ROLL CALL Present: Council Members Serge, Braboy, Puzzello, Taylor, Zakrzewski, Barcome, Paszek, Voorde and Beck Absent: None REPORT FROM THE SUB - COMMITTEE ON MINUTES To the Common Council of the City of South Bend: The sub - committee has inspected the minutes of the July 14 and July 21 meetings of the Council and found them correct. Therefore, we recommend the same be approved. /s/ Beverlie J. Beck /s/ Al Paszek /s/ James Barcome Council Member Serge made a motion that the minutes of the July 14 and July 21, meetings of the Council be accepted and placed on file, seconded by Council Member Puzzello. The motion carried. SPECIAL BUSINESS Council Member Serge made a motion to appoint Herbert Herendeen to the Historic Preservation Commission, seconded by Council Member Puzzello. The motion carried. RESOLUTION NO. 142f'86 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, COMMENDING JUDITH A GRUBER FOR BEING SELECTED AS THE RECIPIENT OF THE 1986 INDIANA SOCIETY OF ASSOCIATION EXECUTIVES "ASSOCIATE MEMBER OF THE YEAR" AWARD. WHEREAS, the Common Council of the City of South Bend, Indiana, recognizes that Judith A. Gruber was selected as the recipient of the 1986 Indiana Society of Association Executives "Associate Member of the Year" ward presented in Indianapolis; and WHEREAS, Judith A. Gruber began her employment with the Century Center in May of 1983 and has served as Director of Sales for the past year; and WHEREAS, the Common Council believes that the City of South Bend is indeed fortunate to have Judith A. Gruber representing the Century Center; and WHEREAS, her professionalism and other fine attributes in sales have garnered her much respect in the meeting /convention industry which benefit our entire Community. NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows: SECTION I. On behalf of all of the citizens of the City of South Bend, Indiana, the Common Council hereby publicly commends JUDITH A. GRUBER, for her many contributions to our community and for being selected as the 1986 "Association Member of the Year" award by the Indiana Society of Association Executives. SECTION II. The Common Council wishes JUDITH A. GRUBER continued success in her profession in the years ahead. SECTION IV. This Resolution shall be in full force and effect from and after its adoption by the Common Council and approval by the Mayor. /s/ Joseph T. Council Member Beck read the resolution and presented it to Judith Gruber. Council Member Taylor made a motion to adopt this resolution, seconded by Council Member Barcome. The resolutio was adopted by a roll call vote of nine ayes. REPORTS Council Member Voorde indicated that the Zoning and Vacation Committee had met on Bill nos. 66, 71 and 72 -86. He indicated Bill No. 66 -86 has been withdrawn, and Bill nos. 71 and 72 -86 received a favorable recommendation. Council Member Braboy indicated that the Human Resources Committee had met on Bill No. 77 -86 and recommended it favorable. Council Member Puzzello indicated that the Personnel and Finance Committee had met on Bill No. 73, 74, 75, and 76 -86. She indicated that Bill no. No. 73, 74, and 76 -86 received a favorable recommendation, and Bill No. 75 -86 received no recommendation. Council Member Serge indicated that the Public Works Committee had met on Bill nos. 78, 79, 80, 81 and 82 -86, and they all received a favorable recommendation. Council Member Barcome made a motion to resolve into the Committee of the Whole, seconded by Council Member Zakrzewski. The motion carried. COMMITTEE OF THE WHOLE Be it remembered that the Common Council of the City of South Bend met in the Committee of the Whole on July 28, 1986, at 7:11 p.m., with nine members present. Chairman Puzzello presiding. BILL NO. 66 -86 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: PORTIONS OF ST. PETER STREET LYING BETWEEN CORBY BLVD., AND NAPOLEON MORE PARTICULARLY DESCRIBED AS FOLLOWS: THE EAST 8.25 FEET AND THE WEST 8.25 FEET OF SAID PUBLIC WAY, FROM CORBY BLVD. TO NAPOLEON FOR A COMBINED TOTAL DISTANCE OF 1188 FEET MORE OR LESS ALL BEIN( IN THE CITY OF SOUTH BEND, INDIANA SORINS 2ND ADD TO THE TOWN OF LOWELL. Council Member Voorde made a motion to strike this bill from the agenda, seconded b, Council Member Barcome. The motion carried. BILL NO. 71 -86 A BILL TO VACATE THE FOLLOWING PROPERTY: THE FIRST NORTH -SOUTH ALLEY EAST OF WILLIAM STREET, FROM WESTERN AVENUE, SOUTH TO THE SOUTH LINE OF LOTS 6 AND 14, VAIL'S SOUTHWEST ADDITION, BLOCK 8; AND THE FIRST EAST -WEST ALLEY SOUTH OF WESTERN AVENUE, FROM WILLIAM STREET EAST TO THE EAST LINE OF LOTS 12 AND 13, VAIL'S SOUTHWEST ADDITION, BLOCK 8. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Van Gates, the petitioner, made the presentation for the bill. He indicated they were requesting the vacation of this alley in order to build on to the dealership. He indicated that several pieces of land he owned were taken by Redevelopment in order this build the stadium and this vacation would make up for some of the land lost. Joseph Guenert 2510 Corby, spoke against this alley vacation. Council Member Zakrzewski made a motion to recommend this bill to the Council favorable, seconded by Council Member Barcome. The motion carried. BILL NO. 72 -86 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: THE FIRST NORTH -SOUTH ALLEY EAST OF SUNNYSIDE AVENUE RUNNING SOUTH FROM MONROE STREET TO SOUTH STREET FOR A DISTANCE OF 250 FEET MORE OR LESS AND LYING BETWEEN LOTS 604 -605 AND LOTS 624 -625 OF SUNNYMEDI THIRD ADDITION TO THE CITY OF SOUTH BEND, INDIANA. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Larry Groth, 1335 E. South St., made the presentation for the bill. He indicated the purpose of this vacation was to insure the safety of neighborhood children. Council Member Beck made a motion to recommend this bill to the Council favorable, seconded by Council Member Zakrzewski. The motion carried. Council Member Beck made a motion to combine public hearing on Bill nos. 73, 74, 75 -86, seconded by Council Member Zakrzewski. The motion carried. Council Member Barcome made a motion to move the salary hearing to the last part of public hearing, seconded by Council Member Beck. The motion carried. BILL NO. 76 -86 A BILL AMENDING ORDINANCE NO. 7357 -84 TO ESTABLISH THE SALARY A CERTAIN POSITION WITHIN THE POLICE DEPARTMENT OF THE CITY OF SOUTH BEND FOR THE CALENDAR YEAR OF 1986. REGULAR MEETING i This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Craig Hartzer, Deputy Mayor, made the presentation for the bill. He indicated the purpose of this bill was to create the civilian position of Emergency Communications Manager with a maximum annual salary of 34,500. He indicated this represents a continuation of our efforts to further professionalize the dispatch operation and put more officers on the street. Council Member Barcome made a motion that the minimum salary be $27,000 and the maximum by $34,500, seconded by Council Member Serge. The motion carried. Council Member Serge made a motion to recommend this bill to the Council favorable, as amended, seconded by Council Member Beck. The motion carried. BILL NO. 77 -86 A BILL TRANSFERRING $60,000 AMONG VARIOUS ACCOUNTS WITHIN THE DIVISION OF COMMUNITY DEVELOPMENT. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Don Inks, Director of Community Planning made the presentation for the bill. He indicated the receivership program has proven to be inefficient, and they were requesting the transfer of a portion of those monies in to the Housing Rehab Fund. He indicated that Code Enforcement has requested monies for the demolition of several unsafe structures and some of this money will be used for that purpose. James Cronk, 702 E. LaSalle, spoke against this bill. He indicated that should retain the receivership program. Council Member Serge made a motion to recommend this bill to the Council favorable, seconded by Council Member Beck. The motion carried. Council Member Beck made a motion to combine public hearing on Bill nos. 78, 79, 80, 81, and 82 -86, seconded by Council Member Paszek. The motion carried. BILL NO. 78 -86 A BILL APPROPRIATING $17,320.62 FROM THE LOCAL ROAD AND STREET FUND TO VARIOUS PROJECTS. BILL NO. 79 -86 A BILL APPROPRIATING $20,000.00 FROM THE LOCAL ROAD AND STREET FUND TO PROJECT R &S 205 EDISON ROAD IMPROVEMENTS. BILL NO. 80 -86 A BILL APPROPRIATING $155,000.00 FROM THE LOCAL ROAD AND STREET FUND TO PROJECT R &S 8604 SAMPLE ST. IMPROVEMENTS. BILL NO. 81 -86 A BILL APPROPRIATING $40,862.99 FROM THE CUMULATIVE SEWER BUILDING AND SINKING FUND TO VARIOUS PROJECTS. BILL NO. 82 -86 A BILL APPROPRIATING $526,000.00 FROM THE CUMULATIVE SEWER BUILDING AND SINKING FUND TO PROJECT CS 830 PENDLE, JUNIPER AND DOUGLAS RD. SEWERS WITHIN THE CUMULATIVE SEWER BUILDING AND SINKING FUND. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Joseph Pluta, of Engineering, made the presentation for the bills. He indicated that Bill No. 78 -86 was an appropriation 1984 Traffic Signal Repair and Jefferson and Eddy streets realignment; Bill No. 79 -86 was an appropriation for Edison Road improvements; Bill No. 80 -86 was an appropriation for Sample Street repairs; Bill No. 81 -86 was an appropriation for Crest -Manor Retention Basin, Leland Avenue repairs and Riverside Sewers; Bill No. 82 -86 was an appropriation for Pendle, Juniper and Douglas Rd., sewers. Joseph Guenert, 3510 Corby, asked if the Pendle Sewers were a part of Clay Utilities. Joseph Pluta indicated they were. Council Member Beck made a motion to recommend Bill No. 78 -86 to the Council favorable, seconded by Council Member Taylor. The motion carried. Council Member Beck made a motion to recommend Bill No. 79 -86 to the Council favorable, seconded by Council Member Zakrzewski. The motion carried. Council Member Taylor made a motion to recommend Bill No. 80 -86 to the Council favorable, seconded by Council Member Zakrzewski. The motion carried. Council Member Zakrzewski made a motion to recommend Bill No. 81 -82 to the Council favorable, seconded by Council Member Taylor. The motion carried. Council Member Braboy made a motion to recommend Bill No. 82 -86 to the Council favorable, seconded by Council Member Zakrzewski. The motion carried. Council Member Beck made a motion to recess, seconded by Council Member Voorde. The motion carried and the meeting was recessed at 7:45 p.m., and reconvened at 8:00 p.m. BILL NO. 73 -86 A BILL FIXING THE ANNUAL PAY AND MONETARY FRINGE BENEFITS OF FIREFIGHTERS FOR THE CALENDAR YEARS OF 1987 AND 1988. ' BILL NO. 74 -86 A BILL FIXING THE ANNUAL PAY AND MONETARY FRINGE BENEFITS OF SWORN MEMBERS OF THE SOUTH BEND POLICE DEPARTMENT FOR THE CALENDAR YEAR OF 1987 AND 1988. BILL NO. 75 -86 A BILL FIXING THE MAXIMUM SALARIES AND WAGES OF APPOINTED OFFICERS AND EMPLOYEES OF THE CITY OF SOUTH BEND, INDIANA, FOR CALENDAR YEARS 1987, 1988 AND 1989. This being the time heretofore set for public hearing on the above bills proponents and opponents were given an o be heard. Jon Hunt, chairman of the City Negotiating Team, indicated therteamtfeelsthatthesesalaryordinances meet the goals and objectives the Council wanted achieved. He indicated that Kathy �LUL_Y_2 8 19 8 6 Cekanski - Farrand, Council attorney would make the presentation for the police and fire salaries, and Michael Vance, controller, would make the presentation for the Teamsters and non -union employees. He indicated that the Wage Committee would request the Council's favorable consideration on their recommendations. Kathy Cekanski Farrand indicated there was a substitute Bill 73 -86 setting salaries for a two year period for the firefighters. Council Member Barcome made a motion to accept the substitute bill on file with the City Clerk, seconded by Council Member Taylor. The motion carried. She indicated this bill received a unanimous recommendation for the Wage Committee, the Council's Personnel and Finance Committee, as well as the firefighters. She indicated the Wage Committee felt this bill meets the goals the City Council requested. She outlined the firefighters salaries and indicated that the fire chief, assistant chiefs and battalion chiefs would receive the same increase as the rank and file. She indicated that Bill No. 74 -86 was a three year contract for the police department. She indicated that the wage committee was recommending this by a three member vote, with one abstention. She asked that the substitute bill be amended to strike the "and" in the title between 1987 and 1988, and place it immediately proceeding 1989. Council Member Barcome made a motion to accept the substitute bill as well as the amendment, seconded by Council Member Taylor. The motion carried. She then explained the contract. She indicated that if this contract is not ratified the acceptance bonus would not be paid for either 1987 or 1988. She indicated that what the Committee was proposing was fair and represented the overall goals. Council Member Taylor made a motion to amend the bill further in the third paragraph add 1989; page 3, Section 4, sub - sections a & b add 1989; Section ii (a) add 1989, seconded by Council Member Beck. The motion carried. Michael Vance Controller, indicated the substitute Bill No. 75 -86 should be amended on page 8 by changing the salary of the Manager of Sec. and Clerical Services to $22,651 in 1987 and $22,951 in 1988; on page 9, Chief Deputy Clerk $20,645 in 1987 and $21,677 in 1989, Deputy Clerk $16,500 in 1987 and $17,325 in 1989; on page 11, Section 7, it should read "In the Event that a Local Option Income Tax becomes effective and tax income from that Local Option Income Tax is received by the City of south Bend in its General Fund in 1988 or 1989, the annual maximum salaries and wages rates for the job classifications listed in Section I shall be increased by $2% from the amount listed for that year. Council Member Beck made a motion to accept the substitute bill and the amendments, seconded by Council Member Barcome. The motion carried. Mr. Vance indicated non -union personnel have a two year agreement and Teamsters have a three year agreement. He indicated they have decreased paid time off in the area of sick time, holidays and vacations. He indicated the agreement was enhanced by by accident and sickness indemnity and long term disability. Corey Stein, 1233 S. 29th, spoke against the Teamsters increase. George Herendeen, attorney for the FOP, spoke against Bill No. 74 -86. Joseph Guenert, 3510 Corby, spoke against Bill No. 74 -86. Council Member Barcome indicated the Council felt that the Negotiating Team had done a great job. Council Member Beck made a motion to recommend Bill No. 73 -86 to the Council favorable, as amended, seconded by Council Member Taylor. The motion carried. Council Member Barcome made a motion to continue public hearing on this bill indefinitely, seconded by Council Member Paszek. The motion carried. BILL NO. 84 -86 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY; THE FIRST EAST -WEST ALLEY SOUTH OF NAVARRE STREET RUNNING WEST FROM MICHIGAN STREET A DISTANCE OF 159 FEET TO A POINT OF SIX FEET EAST OF THE FIRST INTERSECTING NORTH -SOUTH ALLEY EAST OF MAIN STREET, ALL BEING IN THE ORIGINAL PLAT OF SOUTH BEND, INDIANA, AND LYING BETWEEN LOTS 147 AND 148 OF SAID PLAT. This bill had first reading. Council Member Serge made a motion to set this bill for second reading and public hearing August 18, seconded by Council Member Paszek. The motion carried. BILL NO. 85 -86 A BILL AMENDING CHAPTER 21 OF THE SOUTH BEND MUNICIPAL CODE ENTITLED ZONING. This bill had first reading. Council Member Puzzello made a motion to refer this bill to Area Plan, seconded by Council Member Voorde. The motion carried. UNFINISHED BUSINESS Council Member Taylor made a motion to set Bill No. 67 -86 for public hearing and second reading August 18, seconded by Council Member Puzzello. The motion carried. PRIVILEGE OF THE FLOOR Mary Ellen Guenert, 3510 Corby, spoke regarding remarks made by Robert Staley regarding the base ball stadium, the Fair Tax Association and the Catholic Church. Joseph Guenert, 3510 Corby, spoke regarding the stadium. There being no further business to come before the Council, unfinished or new, Council Member Taylor made a motion to adjourn, seconded by Council Member Puzzello.
