Magnolia Street South Bend, Indiana 46613 ORDINANCE NO. 1eq%5. 7 g AN ORDINANCE AMENDING ORDINANCE NO. 4990 -68, AS AMENDED, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (Chapter 21, Municipal Code). BE IT ORDAINED by the Common Council of the City of South Bend, Indiana: Section 1. Ordinance No. 4990 -68, as amended, which ordinance is commonly known as the Zoning Ordinance of the City of South Bend, Indiana, be and the same hereby is amended in order that the zoning classification of the following described real estate in the City of South Bend, St. Joseph County, State of Indiana: A lot or parcel of land Thirty -six (36) feet in width, North and South taken off of and from the entire length.of the South side of Lot Numbered Twenty -two (22) as shown on the recorded Plat of Swygart's Third Addition to the City of South Bend, in St. Joseph County, Indiana, be and the same hereby is established as C Commercial use and D Height and Area District. Section 2. This Ordinance shall be in full. force and effect from and after its pasage by the Common Council, approval by the Mayor and legal publication. This rezoning is requested so as to allow the following Paving or blacktopping for use as a parking area immediately adjacent to Gruber's Super Market, Inc. S. Attached is a copy of (a) legal description of property; (b) a list of names and addresses of all property owners within 300 feet of the petition property; (c) a site plan; and (d) self- addressed, stamped envelopes of all property owners within 300 feet of the petition property. RE: Petition to Rezone Lot #22 of Swygart's Third Addition, commonly known as 1825 South Magnolia. Dear Sir or Madam: Please be advised that we are acting as counsel for Gruber Super Markets, Inc., in connection with this firm's petition to rezone the property described above from a residential to a com- mercial area. The proposed use of the property is an off street parking facility for the Gruber's Super Market located on 1847 Prairie, which is immediately adjacent to the parcel. We are transmitting herewith the required 30 copies of the petition for rezoning in the form prescribed by the Area Plan Commission, including a complete legal description of the sub- ject property and a list of the names and addresses of all other property owners within 300 feet of the proposed rezoning site. At this time we are also providing a Preliminary Sketch Plan for submission to the Area Plan Commission. Finally, we have provided stamped envelopes addressed to each of the property owners listed in the petition and the required filing fee of $10.00. If everything is in order, please refer the matter to the Area Plan Commission for its preliminary recommendation. The area for which rezoning is sought adjoins a 16 foot alley. Proceedings are currently underway to petition the Board of Public Works to vacate this alley in order to expand the proposed parking area. The proposed location has been reflected in the preliminary site plan and should be brought to the attention of the Area Plan Commission.
