ROLL CALL Present: Council Members Serge, Szymkowiak Beck, Taylor, Zielinski, Crone, Harris, Voorde and McGann Absent: None REPORT FROM THE SUB - COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your sub - committee on the inspection and supervision of the minutes would res- pectfully report that it has inspected the minutes of the October 25, 1982, meeting of the Council and found them correct. The sub - committee, therefore, recommends that the same be approved. /s/ Lewis A. McGann /s/ Beverly D. Crone Council Member Serge made a motion that the minutes of the October 25, 1982, meeting of the Council be accepted and placed on file, seconded by Council Member Beck. The motion carried. SPECIAL BUSINESS RESOLUTION NO. 1007 -82 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, COMMEMORATING THE MANY CONTRIBUTIONS MADE TO OUR COMMUNITY BY THE LATE CLYDE E. WILLIAMS, SR. WHEREAS, the Common Council of the City of South Bend, Indiana, recognizes with sadness that one of its finest and most dedicated citizens, Clyde E. Williams, Sr., has recently passed away; and WHEREAS, the Council recognizes with pride the years of 1938 to 1942 when Clyde E. Williams, Sr. served with distinction as City Engineer; and WHEREAS, the Council notes some of the many poitions and honors which Clyde E. Williams, Sr. held and received, such as: the founder of Clyde E. Williams & Associates, Inc.; a member of the South Bend Redevelopment Commission; past Chairman of the Indiana Section of the American Society of Civil Engineers; past Chairman of the Indiana Section of the American Water Works Association; past President of the Counsulting Engineers of Indiana, Inc.; past Director of the St. Joseph Valley Chapter of the Indiana Section of Professional Engineers; recepient of the 1965 Engineer of the Year Award and Award of Merit in 1974, and memberships in many benevolent organizations of our community; and WHEREAS, the professionalism and countless contributions made to the City of South Bend and to the Engineering profession by the late Clyde E. Williams, Sr. make up a rich legacy for our Community to cherish and emulate into the future. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, indiana as follows: SECTION I. On behalf of the citizens of South Bend, Indiana, the Common Council hereby publicly commemorates the late Clyde E. Williams, Sr. for a life of dedicated service and contribution to our community and to the profession of Engineering which he served. SECTION II. The Common Council expresses its deepest sympathy to Mrs. Clyde E. Williams, Sr. and her family, and hopes that the rich memories of her husband will brighten the days ahead. SECTION III. Zielinski /s/ John Harris s/ Beverlie J., Beck REGULAR MEETING NOVEMBER 8, 1982 RESOLUTION NO. 1008 -82 A RESOLUTION OF THE COMMON COUNCIL OF THE CTY OF SOUTH BEND, INDIANA, COMMEMORATING THE MANY CONTRIBUTIONS MADE TO OUR COMMUNITY BY THE LATE ALEX M. ANDRZEJEWSKI WHREAS, the Common Council of the City of South Bend, Indiana, notes with sincere sadness, the passing of one of its finest and dedicted citizens, Alex M. Andrzejewski; and WHEREAS, the Common Council recognizes with pride the thirty (30) years which he served on the South Bend Fire Department, twelve (12) of which were served as Fire Chief under Mayors Edward F. Voorde and George A. Schock; and WHEREAS, the Council notes that during his tenure as Fire Chief he built the Fire Deparmtent into "one of the finest... in the country "; and WHEREAS, the late Alex M. Andrzejewski also served with distinction as the Indiana Toll Road Safety Director, and Bailiff to the St. Joseph County Circuit Court since 1969, and served in countless memberships and positions of leadership in benevolent societies throughout our Community; and WHEREAS, the sincerity and loyal dedication which the late Alex M. Andrzejewski brought to the Fire Fighting Profession and all of the many activities which he enjoyed and participated in, are just art of the right legacy which our Community will long remember. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana, as follows: SECTION I. On behalf of the citizens of South Bend, Indiana, the Common Council hereby publicly commemorates the late Alex M. Andrzejewski, for a full life filled with dedicated service to the fire Fighting Profession and to the South Bend Community where he touched so many lives. SECTION II. The Common Council expresses its deepest sympathy to Mrs. Alex M. Andrzejewski and her family, and sincerely hopes that the rich and bountiful memories of her husband ill help brighten the days head. He indicated they would be framed and presented to the wives at a later date. Council Member Harris made a motion to adopt these resoutions, seconded by Council Member Serge. Kenneth Fedder, attorney for the Economic Development Commission, asked that a new bill, Bill No. 133 -82, be put on the agenda. Council Member Serge made a motion to add Bill No. 133 -82 to the agenda to allow for first reading, seconded by Council Member Szymkowiak. The motion carried. REPORTS Council Member Zielinski indicated that the Special Committee on Snow Removal would meet at 4:30 p.m., on November 15. Council Member Beck made a motion to resolve into the Committee of the Whole, seconded by Council Member Taylor. The motion carried. COMMITTEE OF THE WHOLE Be it remembered that the Common Council of the City of South Bend met in the Committee of the Whole on November 8, 1982, at 7:15 p.m., with nine members present. Chairman Voorde presiding. BILL NO. 32 -82 A BILL DESIGNATING AND ESTABLISHING AN HISTORIC LANDMARK UNDER ORDINANCE NO. 5565 -73, AMENDING ORDINANCE NO. 4990 -68, AS AMENDED, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND (OLIVER SCHOOL.) 'U74. REGULAR MEETING NOVEMBER 8, 1982 This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. John Oxian, vice president of the Historic Preservation Commission, made the presentation for the bill. He indicated this structure is a romantic revival /gothic, which is ranked an 11, which means it could easily qualify for national landmark status. He gave a history of the building. Council Member McGann made a motion to recommend this bill to the Council favorable, seconded by Council Member Serge. The motion carried. BILL NO. 102 -82 A BILL AMENDING ORDINANCE NO. 4990 -68, AS AMENDED, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (CHAPTER 21, MUNICIPAL CODE) (OSTEOPATHIC HOSPITAL.) This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Gary Stair, assistant director of Area`'Plan, indicated this received a favorable recommendation from Area Plan. Council'Member McGann made a motion to amend this bill by substitution as on file with the City Clerk, seconded by Council Member Crone. The motion carried. David Anderson, associate administrator of the Osteopathic Hospital, indicated that the hospital intends to comply with all suggestions given by Area Plan. He indicated they felt this alternative plan would protect the residential character of the neighborho George Herendeen, attorney representing the Swanson Park Neighborhood Association, indicated the general consensus of the neighborhood association, was that this rezoning was as close as the hospital and the association were going to get. He indicated here was always a fear to go from A to B zoning. Hilton Gramps, 237 S. Tuxedo, read a letter from Margaret Stull, 230 S. Tuxedo, against the rezoning: He indicated he was also against this rezoning. Walter Mcfee, 129 N. Tuxedo; Wilson Parks, 315 S. Tuxedo;..and Lewis Kubiak, 236 Tuxedo, spoke against this rezoning. Council Member Taylor made a motion to recommend this bill to the Council Favorable, seconded by Council Member McGann. The motion carried on a roll call vote of six ayes and three nays (Council Members Serge, Szymkowiak and Harris). Council Member Taylor made a motion to recess, seconded by Council Member McGann. The motion carried and the meeting was recessed at 8:00 p.m., and reconvened at 8:10 p.m. BILL NO. 120 -82 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: FIRST 7' NORTH /SOUTH ALLEY WEST OF AND ADJACENT TO LOT F, JOHN E. WALZ REVISED ADDITION RUNNING SOUTH FROM THE SOUTH LINE OF VACATED DEAN STREET TO THE NORTH LINE OF SHERWOOD STREET. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Harold Silberman, 1228 E. Woodside, indicated this vacation was being sought in order to expand his business, Super Auto Salvage. Council Member Taylor made a motion recommend this bill to the Council favorable, seconded by Council Member Serge. The motion carried. BILL NO. 121 -82 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: THE FIRST EAST -WEST ALLEY SOUTH OF NAPOLEON STREET, RUNNING EAST FROM FRANCES STREET TO THE WEST RIGHT -OF -WAY OF THE FIRST NORTH -SOUTH ALLEY IN SORIN'S SECOND ADDITION OF THE CITY OF SOUTH BEND FOR A DISTANCE OF 165'. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. John Leszczynski, Director of Public Works, indicated that the alley vacation was requested by all abutting property owners. Council Member Taylor made a motion recommend this bill to the Council favorable, seconded by Council Member Serge. The motion carried. BILL NO'. 122 -82 A BILL AMENDING ARTICLE 8 CHAPTER 21 OF THE SOUTH BEND MUNICIPAL CODE REGULATING THE SUB - DIVISION OF LAND. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Gary Stair, assistant director of Area Plan, made the presentation for the bill. He indicated the intent of the bill was to bring the City's sub - division ordinance in compliance with State statutes. He indicated that the major changes were procedural. Council Member Serge made a motion recommend this bill to the Council favorable, seconded by Council Member Szymkowiak. The motion carried. BILL NO. 123 -82 A BILL TRANSFERRING $5,500.00 FROM ACCOUNT 110.0 SALARIES AND WAGES, REG., TO ACCOUNT 335.0 PROMOTIONAL EXPENSES WITHIN THE MAYOR'S DEPARTMENT WITHIN THE GENERAL FUND. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Joseph Kernan, City Controller, made the presentation for the bill. He indicated that substantial expenses were anticipated for the City events related to the ethanol plant groundbreaking. He indicated this transfer would guarantee that the promotional account will be sufficent for the balance of the year. Council Member Szymkowiak made a motion to recommend this bill to the Council favorable, seconded by Council Member Taylor. The motion carried. BILL NO. 124 -82 A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING CHAPTER 2, ARTICLE 1, SECTION 2 -2 OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA ENTITLED ADOPTION OF RULES AND REGULATIONS OF THE COMMON COUNCIL AND POWERS THERETO. REGULAR MEETING NOVEMBER 8, 1982 This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Council Member Beck made the presentation for the bill. She indicated that presently there is an informal procedure in effect regarding travel money, however, a written policy would clarify the matter. She made a motion to amend the bill in Sec. 2 -2 (1) after the word request., by adding "with informal Council approval. ", seconded by Council Member Serge. The motion carried. Council Member Taylor made a motion to recommend this bill to the Council favorable, as amended, seconded by Council Member Serge. The motion carried on a roll call vote of five ayes and four nays (Council Members Szymkowiak, Crone, Voorde and McGann.) There being no further business to come before the Committee of the Whole, Council Member Beck made a motion to rise and report to the Council, seconded by Council Member Taylor. The motion carried. RESOLUTIONS RESOLUTION NO. 1009 -82 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AUTHORIZING THE MAYOR TO ENTER INTO AN AGREEMENT WITH ST. JOSEPH COUNTY FOR THE PURPOSE OF AMENDING THE CHARTER AGREEMENT WHICH ESTABLISHES AN EMPLOYMENT AND TRAINING CONSORTIUM, TO BE THE RECOGNIZED GRANTEE FOR BOTH THE CITY OF SOUTH BEND AND ST. JOSEPH COUNTY IN ACCORD WITH PROVISIONS OF THE COMPREHENSIVE EMPLOYMENT AND TRAINING ACT OF 1973, AS AMENDED. WHEREAS, the Mayor of the City of South Bend is the Chief Executive Officer of the City; and WHEREAS, the City of South Bend wishes to make joint application with St. Jospeh County for funds under the Comprehensive Employment and training Act of 1973, as amended; and WHEREAS, the City of South Bend has already entered into an agreement with St. Jospeh County to establish a joint Employment and Training Consortium pursuant to resolutions of this Council; WHEREAS, certain amendments to the Charter Agreement are necessary due to changes in Federal statutes; and WHEREAS, City of South Bend wishes to utilize the benefits of the recently passed "Home Rule Laws." NOW, THEREFORE, BE IT RESOLVED that the Common Council of the City of South Bend, Indiana: SECTION I. Hereby authorizes the Mayor to enter into the attached Amended Charter- Agreement with St. Joseph County to establish a joint Employment and Training Consortium, and thereby jointly apply for funding and operate programs funded under the Comprehensive Employment and Training Act of 1973, as amended. SECTION II. The Mayor shall submit reports on Consortium Activities at the end of each fiscal quarter, detailing expenditures and services performed. SECTION III. The Mayor shall annually present of the Common Council for review and approval the joint preapplication for federal CETA funds and any modifications to the Consortium Agreement. SECTION IV. This resolution shall be in full force and effect from and after its passage by the Common Council and its approval by the Mayor. /s/ John Voorde Member of the Common Council A public hearing was held on the resolution at this time. Tom Bodnar, from the City Attorney's office, indicated this resolution was an making changes in the charter for the CETA Program to encourage the participants to find jobs in the private sector. He indicated that two people from private industry would be on the CETA Board. Council Member Voorde made a motion to adopt this resolution, seconded by Council Member Serge. The resolution was adopted by a roll call vote of nine ayes. BILLS, FIRST READING BILL NO. 125 -82 A BILL AMENDING ORDINANCE NO. 4990 -68, AS AMENDED, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (CHAPTER 21, MUNICIPAL CODE) (615 WEST COLFAX.) This bill had first reading. Council Member Zielinski made a motion to refer this bill to Area Plan, seconded by Council Member Harris. The motion carried. Council Member Taylor made a motion to suspend the rules and have public hearing and second reading on Bill No. 126, 127 and 133 -82, seconded by Council Member Harris. The motion carried on a roll call vote of nine ayes. Council Member Serge made a motion to combine public hearing on these three bills, seconded by Council Member Zielinski. The motion carried. ORDINANCE NO. 7129 -82 AN ORDINANCE AUTHORIZING THE EXECUTION AND DELIVERY OF A SUPPLEMENTAL LOAN AGREEMENT AND A SUPPLEMENTAL INDENTURE OF TRUST WITH REGARD TO THE CITY OF SOUTH BEND, INDIANA $2,500,000 ECONOMIC DEVELOPMENT REVENUE BONDS, SERIES A (MMOB, LTD. PROJECT); APPROVING THE CONVEYANCE OF THE PROJECT FINANCED OUT OF THE PROCEEDS OF THE SALE OF SAID BONDS TO MEMORIAL MEDICAL PLAZA, LTD.; APPROVING THE ASSIGNMENT OF THE ORIGINAL LOAN AGREEMENT, SERIES A NOTE AND MORTGAGE BY MMOB, LTD. TO MEMORIAL MEDICAL PLAZA, LTD., AND RELATED MATTERS. - 3 REGULAR MEETING NOVEMBER 8, 1982 ORDINANCE NO. 7130 -82 AN ORDINANCE AUTHORIZING THE CITY OF SOUTH BEND TO ISSUE ITS ECONOMIC DEVELOPMENT REFUNDING REVENUE BONDS (MICHIANA TELECASTING CORP. PROJECT) AND APPROVING OTHER ACTIONS IN RESPECT THERETO. ORDINANCE NO. 7131 -82 AN ORDINANCE SUPPLEMENTING AND AMENDING ORDINANCE NO. 7086- 82 AUTHORIZING THE ISSUANCE AND SALE OF THE $350,000 ECONOMIC DEVELOPMENT REVENUE BONDS OF THE CITY OF SOUTH BEND, INDIANA, FOR THE PURPOSE OF MAKING A LOAN TO MEDICAL ARTS CORPORATION OF SOUTH BEND, AN INDIANA CORPORATION, IN ORDER TO FINANCE THE CONSTRUCTION AND EQUIPPING OF CERTAIN ECONOMIC DEVELOPMENT FACILITIES LOCATED IN SOUTH BEND, INDIANA; AUTHORIZING EXECUTION OF A LOAN AGREEMENT; PROVIDING FOR THE DELIVERY OF A NOTE AND ASSIGNMENT THEREOF AS SECURITY FOR SAID BONDS; AUTHORIZING AN INDENTURE OF TRUST APPROPRIATE FOR THE PROTECTION AND DISPOSITION OF REVENUES FROM SUCH NOTE. Kenneth Fedder, attorney for the Economic Development Commission, made the presentation or the bills. He indicated that Bill No. 126 -82 was approving the issuance of $2,500,000 revenue bonds for MMOB to finance the cost of acquiring and constructing a facility adjacent to Memorial Hospital. He indicated Bill No. 127 -82 was to permit the refunding of the previously issued revenue bonds for WNDU. He indicated that Bill No. 133 -82 was necessary due to certain changes in the financing arrangements, therefore, it has been determined that a new ordinance should be enacted which would supplement and amend.the previously passed ordinance. Council Member Szymkowiak made a motion to pass Bill No. 126 -82, seconded by Council Member Voorde. The bill passed by a roll call vote of nine ayes. Council Member Taylor made a motion to pass Bill No. 127 -82, seconded by Council Member Beck. The bill passed by a roll call vote of nine ayes. BILL NO. 128 -82 A BILL AMENDING SOUTH BEND MUNICIPAL CODE CHAPTER 18, SECTION 18 -20 AND CHAPTER 20, ARTICLES 1 AND 7, PERTAINING TO SNOW REMOVAL PROCEDURES. This bill had first reading. Council Member Szymkowiak made a motion to set this bill for public hearing and second reading November 22, 1982, and refer it to the Special Committee on Snow Removal, seconded by Council Member Voorde. The motion carried. BILL NO. 129 -82 A BILL APPROPRIATING $50,000.00 FROM THE POLICE PENSION FUND. This bill had first reading. Council Member Voorde made a motion to set this bill for public hearing and second reading November 22, 1982, seconded by Council Member Serge. The motion carried. BILL NO. 130 -82 A BILL APPROPRIATING $50,000.00 FROM THE FIREFIGHTERS PENSION FUND. This bill had first reading. NEW BUSINESS _Council Member Crone indicated that since there was no longer an informal agreement "regarding travel money, and there are now nine shares, she wanted the Council President to put $518 in escrow in case she decided to use the money. There being no further business to come before the Council, unfinished or new, Council Member Beck made a motion to adjourn, seconded by Council Member Taylor.
