HomeMy WebLinkAbout10-25-82 Council Meeting MinutesREGULAR MEETING OCTOBER 25, 1982 a6 Be it remembered that the Common Council of the City of South Bend met in the Council Chambers of the County -City Building on Monday, October 25, 1982, at 7:00 p.m. The meeting was called to order and the Pledge to the Flag was given. ROLL CALL Present: Council Members Serge, Szymkowiak Beck, Taylor, Zielinski, Crone, Harris, Voorde and McGann Absent: None REPORT FROM THE SUB - COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your sub - committee on the inspection and supervision of the minutes would res- pectfully report that it has inspected the minutes of the October 11, 1982, meeting of the Council and found them correct. The sub - committee, therefore, recommends that the same be approved. /s/ Lewis A. McGann /s/ Beverly D. Crone .Council Member Serge made a motion that the minutes of the October 11, 1982, meeting of the Council be accepted and placed on file, seconded by Council Member Zielinski. -The motion carried. SPECIAL BUSINESS Alice Howa, 1004 Berkley Circle, thanked the Council for their support and help in keeping STS on the road. Council Member Taylor made a motion to have one meeting in December, December 6, seconded by Council Member Zielinski. The motion carried. REPORTS Council Member Voorde indicated that the Committee of the Whole had met to discuss Bill No. 93 -82, and decided to continue it indefinitely at the request of the Historic Preservation Commission. Council Member Voorde indicated that the Economic Development Committee had met regarding the three properties on the agenda tonight for tax abatement, and gave a unanimously recommended to all three. Council Member Zielinski indicated that the special committee on snow removal had met to discuss proposed changes to the present ordinance. He indicated there would be further meetings. Council Member Beck made a motion to resolve into the Committee of the Whole, seconded by Council Member Taylor. The motion carried. COMMITTEE OF THE WHOLE Be it remembered that the Common Council of the City of South Bend met in the Committee of the Whole on October 25, 1982, at 7:10 p.m., with nine members present. Chairman Voorde presiding. BILL NO. 93 -82 A BILL OF THE CITY OF SOUTH BEND, INDIANA, BANNING THE DEMOLITION OF HISTORIC BUILDINGS IN THE DOWNTOWN AREA, FOR A PERIOD OF FIVE (5) YEARS. Council Member Serge made a motion to continue this bill, seconded by Council Member Taylor. The motion carried. BILL NO. 107 -82 A BILL DESIGNATING AND ESTABLISHING AN HISTORIC LANDMARK UNDER ORDINANCE NO. 5565 -73, AMENDING ORDINANCE NO. 4990- 68, AS AMENDED, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND (1329 EAST WASHINGTON STREET.) This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Karen Kiemnec, Preservation Planner, gave the history of the house. She indicated this home historically significant, Anthony Trozzolo, present owner of the home, indicated he was in agreement with having his home declared an historic landmark. Council Member McGann made a motion to recommend this bill to the Council favorable, seconded by Council Member Taylor. The motion carried. BILL NO. 116 -82 A BILL APPROPRIATING $161,000.00 FROM THE MUNICIPAL BONDS OF 1981 FUND FOR MOTOR EQUIPMENT WITHIN THE STREET DEPARTMENT. 37 REGULAR MEETING OCTOBER 25, 1982 This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. John Leszczynski, Director of Public Works, made the presentation for the bill. He indicated this appropriation was from interest earned on the investment of General Obligation Bond Funds. He indicated the money would be used for the purchase of motor equipment needed for the operation of the Street Department. Council Member Serge made a motion to recommend this bill to the Council favorable, seconded by Council Member Szymkowiak. The motion carried. BILL NO. 117 -82 A BILL APPROPRIATING $7,200.00 FROM THE COMMUNITY DEVELOPMENT BLOCK GRANT FUND, FOR NEIGHBORHOOD CENTERS ACTIVITY TO BE ADMINISTERED BY THE DIVISION OF COMMUNITY DEVELOPMENT. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Colleen Rosenfeld, Dirctor of Community Development, made the presentation for the bill. She indicated this appropriai would provide the LaSalle Filmore, Northeast and Southeast Neighborhood Centers with $2,400 each for a twelve month period in order to support their non - personnel operationa -7 costs. She indicated that these centers previously received the bulk of their funding through ACTION. Council Member Taylor made a motion to recommend this bill to the Council favorable, seconded by Council Member Serge. The motion carried. BILL NO. 118 -82 A BILL APPROPRIATING $65,574.00 FROM THE EMERGENCY MEDICAL SERVICES FUND FOR CAPITAL REPAIRS WITHIN THE DEPARTMENT. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Chief Brassell made the presentatic for the bill. He indicated this appropriation would complete funding for the reconditio3 of the Fire Department Snorkel. Council Member Szymkowiak made a motion to recommend this bill to the Council favorable, seconded by Council Member Beck. The motion carried. There being no further business to Member McGann made a motion to rise Member Crone. The motion carried. REGULAR MEETING OCTOBER 25, 1982 NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana, as follows: SECTION I. That the Common Council hereby accepts the report and recommendation of the Human Resources and Economic Development Committee that the area herein described be designated an Urban Development Area and hereby adopts a resolution designating this area as an Urban Development Area for purposes of real property Tax Abatement. SECTION II. That the Common Council requests the City Clerk to submit this Resolution along with supporting data to the Area Plan Commission for its written order approving or disapproving this resolution. SECTION III. That the Common Council directs the City Clerk, upon receipt of the report of the Area Plan Commission to cause notice of the adoption of this resolution to be published, said publication providing notice of the public hearing before the Common Council on said declaration. Rick Carey, Senior Planner in Redevelopment, indicated that Jamil Packaging Company was renovating an existing building. He indicated that the real property improvements would be in the sum of $334,000, and the tangible property would be in the sum of $160,000. He indicated that seventeen new jobs would be created. Richard Cramer, attorney for the petitioners, spoke in favor of these petitions. Council Member Szymkowiak made a motion to adopt Resolution No. 1000 -82, seconded by Council Member Taylor. LAFAYETTE AS AN URBAN DEVELOPMENT AREA FOR THE PURPOSES OF TAX ABATEMENT CONSIDERATION. WHEREAS, a petition for real property tax abatement consideration has been filed with the Common Council of the City of South Bend pursuant to Section 2 -76(a) of the Municipal Code requesting that the area commonly known as 1137 S. Rick Carey, Senior Planner with Redevelopment, indicated Exacto was constructing a $350,000 building and tangible abatement would be $996,000. He indicated they planned to add from 32 to 60 new jobs. Doug Carpenter, representing Exacto, spoke in favor or these abatements. Council Member Szymkowiak made a motion to adopt Resolution No. 1002 -82, seconded by Council Member Harris. RESOLUTION NO. 1004 -82 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND DESIGNATING CERTAIN AREAS WITHIN THE CITY COMMONLY KNOWN AS 414 -422 EAST MONROE AND 509 -513 SOUTH FELLOWS STREET AS AN URBAN DEVELOPMENT AREA FOR THE PURPOSES OF TAX ABATEMENT CONSIDERATION. WHEREAS, a petition for real property tax abatement consideration has been filed with the Common Council of the City of South Bend pursuant to Section 2 -76(a) of the Municipal Code requesting that the area commonly known as 414 -422 East Monroe Street and 509 -513 South Fellows Street, and which more particularly described by a line drawn as follows: Lots Numbered One (1), Two (2), Three (3), and Four (4) as shown on the recorded Plat of Moses Stern's Subdivision of a part of Lots Nineteen (19) and Twenty (20) in Denniston and Fellows' Addition of the Town, now City, of South Bend, St. Joseph County, Indiana. be designated as an Urban Development Area under the provisions of Indiana Code 6- 1.1- 11.1 -1 and that the public utility and benefit of the project be determined; and WHEREAS, the Redevelopment Commission has conducted an investigation pursuant to Section 2 -77 of the Municipal Code and prepared a report determining that the area qualified as an Urban Development Area under Indiana Code 6 -1.1- 12.1 -1 and has further prepared maps and plats showing the boundaries and such other information as required by law of the area in question; and WHEREAS, the Human Resources and Economic Development Committee of the Common Council has reviewed said report and recommended to the Common Council that the area qualifies as an Urban Development Area. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana, as follows: SECTION I. That the Common Council hereby accepts the report and recommendation of the Human Resources and Economic Development Committee that the area herein described be designated an Urban Development Area and hereby adopts a resolution designating this area as an Urban Development Area for purposes of real property Tax Abatement. SECTION II. That the Common Council requests the City Clerk to submit this Resolution along with supporting data to the Area Plan Commission for its written order approving or disapproving this resolution. SECTION III. That the Common Council directs the City Clerk, upon receipt of the report of the Area Plan Commission to cause notice of the adoption of this resolution to be published, said publication providing notice of the public hearing before the Common Council on said declaration. SECTION IV. This resolution shall be in full force and effect from and after its adoption by the Common Council and approval by the Mayor. /s/ Lewis A. REGULAR MEETING OCTOBER 25, 1982 RESOLUTION NO. 1005 -82 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, RECOMMENDING THAT ALL AREA RESIDENTS EXERCISE CARE AND SAFETY AS THEY CELEBRATE HALLOWEEN. WHEREAS, the evening of October 31st is a special date celebrated each year by young and old alike; and WHEREAS, Halloween is traditionally remembered as an evening for children going "trick or treating" throughout our neighborhoods as they are dressed in their favorite costumes; and WHEREAS, the Board of Public Safety at its meeting of September 7th designated the hours of 5 p.m. to 7 p.m. on October 31st as the hours for trick or treating; and WHEREAS, the Common Council recommends that residents consider giving out small toys or games rather than food items this year, as a public safety precaution. NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows: SECTION I. The South Bend Common Council recommends that all areas residents exercise care and safety as they celebrate Halloween on October 31st, and consider giving out small toys or games to this years "trick or treaters." SECTION II. The Common Council wishes all residents a safe and happy Halloween. SECTION III. Council President McGann indicated this resolution was recommended that the residents give out small toys and games this Halloween. Jane Swan, 1706 S. Walnut, indicated toys and games were a good idea, however, the cost would be prohibitive. Council Member Serge made a motion to adopt this resolution, seconded by Council Member Taylor. RESOLUTION NO. 1006 -82 A RSOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, APPROVING THE AWARD OF THREE CONTRACTS IN EXCESS OF $10,000.00 FOR THE REHABILITATION WORK IN THE COMMUNITY DEVELOPMENT PROGRAM THROUGH THE BUREAU OF HOUSING'S SOUTH BEND HOME IMPROVEMENT AND REHABILITATION LOAN PROGRAM.
