BE IT ORDAINED by the Common Council of the City of South Bend, Indiana: Section 1. Ordinance No. 4990 -68, as amended, which ordinance is commonly known as the Zoning Ordinance of the City of South Bend, Indiana, be and the same hereby is amended in order that the zoning classification of the following described real estate in the City of South Bend, St. Joseph County, State of Indiana: Kaley's 2nd Addition, Lincoln Way West Addition, Lots 30, 31 and 32, be and the same is hereby established as "C" Commercial, "A" height and area. The Teachers Credit Union is appreciative of the fact that the objections to rezoning "C 1" Commercial is not based upon the use to which the Teachers Credit Union intends to place the building, but rather on the justifiable fear that once the property is rezoned to "C 1" Commercial that the Teachers Credit Union could sell the building to anyone in conformity with the "C 1" Commercial rezoning. However, the Teachers Credit Union gives the assurances that the Petition For Rezoning is based strictly on the needs of-the Teachers Credit Union and not with any intent in the long foreseeable future to sell the building. The Teachers Credit Union has grown over the years from an inconsequential financial institution to one of the major financial institutions in the area. This growth has been occasioned by its services to the membership and the desire of the Teachers Credit Union to acquire this property as a Service Office is based on its desires to fulfill the needs of its membership in the immediate area. It is the present managements' view that the acquisition of this building will fulfill its needs to serve its members within the immediate area for a period of at least 20 years. GROWTH tau SERVICE - since -2- It most certainly, in the view of the Teachers Credit Union, would be poor policy to expend monies for said building and improvements therein except for over ,a long term usage of the building and if ever said building is sold, most certainly any sale which would adversely affect the neighborhood would therefore adversely affect its members and the Teachers Credit Union. The growth of the Teachers Credit Union has been based on the relation of the services it renders to its members, not only in a financial manner but also in its total effect upon the community. The Teachers Credit Union has in all its actions taken into consideration the interest of the community as evidenced by its care of.its facilities, the assistance in the preservation of historical sites and its loan policy. The present hours of the Teachers Credit Union are 9:30 a.m. to 5:30 p.m. Monday through Friday, assuring the tranquility of the neighborhood and no unusual or noisy activities in the evening. Additionally, the Teachers Credit Union has always sought to cooperate with the municipal authorities to assure a minimal.interruption of traffic and to this effect, before any site plan is adopted, the Traffic Engineer of the City of South Bend will be consulted to ensure that the traffic pattern as adopted by the site plan is only after consultation with the Traffic Engineer. Additionally, by filing a site plan, the Teachers Credit Union will be bound by such site plan and if there is any sale in the distant years, such sale shall be controlled by the fact that such purchaser would have to seek a rezoning from "C 1" Commercial to "C 1" Commercial, thus giving the Area Plan Commission and the City Council control over any potential buyer in the distant future. -3- It is the intent of the Teachers Credit Union, by this letter, to give assurances that our request is based upon a permanent long -term need and not any sale and that we have a common interest with the neighborhood in pre- serving the integrity.of the neighborhood. JOHNSON Executive Director (219) 284 -9571 October 18, 1978 In Re: A proposed ordinance and site development plan of Hickey Funeral Home to zone from "B" Residential, "A" Height and Area, to "C" Commercial, "A" Height and Area, property located at 2700 Lincoln Way West, City of South Bend Gentlemen: The attached rezoning petition of Hickey Funeral Home was legally advertised on October 7, 1978. The Area Plan Commission gave it a public hearing on October 17, 1978, at which time the following action was taken: "Upon a motion by Joseph Serge, being seconded by_W.illlam Limerick., and unanimously carried, the petition of Hickey Funeral Home, .Rl amended, to zone from "B" Residential, "A" Height and Area, to "C -1" Commercial, "A" Height and Area, property located at 2700 Lincoln Way West, City of South Bend, is returned to the Common Council with a favorable recommendation, subject to a final site plan and subject to the following three proyisions; 1) auto stacking area for drive�in windows be increased per City Engineerts comments, 2) screen on east boundary be connected so as to proyide a continuous unbroken buffer. 3) curb cut approval," The above recommendation is made subject to a final site plan and the preliminary site plan is attached hereto, The deliberations of the Area Plan Commission and points considered i,n arriving at the above decision are shown in minutes of the public hearing and will be forwarded to you at a later date to be made a part of this report, Attached for your consideration in the review of this matter Is a copy of the Area Plan Commission Staff Report, Very truly yours, Gary M, Stair Assistant Director GMS /bsj attach, cc: YeAg.HgAhnAend, Lakeville, New Carlisle, North Liberty, Roseland & St. Joseph, County, /N Mathews- Purucker- Anella, Inc.
