HomeMy WebLinkAbout06-22-81 Council Meeting Minutes145 REGULAR MEETING JUNE 22, 1981 Be it remembered that the Common Council of the City of South Bend met in the Council Chambers of the County -City Building on Monday, June 22, 1981, at 7:00 p.m. The meeting was called to order and the Pledge to the Flag was given. ROLL CALL Present: Council Members Serge, Szymkowiak Beck, Taylor, Zielinski, Crone, Dombrowski, Voorde and McGann Absent: None REPORT FROM THE SUB - COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your sub - committee on the inspection and supervision of the minutes would res- pectfully report that it has inspected the minutes of the June 8, 1981, meeting of the Council and found them correct. The sub - committee, therefore, recommends that the same be approved. /s/ Lewis A. McGann /s/ Beverly D. Crone Council Member Dombrowski made a motion that the minutes of the June 8, 1981, meeting of the Council be accepted and placed on file, seconded by Council Member Serge. The motion carried. SPECIAL BUSINESS Council Member Crone made a motion that Ordinance No. 6914 -81, passed April 28, 1981, be amended to correct a typographical error, in that the 1982 salary for captain should be $23,080, seconded by Council Member Taylor. The motion carried. REPORTS Council Member Crone gave two Personnel & Finance Committee reports on meetings to discuss funds needed for capital repairs and purchases. Council Member Dombrowski made a motion to resolve into the Committee of the Whole, seconded by Council Member Taylor. The motion carried. COMMITTEE OF THE WHOLE Be it remembered that the Common Council of the City of South Bend met in the Com- mittee of the Whole on June 22, 1981, at 7:08 p.m., with nine members present. Chairman Voorde presiding. BILL NO. 33 -81 A BILL AMENDING ORDINANCE NO. 4990 -68, AS AMENDED, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (CHAPTER 21, MUNICIPAL CODE.) (605 PORTAGE.) Council President McGann indicated that the petitioner had requested a continuance on this bill. He made a motion to continue this bill to July 13, 1981, seconded by Council Member Dombrowski. The motion carried. BILL NO. 34 -81 A BILL AMENDING ORDINANCE 4990 -68, AS AMENDED, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (CHAPTER 21, MUNICIPAL CODE) (TOWN TOWER.) This being the time heretofore set for public hearing on the above bill proponents and opponents were given an opportunity to be heard. Ron Olson, representative of the Town Tower Motel Corporation, made the presentation for the bill. He indicated they were requesting this property be rezoned from "C" Commercial to "A -3" Multi- family Residential, in order to convert the motel into apartments. Council President McGann made a motion to amend the petition by deleting the restaurant and bar, seconded by Council Member Dombrowski. The motion carried. Council Member Serge made a motion to recommend this bill to the Council favorable, seconded by Council Member Dombrowski. The motion carried. BILL NO. 37 -81 A BILL AMENDING ORDINANCE NO. 4990 -68, AS AMENDED, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (CHAPTER 21, MUNICIPAL CODE) (KENSINGTON FARMS.) This being the time heretofore set for public hearing on the above bill, proponents and opponents were given.-an opportunity to be heard. John Feeney, representative of the petitioner, made the presentation for the bill. He indicated they were request- ing this rezoning in order to give the configuration needed for the type of develop- ment proposed on this piece'of property. Council Member Taylor made a motion to recommend this bill to the Council favorable, seconded by Council Member Serge. The motion carried. I REGULAR MEETING JUNE 27,, 1981 BILL NO. 53 -81 A BILL AMENDING ORDINANCE NO. 4990 -68, AS AMENDED, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (CHAPTER 21, MUNICIPAL CODE) (DUNHAM STREET.) This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Larry Magliozzi, from Area Plan, made the presentation for the bill. He indicated that due to the Olive- Sample overpass, it was necessary to relocate some apartment buildings. He indicated this area has been selected and this rezoning to "B" would allow them to build the apart- ments. Council President McGann made a motion to recommend this bill to the Council favorable, seconded by Council Member Serge. The motion carried. BILL NO. 54 -81 A BILL FIXING MAXIMUM SALARIES AND WAGES OF APPOINTED OF- FICERS AND EMPLOYEES OF THE CITY OF SOUTH BEND, INDIANA, WITHIN THE DIVISION OF COMMUNITY DEVELOPMENT FOR THE PERIOD FROM JULY 1, 1981 TO JUNE 30, 1982. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Marzy Bauer, Director of Com- munity Development, made the presentation for the bill. She indicated this bill would set salaries for Community Development for their fiscal year. She indicated that the Personnel & Finance Committee had requested to amendments to this bill, one was to correct a mathematical error, and the other was to clarify the existing sit- uation with one of our staff members to clarify the title, the position was created under Planner III, but the Administration and the Council feels the title should be Neighborhood Services Coordinator. She indicated that by adding that line in the bill they were not adding a position. Council Member Crone made a motion to reduce the engineer's salary to 2,323, and add a new position of Neighborhood Services Coor- dinator, present salary $16,000, proposed salary $17,230, seconded by Council Member Beck. The motion carried. BILL NO. 55 -81 A BILL APPROPRIATING $466,000.00 FROM THE FEDERAL ASSISTANCE GRANT, COMMONLY REFERRED TO AS GENERAL REVENUE SHARING FOR STREET MAINTENANCE AND REPAIR TO BE ADMINISTERED BY THE CITY OF SOUTH BEND, INDIANA, THROUGH THE BUREAU OF STREETS WITHIN THE MOTOR VEHICLE HIGHWAY FUND. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given the opportunity to be heard. Sherrie Petz, Deputy Control- ler, made the presentation for the bill. She indicated this would provide $466,000 for the 1981 street maintenance and repair program. She indicated that while the total appropriation will come from General Revenue funds, only $200,000 will be from the Revenue Sharing contingency fund. She indicated lthat the remainder is a result of cuts in the programs that were discussed earlier, and these programs will not receive the amounts of revenue sharing supplements that had been earmarked. John Gleva, 5039 Packard, asked if this bill was regarding fire trucks. He was told this was for street maintenance. Council Member Taylor made a motion to recommend this bill to the Council favorable, seconded by Council Member Szymkowiak. Council Member Voorde indicated the Council had been asked if they had any ideas where to come up with $68,000. He indicated he had suggested he would rather see the Council consider cutting back on the street paving program. The motion carried. BILL NO. 56 -81 A BILL APPROPRIATING $110,000.00 FROM THE WATER WORKS DEP- RECIATION FUND FOR INSTALLATION OF AN INTERCEPTOR WELL SYS- TEM IN THE LOCATION OF THE OLIVE STREET WELL FIELD AND AP- PROVING THE AWARD OF A CONTRACT FOR SAID INSTALLATION BET- WEEN THE BOARD OF WATER WORKS COMMISSIONERS AND PEERLESS - MIDWEST, INC. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Mike Vance, Director of Util- ities, made the presentation for the bill. He indicated this appropriation will be used for the initial work needed in the clean -up of the Olive Street well field. He indicated that the first phase of that clean -up process will include the installation of an interceptor well system designed to reverse the flow of contamination in the field. Council Member Szymkowiak made a motion to recommend this bill to the Council favorable, seconded by Council Member Taylor. The motion carried. BILL NO. 57 -81 A BILL APPROPRIATING $60,000.00 FROM THE LOCAL ROAD AND STREET FUND TO PROJECT R &S 7905, LINCOLNWAY EAST AND TWYCKENHAM DRIVE INTERSECTION IMPROVEMENTS, WITHIN THE LOCAL ROAD AND STREET FUND. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. John Leszczynski, Director of Public Works, made the presentation for the bill. He indicated this appropriation will be used to widen, channelization and signalization of the Twyckenham and Lincoln Way West "intersection. He indicated these improvements will be done in conjunction with the County's projects. He indicated that this must be done before the bridge is completed, in order to qualify for the Federal funds, which will pay seventy percent of the cost. Pat Miller, 2213 Lincoln Way West, spoke against the appropriation. Council Member Serge made motion to recommend this bill to the Council favorable, seconded by Council Member Taylor. REGULAR MEETING JUNE 22, 1981 BILL NO. 58 -81 A BILL APPPROPRIATING $55,000.00 FROM THE SELF - INSURANCE FUND FOR THE PAYMENT OF INSURANCE CLAIMS TO BE ADMINISTERED BY THE SELF - INSURANCE DEPARTMENT. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Sherrie Petz, Deputy Control- ler, made the presentation for the bill. She indicated this appropriation will pro- vide for $55,000 in the "refunds, awards, indemnities" line item in the City's self - insurance funds. She indicated this line item was being created at the recommend- ation of the State Board of Accounts. Council Member Szymkowiak made a motion to recommend this bill to the Council favorable, seconded by Council Member Taylor. The motion carried. BILL NO. -:'5.9 '8 =1 A:"BILL APPROPRIATING $25,'.000.00` FROM THE PARKING GARAGES FUND TO THE 260.0 ACCOUNT OF THE - PARKING GARAGES BUDGET WITHIN THE PARKING GARAGES FUND. John Leszczynski, Director of Public Works made the presentation for the.bill.; He,ind Gated this appropriation . would be used to pay or consulting services associated with the rehabilitation of the parking garages-:,' He indidatedthe consulting-services are necessary in order to evaluate the existing condition of the garages and determine the scope of the work to be done. Pat Miller, 2213 Lincolnway Way West, spoke against this bill. Council Member Dombrowski made a motion to recommend this bill to the Council favorable, seconded by Council Member Beck. The motion carried. There being no further business to come before the Committee of the Whole, Council Member Dombrowski made a motion to rise and report to the Council, seconded by Coun- cil Member Taylor. RESOLUTIONS RESOLUTION A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND DESIGNATING CERTAIN AREAS WITHIN THE CITY COMMONLY KNOWN AS 332 N. MICHIGAN AS AN URBAN DEVELOPMENT AREA FOR THE PUR- POSES OF TAX ABATEMENT CONSIDERATION. Council Member Voorde made a motion to strike this resolution, seconded by Council Member Dombrowski. The resolution was stricken by a roll call vote of nine ayes. RESOLUTION NO. 888 -81 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, APPROVING THE AWARD OF FIVE CONTRACTS IN EXCESS OF $10,000.00 FOR THE REHABILITATION WORK IN THE COMMUNITY DEVELOPMENT PROGRAM THROUGH THE BUREAU OF HOUS- ING'S REHABILITATION GRANT PROGRAM. WHEREAS, low bids for the rehabilitation work under the Community Development Housing Rehabilitation Grant Program have exceeded $10,000.00. NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of South Bend, Indiana: 1. Kathy Baumgartner, Dir- ector of the Bureau of Housing, indicated Council's approval was necessary in order to rehabilitate these houses. She indicated that the as the limit for the amount of assistance is $11,000, the owner /occupants will pay for the additional rehabilitation cost. Council Member Voorde made a motion to adopt this resolution, seconded by Council Member Dombrowski. The resolution was adopted by a roll call vote of nine ayes. REGULAR MEETING JUNE 27, 1981 BILLS, FIRST READING BILL NO. 61 -81 A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING CHAPTER 2, ARTICLE 1, SECTION 2 -2 OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, ENTITLED ADOPTION OF RULES AND REGULATIONS OF THE CMMON COUNCIL AND POWERS THERETO. This bill had first reading. Council Member Beck made a motion to set this bill for public hearing and second reading July 13, seconded by Council Member Crone. The motion carried. BILL NO. 62 -81 A BILL APPROPRIATING $500,000.00 FROM THE CUMULATIVE SEWER BUILDING AND SINKING FUND TO PROJECT CS 811, OLD CLEVELAND ROAD SANITARY SEWER, WITHIN THE CUMULATIVE SEWER BUILDING AND SINKING FUND. This bill had first reading. Council Member Beck made a motion to set this bill for public hearing and second reading July 13, seconded by Council Member Voorde. The motion carried. BILL NO. 63 -81 A BILL OF THE CITY OF SOUTH BEND SETTING FEES CHARGED BY THE SOUTH BEND POLICE DEPARTMENT FOR CERTAIN SERVICES. This bill had first reading. Council Member Voorde made a motion to set this bill for public hearing and second reading July 13, and refer it to the Personnel & Finance Committee, seconded by Council Member Dombrowski. The motion carried. BILL NO. 64 -81 A BILL APPROPRIATING $285,000.00 FROM THE WATER WORKS GEN- ERAL FUND FOR CONTRACTUAL SERVICES CONVERSE /TEN -ECH AND APPROVING THE AWARD OF CONTRACTS AND EXPENDITURES FOR SER- VICES BY CONVERSE TEN -ECH. This bill had first reading. Council Member Beck made a motion to set this bill for public hearing and second reading July 13, seconded by Council Member Dombrowski. The motion carried. Council Member Crone made a motion to refer this bill to the Utilities Committee, seconded by Council Member Dombrowski. The motion carried. PRIVILEDGE OF THE FLOOR John Gleva, 5039 E. Packard, indicated that the South Bend Tribune had printed a story that the City was going to pay $47,200 for fire truck engines He said that was too much money. Richard Hill, City Attorney, indicated that amount also included complete refurbishing of a pumper.unit.
