GAMMON Approved and signed by me ... a S 19—E-8 Clerk ORDINANCE NO. 9tK--2 9 AN ORDINANCE AMENDING VARIOUS SECTIONS WITHIN CHAP- TER 20, ARTICLE 7, SNOW ROUTES, AND CHAPTER 20, ARTICLE 1, GENERAL PROVISIONS, ADMINISTRATION AND REGULATIONS OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA. STATEMENT OF PURPOSE AND INTENT: In that efficient snow removal procedures are essential to the health, safety and economic benefit of this community; and In that residential areas can best be cleared of snow during normal working hours; and In that it is desirable that all of the City's streets remain function- ing during the snow season, NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows: SECTION I: Chapter 20, Article 7, Snow Routes, of the Municipal Code of the City of South Bend, Indiana, is hereby amended to read in its entirety as follows: Section 20 -101: Definitions As used in this article: 1) Snow Removal Condition means a formal declaration by the Snow Removal Coordinator that in his opinion the actual or expected precipitation of snow will create hazardous or dangerous street and sidewalk conditions. This declaration shall take one of the following forms: Snow Emergency Residential Emergency Weather Disaster 2) Snow Emergency means a snow removal condition which addresses all designated snow routes (main routes). 3) Residential Emer enc means a snow removal condition which addresses all non -snow routes residential streets). 4) Weather Disaster means a formal declaration by the Snow Removal Coordinator that occurrence or eminent threat of widespread or severe damage, injury or loss of life or property resulting from a snow storm requires emergency action to avert danger, damage or distress. (Code 1962, 25 -102; Ord. No. 6317 -78, Chapter 1) 0 5) Pushing Snow, means the moving of an amount of snow that may im- pede or unnecessarily hamper traffic flow. 6) Snow means any precipitation depositing any accumulation on the streets, including snow, sleet, hail, ice and freezing rain. 7) Snow Removal Coordinator means the Mayor or in his absence the following succession of people shall qualify: City Engineer, Manager, Division of Transportation, or Manager, Bureau of Streets. 8) Snow Routes means all streets in the City so designated and marked. 9) Vehicles means all self- propelled motorized licensed vehicles using City streets and highways, excluding public transportation convey- ances. Section 20 -102: Snow Routes: Designations, annual.review; postin master plan to filed with City Clerk a) The Board of Public Works shall designate streets which are heavily traveled and are necessary thoroughfares for the movement of vehi- cular traffic through the City as snow routes. An annual review of the snow routes by the Traffic Engineer and the Common Council Committee on Public Works shall be done and written report filed with the City Clerk by July 1st of each year. b) All streets designated as snow routes shall be posted with suitable signs or 'markers. Section 20 -103: Snow Removal Condition: Declaration a) When, in the opinion of the Snow Removal Coordinator, the actual or expected precipitation of snow will.create hazardous or dangerous highway conditions or vehicular or pedestrian traffic, he shall have the authority to declare a Snow Removal Condition. b) When declaring a Snow Removal Condition, the Snow Removal Coordina- tor shall designate one of the following conditions to be in effect: Snow Emergency Residential Emergency Weather Disaster c) A Snow Removal Condition shall.be declared by the Snow Removal Coordinator by issuing a press release to the local radio, tele- vision, and news services. d) The Snow Removal Condition shall continue in force and effect until the Snow Removal Coordinator declares it to be over in the same manner as provided for in sub - section (c). Section 20 -104: Snow Removal Condition: Traffic Regulations a) Snow Emergency: When the Snow Removal Coordinator has declared a Snow Emergency, the following traffic regulations shall be in effect: a(1) No vehicle shall be parked on a snow route. a(2) The pushing of snow onto any City street by any individual is prohibited. a(3) Any vehicle parked, stalled, incapable of moving under its own power, or left unattended upon any street designated as a snow route shall be ticketed and /or towed and /or impounded. a(4) Parking prohibitions on snow routes shall remain in effect until the Snow Emergency is cancelled or modified by the Snow Removal Coordinator per Section 20- 103(d). b) Residential Emergency: When the Snow Removal Coordinator has declared a Residential Emergency, the following traffic regula- tions shall be in effect: b(1) Parking shall be allowed on all snow routes. b(2) Parking shall be banned weekdays between the hours of 8:00 a.m. and 4:30 p.m. on all streets not designated as snow routes in accordance with the following schedule: ...Even numbered days - no parking on East /West streets ...Odd Numbered days - no parking on North /South streets b(3) Any vehicle parked, stalled, incapable of moving under its own power, or left unattended upon any street in violation of Section 20- 104.b(2) shall be ticketed and/ or towed and /or impounded. b(4) Parking bans as established under Section 20- 104.b(2) shall remain in force and effect on a rotating basis until the entire street has been cleared to the curb line, or until the Residential Emergency has been cancelled by the Snow Removal Coordinator per Section 20- 103(d). b(5) The pushing of snow onto any City street by any individual is prohibited. c) Weather.Disaster: When the Snow Removal Coordinator has de- clared a Weather Disaster, the following traffic regulations shall be in effect: c(1) The Snow Removal Coordinator shall have the power to limit traffic within the City. Anyone traveling on City streets without a valid emergency reason shall be subject to the penalty clause of Section 20 -105. c(2) The Snow Removal Coordinator shall have the power to establish any and /or all parking restrictions which, in his opinion, are.necessary to insure the health and safety of the citizens. Any vehicle parked, stalled, incapable of moving under its own power, or left un- attended upon any street in violation of these restrictions shall be ticketed and /or towed and /or impounded. c(3) The Snow Removal Coordinator shall have the power to designate vehicles such as Bureau of Streets vehicles, four -wheel drive vehicles, and snow mobiles as "Temporary Emergency Vehicles" if in his opinion such designation is necessary to insure the health and safety of the citizens of the community. Any individual abusing the services of these or other City Emergency Vehicles shall be subject to the penalty provisions of Section 20 -105 and shall reimburse the City for all costs expended in responding to any false call. c(4) The Snow Removal Coordinator shall have the power to take whatever action is reasonably necessary to insure the health, safety, and welfare of the citizens during a Weather Disaster. c(5) All traffic restrictions, parking bans, and any other action taken during a Weather Disaster by the Snow Re- moval Coordinator shall remain in effect until the Weather Disaster has been cancelled by the Snow Removal Coordinator per Section 20- 103(d) c(6) The pushing of snow onto any City street by an individual is prohibited. CM Any individual abusing the services of City emergency vehicles shall be subject to the penalty provisions of Section 20 -105 and shall reimburse the City for all costs expended in responding to any false call. Section 20 -105: Penalties a) Any person violating the provisions of Section 20- 104(c) may be fined not more than three hundred dollars ($300.00). (Code 1962, Chapter 25 -106; Ord. No. 6236 -77, Chapter 12; Ord. No. 6317 -78, Chapter 8) b) Any person found to be violating the provisions of this Article other than sub - section 20- 104(c) shall be fined fifty dollars ($50.00). SECTION II: Chapter 20, Article 1, Section 20- 15(a), Impounding of Vehicles During Times of Emergency, of the Municipal Code of the City of South Bend, Indiana, is hereby amended to read as follows: Section 20 -15: Impounding of Vehicles During Times of Emergency a) The Police Department or its designee may remove and impound any unoccupied or unattended vehicle upon any street so as to constitute a definite hazard or obstruction to the move- ment of traffic in times of emergency such as fires, riots, civil emergencies (as provided by law), natural disasters, street cave - ins, snow emergencies, residential emergencies, weather disasters, or any other emergency. SECTION III: This ordinance shall be in full force and effect from and after its passage by the Common Council and approval by the Mayor, and after legal publication.
