GAMMON Approved and signed by me C 2 S-) 1921 Clerk ORDINANCE NO. 1p y q c� °ii AN ORDINANCE AMENDING CHAPTER 20, ARTICLE 3, COMMONLY KNOWN AS THE ABANDONED VEHICLE ORDINANCE, STATEMENT OF PURPOSE AND INTENT The Common Council of the City of South Bend recognizes that abandoned vehicles present a scenic blight and are a public nuisance. The purpose and intent of this amendment is to provide for a even more efficient procedure for the removal and disposal of abandoned vehicles; and to allow the Board of Public Safety to establish towing and storage fees. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of South Bend, Indiana, as follows: SECTION I. Chapter 20, Article 3 of the Municipal Code of the City of South Bend, Indiana, is hereby amended as follows: ARTICLE 3. ABANDONED VEHICLES. Sec. 20 -28. Definitions. (g) "Visible from public property" I as used in this Article shall mean that even if a covering which has been placed over the vehicle and ww c is of a temporary, non - structural nature including but not limit to, a tarpaulin or other similar material whereby the form and outline of the vehicle remains visible to the public; said vehicle shall be deemed visible from public property. Sec. 20 -29. Procedure for Notice, Removal and Disposition of Abandoned Vehicles, Fees. (f) Fees. Said fee shall be determined and fixed by the Board of Public Safety. The Board shall have authority to periodically review said fees and to establish fees which are rea- sonably necessary for towing and storage services within the City. SECTION II. This Ordinance shall be in full force and effect from and after its passage by the Common Council, approval by the Mayor, and legal publication. Presently the ordinance c4lls for a maximum of $15.00 towing and a $2.00 per day storage fee. From the various verbal and written communications with the Abandoned Vehicle Depart - ment of the Bureau of Motor Vehicles, it appears that local govern- ments can control such costs directly.
