GAMMON Clerk ORDINANCE NO. 6480 -78 AN ORDINANCE AMENDING CHAPTER 2 OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, ESTABLISHING A POLICY, PERTAINING TO THE RATE OF REIMBURSEMENT TO EMPLOYEES WHO USE THEIR PRIVATE VEHICLES IN PERFORMING JOB DUTIES FOR THE CITY OF SOUTH BEND, INDIANA. STATEMENT OF PURPOSE AND INTENT WHEREAS, the Administration of the City of South Bend has committed itself to efficient use of its atuo fleet, and the reduction of the fleet by twenty (20) vehicles has been mandated by the 1979 budget. This ordinance sets forth the means by which this goal may be accomplished. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA AS FOLLOWS: SECTION I. The following section of the Municipal Code of the City of South Bend, Indiana shall be amended to read as follows: SEC. 2 -47 Policy pertaining to the rate of reimbursement to employees who use their private vehicles in performing job duties for the City of South Bend, Indiana. 1. The Administration of the City of South Bend will reduce its, fleet of passenger vehicles, in the General Fund, Park Maintenance Fund, Motor Vehicle Highway Fund, and Human Rights Fund by twenty (20) vehicles before January 1, 1979. 2. Any employee who presently operates an assigned vehicle owned or leased by the City or its utilities, and who voluntary gives up the use of said vehicle prior to December 31, 1978, will be reimbursed at a rate of 22 cents per documented mile of usage for the City in ac- cordance with the following terms. A. In keeping in accordance with Internal Revenue Service rulings, such usage shall not include portal to portal travel, but rather only that travel documented after arriving at one's normal work station. B. In addition to this policy being in effect during calendar year 1979, those individuals who give up the use of their City owned or leased passenger vehicle prior to January 1, 1979, will be able to take advantage of this new policy. 3• Until July 1, 1979, those individuals who revert to per- sonal car usage for City business will be paid 22 cents per mile for the first 5,000 miles and 17 cents per mile thereafter. 4. In order for the City of South Bend to protect its insurance rating, and limit its liability, the following insurance requirements shall be mandatory for those individuals collecting mileage on a regular basis. A. Name of Person B. Drivers License Number C. Copy of their Auto Insurance Policy 5. There shall be established an account number 215.0 Local Mileage in the Controller's budget from which reimbursement will be made to those individuals working within departments of the General Fund. This reimbursement will hinge upon verification and approval of Department and Bureau Head and subsequent approval by the Chief Deputy Controller's office of mileage submitted on General Form No. 101. Mileage checks will be written through the normal accounts payable system and will be returned after approval by the Board of Public Works. SECTION II. This ordinance shall be in full force and effect from and after its passage by the Council, approval by the Mayor, and fulfillment of all statutory requirements. Passed, as amended,. NEMETH, Mayor COUNTY -CITY BUILDING SOUTH BEND, INDIANA 46601 September 25, 1978 the Common Council Common Council Building; 4th floor IN 46601 Dear Council Members: I'm presenting an ordinance to you for first reading on September 25, 1978, which will facilitate the implemen- tation of the reduction of the automobile fleet as was mandated in the 1979 budget. 219/284 -9742 As you are aware, over the years many individuals were hired by the City and were told that their job duties would require transportation and that, in fact, the City would provide that transportation. In recent years those individuals who were hired have been told that the City vehicle was not a fringe benefit and was not part of the job and, in fact, that vehicle could be taken away. However, I believe that by taking a City vehicle immediately away from any individual would create an extreme financial hardship, as this individual must go out and buy a new car to supplement the one that has been taken away in order for him to perform his duties. Without a car, he would necessarily be unemployed. For this reason, I am proposing this ordinance to encourage some voluntary return of the vehicles, as well as an equitable compensation for those who voluntarily comply with our wishes. I am proposing that any individual who turns his car back to the City for the remainder of 1978 be paid $.30 per mile, and that effective January 1, 1979, all vehicles that are either voluntarily or involuntarily turned back to the City be paid $.30 a mile for the first 5,000 miles and $.172 thereafter.
