HomeMy WebLinkAbout06-29-78 Council Meeting MinutesREGULAR MEETING JUNE 29, 1978 Be it remembered that the Common Council of the City of South Bend met in the Council Chambers of the County -City Building on Thursday, June 29, 1978, at 7:00 p.m. Council President Parent presiding. The meeting was called to order, and the Pledge to the Flag was given. ROLL CALL PRESENT: Council Members Serge, Szymkowiak. Miller, Taylor, Adams, Dombrowski, Horvath and Parent. ABSENT: Council Member Kopczynski REPORT FROM THE SUB - COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your sub - committee on the inspection and supervision of the minutes would respectfully report that it has inspected the minutes of the June 12, 1978 meeting of the Council and found them correct. The sub - committee, therefore, recommends that the same be approved: /s /Roger 0. Parent /s Mary Christine Adams Council Member Adams made a motion that the minutes of the June 12, 1978, meeting be placed on file, seconded by Council Member Serge. The motion carried. REGULAR MEETING JUNE 29, 1978 SPECIAL BUSINESS Council President Parent thanked Mr. C. M. MacMillan for the work he did with the City Council in negotiating the salary /benefit wage package for the police and firefighters. In appreciation he presented Mr. MacMillan with a check for $1,000. Mr. MacMillan indicated he did not take this assignment with any expectations of being paid. He indicated he enjoyed working with the Council and thanked them. Council Member Taylor made a motion to appoint the following to the South Bend Energy Commission: Joan Weber, Sidney Wolf, Gail Dowty, Morris Eggleston, Frank Yeandel, Charles Early, Randall Chrobot, Sharon Donlon, Carl Liebowitz, seconded by Council Member Miller. The motion carried. Council Member Adams made a motion to appoint Andrew Brown to the A.C.T.I.O.N. Board of Directors, seconded by Council Member Horvath. The motion carried. Council Member Taylor made a motion to reappoint Steve Lobdell to the Transpo Board of Directors seconded by Council Member Adams. The motion carried. Council Member Dombrowski made a motion to resolve into the Committee of the Whole, seconded by Council Member Taylor. The motion carried. COMMITTEE OF THE WHOLE Be it remembered that the Common Council of the City of Soth Bend met in the Committee of the Whole on Thursday, June 29, 1978, at 7:12 p.m., with eight members present. Chairman Frank Horvath presiding. BILL NO. 90 -78 A BILL APPROVING THE FORM AND TERMS OF LEASE AND TRUST INDENTURE AND INDUSTRIAL DEVELOPMENT REVENUE BONDS, AND AUTHORIZING THE EXECUTION THEREOF PERTAINING TO HAROLD MEDOW, GENEVIEVE MEDOW, RONN MEDOW, THEODORA MEDOW, ROBERT MEDOW AND ROCHELLE MEDOW. This being the time heretofore set for public hearing on the above bill, proponents and opponent were given an opportunity to be heard. Mr. Kenneth Fedder, attorney for the Economic Devleopmen Commission made th qDresentation for the bill. He indicated that this bond issue of $200,000 was to construct and equip a facility to be located at 223 -227 North Lafayette Blvd., which will be used as a car dealership. Council Member Adams made a motion to recommend this bill to the Council favorable, seconded by Council Member Dombrowski. The motion carried. BILL NO. 91 -78 A BILL APPROVING THE FORM AND TERMS OF LEASE AND TRUST INDENTURE AND INDUSTRIAL DEVELOPMENT REVENUE BONDS, AND AUTHORIZING THE EXECUTION THEREOF PERTAINING TO THE HOOSIER SPRING CO., INC., PROJECT. This being the time heretofore set for public hearing on the above bill, proponents and opponent were given an opportunity to be heard. Mr. Kenneth Fedder, attorney for the Economic Developmen Commission, made the presentation for the bill. He indicated this bond issue would be used to construct and equip a facility on property located at Burnett Industrial Park. He said there would be approximately five new jobs created. Council Member Szymkowiak made a motion to recom- mend this bill to the Council favorable, seconded by Council Member Dombrowski. The motion car- ried. BILL NO. 83 -78 A BILL APPROPRIATING $5,000.00 FROM THE FEDERAL ASSISTANCE GRANT, COMMONLY KNOWN AS GENERAL REVENUE SHARING, FOR VARIOUS PUBLIC WORKS PROGRAMS TO BE ADMINISTERED BY THE CITY OF SOUTH BEND THROUGH ITS DEPARTMENT OF PUBLIC WORKS. Council Member Adams made a motion to continue public hearing and second reading on this bill until July 10, 1978, seconded by Council Member Dombrowski. The motion carried. BILL NO. 84 -78 A BILL FIXING THE ANNUAL PAY OF FIREFIGHTERS FOR THE CALENDAR YEAR 1979. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Council President Parent gave a brief description of the wage /benefits the firefighters would receive in 1979 and 1980. He made a motion to amend Section I by deleting and classification shall be as follows, and inserting classification, and service years shall be as follows:, Section I delete $5.00 per hour and insert time and one -half, seconde by Council Member Adams. The motion carried. Mr. Tim Brassell, chairman of the wage committee for the firefighters thanked Councilmen Parent and Taylor for the outstanding job of presenting the proposal" to the wage committee. Council Member Adams made a motion to recommend this bill to the Council favorable, as.amended, seconded by Council Member Dombrowski. The motion carried. BILL NO. 88 -78 A BILL AMENDING CHAPTER 20, ARTICLE 3, COMMONLY KNOWN AS THE ABANDONED VEHICLE ORDINANCE. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Councilman Richard Dombrowski made the presentation for the bill. He indicated this amendment would strengthen the City's authority to dispose of abandoned vehicles left on private property in residential areas. Mrs. Jane Swan, 2022 Swygart, indicated that she could not see where the age of the car made any difference and she thought the five years should be removed. Mr. Thomas Brunner, City Attorney, indicated that the same language was used in this bill as the State statute. He indicated that the Legal Department would prefer this remain the the bill. Council Member Szymkowiak made a motion to recommend this bill to the Council favorable, seconded by Council Member Adams. Council Member Serge asked if this was going to be enforced. Mr. Brunner indicated that enforcement was up to the environ- mental protection officer in the district. The motion carried. REGULAR MEETING JUNE 29, 1978 COMMITTEE OF THE WHOLE MEETING (CONTINUED) BILL NO. 93 -78 A BILL APPRPRIATING $20,000.00 FROM THE COMMUNITY DEVELOPMENT BLOCK GRANT FUND, FOR THE REHABILITATION OF THE SOUTHEAST NEIGHBORHOOD CENTER, TO BE ADMINISTERED BY THE DIVISION OF COMMUNITY DEVELOPMENT AND BUREAU OF HOUSING. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Mr. Carl Ellison, Director of Community Development, made the presentation for the bill. He indicated that ACTION, Inc., had proposed the abandonment of the Southeast Neighborhood Center, and that decision served to catalyze neighborhood forces who in conjunction with United Way, Community Development and other agencies, worked diligently to significantly increase the quantity and quality of neighborhood center services. He said in light of these changes, the Administration now believes this center is both stable and viable. Mr. Conrad Damian, Chairman of the Southeast Side Center Committee, spoke in favor of this bill. He gave a list of agencies that were helping with the Center and described the many services that- were helping with the Center and described the many services they were offering. Mrs. Stephany Dunfee, 2702 Miami, representative from the United Way, spoke in favor of this bill. Ms. Marzy Bauer, Executive Director of ACTION, spoke in favor of this bill. She indicated this appropriation would be used to bring the building up to code. Council Member Adams made a motion to recommend this bill to the Council favorable, seconded by Council Member Taylor. The motion carried. BILL NO. 94 -78 A BILL APPROPRIATING $2,899.50 FROM THE DISCOVERY HALL FUND OF THE CITY OF SOUTH BEND, INDIANA, FOR VARIOUS CONSULTING SERVICES TO BE ADMINISTERED BY THE DEPARTMENT OF ADMINISTRATION AND FINANCE. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Mr. Michael Vance, Deputy City Controller, made the presentation for the bill. He said this was the second installment received from the National Endowment for the Humanities. He said these funds are being used for consultant expenses to do research. Council Member Szymkowiak made a motion to recommend this bill to the Council favorabl( seconded by Council Member Adams. The motion carried. BILL NO. 95 -78 A BILL APPROPRIATING $136,500.00 FROM THE FEDERAL ASSISTANCE GRANT, COMMONLY REFERRED TO AS GENERAL REVENUE SHARING, FOR VARIOUS PUBLIC WORKS PROGRAMS TO BE ADMINISTERED BY THE CITY OF'SOUTH BEND THROUGH ITS DEPARTMENT OF PUBLIC WORKS. Mr. Michael Vance, Deputy City Controller, indicated that there had been an advertising problem with this bill, but that State Board had reversed their decision on this and they would like the Council to strike this bill. Council Member Taylor made a motion to strike this bill, seco by Council Member Dombrowski. The motion carried. There being no further business to come before the Committee of the Whole, Council Member Adams made a motion to rise and report to the Council, seconded by Council Member Taylor. The motion carried. PROJECT. This bill had second reading. Council Member Taylor made a motion to pass this bill, seconded by Council Member Adams. The bill passed by a roll call vote of eight ayes. RESOLUTIONS RESOLUTION NO. 626 -78 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, APPROVING A MEMORANDUM OF UNDERSTANDING ENTERED INTO BETWEEN THE WAGE COMMITTEE OF THE SOUTH BEND FIREFIGHTERS UNION LOCAL NO. 36.2 OF THE INTERNATIONAL ASSOCIATION OF FIRE- FIGHTERS, AFL -CIO, AND THE SOUTH BEND COMMON COUNCIL FOR THE ANNUAL PAY AND BENEFITS OF THE FIREFIGHTERS FOR THE CALENDAR YEAR 1980. WHEREAS, the Common Council of South Bend, Indiana, and the Wage Committee of the South Bend Fire Fighters Union have entered into ,a Memorandum of Understanding regarding the salary and benefit package for 1980, marked "ExhibtA" and attached hereto; and WHEREAS, the Memorandum of Understanding incorporates three basic concepts: (1) that the Career Development Plan be expanded into the 10 -11th, 11 -12th, and 12 and above years in the Engineer rank at the rate of $250.00 for each level. (2) that a total of $200,000.00 be allocated among all ranks within the bargaining unit, with specific allocations being made by the last Common Council meeting in July 1979. (3) that a total of $26,400.00 be appropriated for fringe benefits, with the specific appropriations being made by the last Common Council meeting in July 1979. WHEREAS, the Common Council believes that the approval -of the Memorandum of Understanding is in the best interest of the City. NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA: SECTION I. That the Memorandum of Understanding entered into between the Wage Committee of the South Bend Fire Fighters.Union,.Local No. 362 of the International Association of Fire - fighters, AFL -CIO, and the South Bend Common Council, dated June 29, 1978, is hereby approved. SECTION II. This Resolution shall be in full force and effect from and after its adoption by the Common Council and approval by the Mayor. /s /Roger 0. Council President Parent indicated this resolution was a companion to the salary bill passed for the firefighters. He briefly explained the resolution and the Memorandum of Understanding for 1980 salaries. Council Memer Szymkowiak made a motion to adopt this resolution, seconded by Council Member Adams. The resolution was adopted by a roll call vote of eight ayes. BILLS, FIRST READING BILL NO. 97 -78 A BILL APPROVING THE FORM AND TERMS OF LEASE AND TRUST INDENTURE AND INDUSTRIAL DEVELOPMENT REVENUE BONDS, AND AUTHORIZING THEEXECUTION THEREOF PERTAINING TO GENERAL LIQUORS, INC. This bill had first reading. Council Member Adams made a motion to set this bill for public hearing and second reading July 10, 1978, seconded by Council Member Dombrowski. The motion carried. BILL NO. 98 -78 A BILL APPROVING.A CONTRACT BETWEEN THE BUREAU OF WATER OF THE CITY OF SOUTH BEND, INDIANA, AND (1) CLOW CORPORATION, SOUTH BEND, INDIANA (2) KENNEDY VALVE MANUFACTURING COMPANY, ELMIRA, NEW YORK, AND (3) MUELLER CO., CHATTANOOGA, TENNESSEE FOR THE PURCHASE OF AN ASSORTMENT OF WATER MAIN, VALVES, FITTINGS AND HYDRANTS IN THE AMOUNTOF $208,268.58. This.bill had first reading. Council Member Adams made a motion to set this bill for public hearing and second reading July 10, 1978, seconded by Council Member Dombrowski. The motion carried. BILL NO. 99 -78 A BILL APPROPRIATING $21,184.00 OF TITLE XX GRANT MONIES FROM THE CITY OF SOUTH BEND CRIME CONTROL FUND FOR VARIOUS YOUTH SERVICE BUREAU ACTIVITIES DURING THE PERIOD JULY 1, 1978 THROUGH JUNE 30, 1979. BILL NO. 100 -78 A BILL APPROPRIATING $495,000.00 FROM THE COMMUNITY DEVELOPMENT BLOCK GRANT FUND FOR VARIOUS PUBLIC WORKS PROJECTS TO BE ADMINISTERED BY THE CITY OF SOUTH BEND THROUGH THE DIVISION OF COMMUNITY DEVELOPMENT AND THE DEPARTMENT OF PUBLIC WORKS. BOTH COST CATEGORIES BEING WITHIN THE BUREAU OF HOUSING BUDGET FROM THE 1977 COMMUNITY DEVELOPMENT BLOCK GRANT FUND OF THE CITY OF SOUTH BEND, INDIANA. This bill had first reading. This bill had first reading. Council Member Adams made a motion to set this bill for public hearing and second reading July 10, 1978, seconded by Council Member Dombrowski. The motion carried. BILL NO. 106 -78 A BILL APPROPRIATING $5,000.00 FROM THE COMMUNITY DEVELOPMENT BLOCK GRANT FUND, FOR VARIOUS PUBLIC PARK PROJECTS TO BE ADMINISTERED BY THE CITY OF SOUTH BEND THROUGH ITS DIVISION OF COMMUNITY DEVELOP- MENT AND THE DEPARTMENT OF PUBLIC PARKS. This bill had first hearing and second carried. BILL NO. 107 -78 reading. Council Member Adams made a motion to set this bill for public reading July 10, 1978, seconded by Council Member Dombrowski. This bill had first reading. Council Member Adams made a motion to set this bill for public hearing and second reading July 24, 1978, and refer it to Area Plan, seconded by Council Member Dombrowski. The motion carried. There being no further business to come before the Council, unfinished or new, Council Member Dombrowski made a motion to adjourn, seconded by Council Member Adams.
