HomeMy WebLinkAbout04-14-86 Council Meeting MinutesI( REGULAR MEETING F APRIL 14, 1986 Be it remembered that the Common Council of the City of South Bend met in the Council Chambers of the County -City Building on Monday, April 14, at 7:00 p.m. The meeting was called to order and the Pledge to the Flag was given. ROLL CALL Present: Council Members Serge, Braboy, Puzzello, Taylor, Zakrzewski, Barcome, Paszek, Voorde and Beck Absent: None REPORT FROM THE SUB - COMMITTEE ON MINUTES To the Common Council of the City of South Bend: The sub - committee has inspected the minutes of the March 18 and April 1 meetings of the Council and found them correct. Therefore, we recommend the same be approved. /s/ Beverlie J. Beck /s/ Al Paszek /s/ James Barcome Council Member Serge made a motion that the minutes of the March 18 and April 1, meetings of the Council be accepted and placed on file, seconded by Council Member Puzzello. The motion carried. SPECIAL BUSINESS Council Member Serge made a motion to appoint Ernest Niedbalski, Walter Szastakowski and Charles Vogel to the Older Adults Council, seconded by Council Member Braboy. The motion carried. REPORTS COUNCIL Member Voorde indicated that the Zoning and Vacation Committee had met on bill nos. 15 and 16 -86, and recommended them favorable. Council Member Puzzello indicated that the Personnel and Finance Committee had met on Bill No. 39 -86 and recommended it favorable. Council Member Braboy indicated that the Human Resources Committee had met on Bill No. 40 -86 and recommended it favorable. Council Member Barcome made a motion to resolve into the Committee of the Whole, seconded by Council Member Zakrzewski. The motion carried. COMMITTEE OF THE WHOLE Be it remembered that the Common Council of the City of South Bend met in the Committee of the Whole on Monday, April 14, at 7:12 p.m., with nine members present. Chairman Puzzello presiding. BILL NO. 12 -86 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT 721 -23 E. HOWARD IN THE CITY OF SOUTH BEND, INDIANA. Council Member Barcome made a motion to continue this bill until April 28, seconded by Council Member Paszek. The motion carried. BILL NO. 15 -86 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT 1134 LINCOLN WAY EAST IN THE CITY OF SOUTH BEND, INDIANA. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Council Member Voorde made a motion to accept the substitute bill on file with the City Clerk, seconded by Council Member Serge. The motion carried. Larry Magliozzi, of Area Plan, gave the staff report, which was favorable. Kevin Butler, attorney, made the presentation for the bill. He indicated St. John's Business Machines, intended to enlarge their facility on Lincoln Way West. Council Member Zakrzewski made a motion to recommend this bill to the Council favorable, as amended, seconded by Council Member Barcome. The motion carried. BILL NO. 16 -86 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT 2211 E. JEFFERSON IN THE CITY OF SOUTH BEND, INDIANA. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Larry Magliozzi, of Area Plan, gave the staff report which was favorable. Marty Kleva, from Cole Associates, made REGULAR MEETING AP IL 14_, 19$6 the presentation for the bill. He indicated that Cole Associates intended to enlarge their facilities on Jefferson Boulevard. Council Member Taylor made a motion to recommend this bill to the Council favorable, seconded by Council Member Zakrzewski. The motion carried. REGULAR MEETING APRIL 14, 1986 BILL NO. 36 -86 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: THE 1ST NORTH -SOUTH ALLEY EAST OF EDDY STREET RUNNING SOUTH FROM WAYNE STREET TO THE 1ST INTERSECTING EAST -WEST ALLEY FOR A DISTANCE OF 123 FEET ALL BEING IN THE SUNNYMEDE 1ST ADDITION TO THE CITY OF SOUTH BEND, ST. JOSEPH COUNTY, INDIANA. Council Member Voorde made a motion to continue public hearing on this bill until April 28, seconded by Council Member Zakrzewski. The motion carried. BILL NO. 37 -86 A BILL AMENDING CHAPTER 6 OF THE SOUTH BEND MUNICIPAL CODE ENTITLED BUILDING. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Kathy Barnard, Director of Code Enforcement, made the presentation for the bill. She indicated there were two errors in the recently passed building code amendment that will be corrected by this bill. Council Member Zakrzewski made a motion to recommend this bill to the Council favorable, seconded by Council Member Taylor. The motion carried. BILL NO. 39 -86 A BILL APPROPRIATING $5,500.00 FROM THE MORRIS CIVIC AUDITORIUM IMPROVEMENT FUND. This being the time heretofore set for and opponents were given an opportunity Century Center, indicated they planned projection booth equipment, as well as Member Beck made a motion to recommend by Council Member Barcome. The motion public hearing on the above bill, proponents 7 to be heard. Brian Hedman, Director of to purchase two 35 mm movie projectors and procure a communication system. Council this bill to the Council favorable, seconded carried. BILL NO. 40 -86 A BILL APPROPRIATING $67,000.00 FROM THE LOCAL EQUAL HOUSING OPPORTUNITY FUND TO BE ADMINISTERED BY THE CITY OF SOUTH BEND THROUGH ITS HUMAN RIGHTS COMMISSION AND DEPARTMENT OF ECONOMIC DEVELOPMENT. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Larry Johnson, Director of Human Rights, made the presentation for the bill. He indicated the Commission has been awarded a grant from HUD in order to provide funds to develop and implement a more effective fair housing program in the community. Council Member Zakrzewski made a motion to recommend this bill to the Council favorable, seconded by Council Member Taylor. The motion carried. There being no further business to come before the Committee of the Whole, Council Member Taylor made a motion to rise and report to the Council, seconded by Council Member Barcome. The motion carried. BILLS, SECOND READING ORDINANCE NO. 7629 -86 AN ORDINANCE AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT 1134 LINCOLN WAY EAST IN THE CITY OF SOUTH BEND, INDIANA. This bill had second reading. Council Member Zakrzewski made a motion to amend this bill, as amended in the Committee of the Whole, seconded by Council Member Puzzello. The motion carried. ORDINANCE NO. 7630 -86 AN ORDINANCE AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT 2211 E. JEFFERSON IN THE CITY OF SOUTH BEND, INDIANA. REGULAR_ MEETING !! This bill had second reading. Council Member Serge made a motion to pass the bill, seconded by Council Member Zakrzewski. The bill passed by a roll call vote of nine ayes. ORDINANCE NO. 7631 -86 AN ORDINANCE AMENDING CHAPTER 6 OF THE SOUTH BEND MUNICIPAL CODE ENTITLED BUILDING. This bill had second reading. ORDINANCE NO. 7633 -86 AN ORDINANCE APPROPRIATING $67,000.00 FROM THE LOCAL EQUAL HOUSING OPPORTUNITY FUND TO BE ADMINISTERED BY THE CITY OF SOUTH BEND THROUGH ITS HUMAN RIGHTS COMMISSION AND DEPARTMENT OF ECONOMIC DEVELOPMENT. This bill had second reading. Council Member Serge made a motion to pass the bill, seconded by Council Member Braboy. The bill passed by a roll call vote of nine ayes. RESOLUTIONS RESOLUTION NO. 1411 -86 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND URGING THE RETENTION OF THE GENERAL REVENUE SHARING PROGRAM. WHEREAS, the Common Council of the City of South Bend, Indiana, notes that on February 27, 1986, the Mayors from New Orleans, New York, and San Antonio testified before the House Budget Committee to appeal for the retention of the General Revenue Sharing Program; and WHEREAS, the Council agrees with Representative Ted Weiss, Chairman of the Intergovernmental Relations Sub - Committee and House Government Operations Committee who stated that "if revenue sharing is to be saved, it will be because of work on the local level "; and WHEREAS, as of March 15, 1986, the "Congressional Box Score" on the extension of Revenue Sharing was: In the House - 178 for; 85 against; 172 uncommitted In the Senate - 36 for; 26 against; 38 uncommitted; and WHEREAS, the Common Council recognizes that the United States Conference of Mayors, the National Association of Counties, and the Indiana Association of Cities and Towns are some of the many organizations supporting the retention of the General Revenue Sharing Program. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of South Bend, Indiana, as follows: SECTION I. The Common Council of the City of South Bend, Indiana, officially petitions the United States House of Representatives and the United States Senate to extend the General Revenue Sharing Program. SECTION II. The Common Council support the bipartisan activities of the "National Coalition to Save General Revenue Sharing" chaired by United States Conference of Mayors President Ernest Morial. SECTION III. Council Member Voorde indicated Indiana Cities and Towns had requested all members to pass a resolution urging the retention of Federal Revenue Sharing monies. He indicated copies of this resolution would be sent to President Reagan, Senators Quayle and Lugar. Council Member Barcome made a motion to add Representative Hiler's name to the resolution, seconded by Council Member Braboy. Council Member Zakrzewski made a motion to adopt this resolution, seconded by Council Member Barcome. The resolution was adopted by a roll call vote of nine ayes. BILLS FIRST READING BILL NO. 41 -86 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT 2408 PRAIRIE AVENUE IN THE CITY OF SOUTH BEND, INDIANA. This bill had first reading. Council Member Voorde made a motion to refer this bill to Area Plan, seconded by Council Member Puzzello. The motion carried. BILL NO. 42 -86 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT 4402 S. MICHIGAN STREET IN THE CITY OF SOUTH BEND, INDIANA. This bill had first reading. Council Member Puzzello made a motion to refer this bill to Area Plan, seconded by Council Member Voorde. The motion carried. BILL NO. 43 -86 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT 3606 E. JEFFERSON BOULEVARD IN THE CITY OF SOUTH BEND, INDIANA. This bill had first reading. Council Member Puzzello made a motion to refer this bill to Area Plan, seconded by Council Member Voorde. The motion carried. BILL NO. 44 -86 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: (1) THE NORTH -SOUTH RIGHT -OF -WAY BOUNDED BY JEFFERSON BOULEVARD ON THE NORTH AND THE RIGHT -OF -WAY OF THE GRAND TRUNK WESTERN RAILROAD COMPANY ON THE SOUTH, BEING THE SAME 33 -FOOT RIGHT -OF -WAY RUNNING ALONG THE ENTIRE EASTERN BOUNDARY OF FERNWOOD ADDITION TO THE CITY OF SOUTH BEND, AS SHOWN ON THE PLAT THEREOF, RECORDED JULY 12, 1945, IN PLAT BOOK 15, PAGE F, IN THE OFFICE OF THE RECORDER OF ST. Council Member Voorde made a motion to set this bill for second reading and public hearing April 28, and refer it to the Zoning and Vacation Committee, seconded by Council Member Paszek. The motion carried. BILL NO. 45 -86 A BILL OF THE CITY OF SOUTH BEND, INDIANA, ESTABLISHING A SCHEDULE OF DISCHARGE PERMIT FEES. This bill had first reading. Council Member Voorde made a motion to set this bill for second reading and public hearing April 28, and refer it to the Utilities Committee, seconded by Council Member Zakrzewski. Council Member Braboy made a motion to set this bill for second reading and public hearing April 28, and refer it to the Human Resources Committee, seconded by Council Member Puzzello. The motion carried. BILL NO. 47 -86 A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING CHAPTER 2 OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, BY THE INCLUSION OF NEW ARTICLE 18 ENTITLED FIREFIGHTERS AND POLICE OFFICERS SALARY NEGOTIATION ORDINANCE. This bill had first reading. Council Member Taylor made a motion to strike this bill, seconded by Council Member Serge. The motion carried on a roll call vote of five ayes and four nays (Council Members Puzzello, Zakrzewski, Barcome and Voorde.) PRIVILEGE OF THE FLOOR David McCarthy, 1209 N. Olive, spoke regarding handicapped parking problems in South Bend. There being no further business to come before the Council, unfinished or new, Council Member Voorde made a motion to adjourn, seconded by Council Member Barcome.
