Be it remembered that the Common Council of the City of South Bend met in the Council
Chambers of the County -City Building on Monday, August 23, 1982, at 7:00 p.m. The
meeting was called to order and the Pledge to the Flag was given.
ROLL CALL Present: Council Members Serge, Szymkowiak Beck, Taylor,
Zielinski, Crone, Harris, Voorde and McGann

REPORT FROM THE SUB- COMMITTEE ON MINUTES
To the Common Council of the City of South Bend:
Your sub- committee on the inspection and supervision of the minutes would res-
pectfully report that it has inspected the minutes of the August 9, 1982, meeting of
the Council and found them correct.
The sub - committee, therefore, recommends that the same be approved.

Council Member Serge made a motion that the minutes of the August 9, 1982, meeting
of the Council be accepted and placed on file, seconded by Council Member Zielinski.
The motion carried.
SPECIAL BUSINESS
Council President McGann indicated there will be a public hearing on the budget
bills at 5:00 p.m., on August 30.
Council President McGann indicated the Council would have a special meeting Wednesday,
August 25, at 7:00 p.m., on Bill No. 86 -82 and Resolution 9B.
REPORTS
Council Member Voorde indicated that the Human Resources Committee had met on bill
nos. 86, 88, and 89 -82, and the declaratory resolution for Curtis Products, and
recommended all items favorable.
Council Member Beck indicated that the Residential Neighborhood Committee had met on
Bill No. 73 -82, and recommended it be further refined.
Council Member Crone indicated that the Personnel & Finance Committee had numerous
meetings on the budget, and they did not have a recommendation at this time.
Council Member Zielinski made a motion to resolve into the Committee of the Whole,
seconded by Council Member Serge. The motion carried.

Council Member Szymkowiak indicated that the remonstrator had completed the garage,
which was the condition the Council had impossed regarding the closing of this alley.
He made a motion to strike this bill, seconded by Council Member McGann. The motion
carried.
BILL NO. 39 -82
A BILL AUTHORIZING THE ISSUANCE AND SALE OF $350,000 ECONOMIC
DEVELOPMENT REVENUE BONDS OF THE CITY OF SOUTH BEND, INDIANA,
FOR THE PURPOSE OF MAKING A LOAN TO MEDICAL ARTS CORPORATION
OF SOUTH BEND, AN INDIANA CORPORATION, IN ORDER TO FINANCE
THE CONSTRUCTION AND EQUIPPING OF CERTAIN ECONOMIC DEVELOPMENT
FACILITIES LOCATED IN SOUTH BEND_, INDIANA; AUTHORIZING
EXECUTION OF A LOAN AGREEMENT; PROVIDING FOR THE DELIVERY
OF A NOTE AND ASSIGNMENT THEREOF AS SECURITY FOR SAID BONDS;
AUTHORIZING AN INDENTURE OF TRUST APPROPRIATE FOR THE PROTECTION
AND DISPOSITION OF THE REVENUES FROM SUCH NOTE.
Now is the time heretofore set for public hearing on the above bill, proponents and
opponents were given an opportunity to be heard. Peter J. Nemeth, attorney representing
the Medical Arts Corporation, indicated this $350,000 bond issue would be used to
expand existing space and contact new space to be leased to Clinic Outpatient Surgery.
He indicated approximately eight new jobs will be created. Council Member Serge
made a motion to recommend this bill to the Council favorable, seconded by Council
Member:'Beck. The motion carried.
BILL NO. 73 -82 A BILL AMENDING CHAPTER 13 OF THE MUNICIPAL CODE OF THE
CITY OF SOUTH BEND, INDIANA, BY THE INCLUSION OF NEW ARTICLE
7 ENTITLED NOISE CONTROL.
Now is the time heretofore set for public hearing on the above bill, proponents and
opponents were given an opportunity to be heard. Council Member Beck read the Statement
of Purpose and Intent. Council Member McGann made a motion to accept the amended
version of this bill on file with the City Clerk, seconded by Council Member Zielinski.
The motion carried. Council Member Crone made_ a motion the the bill be amended in
Section 13 -83 (a) by adding, during the hours of 7:00 a.m. to 10:00 p.m., and eliminating
paragraph (b), seconded by Council Member McGann. The motion carried. Brad Garton,
• representative from Indiana Cities and Towns, indicated that noise is becoming an
• very large problem in neighborhoods. He indicated his job was to try and help
communities pass legislation to control this problem. Kathleen Cekanski, Council
Attorney, indicated that the bill should be further amended in Section 13 -82 (a) by
removing where the person disturbed or annoyed is located.) Council Member Harris
made a motion to accept this amendment, seconded by Council Member Zielinski. The
motion carried. Carolyn Pfotenhauer, Assistant City Attorney, indicated that the
Administration supported a stronger noise ordinance. She indicated she still had
some qualms regarding the enforcement, but they can be worked out later. She indicated
the police department should purchase more portable meters. Paul Hooker, 914 E.
Donald; Jane Swan, 1706 S.Walnut; Kathleen Lucas, 1738 Caroline; Arthur Quigley,
President of the Northeast Neighborhood Association; Thomas Noes, 1917 N. Eddy; John
Pajor, 804 N. Notre Dame; James Doe, 919 N. College; John Lamphere, 2112 Coachman
Tr; spoke in favor of this bill. Council Member Crone indicated the City only has
two moving noise meters. She urged the Administration to purchase proper equipment
in order to enforce both the moving and stationary noise ordinances. Council Member
McGann made a motion to recommend this bill to the Council favorable, as amended,
seconded by Council Member Zielinski. The motion carried.
BILL NO. 80 -82
A BILL APPROPRIATING $25,000.00 FROM THE LOCAL ROAD AND
STREET FUND TO PROJECT R &S 8205, EDISON ROAD IMPROVEMENTS,
WITHIN THE LOCAL ROAD AND STREET FUND.
Now is'the time heretofore set for public hearing on the above bill, proponents and
opponents were given an opportunity to be heard. John Leszczynski, Director of
Public Works, made the presentation for the bill. He indicated this appropriation
was for the design of Edison Road Improvements Project. Council MemberSzymkowiak
made a motion to recommend this bill to the Council favorable, seconded by Council
Member Serge. The motion carried.

A BILL APPROPRIATING $350,000.00 FROM THE LOCAL ROAD AND
STREET FUND TO PROJECT R &S 8204, SCARIFICATION AND PAVEMENT
IMPROVEMENTS 1982, WITHIN THE LOCAL ROAD AND STREET FUND.

would be used for street scarification. Council Member Szymkowiak made a motion to

ASSISTING THE ECONOMIC DEVELOPMENT OF THE CITY.
Council Member McGann made a motion to continue this bill until August 25, seconded
by Council Member Harris. The motion carried.
BILL NO. 87 -82 A BILL APPROPRIATING $20,000.00 FROM THE LOCAL ROAD AND
STREET FUND TO PROJECT R &S 48 -3, IRONWOOD FROM INWOOD TO
NORTH OF RIDGEDALE, WITHIN THE LOCAL ROAD AND STREET FUND.
Now is the time heretofore set for public hearing on the above bill, proponents and
opponents were given an opportunity to be heard. John Leszczynski, Director of
Public Works, made the presentation for the bill. He indicated this project entails
the widening of Ironwood and installation of storm sewers. Council Member Serge
made a motion to recommend this bill to the Council forable, seconded by Council
Member Zielinski. The motion carried.
BILL NO. 88 -82 A BILL APPROPRIATING $500,000 FROM THE 1982 COMMUNITY BLOCK
GRANT FUND TO SUPPLEMENT THE ECONOMIC DEVELOPMENT CAPITAL
FUND TO BE ADMINISTERED BY THE CITY OF SOUTH BEND, INDIANA,
THROUGH ITS DIVISION OF COMMUNITY DEVELOPMENT.
Council Member McGann made a motion to continue public hearing and second reading on
this bill until August 25, seconded by Council Member Crone. The motion carried.
BILL NO. 89 -82 A BILL APPROPRIATING $30,000.00 FROM THE COMMUNITY DEVELOPMENT
BLOCK GRANT FUND TO CONTRACT WITH PROJECT FUTURE TO PROVIDE
TECHNICAL ASSISTANCE IN CONNECTION WITH CERTAIN ECONOMIC
DEVELOPMENT ACTIVIITES IN THE INNER -CORE AREA OF THE CITY
OF SOUTH BEND, INDIANA.
Now is the time heretofore set for public hearing on the above bill, proponents and
opponents were given an opportunity to be heard. Jon Hunt, Director of Redevelopment,
made the presentation for the bill. He indicated that Project Future was a community -
wide economic development effort, and is the culmination of an eleven month process
of research, analysis, plan development. He indicated it represents all aspects of
our community from government and labor to education and business. Patrick McMahon,
Director of Project Future, asked for Council concurrance by passing this bill.
Council. Member Szymkowiak made a motion to recommend this bill to the Council favorable,
seconded by Council Member McGann. The motion carried.
Council Member McGann made a motion that public hearing be combined on bill nos. 90
and 91 -82, seconded by Council Member Zielinski. The motion carried.
BILL NO. 90 -82 A BILL APPROPRIATING MONIES FOR THE PURPOSE OF DEFRAYING
THE EXPENSES OF THE SEVERAL DEPARTMENTS OF THE CITY GOVERNMENT
OF THE CITY OF SOUTH BEND, INDIANA, FOR THE FISCAL YEAR
BEGINNING JANUARY 1, 1983 AND ENDING DECEMBER 31, 1983,
INCLUDING ALL OUTSTANDING CLAIMS AND OBLIGATIONS, AND FIXING
A TIME WHEN THE SAME SHALL TAKE EFFECT.
BILL NO. 91 -82
A BILL LEVYING TAXES AND FIXING THE RATE OF TAXATION FOR
THE PURPOSE OF RAISING REVENUE TO MEET THE NECESSARY EXPENSES
FOR THE FISCAL YEAR ENDING DECEMBER 31, 1983.
Now is the time heretofore set for public hearing on the above bill, proponents and
opponents were given an opportunity to be heard. Joseph Kernan, City Controller,
made the presentation for the bills. He indicated this budget was an increase of
$2,219,000 over 1982. He indicated this budget does not callfor an appeal of the
levy. Jane Swan, 1706 Walnut, indicated it was difficult to comment on the budget
without seeing the details. Michael McFarland, 1733 O'Brien, indicated the budget
does not disclose the City's indebtness. Council Member McGann made a motion to
continue public hearing until the August 30, 1982, meeting at 5:00 p.m., seconded by
Council Member Beck. The motion carried.

A BILL APPROPRIATING MONIES FOR THE PURPOSE OF DEFRAYING
THE EXPENSES OF THE ENTERPRISE FUNDS OF THE CITY OF SOUTH
BEND, INDIANA, FOR THE FISCAL YEAR BEGINNING JANUARY 1,
1983 AND ENDING DECEMBER 31, 1983, INCLUDING ALL OUTSTANDING
CLAIMS AND OBLIGATIONS, AND FIXING A TIME WHEN THE SAME
TAKE EFFECT.
Council Member Crone made a motion to continue this bill indefinitely, seconded by
Council Member McGann. Themotion carried.
Council Member Zielinski made a motion to recess, seconded by Council Member Beck.
The motion carried and the meeting was recessed at 8:55 p.m., and reconvened at 9:12
p.m.
There being no further business to come before the Committee of the Whole, Council
Member Crone'made a motion to rise and report to the Council, seconded by Council
Member`Zielinski.

CITY OF SOUTH BEND DESIGNATING CERTAIN AREAS
WITHIN THE CITY COMMONLY KNOWN AS AS AN URBAN
DEVELOPMENT AREA FOR THE PURPOSES OF TAX
ABATEMENT CONSIDERATION.
WHEREAS, petition for real property tax abatement consideration
has been filed with the Common Council of the City of South Bend pur-
suant tol ISection 2 -76(a) of the Municipal Code requesting that the
area commonly known as
Lots 13 and 15 of Monroe- Sample Redevelopment Area, City of Souith
Bend, Indiana.
and which more particularly described by a line drawn as follows:

be designated as an Urban Development Area under the provisions of Indiana Code 6-

WHEREAS, the Redevelopment Commission has conducted an investigation pursuant
to Section 2 -77 of the Municipal Code and prepared a report determining that the
area qualified as an Urban Development Area under Indiana Code 6 -1.1- 12.1 -1 and has
further prepared maps and plats showing the boundaries and such other information as
required.-by law of the area in question; and
WHEREAS, the Human Resources and Economic Development Committee of the Common
Council has reviewed said report and recommended to the Common Council that the area
qualifies as an Urban Development Area.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend,
Indiana, as follows:
SECTION I. That the Common Council hereby accepts the report and recommendation
of the Human Resources and Economic Development Committee that the area herein described
be designated an Urban Development Area and hereby adopts a resolution designating
this area as an Urban Development Area for purposes of real property Tax Abatement.
SECTION II. That the Common Council requests the City Clerk to submit this
Resolution along with supporting data to the Area Plan Commission for its written
order approving or disapproving this resolution.
SECTION III. That the Common Council directs the City Clerk, upon receipt of
the report of the Area Plan Commission to cause notice of the adoption of this resolution
to be published, said publication providing notice of the public hearing before the
Common Council on said declaration.
SECTION IV. This resolution shall be in full force and effect from and after
its adoption by the Common Council and approval by the Mayor.

A public hearing was held on the resolution at this time. Jon Hunt Director of
Redevelopment, indicated this resolution would grant tax abatement to Curtis Products
in the Monroe - Sample Development Area. He indicated that Curtis Products planned

major expansion in the area. He indicated that Redevelopment recommended tax abatement
be granted. Council Member Szymkowiak made a motion to adopt this resolution, seconded
by Council member Beck. The resolution was adopted by a roll call vote of eight
ayea.
RESOLUTION A RESOLUTION OF THE COMMON COUNCIL AUTHORIZING THE MAYOR TO
SUBMIT AN AMENDMENT TO AN URBAN DEVELOPMENT ACTION GRANT
(UDAG) APPLICATION TO THE U.S. DEPARTMENT OF HOUSING AND
URBAN DEVELOPMENT.
Council Member Crone made a motion to continue public hearing on this resolution

POSITION OF WATER WORKS PROJECT ENGINEER TO
BE HELD BY THE CITY ENGINEER.
This bill had first reading. Council Member Voorde made a motion to set this bill
for public hearing and second reading September 13, 1982, and refer it to the Personnel
and Finance Committee, seconded by Council Member Crone. The motion carried.
ORDINANCE NO. 7093 -82 AN ORDINANCE TRANSFERRING MONIES FROM VARIOUS ACCOUNTS TO
THE OTHER EQUIPMENT ACCOUNT WITHIN THE MORRIS CIVIC AUDITORIUM
BUDGET.
This bill had first reading. Council member Beck made a motion to suspend the rules
and have public hearing and second reading on this bill, seconded by CouncilMember
Zielinski. The motion carried on a roll call vote of eight ayes. Now is the time
heretofore set for public hearing on the above bill, proponents and opponents were
given an opportunity to be heard. Brian Hedman, Director of Century Center, made
the presentation for the bill. He indicated this transfer would be used to replacethe
rigging equipment in the Morris Civic Auditorium, which is out -of -date and in some
instances unsafe. Council Member Serge made a motion to pass this bill, seconded by
Council Member. Beck. The bill passed by a roll call vote of eight ayes.
