Taylor Street, South Bend, IN 46601 Dear President Lee: Attached is a resolution for consideration by the South Bend Common Council ("Council") requesting authorization from Council for the Board of Public Works to pursue the purchase of the south 16.5', approximately 7,047 square feet, of property along Western Ave ("Property"). The Board of Works intends to follow the statutory framework set forth under IC 36-1-10.5-5 to purchase the Property. The purpose of this purchase is to facilitate the City's effort to complete its Western Avenue Transformation District project. I will present the resolution to Council at its upcoming meeting. TAYLOR STREET, SOUTH BEND, INDIANA WHEREAS, the City of South Bend, acting through its Board of Public Works ("Board"), seeks to acquire a portion of property located at 309 S. Taylor Street, South Bend, Indiana 46613 (the "Property") under the authority of Ind. Code 36-1-10.5-5; and A part of Lot A in St. Patrick — Baumgartner Replat, the plat of which is recorded as Instrument No. 2019-10209, in the Office of the Recorder of St. Joseph County, Indiana, and being a part of the grantor's land lying within the Right -Of -Way lines depicted on the attached Right - Of -Way Parcel Plat, marked Exhibit "B", described as follows: The south 16.5 feet of Lot A in said Plat. Containing 7,074 square feet, more or less. See Attached Exhibit A. WHEREAS, pursuant to Indiana Code 36-1-10.5-5, the Board seeks the consent of the South Bend Common Council to execute the purchase of the Property in furtherance of the City's effort to complete the Western Avenue Transformation District; and WHEREAS, upon the Common Council's approval, the Board will solicit two (2) appraisals for the Property and make an offer to the property owner in a manner consistent with the law; and WHEREAS, pursuant to Ind. Code 36-1-10.5-5, the South Bend Common Council ("Common Council") desires to declare and affirm its interest in Property. NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: Section I. The Common Council hereby declares and affirms its interest in the purchase of the Property and approves and authorizes the Board to purchase the Property in accordance with I.C. 36-1-10.5. Section II. This Resolution shall be in full force and effect from and after its adoption by the Common Council and approval by the Mayor. Canneth J.
