AN ORDINANCE OF THE COMMON COUNCIL OF
THE CITY OF SOUTH BEND, INDIANA, APPROVING
PARKIlVG RATES FOR PARKING GARAGES AND PARKIlVG
LOTS OPERATED BY THE BOARD OF PUBLIC WORKS OF
THE CITY OF SOUTH BEND, INDIANA
STATEMENT OF PURPOSE AND INTENT
Indiana Code § 36-9-11-7 authorizes the Board of Public Works to fix reasonable rates and
charges to be collected for parking vehicles in parking facilities owned and operated by the City and
for other use of those parking facilities so as to promote the maximum use of the facilities by the
public in a safe, orderly, and efficient manner. Such rates fixed by the Board of Public Works are
subject to the approval of the Common Council. The Council has received Resolution No. 3-2003
of the Board of Public Works, a copy of which is attached hereto and incorporated herein, which said
Resolution establishes rates for City-owned parking garages. The Common Council finds that these
rates are reasonable and are designed to bring in revenue sufficient to cover the cost of providing and
operating the parking facilities.
NOW, THEREFORE, BE IT ORDAINED bythe Common Council ofthe City of South Bend,
Indiana as follows:
SECTION I. The following monthlyrates shall be charged for vehicles parked at City operated
parking garages:

A. Monthly Rate -Standard Parking, Per Vehicle
- Month-to-month basis or pursuant to one (1) year contract $ 35.00 $ 40.00
B. Monthly Rate -Premium Parking, Per Vehicle
-Month-to-month basis or pursuant to one (1) year contract --------- $ 50.00
* "Premium Parking" shall consist ofnot more than thirty-five (35) spaces located on the 15` and 2nd floors
of the two hour free parking areas of each of the following: the Colfax Street, Jefferson Street and Wayne
Street Garages AND shall further consist of not more than thirty-five (35) spaces located on the lowest
public parking level of the Leighton Plaza Parking Garage.
The option to issue or renew agreements for parking inCity-owned and operated garages lies
within the sole discretion of the Board of Public Works or its designee. Unless otherwise designated,
parking spaces shall be committed on a first come, first served basis. In the event that demand for
parking exceeds supply, first priority for parking spaces shall be given to parking provided pursuant
to a one (1) year contract wherein payment for same is both timely and current. Second priority shall
be given to parking provided on a month-to-month basis wherein payment for same is both timely
and current.
SECTION II. The following hourly rates shall be charged per vehicle for parking at the Colfax
Street Parking Garage, the Jefferson Street Parking Garage, and the Wayne Street Parking Garage:

SECTION III. The following hourly rates shall be charged per vehicle for parking in the
Leighton Plaza Parking Garage.

SECTION IV. The following rate shall be charged for each token used in any of the four (4)
parking facilities listed above:

SECTION V. This Ordinance rescinds and supersedes all prior ordinances and resolutions
setting rates for City parking garages.
SECTION VI. Nothing herein shall affect rights and liabilities accrued prior to the effective date
of this Ordinance.
SECTION VII. If anyportion of this Ordinance shall be declared illegal or unconstitutional, that
determination shall not affect the balance thereof.
SECTION VIII. This ordinance shall be in full force and effect from and after its passage and
approval by the Mayor.

RE: Ordinance of the Common Council of the City of South Bend, Indiana, Approving Parking
Rates for Parking Garages and Parking Lots Operated by the Board of Public Works of the
City of South Bend, Indiana
Dear Ms. White:
Attached for filing with the South Bend Common Council is an Ordinance which approves
reasonable increases for the City's parking facilities. The new rates should be approved by the South
Bend Board of Public Works at its public meeting on January 13, 2003. A copy of the final
Resolution as approved by the Board of Public Works will be provided to the Council and
substituted as soon as possible for the unexecuted copy now attached.
The current parking garage rates have been in effect for a few years. It is now necessary to
increase rates in order to have sufficient revenue to cover the costs of operating and maintaining the
parking facilities.
Your favorable consideration is requested. Either Owen Rock or I will present this
Ordinance to the Council at its appropriate committee meeting and at the public hearing.
