HomeMy WebLinkAbout02-28-77 Council Meeting Minutesr REGULAR MEETING FEBRUARY 28, 1977 Be it remembered that the Common Council of the City of South Bend met in the Council Chambers of the County -City Building on Monday, February 28, 1977, at 6:00 p.m., Council President Roger O. Parent presiding. The meeting was called to order and the Pledge to the Flag was given. ROLL CALL PRESENT: Council Members Serge, Szymkowiak, Miller, Taylor, Kopczynski, Adams, Dombrowski, Horvath and Parent ABSENT: None REPORT FROM THE SUB - COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your sub - committee on the inspection and supervision of the minutes would respectfully report that it has inspected the minutes of the February 14, 1977 meeting of the Council and found them correct. The sub - committee, therefore, recommends that the same be approved. /s /Mary Chris Adams /s /Roger O. Parent Council Member Serge_ made a motion that the minutes of the February 14, 1977, meeting be accepted as read and placed on file, seconded by Council Member Taylor. The motion carried. REGULAR MEETING FEBRUARY 28r 1977 REGULAR MEETING SPECIAL BUSINESS Council President Parent asked that the following appointments be made: Council Member Horvath be appointed to the Economic Development Commission. Council Member Dombrowski made a motion to accept this appointment, seconded by Council Member Adams. The motion carried. Mrs. Jane Swan be appointed to the Century Center Board of Managers. Council Member Dombrowski made a motion to accept this appointment, seconded by Council Member Adams. The motion carried, with Council Member Miller opposing. Mr. Frank Gootee to the Transportation Board of Directors. Council Member Dombrowski made a motion to accept this appointment, seconded by Council Member Adams. The motion carried. Mr. Robert Swanson to the Human Rights Commission. Council Member Taylor made a motion to accept this appointment, seconded by Council Member Dombrowski. The motion carried. Council President Parent thanked the people involved for accepting these appoint- ments. Council President Parent accounced the following appointments to the Council Standing Committees: Personnel and Finance; Chairman, Council Member Adams, Council Members Kopczynski, Dombrowski and Horvath. Rules Committee; Chairman, Roger O. Parent, Council Members Adams and Taylor. Human Resources; Chairman, Walter T. Kopczynski, Council Members Taylor and Miller. Parks and Recreation; Chairman, Walter Szymkowiak, Council Members Serge and Dombrowski. Public Works; Chairman, Joseph Serge, Council Members Adams, Dombrowski, Kopczynski and Szymkowiak. Residential Neighborhood Committee; Chairman, Roger O. Parent, Council Members Adams, Taylor, Dombrowski and Serge. Public Safety; Chairman, Robert Taylor, Council Members Dombrowski, Horvatl and Serge. Council President Parent asked that two special committees be continued this year, the Committee on Older Adults and Century Center. Council Member Adams made a motion to continue these committees, seconded by Council Member Taylor. The motion carried. Council President Parent indicated that Joseph Serge would be chairman of the Older Adults Committee, and Council Members Horvath and Dombrowski would be appointed to the committee. He.said that on the Century Center Committee, chairman would be Terry Miller, with Council Members Szymkowiak and Adams serving on the committee. Council Member Miller, indicated he declined to serve as chairman of this committee. Council President Parent indicated this was not accepted and that Council Member Miller would serve as chairman. Council President Parent summarized the procedure for citizen members to serve on Council committ He then filed this procedure with the Clerk's office. REPORTS OF COUNCIL COMMITTEES The Administration and Finance Committee has reviewed the CETA budgets for Titles, I, II, and VI and makes the following recommendations: 1. A concentrated effort should be made to reduce administrative costs so that more participants can be served. However, in light of the doubling of the program, there is no recommendation to cut staff at the present time. 2. Since South Bend is the Prime Sponsor, only residents of the City should be served by the CETA Programs. At the present time, an applicant must reside in the city in order to be eligible to participate. We request that this be extended to require the termination of a participant if he /she leaves the city. St. Joseph County has its own CETA Programs for non -South Bend residents so the participant should transfer to that program if he /she leaves the city. We ask that this requirement be noted on the application forms. 3. For Title III which is the summer program which will be submitted later, we request that all supervisory and temporary staff be South Bend residents as we have many young people in South Bend who will be in need of summer employment. The Administration and Finance Committee also requests that Mr. Kelzenberg prepare a written re- port explaining why the figures from the following 3 lists do not agree: 1) PSE CETA list sent for Titles II and VI sent 1 -19 and 1 -24 to Council Members 2) Alpha Payroll list of 1 -17 3) Grant application for Titles II and VI sent to Department of Labor in January. Mary Christine Adams Chairman Council Member Dombrowski made a motion to file this report with the City Clerk's office, seconde by Council Member Adams. The motion carried. Public Works Committee - Council Member Serge made a motion to set the bill to annex Laurel Woods for public hearing and second reading March 28, seconded by Council Member Taylor. The motion carried. Council Member Adams made a motion to resolve into the Committee of the Whole, seconded by Counci Member Dombrowski. The motion carried. COMMITTEE OF THE WHOLE. MAIN STREET). Council Member Miller made a motion to strike this ordinance from the records, in accordance with the request of the petitioner, seconded by Council Member Dombrowski. The motion carried. BILL A BILL ZONING A PARCEL OF -LAND WITHIN THE CITY LIMITS OF SOUTH BEND, INDIANA (Southeast corner of Chippewa and Michigan Streets). This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Mr. Richard Morgan, attorney, made the presentation for the ordinance. He indicated this zoning was for Endodontic Services, Inc., a dental clinic. He indicated that Drs. Feltman and Ma:gers were in the audience, as well as the architect, to answi any questions the Council might have. He said this property was located at the southeast corner of Chippewa and U.S. 31. He described the surrounding properties, which are commercial. He in- dicated this was not a high usage for this property. He said this received a unanimous recom- mendation from Area Plan. Council Member Serge asked how many parking spaces would be provided. Mr. Morgan said the petition indicated twenty -four. Council Member Dombrowski asked how many people would be employed. Mr. Morgan indicated eight. Council Member Kopczynski made a motion to recommend this bill favorable to the Council, seconded by Council Member Taylor. The motion carried. BILL A BILL AMENDING ORDINANCE NO. 4990 -68, AS AMENDED, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (CHAPTER 21, MUNICIPAL CODE) (NORTHEAST CORNER OF FILLMORE ROAD(LINDEN AVENUE) AND CLEMENS STREET). This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Mr. Thomas Brademas, 1614 Devon Circle, made the pre- sentation for the bill. He indicated that immediately adjacent to the site he was seeking to have rezoned is the so called Harber Homes. He said he thought the Council was aware of the pro - blems with these houses. He said his firm had approached HUD with a proposal to acquire, re- habilitate and manage these homes. He said the Housing Assistance Program has indicated there is need for 450 housing units for the elderly. He said they propose to develop 121 units, and have convenience shopping on the site. He said as a companion to this ordinance they have requested a small amount of rezoning for a development within a single building, and there is a small area set aside for a convenience grocery. He said it was their plan to have the grocery owned and operated by the older adults living in the project. He said all buildings will have six units, they will be one story, brick veneer. He showed a plan of the project to the Council. He said this was an opportunity to provide older adults with safe and sound housing. Mr. Michael Carring- ton, Assistant to the Mayor, said that Mr. Brademas had indicated that HUD would approve his pur- chase of Harber Homes. Mr. Brademas indicated that was essentially correct. He said it must be put on the open market but all bidders must be willing to take Harber Homes and rehab and manage it. Mr. Carrington indicated the City's_ primary interest was to get Harber Homes in good condi- tion. Mr. Brademas indicated that the Council had rezoned the area in question to multi- family housing and they had submitted an application to HUD, which -was rejected because of Harber Homes. He said they approached HUD to acquire and rehab Harber Homes, and at the same time develop the additional housing units for the elderly. He said they could not successfully develop these homes for the elderly unless Harber Homes was rehabilitated. Council Member Dombrowski indicated there would be excessive noise in the area from the VFW, the railroad tracks, as well as the not-s s e and unsafe conditions of LaSalle Park. He indicated this area was one of the poorest for the elderly. He said he would recommend this to the Council as not favorable. Council Member Szymkowiak indicated he did not feel the older adults would live there. Council Member Szymkowiak made a motion to recommend this bill to Council unfavorable, seconded by Council Member Kopczynski No action was taken on this motion. Council Member Serge asked what the rent would be for these units. Mr. Brademas indicated $215 to $225 with utilities. He said the rent would be subsidized and they would only be required to pay rent that would not exceed twenty -five percent of their income, and some could go as low as fifteen percent. Council President Parent asked the status of the Block 6 project for senior citizens. Mr. Lloyd Taylor, indicated they had a meeting with the developers and they think their about thirty days away from closing on this project. Council President Parent asked if there was any remonstrance to this rezoning in the Area Plan meeting. Mr. Tony Molnar of Area Plan indicated there was no remonstrance. Council President Parent in- dicated he thought this bill should be referred to our new Residential Neighborhood Committee for further study. Council Member Kopczynski indicated that if the Council addressed the problem of Harber Homes, perhaps they would be in a position to proceed with this project. Mr. Brademas in- dicated he would be willing to have this rezoning delayed and tied -in with the acquisition and rehabilitation of Harber Homes. Council Member Kopczynski made a motion that this bill be re- ferred to the Residential Neighborhood Committee and be set for public hearing and second reading March 28, 1977, seconded by Council Member Adams. The motion carried. BILL A BILL AMENDING ORDINANCE NO. 4990 -68, AS AMENDED, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE:CITY OF SOUTH BEND, INDIANA (CHAPTER 21, MUNICIPAL CODE) (FILLMORE ROAD (LINDEN AVENUE) NORTH OF WESTWOOD LANE) . Council Member Taylor made a motion to refer this bill to the Residential Neighborhood Committee and set it for public hearing and second reading March 28, 1977, seconded by Council Member Dombrowski. The motion carried. A REGULAR MEETING FEBRUARY 28, 1977 COMMITTEE OF THE WHOLE MEETING (CONTINUED) BILL NO. 12 -77 A BILL AMENDING AND SUPPLEMENTING CHAPTER 21 OF THE CITY CODE OF SOUTH BEND, INDIANA, 1971, ALSO KNOWN AS ORDINANCE NO. 4990 -68, AS AMENDED, AND GENERALLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA, AS AMENDED (SOUTH OF JEFFERSON, WEST OF THE ST. JOSEPH RIVER, NORTH OF MONROE, AND EAST OF COLUMBIA STREET). This being the time heretofore set fo were given an opportunity to be heard the bill. Mr. Brownell indicated there was a map in" A BILL APPROPRIATING $205,000.00 FROM THE FEDERAL ASSISTANCE GRANT, COMMONLY REFERRED TO AS GENERAL REVENUE SHARING, FOR THE WHITE WATER RAPIDS CON - STRUCTION, TO BE ADMINISTERED THROUGH THE DEPART- MENT OF HUMAN RESOURCES. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Mr. Peter Mullen, made the presentation for the ordinance. He said this $205,000 was to reimburse the City's Community Development Letter of Credit. He said the reimbursement was necessary because of a certain environmental review assessment require ment governing disbursement procedure that was motion to recommend this bill favorable to the motion carried. BILL NO. 18 -77 not satisfied. Council President Parent made a Council, seconded by Council Member Serge. The A BILL APPROPRIATING $41,300.00 FROM THE FEDERAL ASSISTANCE GRANT, COMMONLY REFERRED TO AS GENERAL REVENUE SHARING, FOR FIRE DEPARTMENT EQUIPMENT, TO BE ADMINISTERED BY THE BUREAU OF' FIRE PROTECTION. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Fire Chief Van Wiele, made the presentation for the ordi- nance. He said this appropriation would be used to purchase cars and a communication console. He said $25,300 will be spent for the purchase of cars and $16,000 for the communication console. Council Member Miller asked what cars were being replaced. The Chief indicated that the present time they had six fire inspectors and they only had three automobiles, so they were asking for three units for these inspectors, the other three units will be used for the arson bureau, and three units will be used for trade -in. Chief Van Wiele explained the new Arson Bureau and their duties. Council Member Adams asked when was the last time they purchased new cars. The Chief indicated four or five years ago. Council Member Dombrowski made a motion to recommend this bill to the Council favorable, seconded by Council Member Szymkowiak. Council Member Horvat indicated the Council was trying to cut -down on the fleet instead of increasing it. Fire Chief Van Wiele indicated that the present time they had inspectors who have to ride double during the day. Council Member Kopczynski said he would like to see a recap of the arson cases in 1976 and 1977, as well as final disposition. Council Member Horvath asked that the Fire Department make a report to the Council the first meeting in April. The motion carried. Council Member Adams made a motion to adjourn, seconded by Council Member Kopczynski. The motion carried, and the meeting was adjourned at 7:53 and reconvened at 8:10 p.m. BILL NO. 19 -77 A BILL APPROPRIATING $200,000.00 FROM THE FEDERAL ASSISTANCE GRANT COMMONLY REFERRED TO AS GENERAL REVENUE SHARING, FOR VARIOUS PUBLIC WORKS PROGRAMS TO BE ADMINISTERED BY THE CITY OF SOUTH BEND THROUGH ITS BUREAU OF STREETS. This being the time heretofore set for public hearing on the above billt proponents and opponent were given an opportunity to be heard. Mr. Patrick McMahon, Director of Public Works, made the presentation for the bill. He said this appropriation was needed for the Street Department's 1977 Summer Work Program. He said they would purchase bituminous and slurry materials. Council Member Kopczynski made a motion to recommend this bill to the Council favorable, seconded by Council Member Taylor. Council Member Horvath asked if they anticipated a lot more street paving due to the severe winter. Mr. McMahon indicated they did not. The motion carried. BILL NO. 21 -77 A BILL APPROPRIATING $221,000.00 FROM THE FEDERAL ASSISTANCE GRANT COMMONLY REFERRED TO AS GENERAL REVENUE SHARING, FOR CODE ENFORCEMENT PROGRAMS, TO BE ADMINISTERED BY THE CITY OF SOUTH BEND THROUGH THE DEPARTMENT OF HUMAN RESOURCES. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Mr. Peter Mullen, City Controller, made the presentation for the bill. He said this would be used to provide funds for the City's share of the E -3 and E -5 Code Enforcement Programs. He said this was to provide repayment to the Redevelopment Re- volving Fund for the cost overrun on these projects. He said this repayment was based on the final audit report on these projects. He said that $221,000 of other project funds were used in completing these projects, and this money would have to be repaid with local funds in order to permit completion of the other projects. Council Member Kopczynski asked the cause of the overspending. Mr. Mullen indicated that all moneys were put into one fund, and money was spent over and above the amount that should have been spent. REGULAR MEETING FEBRUARY 2$, 1977 COMMITTEE OF THE WHOLE MEETING (CONTINUED) Mr. Brownell, Executive Director of Redevelopment, indicated that the City had requested $221, 000.00 over and above what was allocated for sidewalks and curbs, etc. Council President Parent indicated the $221,000 was not misspent. He made a motion to recommend this bill to the Council favorable, seconded by Council Member Taylor. The motion carried. BILL NO. 23 -77 A BILL APPROPRIATING $200,000.00 FROM THE FEDERAL ASSISTANCE GRANT COMMONLY KNOWN AS THE GENERAL REVENUE SHARING FUND FOR CENTURY CENTER CONSTRUCTION, TO BE ADMINISTERED BY THE CITY OF SOUTH BEND THROUGH THE DEPARTMENT OF PUBLIC WORKS. Council Member Miller made a motion to continue public hearing and second reading on this bill until March 14, 1977, seconded by Council Member Dombrowski. The motion carried. BILL NO. 6 -77 A BILL APPROVING MONEYS FOR THE PURPOSE OF DEFRAYING THE CETA TITLE I EXPENSES OF THE DEPARTMENT OF EMPLOY- MENT AND TRAINING FOR THE FISCAL YEAR BEGINNING JANUARY 1, 1977 AND ENDING DECEMBER 31, 1977, INCLUDING ALL OUTSTANDING CLAIMS AND OBLIGATIONS, AND FIXING A TIME WHEN THE SAME SHALL TAKE EFFECT. 39 Council Member Horvath indicated public hearing would be held on all three budgets, Titles I, II, and VI. This being the.time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Mr. Elroy Kelzenberg, Director of the Burea of Employment and Training, made the presentation for the ordinance. Mr. Kelzenberg indicated the three budgets represented the substantial portion of the funding of the department. He in- dicated there were some additions which the Council would be appraised of in later budgets. Ms. Barbara Schankerman, 1615 Rockne, indicated she had been trying to get help from this agency for two years. She read a report on what she discovered on her investigation of CETA. Mr. Al Langel, 4403 Huron Circle, congratulated Ms. Schankerman on her courage. Mr. Kelzenberg spoke in rebuttal to Ms. Schankerman. Mr. Floyd Carter, 1619 Fassnacht, asked why there were no total figures given in the title of the bill. Mr. Kelzenberg gave him the total figures for Titles I, II and VI. Ms. Karen Gleason, Director of Civic Planning,.indicated there were some people who are receiving funds of $10,000 or more and she thought that the top was $10,000. She said there were two CETA people who are in the same department, one is being reimbursed and the other is not She asked if it was allowable to withdraw money from an account and then reimburse. Mr. Mullen, City Controller, indicated that if it had been approved by budget it was not a reimbursement. Council Member Adams indicated that the Committee on Administration and Finance would like the CETA staff to check and make sure that if a person on CETA moves out of the City they are ter- minated from this program. She said they felt that there are many people in South Bend who need jobs and CETA employees must realize they are going to have to give up the position if they leave the City. Mr. Kelzenberg discussed the new eligible criteria for CETA. Council Member Kopczynsk indicated there was resentment in the community with regard to the CETA program. Mr. Kelzenberg indicated that the resentment was felt on the part of ineligible participants. He said the thrus of CETA was to serve those who are most hurt by the labor market. Council Member Kopczynski indicated that the City might be getting too many employees that really are not needed and if CETA should be discontinued there would be a problem. Council Member Kopczynski said he be- lieved in the long run CETA would hurt the community. He indicated he thought it was high time to make sure it was not being used to augment local government funds. Council President Parent indicated he thought CETA was good for the community. He thanked Council Member Adams and her committee for doing a lot of work on this project. He made a motion to recommend this bill to the Council favorable, seconded by Council Member Dombrowski. Council Member Miller asked if citizens over 65 were eligible to participate in CETA. Mr. Kelzenberg indicated there was no age limit. The motion carried.
