IN THE CITY OF SOUTH BEND, INDIANA BE IT ORDAINED by the Common Council of the City of South Bend, Indiana: SECTION 1. Ordinance No. 4990-68, is amended, which ordinance is commonly known as the Zoning Ordinance of the City of South Bend, Indiana, be and the same hereby is amended in order that the zoning classification of the following described real estate in the City of South Bend, St. Joseph County, State of Indiana: Lot Numbered Thirty (30) as shown on the recorded Plat of Twin City Realty Company's Subdivision of Lot "C" in the First Sub-division in River Park, now within and a part of the City of South Bend, excepting therefrom that part thereof conveyed to the Town of River Park for street purposes be and the same is hereby established as "B" Residential, "B" Height and Area. The Area Plan Commission at its public hearing on February 18, 2003, took the following action: IIpon a motion by Robert Hawley, being seconded by John DeLee and unanimously carried, the proposed ordinance and site development plan of Tiberius Mihalache to zone from "A" Residential, "A" Height and Area to "B" Residential, "B" Height and Area, property located at 2701 Northside Boulevard, City of South Bend is sent to the Common Council with a favorable recommendation, subject to a final site development plan. This rezoning represents a positive investment in the River Park Neighborhood and is in line with other multi-family properties along Northside Boulevard and the St. Joseph River. The deliberations of the Area Plan Commission and points considered in arriving at the above decision are shown in the minutes of the public hearing, and will be forwarded to you at a later date to be made a part of this report. Serving South Bend, Lakeville, New Carlisle, North Liberty, Osceola, Roseland and St. Joseph County, Indiana STAFF REPORT February 10, 2003 Tiberius Mihalache 2187-03 Location: 2701 Northside Boulevard City of South Bend REQUESTED ACTION: The petitioner is requesting a zone change from "A" Residential, "a" Height and Area to "B" Residential, "b" Height and Area to allow a multi-family residential building. EXISTING LAND USE: The property contains a vacant single family structure. SURROUNDING LAND .USE AND ZONING: All the surrounding properties are zoned "A" Residential, "a" Height and Area. Located to the north are single family homes; located to the east is a multi-family building, located to the south is vacant land and the St. Joseph River; and located to the west is the River Park Neighborhood Partnership Center. ACCESS: Access to the site is from the alley north of the property. WATER SOURCE/SEWAGE DISPOSAL: Water and sewer are available to the site. DRAINAGE: The drainage has not been addressed by the petitioner. SITE DATA: The total site to be rezoned is 5,194 square feet. Of that, the buildings will occupy 1,920 square feet, or 37 percent of the site; the parking and drives will occupy 840 square feet, or 16 percent of the site; and 2,434 square feet or 47 percent of the site will remain as open space. ENVIRONMENTAL DATA: A check of the Agency's maps indicates that no public wells, wetlands, flood or environmental hazard areas are present. SITE PLAN: The site plan is preliminary. AGENCY COMMENTS: A drainage plan will be required at the final site plan stage. As shown, a variance is required to allow the building to be within the front yard setback. PRELIMINARY STAFF RECOMMENDATION: Based on information available prior to the public hearing, the staff recommends that this petition be sent to the Common Council with a favorable recommendation subject to a final site development plan.
