Important Information Regarding this Request
REQUIRED DOCUMENTATION AND SITE PLANS
The Historic Preservation Commission of South Bend and St. Joseph County cannot process an Application
without required documentation. Comprehensive documentation provides a complete understanding of the
project. Problems often occur during a project review or during the execution of the project when the
property owner, staff or commissioners are unclear as to project specifics. Applications will NOT be
processed without required documentation.
Photographs may be submitted in digital format or in photographic print. When a project involves
blueprints and/or site plans, one (1) set shall be submitted with the Application. Any documentation
submitted to this office cannot be returned to the applicant.
APPLICATION FEE
The application processing fee for any Application for a Certificate Of Appropriateness is $20
Payment must accompany the application at the time of submission. For an electronically submitted
application, payment must reach the HPC office within 48 hours following transmission. Payment can be
made by credit card by contacting
Business License Administrator Michelle Adams at (574) 235-5912; by cash in person in the Department of
Community Investment on the 14th floor of the County City Building; or by check made out to City of
South Bend. Applications will NOT be processed without the required fee.
MEETING ATTENDANCE
When an Application has been scheduled for any meeting, the owner, architect or contractor(s) retained for
the project shall attend the meeting where their project will be reviewed and a decision rendered. Failure by
the owner, architect, or contractor to attend such meetings may result in denial of the Application due to
insufficient representation.
CERTIFICATE ISSUANCE
Certificates of Appropriateness will be filed with the Building Department of South Bend and St. Joseph
County. A copy of the Certificate will be emailed directly to the owner and/or contractor(s) listed on the
application.
INSPECTION AUTHORITY
All projects will be inspected during and following execution for compliance with the decision(s) rendered
by the Historic Preservation Commission of South Bend and St. Joseph County.

Owner acknowledges that while the Historic Preservation Commission only considers Certificates of
Appropriateness for exterior features, under certain circumstances it may be necessary for the Commission
Staff to have access to the interior of the building in order to accurately assess the condition of the exterior
feature and that the lack of access to the interior may prevent the Commission Staff from making a
favorable recommendation.
Any work performed on a historic landmark or in an historic district which does not conform to the
Certificate of Appropriateness certificate shall be immediately halted by the Historic Preservation
Commission and the Building Department of South Bend and St. Joseph County. Fines may be levied for
projects not in compliance.

Description of Proposed Work:
The Norway Maple in the side yard dropped a number of big limbs three different times this spring and
summer. Arbor Care had treated it annually. Arbor Care checked the limb and diagnosed with ver ticillium,
noted other branches in the tree that were weakened, said it could not be successfully treated, and
recommended that it be removed soon before branches fell and damaged the patio or hurt people.
Har twood confirmed the same. Hartwood was hired to remove the tree.
Alicia called Ross and had him come and look, and showed him what she plans to do. He said it would be
approved, and said to submit the COA application to record the approval.

Terms and Conditions
It is agreed by and between HartWood Tree Care, LLC and the Customer that the following provisions are made as part of this contract:
Warranty of Ownership: The customer warrants and represents that they are the owner of the real estate where the work contemplatedby this contract will be performed and that the customer’s signature is on behalf of all persons and entities holding an ownership interest inrespect to such real estate. In the event that the contemplated project will occur on the premise of a corporation, LLC or other similar entity,the customer executing this contract represents that they are authorized by the owner of the premises to enter into this contract andcommission this work.
Insurance by Contractor: HartWood Tree Care warrants that it is insured for liability resulting from injury to person(s) or property and thatall employees are covered by Workers’ Compensation as required by law. Certificates of coverage are available upon request.
Cancellation Fee: HartWood Tree Care kindly requests that the authorizing party provide at least 24 hours advance notice of any full orpartial work cancellation. If a crew has been dispatched to the job site and is turned away or cannot access the work site, the customer willbe assessed a mobilization fee of $150.00 for incurred expenses.
Mobilization Fee for Small Projects: With the exception of Plant Health Care services, HartWood Tree Care requires a minimum of $300of total charges to mobilize our crew and equipment. If less than $300 of work is approved, a variable mobilization fee will be assessed sothat the total charge for the project reaches the minimum of $300. For example: Shrub Pruning ($125) + Mobilization Fee ($175) = TotalCharge ($300).
Digital Transaction Fee: All digital transactions including credit cards, will be charged with a 2.9% processing fee.
Completion of Contract: HartWood Tree Care agrees to do its best to meet any agreed upon performance dates, but shall not be liable indamages or otherwise for delays because of inclement weather, labor, or any other cause beyond its control; nor shall the customer berelieved of project completion for delays.
Tree Ownership: The customer warrants that all trees listed are located on the customer’s property, and, if not, that the authorizing partyhas received full permission from the owner to allow HartWood Tree Care to perform the specified work. Should any tree be mistakenlyidentified as to ownership, the customer agrees to indemnify and hold harmless HartWood Tree Care for any damages or costs incurred fromthe result thereof, including any costs of litigation and attorney’s fees.
Safety: HartWood Tree Care conducts regular safety training and professional development to align arboricultural operations with industrysafety standards. The authorizing party agrees to not enter the work area during arboricultural operations unless authorized by the crewleader on-site.
Plant Health Care: HartWood Tree Care implements best management practices to diagnose and prescribe proper interventions to achievedesired results. Much like a prescription from a doctor, however, Plant Health Care treatments cannot be guaranteed, and HartWood TreeCare is not responsible for unforeseen or abnormal reactions resulting from the use or application of treatments. When relocating shrubs ortrees, we cannot guarantee the longevity or the life of the transplanted item or be responsible for care post-transplanting beyond theinstructions given to the customer. Plant Health Care is scheduled independently from tree services, when weather conditions and seasonalrequirements are met.
Stump Removal: Unless specified in the proposal, stump removal is not included in the price quoted. Surface and subsurface roots beyondthe stump are not removed unless specified in this proposal.
Concealed Contingencies: Any additional work or equipment required or caused by previously undisclosed or unknown foreign material inthe trunk, the branches, underground, or any other condition not apparent in estimating the work specified, shall be paid for by the customeron a time and material basis. HartWood Tree Care is not responsible for damages to concealed structures including but not limited tounderground sprinklers, drain lines, water and sewer lines, invisible fences, underground wires, conduit, or cables unless the system(s) areadequately and accurately mapped by the authorizing party and a copy is presented before or at the time the work is performed.
Change Orders: In the event that additional work or equipment is required to perform work outside the scope of work contemplated by thiscontract, a written change order signed by all parties to this contract will be required before HartWood Tree Care will provide additionalwork.
Pet Waste Fee: Since animal waste (most commonly from dogs) can contaminate equipment, there will be a $100 fee if employees ofHartWood Tree Care need to clean up animal waste to access the worksite.
Clean-up: Clean-up shall include removing wood, brush, and clippings, and raking of the entire area affected by the specified work, unlessnoted otherwise on this proposal.
Lawn Repair: Ruts, divots, and lawn damage can occur in the course of completing tree work. Additional lawn protection measures andlawn repairs are not included in the contract price, unless noted otherwise on this proposal.
Damage to Hard Surfaces: HartWood Tree Care and/or its subcontractors assume no liabilities or responsibilities for any cracking,breaking, puncturing, depressing, or any other damage to any driveway, patio or other paved, bricked, stoned, concrete, or asphaltedsurface which may result from trucks and equipment being used to access the job site.
Light Fallen Debris: HartWood Tree Care is not liable for light fallen debris, such as sawdust, small branches or sap on cars, furniture,landscaping or other objects located under or near the vicinity of the tree being worked on. Customer assumes all responsibility for removingsuch objects from the work area.
Dispute Resolution: Both customer and HartWood Tree Care agree to attempt to work out any disputes regarding this contract throughdirect negotiation and/or mediation prior to seeking any other available legal remedy.
Acknowledgement of Hazards: Trees inherently pose a certain degree of hazard and risk from breakage, failure or other causes andconditions. Recommendations are intended to minimize or reduce such hazardous conditions. However, there can be no guarantee thatefforts to discover or correct unsafe conditions will prevent future breakage or failure, nor can there be any guarantee that all hazardousconditions have been detected. The customer should not infer that a tree is safe either because work has been done to reduce risk, orbecause no work has been recommended on a specific tree.
Inspection of Tree Support Systems: Customer understands that all tree support systems, such as cabling and bracing devices, as wellas lightning protection systems, must be inspected regularly, or after any major weather event, by a qualified arborist, to ensure thesystem’s condition, position and/or grounding integrity. It is the responsibility of the customer to make sure that each system is inspectedand maintained by a qualified arborist.
Terms of Payment: Payment is to be received upon completion of the job and will be considered late after 30 days. Interest shall be addedto any balance remaining due and payable 30 days after invoice date at the statutory rate of 0.66% per month (8% per year). Customerfurther agrees to pay reasonable attorney’s fees and all costs of collection if payment in full is not made within 30 days after invoice date.HartWood Tree Care maintains the right to require full payment prior to commencement of work.
Customer Insurance: HartWood Tree Care shall not assert any insurance claim on behalf of the customer.
Financing: HartWood Tree Care now offers financing through Wisetack. To prequalify, please click here or call the office at (574) 313.1414.
Deposit: Projects over $4,000 that do not use financing require a 50% deposit before work can be scheduled.
Scheduling Process: For approved estimates, HartWood Tree Care will schedule customer’s service and email the service date forapproval. Inclement weather, emergency storm work, and priority service requests are all factors that can delay service. For specific timingneeds, please call (574) 313-1414 or email info@hartwood.biz.
Subcontractors: Based on the scope of work, HartWood may subcontract with one or more of the following entities for the use ofspecialized equipment to ensure that work is completed safely and efficiently: Cut-Rite Tree Service (PO Box 230 Bremen, IN, 46506);Veenstra Climbing Solutions (64654 County Road 15, Goshen, IN 46526); Noah's Stump Grinding (420 North Beech Road, Osceola, IN 46561);Dogwood Hills Tree Farm (53899 Co Rd 39, Middlebury, IN 46540).
Returned Check Fee: There will be a $25.00 fee charged for all checks returned to our office for non-sufficient funds.
Entire Contract: This contract represents the entire agreement between HartWood Tree Care and the Customer and may only be modifiedby the signature of both parties hereto. The attached quote is valid for 45 days.

Customer assumes all responsibility for removingsuch objects from the work area.
Dispute Resolution: Both customer and HartWood Tree Care agree to attempt to work out any disputes regarding this contract throughdirect negotiation and/or mediation prior to seeking any other available legal remedy.
Acknowledgement of Hazards: Trees inherently pose a certain degree of hazard and risk from breakage, failure or other causes andconditions. Recommendations are intended to minimize or reduce such hazardous conditions. However, there can be no guarantee thatefforts to discover or correct unsafe conditions will prevent future breakage or failure, nor can there be any guarantee that all hazardousconditions have been detected. The customer should not infer that a tree is safe either because work has been done to reduce risk, orbecause no work has been recommended on a specific tree.
Inspection of Tree Support Systems: Customer understands that all tree support systems, such as cabling and bracing devices, as wellas lightning protection systems, must be inspected regularly, or after any major weather event, by a qualified arborist, to ensure thesystem’s condition, position and/or grounding integrity. It is the responsibility of the customer to make sure that each system is inspectedand maintained by a qualified arborist.
Terms of Payment: Payment is to be received upon completion of the job and will be considered late after 30 days. Interest shall be addedto any balance remaining due and payable 30 days after invoice date at the statutory rate of 0.66% per month (8% per year). Customerfurther agrees to pay reasonable attorney’s fees and all costs of collection if payment in full is not made within 30 days after invoice date.HartWood Tree Care maintains the right to require full payment prior to commencement of work.
Customer Insurance: HartWood Tree Care shall not assert any insurance claim on behalf of the customer.
Financing: HartWood Tree Care now offers financing through Wisetack. To prequalify, please click here or call the office at (574) 313.1414.
Deposit: Projects over $4,000 that do not use financing require a 50% deposit before work can be scheduled.
Scheduling Process: For approved estimates, HartWood Tree Care will schedule customer’s service and email the service date forapproval. Subcontractors: Based on the scope of work, HartWood may subcontract with one or more of the following entities for the use ofspecialized equipment to ensure that work is completed safely and efficiently: Cut-Rite Tree Service (PO Box 230 Bremen, IN, 46506);Veenstra Climbing Solutions (64654 County Road 15, Goshen, IN 46526); Noah's Stump Grinding (420 North Beech Road, Osceola, IN 46561);Dogwood Hills Tree Farm (53899 Co Rd 39, Middlebury, IN 46540).
Returned Check Fee: There will be a $25.00 fee charged for all checks returned to our office for non-sufficient funds.
Entire Contract: This contract represents the entire agreement between HartWood Tree Care and the Customer and may only be modifiedby the signature of both parties hereto. The attached quote is valid for 45 days.

To whom it may concern: the Norway maple and the Fullenkamp’s yard was diseased with verticillium
wilt, an untreatable infection. I recommended removal as there were no viable options for treatment
and pruning would not have solved this issue either.
