, proponents and opponen- were given an opportunity to be heard. Mayor Roger Parent made the presentation for the bill. He indicated that this position was approved by the previous Council, and at that time it was intended it would be funded with Revenue Sharing moneys. Council Member Kopczynski made a motion to recommend this bill to theCouncil favorable, seconded by Council Member Taylor. The motion carried. BILL NO. 201 -79 A BILL APPROPRIATING $24,100.00 FROM THE FEDERAL ASSISTANCE GRANT COMMONLY REFERRED TO AS GENERAL REVENUE SHARING, FOR DOG ENFORCEMENT PERSONNEL, TO BE ADMINISTERED BY THE CITY OF SOUTH BEND THROUGH ITS MAYOR'S ACTION CENTER. Mr. Joseph Kernan, City Controller, indicated that this bill, as well as Bill No. 205 -79, shouli have public hearing at the same time. Council President McGann made a motion to have public hearing on Bill No. 205 -79, seconded by Council Member Beck. The motion carried. BILL NO. 205 -79 A BILL APPROPRIATING $100,000.00 FROM THE FEDERAL ASSISTANCE GRANT, COMMONLY REFERRED TO AS GENERAL REVENUE SHARING FOR VARIOUS PUBLIC SAFETY PROGRAMS TO BE ADMINISTERED BY THE CITY OF SOUTH BEND THROUGH THE DEPARTMENT OF ADMINISTRATION AND FINANCE. This being the time heretofore set for public hearing on the above bills, proponents and opponei were given an opportunity to be heard. Mr. Joseph Kernan, City Controller, made the presenta- tion for the bills. He indicated that the $24,100 appropriation was.for theCity's own animal control program and provides the salaries for two dog wardens. He requested that the $100,000 appropriation be amended to $75,000 to be budgeted over a nine month period. He indicated this was based on a compromise worked out with the Humane Society. Henry Ferrettie, County Commissioner, asked how the City was going to provide the service for the other three months. Mr. Kernan indicated the City would be going into a nine month contract, but would have an agreement that we could extend it for three months. Mr. James Varga, 1617 S. Taylor, asked if the Humane Society still charged for picking up animals. Mr. Phillip Snyder, Director of the Humane Society, indicated that if someone wanted their own dog picked up they charge $15. Council Member Taylor indicated there was a problem with the City's animal con- trol program, and the, cost of these two items over the next twelve months could be from $130,000 to $150,000. He indicated that Mr. Snyder has said that the Humane Society could handle the entire package for $115,000 a year. He indicated that some of the Council would be interested in giving the Humane Society a trial by giving them a one year contract with a stipulation that if at the end of six months the City found that the agency has failed, the City could get out of the contract. He indicated that Mr. Snyder had agreed that the Humane Society would provide two vans at all times. Mr. Snyder indicated that the Humane Society could effectively handle the animal control for the City. He indicated he felt their Board would approve of the six month stipulation in the contract. Council Member Taylor indicated that these bills should be continued until the next meeting. He asked the Council Attorney to assemble the proper wording for a contract with a six month stipulation to cancel. Richard Hill, City Attorney, indicated there might be a problem with the advertising if these bills were continued. He indicated that if the City was giving the contract to the Humane Society there would be a need to amend Bill No. 201 -79 to reflect the salaries of the two dog wardens from January 2, to February 15. He indicated they could appropriate the balance of the contract at a later date. He indicated that the salaries should be amended to $3,200. Council Member Beck asked how long it would take for the Humane Society to obtain a new van. Mr. Snyder indicated he did not know how long it would take for delivery, but they would be read to start at once. BILL NO. 202 -79 A BILL APPROPRIATING $104,000.00 FROM THE FEDERAL ASSISTANCE GRANT, COMMONLY KNOWN AS GENERAL REVENUE SHARING, FOR THE CITY'S SHARE OF THE MODEL CITIES CODE ENFORCEMENT PROGRAM, TO BE ADMINISTERED BY THE CITY OF SOUTH BEND, THROUGH ITS DEPARTMENT OF ADMINISTRATION AND FINANCE. This being the time heretofore set for public hearing on the above bill, proponents and op- ponents were given an opportunity to be heard. Mr. Carl Ellison, Director of Redevelopment, made the presentation for the bill. He indicated there was a deficiency in the City's share of the Model Cities Program. He said they had been working with HUD for five or six years trying to solve this problem. He indicated this was the final payment for this project. Council Member Kopczynski made a motion to recommend this bill to the Council favorable, seconde, .by Council President McGann. The motion carried. BILL NO. 203 -79 A BILL APPROPRIATING $48,000.00 FROM THE FEDERAL ASSISTANCE GRANT, COMMONLY REFERRED TO AS GENERAL REVENUE SHARING, FOR POLICE COMPUTER SERVICES, TO BE ADMINISTERED BY THE CITY OF SOUTH BEND THROUGH THE POLICE DEPARTMENT. This being the time heretofore set for public hearing on the above bill, proponents and opponent were given an opportunity to be heard. Police Division Chief, Spanward Mitchum, made the presentation for the bill. He indicated this appropriation was for additional terminals. He indicated this would allow the police department to implement more information regarding law enforcement. Council Member Beck made a motion to recommend this bill to the Council favorable, seconded by Council President McGann. The motion carried. BILL NO. 204 -79 A BILL APPROPRIATING $256,000.00 FROM THE FEDERAL ASSISTANCE GRANT, COMMONLY REFERRED TO AS THE GENERAL REVENUE SHARING GRANT FOR MOTOR EQUIPMENT TO BE ADMINISTERED BY THE CITY OF SOUTH BEND THROUGH THE DEPARTMENT OF ADMINISTRATION AND FINANCE. This being the time heretofore set for public hearing on the above bill, proponents and opponen- were given an opportunity to be heard. Police Division Chief, Spanward Mitchum, made the pre- sentation for the bill. He indicated this appropriation was for new cars for the police depart- ment for 1980. He said they were going to purchase thirty -five patrol cars and six detective bureau cars. Council Member Taylor made a motion to recommend this bill to the Council favorably seconded by Council Member Kopczynski. The motion carried. (Public Hearing for Bill No. 205 -79 is with Bill No. 201 -79) BILL NO. 206 -79 A BILL APPROPRIATING $290,000.00 FROM THE FEDERAL ASSISTANCE GRANT, COMMONLY KNOWN AS GENERAL REVENUE SHARING, FOR THE OPERATION OF CENTURY CENTER, TO BE ADMINISTERED BY THE CITY OF SOUTH BEND THROUGH THE CENTURY CENTER BOARD OF MANAGERS. This being the time heretofore set for public hearing on the above bill, proponents and opponent; were given an opportunity to be heard. Mr. Joseph Kernan, City Controller, made the presentatio for the bill. He indicated this appropriation was to supplement the operating budget of Century Center, and is the same amount that has been appropriated for the last two years. Council Member Serge asked if Century Center would ever be self - supporting. Brian Hedman, Director of Century Center, indicated that more business has to be developed before it could be self - supporting. Council Member Taylor indicated that Revenue Sharing money might be dis- continued and we would not be able to fund the center through this means. He indicated there was a need for discussion of alternative funding between the City and the Century Center Board of Managers. Council Member Serge made a motion to recommend this bill to the Council favorable seconded by Council Member Taylor. The motion carried. BILL NO. 207 -79 A BILL APPROPRIATING $108,852.00 FROM THE FEDERAL ASSISTANCE GRANT, COMMONLY REFERRED TO AS GENERAL REVENUE SHARING, FOR THE RIVER BEND PLAZA TO BE ADMINISTERED BY THE CITY OF SOUTH BEND THROUGH THE DEPARTMENT OF ADMINISTRATION AND FINANCE. This being the time. heretofore set for public hearing on the above bill, proponents and opponent; were given an opportunity to be heard. Mr. James Seitz, Superintendent of Public Parks, made the presentation for the bill. He indicated this appropriation was for the maintenance of River Bend Plaza. Council Member Kopczynski indicated that when the Plaza was built there was talk of a special tax district for raising money to take care of the area. Mr. Seitz indicated that was discussed but he was not sure if the City has the authorization. Council Member Kopczynski indicated that a followup should be made on this matter. He asked that Mr. Seitz followup on this and reply to the Council in writing in ninety days. Council Member Serge made a motion to recommend this bill to the Council favorable, seconded by Council President McGann. The motion carried. REGULAR MEETING JANUARY 14, 1980 COMMITTEE OF THE WHOLE MEETING (CONTINUED BILL NO. 208 -79 A BILL APPROPRIATING $110,000.00 FROM THE FEDERAL ASSISTANCE GRANT COMMONLY REFERRED TO AS GENERAL REVENUE SHARING, FOR THE RIVER BEND PLAZA TO BE ADMINISTERED BY THE CITY OF SOUTH BEND THROUGH THE CENTURY CENTER BOARD OF MANAGERS. This being the time heretofore set for public hearing on the above bill, proponents and opponent were given an opportunity to be heard. Mr. Joseph Kernan, City Controller, made the presenta- tion for the bill. He indicated this was the entire operating budget for Discovery Hall. Count Member Taylor made a motion to recommend this bill to the council favorable, seconded by Counci: Member Serge. The motion carried. BILL NO. 209 -79 A BILL APPROPRIATING $31,238.00 FROM THE FEDERAL ASSISTANCE GRANT COMMONLY REFERRED TO AS GENERAL REVENUE SHARING, FOR CODE ENFORCE: MENT, TO.BE'- ADMINISTERED BY THE CITY OF SOUTH BEND THROUGH THE DEPARTMENT OF ADMINISTRATION AND FINANCE. This being the time heretofore set for public hearing on the above bill, proponents and opponen7 were given an opportunity to be heard. Mr. Richard Hill, City Attorney, made the presentation for the bill. He indicated this would continue the City's code enforcement, or the substandard hearing officer process. He said this appropriation was approximately five percent above 1979. He asked that this bill be amended by increasing the hearing officer's salary to $15,368, re- ducing equipment repair to $300, and reducing other office supplies to $332. Council Member Taylor made a motion to amend the bill, seconded by Council Member Kopczynski. The motion car- ried. Council Member Kopczynski made a motion to recommend this bill to the Council favorable, as amended, seconded by Council Member Taylor. The motion carried. BILL NO. 210 -79 A BILL APPROPRIATING THE SUM OF $130,000.00 FROM THE FEDERAL ASSISTANCE GRANT FUND, MORE COMMONLY REFERRED TO AS GENERAL REVENUE SHARING TO PROVIDE MATCHING FUNDS FOR FUNDS DONATED TO THE POTAWATOMI ZOO, BY THE MUESSEL- CLARKS TRUSTS, TO BE ADMINISTERED BY THE CITY OF SOUTH BEND THROUGH THE DEPARTMENT OF ADMINISTRATION AND FINANCE. This being the time heretofore set for public hearing on the above bill, proponents and opponen7 were given the opportunity to be heard. Mr. James Seitz, Superintendent of Parks, made the presentation for the bill. He indicated that the City has received a donation for the con- struction of an educational building at the Potawatomi Zoo for the Muessel and Clarke trusts, and the Council, by resolution, agreed to provide matching funds in the amount of $130,000 from the 1980 Revenue Sharing Fund. He indicated that the building was under construction and the bids have come in higher than anticipated. Council Member Kopczynski made a motion to recoi mend this bill to the Council favorable, seconded by Council Member Serge. The motion carried. BILL NO. 211 -79 A BILL APPROPRIATING $75,000.00 FROM THE FEDERAL ASSISTANCE GRANT, COMMONLY REFERRED TO AS GENERAL REVENUE SHARING, FOR THE DESIGN OF THE EAST RACE PROJECT, TO BE ADMINISTERED BY THE CITY OF SOUTH BEND THROUGH ITS DEPARTMENT OF PUBLIC PARKS. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Mr. James Seitz, Superintendent of .Parks, made the pre- sentation for the bill. He indicated this appropriation was for a scale model of the East Race- way which will be used for testing the various operations of the proposed project. He• indicated that after a thorough review he, and the engineers felt this model could be done for $65,000. Council Member Kopczynski made a motion to amend this bill to $65,000 wherever the amount ap- peared in the bill, seconded by Council Member Serge. The motion carried. He indicated that the Department of Parks proposed to reopen the Raceway. He said there will be a fish ladder, and it could be used for flood control, kayak and canoe course. He indicated there was no facility in the United States comparable to this. Mr. Tom Barth, vice president.of the Michiana Steelheaders and Salmon Association, indicated they supported the funding of this test model. Mr. Bruce Carter, 744 W. Washington, president of the Michiana Watershed, indicated their group was in support of this bill, as well as the development of the East Raceway. He introduced Ms. Jean Sharp and George Scheuer, co- chairmen of the EAst Race Development. Ms. Sharp in- dicated that many of the ideas for the restoration of the East Bank originated with Michiana Watershed members. Council Member Kopczynski made a motion to recommend this bill to the Council favorable, as amended, seconded by Council Member Taylor. The motion carried. There being no further business to come before the Committee of the Whole, Council Member Kopczynski made a motion to rise and report to the Council, seconded by Council Member Taylor.
