HomeMy WebLinkAbout06-27-77 Council Meeting MinutesREGULAR MEETING JUNE 27, 1977 Be it remembered that the Common Council of the City of South Bend met in the Council Chambers of the County -City Building on Monday, June 27, 1977, at 7:00 p.m. Council President Roger O. Parent presiding. The meeting was called to order, and the Pledge to the Flag was.given. ROLL CALL PRESENT: Council Members Serge, Szymkowiak, Miller, Taylor, Kopczynski, Adams, Dombrowski and Parent ABSENT: Council Member Horvath REPORT FROM THE SUB - COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your sub- committee on the inspection and supervision of the minutes would respectfully re- port that it has inspected the minutes of the June 13, 1977 meeting of the Council and found th correct. The sub - committee, therefore, recommends that the same be approved. /s /Roger Parent /s /Mary Chris Adams Council Member Dombrowski made a motion that the minutes of the June 13, 1977, meeting of the Council be placed on file, seconded by Council Member Serge. The motion carried. SPECIAL BUSINESS Council President Parent indicated that Council Members had questions to ask of the Police Depart ment and the Mayor regarding the recent "ticket binge. He indicated that this was for their own personal gain and the Mayor never ordered the police officers to stop their unfair tactics. Council Member Taylor indicated that the citizen's confidence in the Police Department had been shaken because of this tactic. He said he thought this tactic only served to undermine the ex- ecutive branch of government. He asked who organized this "ticket binge." Police Chief Borkowsk indicated that the FOP was the major voting body. Council Member Adams outlined the meetings that had taken place with the FOP in an attempt to negotiate with them. She said she resented the fact that statements have been made that the Council will not negotiate. She said she felt the Council has been fair and no firm figure has been set. Council Member Kopczynski indicated that when the ticket blitz started he called the Mayor and it was evident he supported this type of tactic. He indicated he had calls from citizens that in as much as the police had time to write this amount of tickets in such a short time it only proves they have time on their hands and are not doing their job. He indicated that it was difficult for the Council to negotiate when the police have said that the items they want are not negotiable. Council Member Serge indicated that the police had disobeyed the rules of their department. He indicated he was in favor of higher pay for the police, if there was money in the budget. Council Member Adams indicated she hoped the Mayor was misquoted in the SOUTH BEND TRIBUNE regarding statements that the Council resume negotiations; with the FOP. She indicated the Council had never stopped negot Ling. Council Member Dombrowski indicated that he hoped the FOP would sit down and bargain in good faith, Cpl: Ron Wilson, head of the wage committee, indicated they had met with the Council three different times and were told the Council did not know how much was available, and they could not tell us what they could give us. He said that was not negotiating. Council Member Miller indicated he did not think the Council should get into negotiating at this meeting, and he felt they should move on to the agenda. REGULAR MEETING JUNE 27, 1977 Council Member Adams indicated that the Council does not know exactly how much is available. She asked the controller to explain this situation. Mr. Peter Mullen, City Controller, in- dicated they would not know until at least the end of this month exactly how much funding the City would have in 1978. He said they would not know the exact amount until they receive certif cation from the State. Council President Parent asked police officer Wells how this year's negotiations differed from the last year. Officer Wells indicated there was very little differei He said that year after year they are promised that if they do a good job they will be rewarded.; He indicated they could not negotiate any part of their package until they know a firm figure. Council President Parent indicated he was particularly concerned about the word being spread than the Council was not negotiating in good faith, or not negotiating at all. He said in the past we have always been able to compromise and this year's process should not be any different. He said that $800 is around six percent of $13,000 and equivalent to what the Administration is proposing. He said the $400 was discussed for the higher ranks because they received large in- creases last year. He said the lower end of the scale would receive less primarily because of the pension. He asked the Mayor how much money would be available if the Council were to apply his recommendation across the board. Mayor Peter J. Nemeth said the Administration obviously would not propose something if they could not fund it. He said the six percent across the board is what the Administration feels could be funded. He said it was up to the Council to carry out the negotiations. Council Member Adams indicated that taxes might have to be increased to meet the six percent salary increases which would cost $850,000, including fringe. Mayor Nemeth in- dicated he did not know what the budget was going to be, but there was a possibility that taxes would have to be increased. Council Member Adams asked if when they were negotiating with the Teamsters, money was set aside for police and fire. Mayor Nemeth indicated that since this was up to the Council, he felt it best to leave it to the Council. Council Member Serge discussed all fringe benefits the Police Department receives from the tax role. Council Member Kopczynski discussed the crime reduction and asked how much "Sting" contributed to the reduction. Chief Borkowski indicated that was very difficult to determine. Mr. Edward Jerzak, Jr., 1914 Kemble, indicated to the Council that he was beaten by the police and showed his wounds to the Council. Council President Parent asked Chief Borkowski to send him a report on this incident. Mrs. Jane Swan, 2022 Swygart, indicated the citizens were apprehensive about reporting harrassment, becaus they were afraid of retaliation from the police. She indicated that the people are outraged by the petty action of the police. She said this was a blatant attempt to make this look like it was the fault of the Council. She said she had never heard any Council Member promise rewards for a lower crime rate. SheZaid the decline in crime is a nationwide trend and South Bend-.is not unique. She said the Council will not be stampeded into action that will -harm the City. She said if the Mayor does not take action, then the people of the City will have to let the Mayor know they will not be harassed by the FOP. She said that many members of the police force do no live in South Bend and do not pay taxes. Mr. Paul Bognar, 807 W. Washington, indicated that police and fire negotiations caused the problem that New York City and San Francisco is now facing. Mr. Franklin Morse, President of the Board of Public Safety, indicated that he, and the two other members of the Board of Public Safety, were out -of -town last week. He said when he returned he read in the paper that he would be asked to explain the silence of the Board of Publ Safety. He said he did not consider the Board of Safety answerable to the Council. He said they should work hand -in -hand on any mutual problem that confronts us. He said he has asked Chief Borkowski to make a full report of any unethical problems with any police officer in the past three days. He said the Board of Public Safety was going to pass a resolution that if any member of the public feels there is misconduct by any officer during this period we want to know about it and we will deal with it fairly and severely. He said the police cannot strike and the only recourse was "slow down ", "blue flu" or "speed up ", and he felt that the speed up was the best course to take. He said he thought everyone concerned should get back to the negotiating table. Mr. Harry Dieter, 1030 Birchwood, indicated he has had a problem with the Police Depart- ment for several months. He wanted to know who a person could turn to, to get answers from the Police Department. Mrs. Betty Andrzejewski, 2922 Bonds, indicated there has to be a middle somewhere, if the police speed up there are complaints and if they slow down there are complaint Mr. John Radzikowski, 625 N. Brookfield,.spoke in favor of the Police Department's request for a raise. Council President Parent indicated that most.of the Council felt the Police Department was comprised of good employees. He said he was proud of the Police Department. He said he would support higher salaries for.any City employee. He said he would work very hard to support the police and he hoped the Council can give them as much as possible. Council Member Taylor made a motion to recess, seconded by Council Member Serge. The motion carried and the meeting recessed at 7:30 p.m., and reconvened at 8:00 p.m. Council Member Adams made a motion to resolve into the Committee of the Whole, seconded by Counc: Member Dombrowski. BILL NO. 24 -77 that the Common Council of the City of South Bend met in the Committee of the June 27, 1977, at 8:04 p.m., with eight members present. Council Member Kopczynski made a motion to send this bill to the Utilities Committee, seconded by Council Member Dombrowski. The motion carried, with Council Members Szymkowiak and Miller opposing. BILL NO. 25 -77 A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, APPROVING THE LEASING OF SEWAGE DISPOSAL FACILITIES OF CLAY UTILITIES, INC. Council Member Kopczynski made a motion to send this bill to the Utilities Committee, seconded by Council Member Dombrowski. The motion carried, with Council Members Szymkowiak and Miller opposing. BILL NO. 26 -77 A BILL APPROPRIATING $92,985.00 FROM FUND 30, COMMONLY KNOWN AS THE DEPRECIATION FUND OF THE BUREAU OF WATER, TO LINE 30.0710, COMMONLY DESCRIBED AS BUILDING STRUCTURES AND IMPROVEMENTS, ALL FUNDS BEING WITHIN THE BUREAU OF WATER OF THE CITY OF SOUTH BEND. REGULAR MEETING JUNE 27, 1977 COMMITTEE OF THE WHOLE MEETING (CONTINUED) Council Member Dombrowski made a motion to recommend this bill to the Council favorable, seconde by Council Member Serge. Council Member Adams reminded the Council that this was a companion ordinance and possibly should be sent to Committee. Council Member Dombrowski withdrew his moti and Council Member Serge withdrew his second. Council President Parent made a motion to send this bill to the Utilities Committee, seconded by Council Member Dombrowski. The motion carried with Council Members Szymkowiak and Miller opposing. BILL NO. 59 -77 A BILL AMENDING CHAPTER 5, ANIMALS, OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA. This being the time heretofore set for public hearing on the above bill, proponents and opponent: were given an opportunity to be heard. Mr. Peter Mullen, City Controller, made the presentation for the bill. He said this bill was an attempt to provide better animal control and licensing for the citizens of South Bend. He said animal control has recently become more expensive, and this bill will attempt to generate additional income to the City which can offset these increases costs. Council Member Dombrowski made a motion to send this bill back to the Committee of the Whole, seconded by Council Member Kopczynski. Council Member Kopczynski indicated that he thougl it only fair that the Council look at the financing of the dog control program. He said he thought a program should be designed to take care of strays. Council President Parent indicated he felt the problem with this bill was that it does not require animals to have rabies shots before they are licensed. Mr. Mullen indicated that.State law provides for rabies shots. Counc.i Member Szymkowiak indicated that the problem was stray dogs in the City. Council President Parer indicated he felt our present animal ordinance was sufficient. Council Member Dombrowski changes his motion, and referred this to the Committee on Public Safety,.seconded by Council Member Kopczynski. The motion carried. BILL NO. 63 -77 A BILL APPROPRIATING $27,950.00 FROM THE FEDERAL ASSISTANCE GRANT, COMMONLY KNOWN AS GENERAL REVENUE SHARING, FOR VARIOUS ADMINISTRATION AND FINANCE PROGRAMS TO BE ADMINISTERED BY THE CITY OF SOUTH BEND THROUGH ITS DEPARTMENT OF ADMINISTRATION AND FINANCE. This being the time heretofore set for public hearing on the above bill, proponents and opponent were given an opportunity to be heard. Mr. Peter Mullen, City Controller, made the presentation for the bill. He said this bill was to authorize the hiring of a museum design consultant. He said Joseph A. Wetzel Associates have been hired. He said with this money they will be able to put together a planning design and construction format, in order that they can be used in future fund - raiding activities. He said funds raised from this activity will be used to pay for exhibi design and construction costs. Council Member Serge asked if once they appropriated this money, would this be self- sustaining. Mr. Mullen indicated this money would hopefully raise about $200,000 for the museum. Council Member Serge asked if there would be a charge to get into the museum. Mr. Mullen indicated that this was being discussed, but no definite decision had been made. Council Member Dombrowski made a motion to recommend this bill to the Council favorable, seconded by Council Member Taylor. The motion carried. BILL NO. 64 -77 A BILL FIXING MAXIMUM SALARIES AND WAGES OF APPOINTED OFFICERS AND EMPLOYEES OF THE CITY OF SOUTH BEND, INDIANA, FOR THE YEAR 1978. This being the time heretofore set for public hearing on the above bill, proponents and opponent were given an opportunity to be heard. Council President Parent made a motion that this bill be referred to the Council with no recommendation, seconded by Council Member Dombrowski. The moti carried. Mayor Peter J. Nemeth asked if there was going to be a public hearing now, or later. Council Member Adams indicated they would hold a public hearing tonight if any one wished to spe as well as at a later date. Mr. Peter Mullen, City Controller, proposed the following amendment to the bill: Page 1, II. Department of Law, add hearing officer $13,780; III. Century Center - Discovery Hall Dir /Curator (remove Curator) change salary to present $16,000 - annual proposed $16,960; IV. Bureau of Manpower Adm., change assistant field director to supportive service coordinator, add program review specialist at a salary of $12,402 and personnel specialist at a salary of $12,702, change outreach worker II to client service aide II and outreach worker I to client service aide I, add the position of job coach II at a salary of $10,911. Page 2, Parks, change assistant superintendent of business to fiscal officer, and change proposed salary to $15,388. Page 3. Building and Permits eliminate sub - standard office manager and chief inspecto Page 7, General Classification, change auditor III salary to minimum $11,661 - maximum $12,949, and auditor II salary maximum to $11,677. Council Member Kopczynski made a motion to accept these amendments, seconded by Council Member Taylor. The motion carried. Mr. Mike Lawrence, representative of Teamsters Local 364, indicated he would defer his comments until the next publ hearing. Council Member Parent made a motion to continue public hearing until July 18, a specia meeting of the Council, seconded by Council Member Dombrowski. The motion carried. BILL NO. 68 -77 A BILL FIXING MAXIMUM SALARIES AND WAGES OF APPOINTED OFFICERS AND EMPLOYEES OF THE CITY OF SOUTH BEND, INDIANA, WITHIN THE DIVISION OF COMMUNITY DEVELOPMENT FOR THE YEAR FROM JULY 1, 1977, TO JUNE 30, 1978. Council President Parent made a motion to continue public hearing on this bill until July 18, 1.977, seconded by Council Member Dombrowski. The motion carried. BILL NO. 69 -77 A BILL APPROPRIATING $2,300 FROM THE FEDERAL ASSISTANCE GRANT, COMMONLY REFERRED TO AS GENERAL REVENUE SHARING, FOR EQUIPMENT REPAIR AT MORRIS CIVIC AUDITORIUM, TO BE ADMINISTERED BY THE CITY OF SOUTH BEND, INDIANA, THROUGH THE DEPARTMENT OF ADMINISTRATION AND FINANCE. REGULAR MEETING JUNE 27, 1977 COMMITTEE OF THE WHOLE MEETING (CONTINUED) This being the time heretofore set for public hearing on the above bill, proponents and opponen were given an opportunity to be heard. Mr. Patrick McMahon, Director of Public Works, made the presentation for the bill. He said money would be used to repair a cooling coil and replace a drive shaft in the main blower unit of the Morris Civic Auditorium. He said the coil, subject to the severe winter, has been damaged and requires repair. He said the shaft, for reasons yet undetermined by his office, has become warped and as presently operating on a marginal basis. Council Member Serge made a motion to recommend this bill to the Council favorable, seconded by Council Member Taylor. Council Member Dombrowski asked if the building engineer from Century Center could service this building also. Mr. McMahon indicated he could and he had looked into this problem. The motion carried. BILL NO. 70 -77 A BILL APPROPRIATING ADDITIONAL MONIES TO VARIOUS FUNDS AS SET FORTH IN SECTION I. FOR THE PURPOSE OF DEFRAYING THE EXPENSE OF LIABILITY AND PROPERTY INSURANCE FOR THE CITY OF SOUTH BEND DURING THE PERIOD OF JULY 15 TO JANUARY 15, 1978. This being the time heretofore set for public hearing on the above bill, proponents and opponent were given an opportunity to be heard. Mr. Peter Mullen, City Controller, made the presentation for the bill. He said that in January a resolution was passed accepting the proposal of Aetna Insurance for the coverage of the City. He said that at that time he informed the Council that there would be a need for additional funds to pay premiums and audit costs. He said the funds, as detailed in the ordinance, will pay premiums owed for the period July 15, 1977 through Januar 15, 1978, and therefore, allow the City to maintain present coverage as it was bid. He said premium costs have been spread among several funds, in an attempt to place premium responsibilit on the source of exposure. Council Member Kopczynski made a motion to recommend the bill to the Council favorable, seconded by Council Member Taylor. The motion carried. BILL NO. 71 -77 A BILL APPROPRIATING $91500 FROM THE FEDERAL ASSISTANCE GRANT, COMMONLY REFERRED TO AS GENERAL REVENUE SHARING FOR VARIOUS PUBLIC SAFETY PROGRAMS TO BE ADMINISTERED BY THE CITY OF SOUTH BEND THROUGH ITS POLICE DEPARTMENT. This being the time heretofore set for public hearing on the above bill, proponents and opponent were given an opportunity to be heard. Division Chief Glenn Terry of the Police Department, mad the presentation for the bill. He said there was a need for twenty -eight new in -car chargers capable of handling a 700 milampre battery attached to existing portable radios and two charger units. One charger unit would hold and charge thirty batteries while not in use at the Police Department and the other would be a five unit charger for the Bureau of Communications' repair shop.- He said modifications to the 700 milampre system allows for better contact points in the charger unit, longer life of the battery while out of the charger and more sending power. He said the system would decrease down -time on radios, keeping the vehicles functioning and avail- able for regular beat assignment. He said a bid had been accepted in the amount of $8,673, and asked the bill be amended to that amount. Council Member Kopczynski made a motion to amend the amount of this bill to $8,673, to conform with the bid, throughout the bill, seconded by Council President Parent. The motion carried. Council Member Szymkowiak made a motion to recommend this bill to the Council favorable, as amended, seconded by Council Member Taylor. The motion carried. BILL NO. 72 -77 A BILL APPROPRIATING $13,500 FROM THE FEDERAL ASSISTANCE GRANT, COMMONLY REFERRED TO AS GENERAL REVENUE SHARING, FOR VARIOUS PUBLIC SAFETY PROGRAMS, TO BE ADMINISTERED BY THE CITY OF SOUTH BEND THROUGH THE DEPARTMENT OF AD- MINISTRATION AND FINANCE. This being the time heretofore set for public hearing on the above bill, proponents and opponent were given an opportunity to be heard. Mr. Peter Mullen, City Controller, made the presentation for the bill. He said this money will be used to provide the funds for our new contract with the Humane Society. He said $24,000 was budgeted for the 1977 payment, however, this was before the reorganization of the Humane Society. He said the City has arranged to continue its own animal shelter. Council Member Kopczynski made a motion to recommend this bill to the Council favorable, seconded by Council Member Dombrowski. The motion carried. BILL NO. 73 -77 A BILL APPROPRIATING $1,850 FROM THE ANTI - RECESSION FUND, COMMONLY REFERRED TO AS COUNTER - CYCLICAL GRANT, FOR VARIOUS ADMINISTRATIVE PROGRAMS, TO BE ADMINISTERED BY THE CITY OF SOUTH BEND, THROUGH ITS DEPARTMENT OF ADMINISTRATION AND FINANCE. This being the time heretofore set for public hearing on the above bill, proponents and opponent were given an opportunity to be heard. Mr. Peter Mullen, City Controller, made the presentation for the bill. He said one of the animal control vans was damaged beyond repair. He said a settlement from Allstate Insurance, in the amount of $1,546.10 has been received and an addition $1,850 is needed to replace the van. Council Member Adams reported the Personnel and Finance Committee recommended this bill to the Council favorable. Council Member Kopczynski made a moti to recommend this bill to the Council favorable, seconded by Council Member Szymkowiak. The motion carried. BILL NO. 74 -77 A BILL APPROVING A CONTRACT BETWEEN THE BUREAU OF WATER OF THE CITY OF SOUTH BEND, INDIANA AND ; (1) MIDWEST CHLORINE, CHICAGO, ILLINOIS; (2) VAN WATERS AND ROGERS, SOUTH BEND, INDIANA AND (3) WATCON, INC., SOUTH BEND, INDIANA, FOR THE PURCHASE OF CHEMICALS FOR USE FROM JUNE 1, 1977 TO JUNE 1, 1978 . IN THE TOTAL AMOUNT OF $48,773.75. REGULAR MEETING JUNE 27, 1977 COMMITTEE OF THE WHOLE MEETING (CONTINUED) This being the time heretofore set for pubic hearing on the above bill, proponents and opponent: were given an opportunity to be heard. Mr. John Stancati, Director of Utilities, made the pre- sentation for the bill. He said these chemicals will be used for purification of water and additives beneficial to health. He said bids were let pursuant to thestatutes of the State of Indiana and were found competitive. Council Member Serge made a motion to-fecommend this bill to the Council favorable, seconded by Council Member Taylor. The motion carried. There being no further business to come before the Committee of the Whole, Council Member Tayl made a motion to rise and report to the Council, seconded by Council Member Serge. The motion carried. ORDINANCE NO. 6164 -77 AN ORDINANCE APPROPRIATING $27,950.00 FROM THE FEDERAL ASSISTANCE GRANT, COMMONLY KNOWN AS GENERAL REVENUE SHARING, FOR VARIOUS ADMINISTRATION AND FINANCE PROGRAMS TO BE ADMINISTERED BY THE CITY OF SOUTH BEND THROUGH ITS DEPARTMENT OF ADMINISTRATION AND FINANCE. This bill had second reading. Council Member Miller made a motion to amend the FA number to 13 seconded by Council Member Taylor. The motion carried. Council Member Taylor made a motion to pass the bill, as amended, seconded by Council Member Dombrowski. The bill passed by a roll ca vote of eight ayes.
