Parent presiding. The meeting was called to order, and the Pledge to the Flag was given. ROLL CALL PRESENT: Council Members Serge, Szymkowiak, Miller, Taylor, Kopczynski, Adams, Dombrowski and Parent ABSENT: Council Member Horvath REPORT FROM THE SUB - COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your sub - committee on the inspection and supervision of the minutes would respectfully re port that it has inspected the minutes of the June 27, 1977 meeting of the Council and found th correct. The sub - committee, therefore, recommends that the same be approved. /s/ Roger 0. Parent /s/ Mary Chris Adams Council Member Serge made a motion that the minutes of the June 27, 1977, meeting of the Council be placed on file, seconded by Council Member Dombrowski. The motion carried. REPORTS Council Member Kopczynski, chairman of the Human Resources Committee gave the following report on Bill No. 74 -77 - Restricted Refuse Collectors Licenses: He said that the committee recommend that the restricted license remain in effect to enable removal of materials that cannot be handl in packer type containers. Council Member Adams made a motion to resolve into the Committee of the Whole, seconded by Counci Member Dombrowski. The motion carried. COMMITTEE OF THE WHOLE Be it remembered that the Common Council of the City of South Bend met in the Committee of the Whole on Monday, July 11, 1977, at 5 :05 p.m., with eight members present. BILL NO. 78 -77 A BILL APPROVING THE FORM AND TERMS OF LEASE, MORTGAGE, AND TRUST INDENTURE AND INDUSTRIAL DEVELOPMENT REVENUE BONDS, AND AUTHORIZING THE EXECUTION THEREOF PERTAINING TO FRANK E. SUVERKRUP BUILDING IN THE SOUTH BEND INDUSTRIAL PARK. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Mr. Kenneth Fodder, attorney for the Economic Development Commission, made the presentation for the bill. He said the Commission passed a resolution ap- proving this type of financing. He said this was a new business moving into the area and it woul� be a janitorial service. He asked that the following amendments be made to the lease agreement on page 4 add 15 years and 7% in appropriate blanks; on page 11 add 15 y ears and $3,101 pe month in appropriate blanks. Council Member Adams made a motion to amend thelease, seconded by r council Member Dombrowski. The motion carried. Council Member Adams made a motion to recommend this to the Council favorable, as amended, seconded by Council Member Dombrowski. The motion carried. REGULAR MEETING JULY 11, 1977 COMMITTEE OF THE WHOLE MEETING (CONTINUED BILL NO. 77 -77 A BILL APPROVING THE FORM AND TERMS OF LEASE AND TRUST INDENTURE AND INDUSTRIAL DEVELOPMENT REVENUE BONDS, AND AUTHORIZING THE EXECUTION THEREOF PERTAINING TO GRIFFIN'S OUTBOARD MARINE, INC. This being the time heretofore set for public hearing on the above bill, proponents and opponent were given an opportunity to be heard. Mr. Kenneth Fedder, attorney for the Economic Developmen Commission, made the presentation for the bill. He said this was an expansion of an existing operation in the City. He asked that the bill be amended from $400,000 to $50.0,000. Council Member Adams made a motion to amend this bill, seconded by Council Member Dombrowski. The motio carried. He said this would mean additional employment and tax base for the community. Council Member Taylor made a motion to recommend this bill to the Council favorable, as amended, seconde by Council Member Szymkowiak. The motion carried. BILL NO. 66 -77 A BILL AMENDING ORDINANCE NO. 4990 -68, AS AMENDED, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (CHAPTER 21, MUNICIPAL CODE) (A 2.6 ACRE PARCEL OF GROUND LOCATED ON THE NORTH SIDE OF THE INTERSECTION OF MONROE STREET AND LINCOLN WAY WEST). This being the time heretofore set for public hearing on the above bill, proponents and opponent were given an opportunity to be heard. Mr. Tim Eckerle, of Area Plan, made the presentation for the bill. He said this rezoning was for Block Six to change from "B" Residential to "A -3" High Density Residential Office and Professional District, "G" Height and Area. Council Member Adams made a motion-to recommend this bill to the Council favorable, seconded by Council Member Dombrowski. The motion carried. BILL NO. 74 -77 A BILL TO ELIMINATE RESTRICTED REFUSE COLLECTORS LICENSES BY AMENDING CHAPTER 15, ARTICLE 4, OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, SECTIONS 16 -27, 16 -28 AND 16 -29. This being the time heretofore set for public hearing on the above bill, proponents and opponent; were given an opportunity to be heard. Mr. David Wells, Manager of Administration and Design, made the presentation for the bill. He said the purpose of this bill was to take the small pick -up trucks that litter, off the road. He said this bill was meant to address the trucks that pick up in residential districts. Council Member Kopczynski indicated that the problem with deleting restricted licenses was the removal of bulk items. He said there was nothing wrong with the present ordinance, but it was not being enforced. Council Member Serge asked how many of these licenses have been checked. Mr. Peter Mullen, City Controller, indicated that they have issued thirty -eight restricted licenses. He said a list of those that had not pur- chased licenses this year had been turned over to Chief Borkowski to be checked out. Council Member Szymkowiak asked who checked the equipment before a license was issued. Mr. Mullen in- dicated that Mr. Klebosits at the MSF facility does the inspection. Council Member Szymkowiak indicated that he would recommend that the police enforce the ordinance. Council Member Dom- browski indicated that the trucks are not using tarps, and this should be enforced. Council Member Adams made a motion to recommend this bill to the Council unfavorable, seconded by Counci: Member Parent. The motion carried, with Council Member Szymkowiak opposing. BILL NO. 76 -77 A BILL REPEALING ORDINANCE NO. 5339 -71, PASSED SEPTEMBER 27, 1971, WHICH ANNEXED TO THE MUNICIPAL CITY OF SOUTH BEND, INDIANA, CERTAIN TERRITORY DESCRIBED AS LYING GENERALLY WEST OF HICKORY ROAD, SOUTH OF THE TOLL ROAD, EAST OF IVY ROAD, AND NORTH OF THE PRESENT CITY LIMITS, AS AMENDED, AND COM- MONLY.KNOWN AS MAPLE LANE. This being the time heretofore set for public hearing on the above bill, proponents and opponent were given an opportunity to be heard. Council Member Taylor, made the presentation for the bill. He said this annexation falls in the same category as Gilmer Park, and that annexation was repealed not too long ago. He indicated that this annexation has been in court for six year He said from the very beginning it was questionable as to whether Maple Lane would serve any benefit to South Bend. He said the City has failed to win the case in court, and if we would allow Maple Lane to become a part of the City we actually would be putting the citizens of South Bend in the position of subsidizing people who live in Maple Lane. Council Member Adams made a motion to recommend this bill to the Council favorable, seconded by Council Member Taylor. The motion carried, with Council Member Miller opposing. BILL NO. 79 -77 A BILL APPROVING A CONTRACT BETWEEN THE BUREAU OF WATER OF THE CITY OF SOUTH BEND, INDIANA, AND (1) CLOW CORPORATION, SOUTH BEND, INDIANA, (2) KENNEDY VALVE MANUFACTURING COMPANY, ELMIRA, NEW YORK, AND (3) MUELLER CO., CHATTANOOGA, TENNESSEE, FOR THE PURCHASE OF AN ASSORTMENT OF WATER MAIN, VALVES, FITTINGS, AND HYDRANTS IN THE AMOUNT OF $207,914.42. This being the time heretofore set for public hearing on the above bill, proponents and opponen were given an.opportunity to be heard. Mr. Bill Dillon, engineer for the Water Works, made the presentation for the bill. He said bids were let pursuant to the statutes of the State of Indi and were found competitive. Council Member Adams asked if the prices were comparable to last year. Mr. Dillon indicated they were almost the.same. Council Member Szymkowiak made a motion to recommend this bill to the Council favorable, seconded by Council Member Taylor. The motion carried. REGULAR MEETING JULY 11, 1977 COMMITTEE OF THE WHOLE MEETING (CONTINUED) BILL NO. 80 -77 A BILL APPROVING A CONTRACT BETWEEN THE BUREAU OF WATER OF THE CITY OF SOUTH BEND, INDIANA, AND CLOW CORPORATION OF SOUTH BEND, INDIANA, FOR THE PURCHASE OF ONE 16" BUTTERFLY VALVE IN THE TOTAL AMOUNT OF $3,960.60. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Mr. Bill Dillon, engineer for the Water Works, made the presentation for the bill. He said this valve would allow semi- automatic control of water intake from the Edison Station to the North Reservoir. Council Member Szymkowiak made a motion that this bill be recommended to the Council favorable, seconded by Council Member Adams. The motion carried. BILL NO. 81 -77 A BILL APPROPRIATING $281,191.00 FROM THE COMMUNITY DEVELOPMENT BLOCK GRANT FUND FOR COMMUNITY DEVELOPMENT ADMINISTRATION COSTS TO BE ADMINISTERED THROUGH ITS DEPARTMENT OF HUMAN RESOURCES/ DIVISION OF COMMUNITY DEVELOPMENT. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Mr. Carl Ellison, Community Development Director, made th presentation for the bill. He said as part of Community Development's commitment to improve the "quality of life" in the City, the City through its Department of Human Resources and Economic Development has applied for and received the approval of the United States Department of Housing and Urban Development to expend $3,745,139 in the execution of certain public works, park improve ments, housing, and public service projects activities. He said in order to provide for efficien and effective utilitization of the CDBG funds, through planning, program development, and managem additional funds are required by the Division of Community Development. Council Member Adams mad a motion to eliminate the position of chief planner, and change the amounts for postage to $1,500 travel to $2,700, telephone to $6,200, printing and publication to $2,800, office supplies to $,2500, subscriptions to $2,800, and furniture and fixtures to $1,500, seconded by Council Presid Parent. The motion carried, with Council Member Miller opposing. Mr. Ellison asked that an amen ment be made to add a line item for gasoline and vehicle insurance in the amount of $2,000. Coun Member Adams made the motion, seconded by Council Member Dombrowski. The motion carried. Counci Member Adams made a motion that the attached letter, with the line items, be made a part of the ordinance, and she recommend this bill go to Council favorable, seconded by Council President Par The motion carried. BILL NO. 82 -77 A BILL APPROPRIATING $290,000.00 FROM THE COMMUNITY DEVELOPMENT BLOCK GRANT FUND, FOR HOUSING PROGRAM ADMINISTRATION TO BE AD- MINISTERED BY THE CITY OF SOUTH BEND ,THROUGH ITS DEPARTMENT OF HUMAN RESOURCES /DIVISION OF COMMUNITY DEVELOPMENT FOR THE BUILD- ING DEPARTMENT /BUREAU OF HOUSING. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Mr. Carl Ellison, Director of Community Development, made the presentation for the bill. He said the $290,000 appropriation request will be used for the personnel and non - personnel costs related to the administration of those programs under the Burea of Housing. Council Member.Szymkowiak made a motion to recommend this bill to the Council favora seconded by Council Member Dombrowski. The motion carried. BILL NO. 83 -77 A BILL APPROPRIATING $450,000.00 FROM THE COMMUNITY DEVELOPMENT BLOCK GRANT FUND, FOR PROJECT REHABILITATION GRANTS, TO BE AD- MINISTERED BY THE CITY OF SOUTH BEND THROUGH ITS DEPARTMENT OF HUMAN RESOURCES /DIVISION OF COMMUNITY DEVELOPMENT AND THE BUILD - ING DEPARTMENT /BUREAU OF HOUSING. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Mr. Carl Ellison,Director of Community Development, made the presentation for the bill. He said this appropriation request would be used for the continua of the Community Development Project Rehabilitation Program in those target areas approved for th 1977 program year. Council Member Serge made a motion to recommend this bill to the Council, fav orable, seconded by Council Member Dombrowski. The motion carried. BILL NO. 84 -77 A BILL APPROPRIATING $50,- 000.00 FROM THE COMMUNITY DEVELOPMENT BLOCK GRANT FUND, FOR THE ACQUISITION OF RESIDENTIAL PROPERTY FOR ,A LOCAL HOMESTEADING PROGRAM, TO BE ADMINISTERED BY THE CITY OF SOUTH. BEND THROUGH ITS DEPARTMENT OF HUMAN RESOURCES/ DIVISION OF COMMUNITY DEVELOPMENT AND THE BUILDING DEPARTMENT/ BUREAU OF HOUSING. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Mr. Jon Hunt, Deputy Director of Community Development, made the presentation for the bill. He said this appropriation would be used for the expansion of the City's present Federal Homestead Program. He said they intended to establish a City Home- stead Program through which properties will be made available to eligible applicants. He said only properties deemed feasible for rehabilitation will be offered. Council Member Miller asked what criteria would be used to judge whether or not to buy the house. Mr. Hunt indicated the first step would be to develop a list of possible units in the area, and the second would be to have an inspector determine the cost of rehabilitation. Council Member Miller asked what the top amount would be they would pay for these homes. Mr. Keith Crighton, Director of the Bureau of Housing, indicated he would anticipate $2,000 to $2,500 for a structure. Council Member Serge asked if this would be run the same as the Federal Program. Mr. Crighton indicated it would be similar. Council Member Adams made a motion to recommend this bill to the Council favorable, seconded by Council Member Dombrowski. The motion carried. t, t 1 t. e, REGULAR MEETING JULY 11, 1977 COMMITTEE OF THE WHOLE MEETING (CONTINUED BILL NO. 85 -77 A BILL APPROPRIATING $45,000.00 FROM THE COMMUNITY DEVELOPMENT BLOCK GRANT, FOR NON- PROFIT GROUP REHABILITATION OF SUBSTANDARD HOUSING UNITS, TO BE ADMINISTERED BY THE CITY OF SOUTH BEND THROUGH THE DEPARTMENT OF HUMAN RESOURCES /DIVISION OF COMMUNITY DEVELOPMENT AND THE BUILDING DEPARTMENT /BUREAU OF HOUSING. Thisbein;g the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Mr. Jon Hunt, Deputy Director of Community Development, made the presentation for the bill. He said this appropri &ion request would be used for the continuation of the present program thoughout the 1977 program year. He said grants have been made to such diverse groups as Renew, Inc., Montessori School and the Homeowners of the Near Northwest. Council Member Serge asked if these homes were in the target area. Mr. Hunt in- dicated any money spent for housing from Community Development has to be targeted. Council Member Adams made a motion to recommend this bill to the Council favorable, seconded by Council Member Serge. The motion carried. BILL NO. 86 -77 A BILL APPROPRIATING $25,000.00 FROM THE COMMUNITY DEVELOPMENT BLOCK GRANT FUND, FOR THE PROVISION OF SOCIAL SERVICES (LEGAL AID), TO BE ADMINISTERED BY THE CITY OF SOUTH BEND THROUGH ITS DEPARTMENT OF HUMAN RESOURCES /DIVISION OF COMMUNITY DEVELOPMENT AND THE LEGAL AID SOCIETY OF ST. JOSEPH COUNTY, INC. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Mr. Carl Ellison, Director of Community Development made the presentation for the bill. He said this appropriation was to provide social services (Legal Aid) for individuals and groups in the target areas. He indicated that Mr. Alan Burke, from the Legal Aid Society was present to answer any questions. Council President Parent indicated that this was more than they requested last year. Mr. Burke indicated that they anticipated represent ing 1,000 individuals next year. He said a vast majority of the money goes to services to in- dividuals, there is very little in the way of overhead expense. Council Member Adams indicated that they were increasing the number of law interns. She made a motion to amend the bill by reducing it by $3,000 or a total of $22,000, seconded by Council Member Dombrowski. The motion failed. Council Member Taylor made a motion to recommend the bill to the.Council favorable, seconded by Council Member Dombrowski. The motion carried. BILL NO. 87 -77 A BILL APPROPRIATING $40,000.00 FROM THE COMMUNITY DEVELOPMENT BLOCK GRANT FUND FOR ADMINISTRATION AND PERSONNEL COSTS, TO BE ADMINISTERED BY THE CITY OF SOUTH BEND THROUGH ITS DIVISION OF COMMUNITY DEVELOPMENT AND BUILDING DEPARTMENT /BUREAU OF SUB- STANDARD BUILDINGS. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Mr. Carl Ellison, Director of Community Development, made the presentation for the bill. He said the Bureau of Substandard Buildings will conduct several project activities during the Program Year, such as the Community Development Demolition Program and the Community Development Code Enforcement Program. He said to effectively and efficiently execute these project activities, additional administration and personnel funds will be required. Council Member Szymkowiak made a motion to recommend this bill to the Council favorable, seconded by Council Member Adams. The motion carried. BILL NO. 88 -77 A BILL APPROPRIATING $69,000.00 FROM THE COMMUNITY DEVELOPMENT BLOCK GRANT FUND FOR THE PURPOSE OF ESTABLISHING A DEMOLITION PROGRAM FOR UNSAFE AND DILAPIDATED STRUCTURES TO BE ADMINISTERED BY THE CITY OF SOUTH BEND THROUGH ITS DIVISION OF COMMUNITY DEVELOPMENT AND BUILDING DEPARTMENT /BUREAU OF SUBSTANDARD BUILDINGS. This being the time heretofore set for public hearing on the above bill, proponents and opponents' were given an opportunity to be heard. Mr. Carl Ellison, Director of Community Development, made the presentation for the bill. He said this appropriation will be used for non - personnel costs to board and /or demolish.dilapidated and unsafe structures. Council Member Serge made a motion to recommend this bill to the Council favorable, seconded by Council Member Dombrowski. Council Member Kopczynski indicated that some demolition contractors are causing debris to be thrown on the streets. He said he thought some one in the administration should take steps to correct this situation. He said in many cases trucks were overloaded. Council Member Dombrowski indicat that the trucks should not be overloaded and they should use a tarp. Mr. John DeLee, Building Commissioner, indicated he looked for better control over the demolition contractors since it was now being handled from his office. Council Member Adams asked if they had a written boarding policy. Mr. DeLee Indicated they did not want to board any homes if at all possible. He said in the past, there was insufficient money to board -up homes. Council Member Adams asked if they would develop a written policy. Mr. DeLee indicated they could. Council Member Serge commended Mr. DeLee for the fine job his department was doing. The motion carried. BILL NO. 89 -77 A BILL APPROPRIATING $30,000.00 FROM THE COMMUNITY DEVELOPMENT BLOCK GRANT FUND FOR THE'PURPOSE OF ESTABLISHING A REVOLVING FUND FOR A CODE ENFORCEMENT PROGRAM UNDER THE STATE'S UNSAFE BUILDING ACT OF 1973, AS AMENDED BY THE ACT OF 1977, TO BE AD- MINISTERED BY THE CITY OF SOUTH BEND THROUGH ITS DIVISION OF COMMUNITY DEVELOPMENT AND BUILDING DEPARTMENT /BUREAU OF SUB- STANDARD BUILDINGS. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Mr. Carl Ellison, Director of Community Development, made the presentation for the bill. He said this appropriation request would be used for non - personne costs to establish a Code Enforcement Revolving Fund. He said the purpose and intent of the fund would be to upgrade substandard structures and, thus, to lessen urban blight. Council President Parent made a mtoion to recommend this bill to the Council favorable, seconded by Council Member Taylor. The motion carried. REGULAR MEETING JULY 11, 1977 COMMITTEE OF THE WHOLE MEETING (CONTINUED BILL NO. 90 -77 A BILL APPROPRIATING $20,000.00 FROM THE COMMUNITY DEVELOPMENT BLOCK GRANT FUND, FOR VARIOUS PUBLIC PARK PROJECTS TO BE AD- MINISTERED BY THE CITY OF SOUTH BEND THROUGH ITS DEPARTMENT OF HUMAN RESOURCES /COMMUNITY DEVELOPMENT AND THE DEPARTMENT OF PUBLIC PARKS. This being the time heretofore set for public hearing on the above bill, proponents and opponen were given an opportunity to be heard. Mr. Carl Ellison, Director of Community Development, mal the presentation for the bill. He said this appropriation request would be used to light the two LaSalle tennis courts and fence off Beck's Lake along Washington Street. Mr. James Seitz, Superintendent of Parks, indicated many small children walk along Washington Street to and from the recreation center park and they were concerned that a child might fall into the lake. Coun Member Dombrowski asked if they were going to build a guard rail to stop people from driving sto cars into the lake. Mr. Seitz indicated they would have no objection. Council Member Dombrows made a motion to recommend this bill to the Council favorable, seconded by Council Member Adams The motion carried. BILL NO. 91 -77 A BILL APPROPRIATING $360,000.00 FROM THE COMMUNITY DEVELOPMENT BLOCK GRANT FUND, TO IMPROVE THE FIREFIGHTING CAPACITY OF SOUTH BEND'S FIRE DEPARTMENT, TO BE ADMINISTERED BY THE CITY OF SOUTH BEND THROUGH ITS DEPARTMENT OF HUMAN RESOURCES /DIVISION OF COM- MUNITY DEVELOPMENT AND THE DEPARTMENT OF PUBLIC WORKS. This being the time heretofore set for public hearing on the above bill, proponents and opponen were given an opportunity to be heard. Mr. Jon Hunt, Deputy Director of Community Development, made the presentation for the bill. He said this appropriation would be used to construct a new fire station and purchase a fire ladder truck. He said the fire station would be built in the vicinity of Western Avenue and Lake Street. Mrs. Jane Swan, 2022 Swygart, indicated she would like.ao know the advantage of a new station. Fire Chief Van Wiele indicated the new station would provide a ladder truck that is sorely needed in that area of the City. Mrs. Swan asked why they did not build on to the Gladstone Station. Chief Van Wiele indicated that the property was too limited and it was felt it would be much more expensive to remodel that statio Mrs. Swan indicated thatshe questioned the building of a new station because it was only seven blocks from the Gladstone Station. Council Member Dombrowski questioned moving the station in toward the City, as he thought it should be moved further west. Council Member Dombrowski made a motion to send this bill to the Public Safety Committee, seconded by Council Member Parent. Council President Parent indicated he thought more time was needed to look at this problem. Council Member Adams indicated she questioned whether we need a new station. She said she woul like the Administration and Chief Van Wiele to explain why this is needed, at the Public Safety meeting. The motion carried. BILL NO. 92 -77 A BILL APPROPRIATING $200,000.00 FROM THE COMMUNITY DEVELOPMENT GRANT FUND TO R &S 60, ORANGE STREET /COLFAX STREET CONNECTOR, WITHIN THE LOCAL ROAD AND STREET FUND. This being the time heretofore set for public hearing on the above bill, proponents and opponen were given an opportunity to be heard. Mr. Jon Hunt, Deputy Director of Community Development, made the presentation for the bill. He said this appropriation would be utilitized for the construction of storm sewers within the project area, and will serve as a partial match to the Federal -aid Urban Funds which make up the bulk of the funding for this project. Mr. Andy Toth, local architect, indicated he was concerned with what the City was doing relative to storm wate control. He said the City has twelve lagoons covering one hundred and forty acres of land, whi is lost as a tax income. He said storm water run -off carries disease, and that polluted water is a contributing cause of cancer. Council Member Szymkowiak indicated there was no reason why the development of the connector should be delayed. He made a motion to recommend this bill to the Council favorable, seconded by Council Member Adams. Council President Parent indicated th things Mr. Toth said were valid and that the Council was going to have to start looking at prob lems that might be twenty -five to thirty years in the future. Council Member Kopczynski said he was familar with water pollution in Lake Michigan. He said he thought the Council should know how much sewage is being pumped into the river. Mr. David Wells, Bureau of Administration and Design, indicated that the Engineering Department felt the present system was doing a fine job. He indicated there were diversion chambers that allowed run -off after a heavy rain. Coun Member Kopczynski asked if water samples were taken from the river at various times. Mr. Wells indicated that samples were taken weekly. The motion carried. Council President Parent asked if the Council would be given an input as to the spending of these funds Mr. Hunt indicated they had conducted a survey of possible curb projects and he would be glad to send him a list. Council President Parent indicated he did not feel the fifty -fifty basis would work, because people in the target areas could not afford it. He indicated he did not approve of this policy. PRIVILEGE OF THE FLOOR Mr. David Wells, member of the TRANSPO Board of Directors, indicated that July 12 TRANSPO was offering a ride for a dime, and he invited everyone to ride the bus for a dime. NEW BUSINESS Council Member Adams made a motion to suspend the rules and hear a resolution submitted by Urban Observatory to authorize inspectors of the City's Bureau of Housing to receive additional com- pensation pursuant to a contract between the City and the Institute for Urban Studies at Notre Dame, seconded by Council Member Miller. The motion carried by a roll call vote of eight ayes. RESOLUTION NO. 565 -77 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, AUTHORIZING INSPECTORS OF THE CITY'S BUREAU OF HOUSING TO RECEIVE ADDITIONAL COMPENSATION PURSUANT TO A CONTRACT BETWEEN THE CITY AND THE IN- ' STITUTE FOR URBAN STUDIES AT THE UNIVERSITY OF NOTRE DAME. WHEREAS, Ordinance No. 5830 -75, -being section 2 -118 (a) -(d) of the Municipal Code of the City of South Bend provides that no additional compensation shall be paid by the City to any City employees without approval of the Common Council; and, WHEREAS, The City of South Bend, through its Community Development Program, proposes to enter into a contract with the Institute for Urban Studies at the University of Notre Dame for a survey of current conditions of homes which have been rehabilitated through the City's several programs of housing rehabilitation; and, WHEREAS, the Institute for Urban Studies proposed to employ, with the funds received from the City through its Community Development Program, qualified inspectors for the City's Bureau of Housing to inspect the conditions of rehabilitated homes at the rate of ten dollars ($10.00) per home, on their personal time at their own volition: NOW, THEREFORE, BE IT RESOLVED, by.the Common Council of the City of South Bend, Indiana; Section I. That the inspectors employed` in the Bureau of Housing who qualify to work for the Institute for Urban Studies in its contract with the City may receive the additional compensation of ten dollars ($10.00) for each home inspected pursuant to the contract proposed between the City and the Institute for Urban Studies at the University of Notre Dame. /s /Roger 0. Parent Member of the Council A public hearing was held at this time on the resolution. Mr. Todd Areson, of Urban Observatory, indicated that the Urban Observatory recently created an additiional project for 1977. He said this was a study of the housing rehabilitation over the past decade. He said it would cover three things; homes that have been rehabilitated, occupants, and effect and impact on the neighborhood where the program has been operating. He said they were going to try_ and inspect twenty percent of the homes that have been rehabilitated. Council Member Adams made a motion to adopt this resolution, seconded by Council Member Kopczynski. Council President Parent indicated he was against the adoption of this resolution for two reasons; he did not think that City employees should receive reimbursement from two sources, and having people who work for the City doing the study might raise questions about its validity. The resolution was adopted by a roll call vote of seven ayes and one nay (Council President Parent). Council President Parent indicated that for the last six months Council Members have discussed the need that something be done about safety at Island Park. He said up to now the Council has been told to improve the safety aspect would lose the aesthetic value. He said he would like the Council to establish a committee of citizens to look at this situation and make a recommenda- tion. Council Member Kopczynski made a motion to establish a committee with no more than five persons to look into this situation at Island Park and report to the Council in a month or so, seconded by Council Member Adams. Council Member Miller said there were danagers all along the river, and there are safety provisions made along the river and on Island Park that are sufficier for its usage. He said the situation should be watched very closely to see how the park is used. He said if the Council needs further study he thought the Council was really taking the position to provide for total safety, which would mean a fence all along the river. He said he was again: this motion. Council Member Serge indicated that some type of protection should be there. Counc Member Kopczynski indicated it was clearly evident that many rules of water safety have been violated. Council Member Dombrowski indicated that perhaps a citizen's committee could find SOME thing that the professional cannot see. The motion carried, with Council Member Miller opposing. There being no further business to come before the Council unfinished or new, Council Member Kopczynski made a motion to adjourn, seconded by Council Member Adams.
