HomeMy WebLinkAbout10-24-83 Council Meeting MinutesREGULAR MEETING OCTOBER 24, 1983 Be it remembered that the Common Council of the City of South Bend met in the Council Chambers of the County -City Building on Monday, October 24, at 7:00 p.m. The meeting was called to order and the Pledge to the Flag was given. ROLL CALL Present: Council Members Serge, Szymkowiak McGann, Taylor, Zielinski, Crone, Harris, Voorde and Beck Absent: None REPORT FROM THE SUB - COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your sub - committee on the inspection and supervision of the minutes would res- pectfully report that it has inspected the minutes of the October 10, 1983, meeting of the Council and found them correct. The sub- committee, therefore, recommends that the same be approved. /s/ Beverlie J. Beck /s/ Beverly D. Crone Council Member Serge made a motion that the minutes of the October 10, meeting of the Council be accepted and placed on file, seconded by Council Member McGann. The motion carried. SPECIAL BUSINESS Council President Beck indicated that Chuck Dempsey was reappointed to the Older Adults Council, and Virginia Evans was appointed to that Council. She indicated that Joseph Serge was appointed to the Technical Advisory Committee for the Job Training Program. REPORTS Council Member Serge indicated that the Personnel and Finance Committee had met on Bill nos. 116, 117 and 118 -83, and recommended them favorable. Council Member Harris indicated that the Public Safety Committee had met on bill nos. 114 and 115 -83 and recommended them favorable. Council Member Voorde indicated that the Zoning and Vacation Committee had met on Bill No. 98 -83 and recommended it favorable. Council Member Zielinski read a letter from the Mayor regarding the Studebaker Museum. He indicated a letter was being drafted to the Mayor to the effect that Studebaker Museum, Inc., not do anything until the Studebaker Museum Committee has had a chance to meet. Council Member Taylor made a motion to resolve into the Committee of the Whole, seconded by Council Member Serge. The motion carried. COMMITTEE OF THE WHOLE Be it remembered that the Common Council of the City of South Bend met in the Committee of the Whole on October 24, at 7:25 p.m., with nine members present. Chairman Zielinski presiding. BILL NO. 98 -83 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: THE FIRST ALLEY EAST OF EDDY STREET RUNNING SOUTH FROM JEFFERSON BOULEVARD TO WAYNE STREET, NORTH BETWEEN LOTS 5 AND 6 AND LOTS 88 AND 89 FOR A DISTANCE OF 335 FEET MORE OR LESS BEING IN SUNNYMEDE 1ST EDITION TO THE CITY OF SOUTH BEND, ST. JOSEPH COUNTY, INDIANA. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Paul Bowles, 1202 E. Jefferson, made the presentation for the bill. He indicated the primary reason for the alley vacation was it will provide a safety factor for the four residences on the alley. Council Member Taylor made a motion to recommend this bill to the Council favorable, seconded by Council Member McGann. The motion carried. Council Member Taylor made a motion to combine public hearing on the next two bills, seconded by Council Member Harris. The motion carried. BILL NO. 114 -83 A BILL APPROPRIATING $20,000.00 FROM THE EMERGENCY MEDICAL SERVICES FUND FOR HAZ -MAT EQUIPMENT. BILL NO. 115 -83 A BILL APPROPRIATING $30,000.00 FROM THE FEDERAL ASSISTANCE GRANT FUND COMMONLY REFERRED TO AS THE GENERAL REVENUE SHARING TRUST FUND FOR HAZ -MAT EQUIPMENT FOR 1983 TO BE ADMINISTERED BY THE FIRE DEPARTMENT OF THE CITY OF SOUTH BEND. REGULAR MEETING OCTOBER 24, 1983 This being the time heretofore set for public hearing on the above bills, proponents and opponents were given an opportunity to be heard. Tim Brassell, Fire Chief, made the presentation for the bills. He indicated that in 1980 the South Bend Fire Department started the formation of an Emergency Hazardous Materials Response Team, and team members have accumulated over 1,000 hours of schooling and training. He indicated that in order for the team to become operational, the necessary equipment must be acquired. He indicated the equipment is divided into three categories; personal safety, communication and support equipment, and a vehicle. Council Member Serge made a motion to recommend Bill No. 114 -83 to the Council favorable, seconded by Council Member McGann. The motion carried. Council Member McGann made a motion to recommend Bill No. 115 -83 to the Council favorable, seconded by Council Member Crone. The motion carried. BILL NO. 116 -83 A BILL APPROPRIATING $1,600,000.00 FROM THE FEDERAL ASSISTANCE GRANT FUND COMMONLY REFERRED TO AS GENERAL REVENUE SHARING TRUST FUND FOR THE 1983 POLICE AND FIRE PENSION COSTS OF THE CITY OF SOUTH BEND, INDIANA. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Sherrie Petz, Deputy Controller, made the presentation for the bill. She indicated this appropriation would be used to pay pension benefits for retirees in the Police and Fire Pension Funds in 1983. Council Member Serge made a motion to recommend this bill to the Council favorable, seconded by Council Member Crone. The motion carried. BILL NO. 117 -83 A BILL APPROPRIATING $100,000.00 FROM THE FEDERAL ASSISTANCE GRANT FUND COMMONLY REFERRED TO AS GENERAL REVENUE SHARING TRUST FUND FOR OPERATING COSTS OF THE PARKING GARAGES OF THE CITY OF SOUTH BEND, INDIANA. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Sherrie Petz, Deputy Controller, made the presentation for the bill. She indicated the appropriation will provide additional funds to supplement the operating budget for the parking garages in 1983. Council Member McGann made a motion to recommend this bill to the Council favorable, seconded by Council Member Serge. The motion carried. BILL NO. 118 -83 A BILL APPROPRIATING $65,000.00 FROM THE FEDERAL ASSISTANCE GRANT FUND COMMONLY REFERRED TO AS GENERAL REVENUE SHARING TRUST FUND FOR REPAIR OF ISLAND PARK FOR 1983 TO BE ADMINISTERED BY THE ENGINEERING DEPARTMENT OF THE CITY OF SOUTH BEND, INDIANA. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. John Leszczynski, Director of Public'Works, made the presentation for the bill. He indicated this appropriation would be used for repairs to Island Park. He indicated the construction work would stop the wall movement and repair the walkways. Council Member Serge made a motion to recommend this bill to the Council favorable, seconded by Council Member Beck. The motion carried. There being no further business to come Member McGann made a motion to rise and Member Szymkowiak. The motion carried. RESOLUTIONS RESOLUTION NO. 1092 -83 AN INDUCEMENT RESOLUTION RELATING-TG--THE CENTER CITY HOUSING PROJECT -. WHEREAS, pursuant to I.C. 18- 6 -4.5, the Common Council of the City of South Bend, Indiana created the South Bend Economic Development Commission, which Commission, following an investigation and survey, has determined that a need exists in the community for additional job opportunities and commercial and job opportunities, commercial diversification, and the general welfare of the community, a financing agreement should be entered into with T. Brooks Brademas, or his assigns, relating to a project to be known as the "Center City Housing Project "; and WHEREAS, T. Brooks Brademas proposes to acquire parcels of real estate located on Colfax Avenue, Washington Street and Jefferson Blvd., in South Bend, St. Joseph County, Indiana, and to acquire and rehabilitate buildings thereon, consisting of some 70,000 square feet; and, WHEREAS, to induce T. Brooks Brademas, or his assigns, to become the principal user of such Economic Development Facilities, the South Bend Common Council desires to adopt this resolution; and WHEREAS, it is apparent that the development of the Center City Housing Project will increase job opportunities and commercial diversification in St. Joseph County, Indiana, resulting in benefit to the welfare of the public in the CIty of South Bend and in St. Joseph County, Indiana. NOW, THEREFORE, BE IT RESOLVED by the South Bend Common Council as follows: SECTION 1. That approval is hereby given relating to the acquisition of such real estate thereon, wherein Industrial Revenue Bonds would Indiana, for an amount not exceeding $2,250,000 a period of time and with a maturity date which years after the issue date. to the application of T. Brooks Brademas and the rehabilation of the buildings be issued by the City of South Bend, repayable with interest thereon over does not extend beyond thrity (30) REGULAR MEETING OCTOBER 24, 1983 SECTION 2. In order to encourage, induce and solicit such application by T. Brookss Brademas for such Industrial Revenue Bond issue relating to the acquisition and rehabilitation of such other acts as will facilitate the issuance of such Industrial Revenue Bonds by the City of South Bend, Indiana, to provide funds to be used toward the payment of the costs of acquiring such real estate and the rehabilitation of such Economic Development Facilities. SECTION 3. Any costs or expenses incurred in connection with the Center City Housing Project shall be included in the project costs and reimbursed from the proceeds of the Industrial Revenue Bonds to be issued with respect thereto. SECTION 4. That the liability and obligation of the South Bend Common Council and the City of South Bend, Indiana, shall be limited solely to the good faith efforts to consummate such proceedings and issue such Bonds, and neither the South Bend Common Council nor the City of South Bend, Indiana, or its officers or agents, shall incur any liability whatsoever if for any reason the proposed issuance of such Bonds is not consummated. Beck Member of the Common Council A public hearing was held on the resolution at this time. T. Brooks Brademas, 100 Center Complex, indicated there is a need for low and moderate income housing. He indicated he planned to acquire these two housing units and rehabilitate them. Council Member McGann made a motion to adopt this resolution, seconded by Council Member Szymkowiak. The resolution was adopted by a roll call vote of nine ayes. RESOLUTION A RESOLUTION OF THE COMMON COUNCIL AUTHORIZING THE CITY OF SOUTH BEND TO SUBMIT AN APPLICATION FOR AN URBAN DEVELOPMENT ACTION GRANT TO THE DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT. Council Member Zielinski made a motion to strike this resolution, seconded by Council Member Taylor. The motion carried. BILLS, FIRST READING BILL NO. 119 -83 A BILL AMENDING CHAPTER 2 OF THE SOUTH BEND MUNICIPAL CODE, BY ADDING A NEW ARTICLE 13, ENTITLED ECONOMIC DEVELOPMENT TARGET AREAS. This bill had first reading. Council Member Serge made a motion to set this bill for public hearing and second reading November 14, and refer it to the Human Resources and Economic Development Committee, seconded by Council Member McGann. The motion carried. BILL NO. 120 -83 A BILL TRANSFERRING $6,433.00 AMONG VARIOUS ACCOUNTS, ALL ACCOUNTS BEING WITHIN THE DIVISION OF COMMUNITY DEVELOPMENT. This bill had first reading. Council Member Taylor made a motion to set this bill for public hearing and second reading November 14, seconded by Council Member Crone. The motion carried. BILL NO. 121 -83 A BILL APPROPRIATING INTEREST EARNED FROM THE PURCHASE OF CERTIFICATES OF DEPOSIT OUT OF THE PROCEEDS OF THE 1982 PARK DISTRICT BOND CONSTRUCTION FUND 50 IN THE AMOUNT OF $321,000.00. This bill had first reading. Council Member Serge made a motion to set this bill for public hearing and second reading November 14, seconded by Council Member Crone. The motion carried. UNFINISHED BUSINESS Reports from Area Plan Bill No. 99 -83 - Bendix and Cleveland Bill No. 102 -83 - Permitted Signs by Districts Bill No. 108 -83 - Linden and Mayflower Council Member McGann made a motion to set these bills for public hearing and second reading November 14, seconded by Council Member Zielinski. The motion carried. There being no further business to come before the Council, unfinished or new, Council Member McGann made a motion to adjourn, seconded by Council Member Crone.
