HomeMy WebLinkAbout08-19-2026 STR Overview FILEDShort Term Rental Town Hall August 19, 2026 Filed in Clerk's Office AUG 2 0 2026 Bianca Tirado City Clerk, South Bend, IN Two Proposed Short-Term Rental Bills Bill No. 52-26 • Requires a City permit for short-term rentals • Captures owner and emergency contact information • Applies standards and enforcement tools City-wide Bill No. 53-26 • Creates a Short-Term Rental Special Exception in the zoning code • Requires a special exception for non-owner-occupied STRs • Adds case-by-case review through the existing zoning process for special exceptions Background Requirements -Bill No. 52-26 • Definitions established by reference to Indiana law • Legislative intent consistent with purposes of regulation authorized by Indiana law-promoting health and safety; promoting residential character of neighborhoods; regulation of noise and nuisance • Requires use to be established by either being owner occupied or obtaining special exception (may also be legal non-conforming) • Must comply with Fire/Building/Property Maintenance Code • Occupancy of home under Property Maintenance Code, incorporated into Section 6-37 of Municipal Code • Fee for permit is $150 • Must provide emergency contact information • If information changes, must be updated in 30 days • Permit issued within 30 days • Expired after 1 year, no fee for renewal • May be revoked after 3 citations, opportunity for hearing-revocation effective up to 1 year • May reapply after revocation, but must pay permit fee and any fines • New owner must apply for new permit • Operating without permit may result in fine up to $500 • Incorporates Short-Term Rental use in Zoning Ordinance-requires having a valid permit • Owner-occupied rentals excluded from requirement • Incorporates Short-Term Rental use as a Special Exception throughout zoning districts • Ordinance framework emphasizes that this change will be woven into existing special exception processes Discussion & Feedback
