The meeting was called to order, and the Pledge to the Flag was given. ROLL CALL PRESENT: Council Members Szymkowiak, Miller, Taylor, Kopczynski, Adams, Dombrowski, Horvath and Parent. ABSENT: Council Member Serge Due to the weather, Council Member Kopczynski made a motion to continue this meeting until 4:00 p.m., Thursday, January 12, 1978, seconded by Council Member Horvath. The motion carried. REGULAR MEETING (RECONVENED) JANUARY 12, 1978 Be it rembered that the Common Council of the City of South Bend reconvened in the Council Chambers of the County -City Building on Monday, January 12, 1978, at 4:00 p.m. Council Presidenl Parent presiding. The meeting was called to order, and the Pledge to the Flag was given. ROLL CALL PRESENT: Council Members Adams, Szymkowiak, Miller, Taylor, Kopczynski, Adams, Dombrowski, Horvath and Parent ABSENT: None REPORT FROM THE SUB - COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your sub - committee on the inspection and supervision of the minutes would respectfully re- port that it has inspected the minutes of the December 19, 1977 meeting of the Council and found them correct. The sub - committee, therefore, recommends that the same be approved. /s /Roger Parent Council Member Serge made a motion that the minutes of the December 19, 1977, meeting of the Council be placed on file, seconded by Council Member Taylor. The motion carried. Council Member Taylor made a motion to resolve into the Committee of the Whole, seconded by Council Member Adams. The motion carried. COMMITTEE OF THE WHOLE Be it remembered that the Common Council of the City of South Bend met in the Committee of the Whole on Monday, January 12, 1977, at 4:09 p.m., with nine members present. Chairman Frank Horvath presiding. BILL NO. 208 -77 A BILL APPROVING THE FORM AND TERMS OF LEASE AND TRUST INDENTURE AND INDUSTRIAL DEVELOPMENT REVENUE BONDS, AND AUTHORIZING THE EXECUTION THEREOF PERTAINING TO THE REAL ESTATE VENTURES PROJECT. This being the time heretofore set for public hearing on the above bill, proponents and opponent were given an opportunity to be heard. Mr. Kenneth Fedder, attorney for the Economic Developmen Commission, made the presentation for the bill. He introduced Mr. Warren McGill, attorney for the applicant, Real Estate Ventures. He said this facility will be located in the Industrial Park and will create twenty new jobs in the community. Council Member Serge made a motion to recommend this bill to the Council favorable, seconded by Council Member Dombrowski. The motion carried. BILL NO. 202 -77 A BILL APPROPRIATING $27,425. 00 FROM THE FEDERAL ASSISTANCE GRANT, COMMONLY REFERRED TO AS GENERAL REVENUE SHARING, FOR VARIOUS LAW ENFORCEMENT PROGRAMS TO BE ADMINISTERED BY THE CITY OF SOUTH BEND THROUGH ITS DEPARTMENT OF LAW. This being the time heretofore set for public hearing on the above bill, proponents and opponent were given an opportunity to be heard. Mr. Thomas Brunner, City Attorney, made the presentation for the bill. He said this would continue to fund the legal intern program, the salary of one deputy attorney, as well as supplement a secretary III, whose salary level was incorrectly set in this year's budget. Council Member Adams asked how many deputies were in the department. Mr. Brunner indicated there were eight, including the chief. Council Member Szymkowiak made a motion to recommend this bill to the Council favorable, seconded by Council Member Dombrowski. The motion carried. BILL NO. 203 -77 A BILL APPROPRIATING $53,200.00 FROM THE FEDERAL ASSISTANCE GRANT, COMMONLY REFERRED TO AS GENERAL REVENUE SHARING, FOR VARIOUS PUBLIC SAFETY PROGRAMS TO BE ADMINISTERED BY THE CITY OF SOUTH BEND THROUGH THE DEPARTMENT OF ADMINISTRATION AND FINANCE. This being the time heretofore set for public hearing on the above bill, proponents and opponent were given an opportunity to be heard. Mayor Peter J. Nemeth, made the presentation for the bil He said this appropriation was for the Humane Society for services provided for picking up and housing of stray animals within the City. Mr. Phil Snyder of the Humane Society indicated this was based on the budget of the Society, and represented a seven percent increase over last year. Council Member Miller made a motion to recommend this bill to the Council favorable, seconded by Council Member Parent. The motion carried. REGULAR MEETING JANUARY 12, 1978 COMMITTEE OF THE WHOLE MEETING BILL NO. 204 -77 A BILL APPROPRIATING $110,000.00 FROM THE FEDERAL ASSISTANCE GRANT COMMONLY KNOWN AS GENERAL REVENUE SHARING, FOR OPERATING THE DISCOVERY HALL PORTION OF CENTURY CENTER FOR THE CALENDAR YEAR 1978, TO BE ADMINISTERED BY THE CITY OF SOUTH BEND THROUGH THE DEPARTMENT OF ADMINISTRATION AND FINANCE. This being the time heretofore set -for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Mayor Peter Nemeth, made the presentation for the bill. He said this appropriation was to cover the operating expenses of Discovery Hall. Council Member Kopczynski asked how much a year it will cost to run Discovery Hall in the future. The Mayor indicated the cost will probably go up with the cost of living index. Council Member Kopczynski questioned the use of government funding for this museum. Mr. Richard Welsh, Director of Discovery Hall, indicated he did not know of any museum that was not helped through govern- ment funding. Council Member Miller made a motion to recommend this bill to the Council favorable seconded by Council Member Serge. The motion carried on a roll call vote of eight ayes and one nay (Council Member Kopczynski.) BILL NO. 205 -77 A BILL APPROPRIATING $57,931.00 FROM THE FEDERAL ASSISTANCE GRANT, COMMONLY KNOWN AS GENERAL REVENUE SHARING, FOR THE OPERATION OF THE YOUTH SERVICES BUREAU, TO BE ADMINISTERED THROUGH THE DEPARTMENT OF HUMAN RESOURCES. This being the time heretofore set for public hearing on the above bill, proponents-and opponents were given an opportunity to be heard. Ms. Bonnie Strycker, Director of the Bureau, made the presentation for the bill. She indicated the Bureau has been in operation for four years. She gave a comprehensive report on the work the Bureau was doing for the City. Mrs. Marlene Quigley, 1019 N. Francis, spoke in support of this bill and the Youth Services Bureau. Council President Parent thanked Ms. Strycker for the report. Council Member Serge made a motion to recommend this bill to the Council favorable, seconded by Council Member Dombrowski. The motion carried. BILL NO. 206 -77 A BILL APPROPRIATING $290,000.00 FROM THE FEDERAL ASSISTANCE GRANT, COMMONLY KNOWN AS GENERAL REVENUE SHARING, FOR THE OPERATION OF CENTURY CENTER, TO BE ADMINISTERED THROUGH THE DEPARTMENT OF HUMAN RESOUCES This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Mayor Peter J. Nemeth, made the presentation for the bill He said this money will be used to pay the utility bills at Century Center. Council Member Serge asked how many people were employed at the Center. Mr. Brian Hedman, Director of Century Center, indicated approximately forty people were employed. Council Member Adams indicated she had re- ceived a letter regarding the fact that the City could not pay personnel, out of the Parking Garage Fund, that take care of the parking lot at Century Center. Council Member Serge made a motion to recommend this bill to the Council favorable, seconded by Council Member Dombrowski. The motion carried on a roll call vote of seven ayes and two nays (Council Members Kopczynski and Horvath. BILL NO. 207 -77 A BILL APPROPRIATING $49,460.00 FROM THE FEDERAL ASSISTANCE GRANT COMMONLY REFERRED TO AS GENERAL REVENUE SHARING, FOR THE RIVER BEND PLAZA, TO BE ADMINISTERED BY THE CITY OF SOUTH BEND THROUGH THE DEPARTMENT OF PUBLIC WORKS. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Mr. James Seitz, Superintendent of Parks, made the pre- sentation for.-the bill. He said this budget was $6,400 higher than last year, and the major in- crease was for motor equipment. He said all personnel are CETA employees, except the foreman who is paid from the Park Department budget. Council Member Serge made a motion to recommend thi bill to the Council favorable, seconded by Council Member Dombrowski. The motion carried. BILL NO. 210 -77 A BILL APPROPRIATING $36,500 FROM THE FEDERAL ASSISTANCE GRANT, COMMONLY REFERRED TO AS GENRAL REVENUE SHARING, FOR THE POLICE RECRUIT PROGRAM, TO BE ADMINISTERED BY THE CITY OF SOUTH BEND THROUGH THE POLICE DEPARTMENT. This being the time heretofore set for public hearing on the above bill, proponents and opponents were qiven an opportunity to be heard. Mr. Glenn Terry, Division Chief, made the presentation for the bill. He said this will fund the police recruits for the first quarter of 1978. He said based upon the summary of anticipated expenses, they suggest that the bill be amended to $30,500 in the amount requested. Council Member Taylor made a motion to amend the bill to $30,50 wherever it appeared in the bill, seconded by Council Member Adams. The motion carried. Council Member Szymkowiak made a motion to recommend this bill to the Council favorable, seconded by Council Member Dombrowski. The motion carried. BILL NO. 211 -77 A BILL APPROPRIATING $87,183.00 FROM THE ANTI - RECESSION FUND, COMMONLY KNOWN AS THE COUNTER CYCLICAL GRANT, FOR VARIOUS ADMINISTRATIVE AND PUBLIC SAFETY PROGRAMS TO BE ADMINISTERED BY THE CITY OF SOUTH BEND THROUGH THE DEPARTMENT OF ADMINISTRATION AND FINANCE. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Mayor Peter J. Nemeth, made the presentation for the bill. He said this bill would cover three major Anti- Recession categories. He said it was a supple- mentary budget for the Mayor's Environmental Center, fund the salary of the Merit Board Coordina- tor, as well as the salary for the Code Enforcement Hearing Officer and his secretary. Council Member Adams asked Mr. Ambler the Code Enforcment Hearing Officer, how long it took to demolish a structure. Mr. Ambler indicated approximately thirty days. Council Member Serge made a motion to recommend this bill to the Council favorable, seconded by Council Member Adams. The motion car ried. REGULAR MEETING JANUARY 12, 1978 COMMITTEE OF THE WHOLE MEETING BILL NO. 215 -77 A BILL ANNEXING TO AND BRINGING WITHIN THE CITY LIMITS OF SOUTH BEND, INDIANA, CERTAIN LAND LOCATED IN PENN TOWNSHIP, ST. JOSEPH COUNTY, INDIANA. This being the time heretofore set for public hearing on the above bill, proponents and opponent were given an opportunity to be heard. Mr. Robert Parker, Deputy City Attorney, made the presen tion for the bill. He submitted an amendment to Exhibit A and Exhibit B to the petition. Counc Member Miller made a motion to accept these amendments, seconded by Council Member Taylor. The motion carried. Mr. Ed Rabbit, an officer in Edward Rose, the Developer, spoke to the Council regarding his company. He described the proposed apartment complex. Mr. Art Osterwald, of Edwa. Rose, gave an impact statement regarding schools, property values, etc., with respect to their proposed development. Mr. James Groves, attorney representing the Southeast Neighborhood As- sociation, spoke against this annexation. He indicated that if this land was annexed the re- monstrators would possibly file suit. He said that certain requirements for annexation have not been met. Mr. Paul Dits, 17433 Battles Road, spoke against this low rent apartment complex. He indicated the land was too beautiful for this type of complex. Ms. Dianne Matthias, 17700 Irela. Road, spoke against this type of apartment complex. Mr. Richard Gampoli, 59349 Hazel Road, spok against this type of apartment complex. Mr. Richard - Gampoli, 59349 Hazel Road, spoke against this type of apartment complex. Mrs. Marily Ottevaere, 17559 Battles Road., spoke against the annexation and the development. Ms. Andria Waggoner, 17390 Battles Road, spoke against the an- nexation, as well as the development. Mrs. Irene Gammon, City Clerk, indicated that her propert was adjacent to Park Jefferson Apartments and it had not effected the property value of her pro- perty. Mayor Nemeth, spoke in favor of this development in regard to taxation and other advanta the apartment complex will bring to the City. Mr. Mark Toth, 3935 Ironwood, spoke against this development. He said the citizens of South Bend in that immediate neighborhood were also again this development. Mr. Leonard Leffel, 17536 Battles Road, spoke against this annexation, as wel as the development. Mrs. Miller, 17605 Battles Road, spoke against this development, due to the traffic flow in the area. Mr. Ed Mercer, 17599 Battles Road, spoke against this annexation. Mrs. Sallary Vansant, 17450 Ireland, spoke against this apartment complex. Council President Parent indicated that apartment complexes do not bring down property values. Council President Parent made a motion to recommend this bill to the Council favorable, seconded by Council Member Miller. Council Member Kopczynski indicated that the City provides a lot of services for the County residents and they do not contribute to the tax base of the City. Council Member Serge indicated that the apartment complex in the NW area has proved to be an asset to the neighbo hood. Council Member Adams asked if the storm water retention basin was adequate for a project of this size. Mr. McMahon, Director of Public Works, indicated that it was adequate. The motio carried. There being no further business to come before Kopczynski made a motion to rise and report to Dombrowski. This bill had second reading. Council Member Taylor made a motion to pass this ordinance, second( by Council Member Dombrowski. The bill passed by a roll call vote of nine ayes. After a dis- cussion, it was decided the bill should be amended in the regular meeting. Council Member Miller made a motion to reconsider the action on the last motion, seconded by Council Member Dombrowski. The motion carried. Council Member Miller made a motion to incorporate Exhibit A under Section I of the ordinance, and incorporate Exhibit B under Section II, in lieu of "and marked Exhibit A and Exhibt B," seconded by Council Member Dombrowski. The motion carried. Council Member Taylor made a motion to pass the bill, as amended, seconded by Council Member Dombrowski. The bill passed by a roll call vote of nine ayes. BILL NO. 4 -78 A BILL AMENDING ORDINANCE NO. 4990 -68, AS AMENDED, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (CHAPTER 21, MUNICIPAL CODE) (SOUTHEAST CORNER OF MAYFLOWER AND 'LINDEN AVENUE.) This bill had first reading. Council Member Adams made a motion to refer this bill and petition to Area Plan, seconded by Council Member Dombrowski. The motion carried. BILL NO. 5 -78 A BILL APPROPRIATING THE SUM OF $11,964.89 FROM THE CUMULA- TIVE SEWER BUILDING AND SINKING FUND TO THE GENERAL IMPROVE- MENT FUND. This bill had first reading. Council Member Adams made a motion to set this bill for public hearing and second reading January 23, 1978, seconded by Council Member Dombrowski. The motion carried. BILL NO. 6 -78 A BILL APPROVING A CONTRACT BETWEEN THE BUREAU OF WATER OF THE CITY OF SOUTH BEND, INDIANA, AND CONSTRUCTION COORDINATORS, INC., SOUTH BEND, INDIANA FOR THE BORING OF A 16 -INCH STEEL CASING UNDER MAYFLOWER ROAD IN THE TOTAL AMOUNT OF $2,845.00. This bill had first reading. Council Member Adams made a motion to set this bill for public hearing and second reading, January 23, 1978, seconded by Council Member Dombrowski. The motion carried. UNFINISHED BUSINESS Report from Area Plan Upon a motion to Earl Kime,* being seconded by Joseph Simeri and carried unanimously, the petition of Bower Homes Associa- tion, Inc., to zone from "C-l" Commercial, "A" Height and Area, to "C -1" Commercial, "A" Height and Area, for a change in use of the site plan, prperty located at 3533 McKinley Highway, City of South Bend is returned to the Common Council with a favorable recommendation, by the Area Plan Commission. Council Member Adams made a motion to set this bill for public hearing and second reading Febru 13, 1978, seconded by Council Member Dombrowski. The motion carried. NEW BUSINESS Council Member Kopczynski made a motion to suspend the rules and have first reading and public hearing on the bill pertaining to the insurance coverage for taxi cabs, seconded by Council- 'Membe Taylor. The motion carried on a roll call vote of nine ayes. ORDINANCE NO. 6299 -78 AN ORDINANCE TO AMEND SECTION 15 -43 OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA. This bill had first reading. This being the time heretofore set for public hearing, proponents and opponents were given an opportunity to be heard. Mr. Kevin Butler, attorney for the South Bend Cab Company, Inc., made the presentation for the bill. He said this bill would amend the City Code to provide a limit of $100,000 of public liability insurance per occurance for the owners of the South Bend Cab Company. He said the company had been unable to obtain the amount of insurance presently required under ordinance. Council Member Taylor made a motion to pass this bill, seconded by Council Member Adams. The bill passed by a roll call vote of nine ayes. Council President Parent asked Council Vice President Dombrowski to chair this portion of the meeting. Council President Parent indicated there has been concern in the community, as well as the Council, as to what the City Council can do in terms of taking official action to support the development of the Century Mall Project, particularly in view of the action taken by the Historic Preservation Commission. He indicated he had prepared a letter and statement, on behalf of the Council, to be sent to the Department of National - Resources, Division of Historic Preservation. It was the feeling of the Council that this letter should include a statement to the effect that this letter in no way should be construed to mean that the Council feels there are buildings of historic value in the downtown area. Mayor Nemeth indicated that it would appear to him that it would certainly help if the Historic Preservation Commission would withdraw their request He said the owners of the buildings have not consented to have their buildings declared Historic Lnadmarks. Council Member Taylor indicated he felt this statement by the Council would indicate they are one hundred percent on the side of the development of the mall. The Council unanimously agreed to the sending of this letter. Council Member Miller suggested that the City provide for sanding of intersections when the tempa{ ture is below five to ten degrees. There being no further business to come before the Council, unfinished or new, Council Member Adams made a motion to adjourn, seconded by Council Member Dombrowski.
