HomeMy WebLinkAbout05-10-82 Council Meeting MinutesREGULAR MEETING MAY 10, 1982 Be it remembered that the Common Council of the City of South Bend met in the Council Chambers of the County -City Building on Monday, May 10, 1982, at 7:00 p.m. The meet - ing was called to order and the Pledge to the Flag was given. 'ROLL CALL Present: Council Members Serge, Szymkowiak Beck, Taylor, Zielinski, Crone, Dombrowski, Voorde and McGann Absent: None REPORT FROM THE SUB - COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your sub - committee on the inspection and supervision of the minutes would res- pectfully report that it has inspected the minutes of the April 26, 1982, meeting of the Council and found them correct. The sub - committee, therefore, recommends that the same be approved. /s/ Lewis A. McGann /s/ Beverly D. Crone Council Member Serge made a motion that the minutes of the April 26, 1982, meeting of the Council be accepted and placed on file; seconded by Council Member Dombrowski. The motion carried. REPORTS Council Member Beck indicated that the Residential Neighborhood Committee had met regarding Bill No. 37 -82. j Council Member Voorde indicated that the Human Resources comm ittee had met on four j items on the agenda, the three resolutions and Bill No. 44 -82. He indicated that committee recommended all items favorable. Council Member Zielinski indicated that the Utilities Committee had recommended that Bill No. 45 -82 be studied further. Council Member Dombrowski made a motion to resolve into the Committee of the Whole, seconded by Council Member Beck. The motion carried. REGULAR MEETING MAY 10, 1982 COMMITTEE OF THE WHOLE Be it remembered tee of the Whole Voorde presiding. BILL NO. 39 -82 that the Common Council of the City of South Bend met in the Commit - on May 10, 1982, at 7:03 p.m., with nine members present. Chairman A BILL AUTHORIZING THE ISSUANCE AND SALE OF $350,000 ECONOMIC DEVELOPMENT REVENUE BONDS OF THE CITY OF SOUTH BEND, INDIANA, FOR THE PURPOSE OF MAKING A LOAN TO MEDICAL, ARTS CORPORATION OF SOUTH BEND, AN INDIANA CORPORATION, IN ORDER TO FINANCE THE CONSTRUCTION AND EQUIPPING OF CERTAIN ECONOMIC DEVELOPMENT FACILITIES LOCATED IN SOUTH BEND, INDIANA: AUTHORIZING EXECUTION OF A LOAN AGREEMENT: PROVIDING FOR THE DELIVERY OF A NOTE AND ASSIGNMENT THEREOF AS SECURITY FOR SAID BONDS; AUTHORIZING AN INDENTURE OF TRUST APPROPRIATE FOR THE PROTECTION AND DISPOSITION OF THE REVENUES FROM SUCH NOTE. Council Member Taylor made a motion to continue this bill indefinitely, seconded by Council Member Dombrowski. The motion carried. BILL NO. 40 -82 A BILL CONSENTING TO CERTAIN ACTION APPLICABLE TO THE CITY OF SOUTH BEND ECONOMIC DEVELOPMENT FIRST MORTGAGE REVENUE BONDS, SERIES 1980 (TIMBERLINE TRACE PROJECT) AND OTHER DOCUMENTS RELATED THERETO. Now is the time heretofore set for public hearing on the above bill proponents and opponents were given an opportunity to be heard. Kenneth Fedder, attorney for the Economic Development Commission, made the presentation for the bill. He indicated this bill is requesting the City to approve the transfer of the interest of Timber- line Trace Partnership and the assignment and assumption of that bond obligation. He indicated that the trustee and the bondholders have all approved this procedure. Council Member McGann made a motion to recommend this bill to the Council favorable, seconded by Council Member Taylor. The motion carried. BILL NO. 41 -82 A BILL AMENDING AN ORDINANCE ENTITLED: "AN ORDINANCE AUTHORIZING THE ISSUANCE AND SALE NOT EXCEEDING $4,000,000.00 OF REVENUE BONDS OF THE CITY OF SOUTH BEND, INDIANA, FOR THE PURPOSE OF MAKING A LOAN-TO HEALTH QUEST REALTY V, IN ORDER TO FINANCE THE ACQUISITION AND CONSTRUCTION OF CERTAIN ECONOMIC DEVELOPMENT FACILITIES LOCATED IN ST. JOSEPH COUNTY, INDIANA, TO BE USED AND OCCUPIED BY FOUNTAINVIEW PLACE CORPORATION OF SOUTH BEND; AUTHORIZING EXECUTION OF TRUST INDENTURE AND FINANCING AGREEMENT; PROVIDING FOR THE DELIVERY OF AN FHA - INSURED MORTGAGE NOTE AS SECURITY FOR SAID BONDS; AND AUTHORIZING THE TERMS. Kenneth Fedder, attorney for the Economic Development Commission, made the presentation for the bill. He indicated He indicated that on August 24, 1981, the Council passed Ordinance No. 6954 -81 which authorized the sale of bonds not to exceed $4,000,000. He indicated that because of increases in the market interest rates it was necessary to increase the amount of the bonds to $4,500,000, with an interest rate of 14 1 /2s. Council Member Szymkowiak made a motion to recommend this bill to the Council favorable, seconded by Council Member Serge. The motion carried. BILL NO. 2 -82 A BILL AMENDING ORDINANCE NO. 4990 -68, AS AMENDED, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (CHAPTER 21, MUNICIPAL CODE)(217 -223 E. OHIO.) Now is the time heretofore set for public hearing on the above bill proponents and opponents were given an opportunity to be heard. Larry Magliozzi, representative of Area Plan, indicated that their Commission had given a favorable recommendation to this rezoning. Mr. Joseph Kerwin, a representative of St. Vincent DePaul, made the presentation for the bill. He indicated they were planning to expand their present facilities. Glendarae Hernandez, 702 E. South, spoke against this rezoning. Council Member Taylor made a motion to recommend this bill to the Council favorable, seconded by Council Member Szymkowiak. The motion carried. Council Member McGann made a motion to have combined public hearing on the next two bills, seconded by Council Member Dombrowski. The motion carried. BILL NO. 30 -82 A BILL DESIGNATING AND ESTABLISHING AN HISTORIC LANDMARK UNDER ORDINANCE NO. 5565 -73, AMENDING ORDINANCE NO. 4990 - 68, AS AMENDED, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND (314 WEST LASALLE.) BILL NO. 31 -82 A BILL DESIGNATING AND ESTABLISHING AN HISTORIC LANDMARK UNDER ORDINANCE NO. 5565 -73, AMENDING ORDINANCE NO. 4990 - 68, AS AMENDED, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND (233 NORTH LAFAYETTE.) Now is the time heretofore set for public hearing on the above bill proponents and opponents were given an opportunity to be heard. John Oxian, Vice President of the Historic Preservation Commission, made the presentation for the bills. He indicated that the Commission recommended both of these sites as historic landmarks. He in- dicated they could easly be put on the national register. He gave a brief history of the buildings. Council Member Serge made a motion to recommend these bills to the Council favorable, seconded by Council Member Dombrowski. The motion carried. REGULAR MEETING MAY 10, 1982 BILL NO. 37 -82 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: THE FIRST EAST -WEST ALLEY SOUTH OF LINCOLNWAY WEST RUNNING EAST FROM RYER STREET TO THE FIRST INTERSECTING NORTH -SOUTH ALLEY FOR A DISTANCE OF 120'; ALL BEING IN BRENTWOOD ESTATES 4TH ADDITION TO THE CITY OF SOUTH BEND, INDIANA. Council Member Szymkowiak indicated he had inspected this proposed vacation. He indicated that the closing of this alley block the entrance to.a garage. He in- dicated that the garage was presently not being used as a garage, but as a linen storage, for a motel, however, the owner, Mr. Szabo, wanted to convert it back to a garage. He said that the Council would give Mr. Szabo until August 23, 1982, to convert this area to a garage. He made a motion to continue this bill until August 23, seconded by Council Member Taylor. The motion carried. BILL NO.- 42 -82 A BILL AMENDING CERTAIN PORTIONS OF CHAPTERS 13 AND 16 OF THE SOUTH BEND MUNICIPAL CODE, REGULATING NUISANCE AND OTHER OFFENSES. Council Member McGann made a motion to continue public hearing on this bill to May 24, 1982, seconded by Council Member Dombrowski. The motion carried. BILL NO. 43 -82 A BILL APPROPRIATING $35,000 FROM THE FEDERAL ASSISTANCE GRANT, COMMONLY REFERRED TO AS GENERAL REVENUE SHARING FOR THE SPRING CLEAN -UP PROGRAM FOR 1982 TO BE ADMINISTERED BY THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, IND- IANA. Now is the time heretofore set for public hearing on the above bill proponents and opponents were given an opportunity to be heard. John Leszczynski, Director of Public Works, made the presentation for the bill. He indicated this appropriation would cover a portion of the spring clean -up expense. He indicated they would be coming back to the Council for the balance. Council Member Serge made a motion to recommend this bill to the Council favorable, seconded by Council Member Beck. The motion carried. BILL NO. 44 -82 A BILL TRANSFERRING $1,035,639 AMONG VARIOUS ACCOUNTS, ALL ACCOUNTS BEING WITHIN THE DIVISION OF COMMUNITY DEVELOP- MENT. Now is the time heretofore set for public hearing on the above bill proponents and opponents were given an opportunity to be heard. Jon Hunt, Director of Redevleop- ment, made the presentation for the bill. He indicated this transfer would ac- complish a variety'of functions; annualization of additional budgets, increased or continued funding for high- demand activitie's,'and assist in utilizing funds in the current program year. Council Member Szymkowiak made a motion to recommend this bill to the Council favorable, seconded by Council Member Beck. The motion carried. BILL NO. 45 -82 A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING CHAPTER 16, ARTICLE 2, SECTION 16 -8 OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, COMMONLY KNOWN AS REFUSE. Council Member McGann made a motion to continue public hearing on this bill until May 24, seconded by Council Member Dombrowski. The motion carried. There being no further business to come before the Committee of the Whole, Council Member Dombrowski made a motion to rise and report to the Council, seconded by Coun- cil member Zielinski. The motion carried. RESOLUTIONS RESOLUTION NO. 956 -82 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, DESIGNATING 3202 W. SAMPLE AN URBAN DEVELOP- MENT AREA FOR TANGIBLE PERSONAL PROPERTY TAX ABATEMENT CON- SIDERATION. WHEREAS, a petition for Personal Property Tax abatement consideration has been filed with the Common Council of the City of South Bend pursuant to Section 2 -76 of the Municipal Code for the tangible personal property to be located at 3202 West Sample Street, South Bend, Indiana. WHEREAS, the legal description of the facility in which the tangible personal property is to be located, is more particularly described by a line drawn as follows: Part of the Northwest Quarter (1/4) of the Northwest Quarter (1/4) of Section fifteen (15), Township Thirty -seven (37) North, Range Two (2) East, described as beginning on the South line of Sample Street, (now 70 feet wide) One Hundred Sixty -five (165) feet East and Thirty -five (35) feet South of the Northwest corner of said Quarter (1 /4) Quarter (1/4) Section, running thence East long the South line of Sample Street One Hundred Sixty -five (165) feet; thence South Seven Hundred Fourteen and One Hundredth Fourteen (714.0) feet to the Northerly right -of -way line of the New Jersey, Indiana and Illinois Railroad; thence Southwest4 along said right -of -way Three Hundred Sixty -one (361) feet to the West line of said Quarter (1/4) Quarter (1/4) Section; thence North along said West line Six Hundred Thirty -one and Twenty -two Hundredths feet; thence orth Two Hundred Twenty - nine (229) feet to the place of beginning. WHEREAS, the Redevelopment Commission has conducted an investigation pursuant to Section 2 -77 of the Municipal Code and prepared a report determining that there is compliance with the Statutory obsolescence and eligibility criteria under Indiana Code 6 -1.1- 12.1 -1 et seq. WHEREAS, the Human Resources and Economic Development Committee of the Common Council has reviewed said report and recommended to the Common Council that the area qualifies as an Urban Development Area, and that the tangible personal property to be located at such location is entitled to a deducation from the assessed value of the equipment for a period of five (5) years. r6e . REGULAR MEETING MAY 10, 1982 NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana, as follows: SECTION I. The Common Council hereby accepts the report and recommendation of the Human Resources and Economic Development Committee that the area herein described be designated an Urban Development Area, and that the tangible personal property to be located at such location is entitled to a deduction from the assessed value of the equipment for a period of five years (5) years. SECTION II. The Common Council hereby adopts a resolution designating this area as an Urban Development Area for purposes of personal property tax abatement. SECTION IV. The Common Council directs the City Clerk, upon the receipt of the report of the Area Plan Commission to cause notice of the adoption of this Resolution to be published. Said publication shall provide notice of the public hearing before the Common Council of said declaration. SECTION IV. This Resolution shall be in full force and effect rom and after its adoption by the Common Council and approval by the Mayor. s/ Lewis A. Bruce Hammerschmidt, at- torney for the petitioner indicated Armco had purchased and installed new machinery in order to be competitive in their field, as well as maintain the plant in South Bend. He indicated with this new personal property the assessed valuation of pro- perty would increase. Council Member Szymkowiak made a motion to adopt this resolu- tion, seconded by Council Member Beck. The resolution was adopted by a roll call vote of nine ayes. RESOLUTION NO. 957 -82 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND DESIGNATING CERTAIN AREAS WITHIN THE CITY COMMONLY KNOWN AS 121 WEST COLFAX, SOUTH BEND, INDIANA, AS A URBAN DVELOPMENT AREA FOR PURPOSES OF TAX ABATEMENT CONSIDERATION. WHEREAS, petition for real property tax abatement consideration has been filed with the Common Council of the City of South Bend pursuant to Section 2 -76(a) of the Municipal Code requesting that the area commonly known as 121 West Colfax South Bend, Indiana 46601 and which more particularly described by a line drawn as follows: A part of Lot Numbered Seven (7) as shown on the Original Plat of the Town, now City, of South Bend, St. Joseph County, Indiana, which part is bounded by a line running as follows, viz: Beginning on the North line of Colfax Avenue in said City, at a point 66 feet West of the South East corner of said lot, thence run- ning North 66 feet to the North line of said Lot; thence West on said North line a distance of 22 feet; thence South 16 feet; fence East 6 inches; thence South 50 feet to the South line of said Lot and North line of said Colfax Avenue; thence East on said line 21 1/2 feet to the place of beginning. be designated as an Urban Development Area under the provisions of Indiana Code 6- 1.1- 11.1 -1 and that the public utility and benefit of the project be determined; and WHEREAS, the Redevelopment Commission has conducted an investigation pursuant to Section 2 -77 of the Municipal Code and prepared a report determining that the area qualified as an Urban Development Area under Indiana Code 6 -1.1- 12.1 -1 and has further prepared maps and plats showing the boundaries and such other information as required by law of the area in question; and WHEREAS, the Human Resources and Economic Development Committee of the Common Council has reviewed said report and recommended to the Common Council that the area qualifies as an Urban Development Area. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana, as follows: SECTION I. That the Common Council hereby accepts the report and recommendation of the Human Resources and Economic Development Committee that the area herein des- cribed be designated an Urban Development Area and hereby adopts a resolution design- ating this area as an Urban Development Area for purposes of real property Tax Abate- ment. SECTION II. That the Common Council requests the City Clerk to submit this Resolution along with supporting data to the Area Plan Commission for its written order approving or disapproving this resolution. SECTION III. That the Common Council directs the City Clerk, upon receipt of the report of the Area Plan Commission to cause notice of the adoption of this resol- ution to be published, said publication providing notice of the public hearing before the Common Council on said declaration. Kevin Horton, Deputy Di- rector of Redevelopment, indicated that this request for tax abatement was for the relocation of Griffon Bookstore. Council Member Serge made a mtoion to adopt this resolution, seconded by Council member Szymkowiak. The resolution was adopted by a roll call vote of.nine ayes. RESOLUTION NO. 958 -82 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AUTHORIZING THE MAYOR TO SUBMIT TO THE UNTIED STATES GOVERNMENT, DEPARTMENT OF HOUSING AND URBAN DEVELOP- MENT, AN APPLICATION FOR 1982 COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS UNDER TITLE I OF THE HOUSING AND COMMUNITY DE- VELOPMENT ACT I OF 1977 AS AMENDED IN THE HOUSING AND COM- MUNITY DEVELOPMENT ACT OF 1981. WHEREAS, the Mayor of the City of South Bend, Indiana, is the Chief Executive Officer of the City, and is the applicant for Community Develpment Block Grant Funds under Title I of the Housing and Community Development Act of 1977, as amended by the Housing and Community Development Act of 1981. NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of South Bend, Indiana: SECTION I. That the Mayor of ther City of South Bend, Indiana is hereby author- ized to submit the 1982 Community Development Block Grant Application to the United States Government under title I of the Housing and Community Development Act of 1977 as amended by the Housing and Community Development Act of 1981. SECTION II. That the Common Council of the City of South Bend, Indiana, hereby requests that the Mayor submit the 1982 Community Development Block Grant Application to the Common Council for review and comment prior to the date upon which the Com- munity Development Block Grant Application must be filed with the Department of Hous- ing and Urban Development. SECTION III. That for every activity, project, or program to be funded under this Resolution, the Mayor shall submit to the Common Council an appropriation ordi- nance prior to expenditure of any Community Development Block Grant funds received upon approval of this application. SECTION IV. That this Resolution shall be in full force and effect from and after its adoption by the Common Council and approval by the Mayor. /s/ Lewis A. McGann Member of the Common Council A public hearing was held on the resolution at this time. Jon Hunt Director of Eco- nomic Developmetn and Redevelopment, indicated this application was for the 1982 CDBG funding. Council Member Beck made a motion to amend this resolution by incorporating the attached document, seconded by Council Member Dombrowski. The motion carried. Floyd Carter, 1619 Fassnacht, indicated he supported this application with reserva- tions regarding the traffic signal that is needed on the Orange - Colfax Connector. Glendarea Hernandez, 702 E. Scott, spoke against this resolution. She indicated she was not pleased with all the priorities in the application. Jane Swan, 1706 S. Wal- nut, and Jeff Gibney, 726 W. Washington, spoke regarding items not funded in this application. Jon Hunt indicated that the traffic control on the Orange - Colfax Con- nector was presently under study. Council Member Szymkowiak made a motion to adopt this resolution, seconded by Council Member Beck. The resolution was adopted by a roll call vote of nine ayes. The motion carried. PRIVILEGE OF THE FLOOR Jane Swan, 1706 S. Walnut, discussed the bids on the new fire trucks and equipment. She indicated some of this equipment was too sophisticated for the size of our city. Clifford Ades, 1318 Elliott, Rev. David Smaltz Church, Mrs. Charles Ades, 1318 Elliott, and LeslietDoty, 3502FLincolnway West, spoke aginst disarmament of nuclear weaponry. T. Brooks Brademas, spoke regarding non - cooperation he is receiving from the city government, as well as the Transpo lot, and the Studebaker museum.
