Be it remembered that the Common Council of the City of South Bend met in the
Council Chambers of the County -City Building on Monday, February 3, 1986, at 7:00
p.m. The meeting was called to order and the Pledge to the Flag was given.
ROLL CALL Present: Council Members Serge, Braboy, Puzzello,

REPORTS
Council Member Braboy indicated that the Human Resources Committee had met on
Resolution 5A and recommended it favorable.
RESOLUTION NO. 1400 -86 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH
BEND, INDIANA, REDESIGNATING CERTAIN AREAS WITHIN THE
CITY AS ECONOMIC REVITALIZATION AREAS FOR THE PURPOSES
OF PROPERTY TAX ABATEMENT.
WHEREAS, the City of South Bend acknowledges the receipt of a memorandum dated
November 27, 1985, from the State Board of Tax Commissioners addressing Economic
Revitalization Area Designations and restrictions; and
WHEREAS, the City has reviewed all of the abatements approved by the Common
Council since it began reviewing such petitions and has determined that the
abatements originally described as urban development areas referred to herein should
be designated as Economic Revitalization Areas pursuant to I.C., 6- 1.1012.1 -1 et
seq.; and
WHEREAS, The Department of Economic Development previously completed
investigations and prepared reports with the information sufficient for the Common
Council to determine that the areas referred to herein qualified as Economic
Revitalization Areas under Indiana Code 6 -1.1- 12.1 -1 et seq., and has further
prepared maps and plats showing the boundaries and such other information as
required by law of the areas in question; and
WHEREAS, the Human,Resources and Economic Development Committee of the Common
Council has previously reviewed the reports and has recommended to the Common
Council that the areas qualify as Economic Revitalization Areas.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend,
Indiana, as follows:
SECTION I. The Common Council accepts the reports and recommendations of the
Human Resources and Economic Development Committee that the following described
Resolutions describing specific areas as Urban Development Areas (UDA) should be
amended to designate the following areas previously designated as Urban Development
Areas as Economic Revitalization Areas (ERA) and hereby adopts a resolution
redesignating such areas as Economic Revitalization Areas for purposes of real and
personal property tax abatement (as indicated):
(1) Res. No. 719 -79 Urban Development declaring 1st Source Bank and the Marriott
Center Complex for real property tax abatement consideration. (adopted 9- 24 -79)
(2) Res. No. 726 -79 Urban Development Area for River Glen Office Plaza
Associates Project for real property tax abatement consideration. (adopted 10 -8 -79)
(3) Res. No. 729 -79 Urban Development Area for Niles Avenue Partnership for real
property tax abatement consideration. (adopted 10- 22 -79)
(4) Res. No. 733 -79 Urban Development Area for the area located southeast of the
corner of Sample and High Street for real property tax abatement consideration
(adopted 11- 15 -79)
(5) Res No. 741 -79 Urban Development Area for 1007 Sample Street (R &C Realty
Project) for real property tax abatement consideration. (adopted 12- 17 -79)
(6) Res. No. 799 -79 Urban Development Area for 301 East Sample (a Mossberg
Project) for real property tax abatement consideration. (adopted 8- 11 -80)

SECTION II. The Common Council directs the City Clerk to cause notice of the
adoption of this resolution to be published, said publication providing notice of
the public hearing on February 24, 1986, before the Common Council on said
declaration. Such designations are for real and personal property tax abatement (as

indicated) and are limited to the period of time addressed in the original tax
abatement declarations.
SECTION III. This resolution shall be in force and effect from and after its
adoption by the Common Council and approval by the Mayor.

A public hearing was held on the resolution at this time. Council Member Barcome
made a motion to accept the substitute resolution on file with the City Clerk,
seconded by Council Member Braboy. The motion carried. Kathy Cekanski- Farrand,
Council attorney, indicated that the City received a memorandum from the State Board
of Tax Commissioners advising all communities that all areas previously designated
as Urban Development Areas must be redesignated as Economic Revitalization Areas by
March 1, 1986. She indicated this resolution is the first step of that process, and
the confirming resolution will be hard at the February 24 meeting. Council Member
Serge made a motion to adopt this resolution, seconded by Council Member
Zakrzewski. The resolution was adopted by a roll call vote of nine ayes.
RESOLUTION A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND VOTING IN
FAVOR OF A PROPOSED ORDINANCE OF THE ST. JOSEPH COUNTY INCOME TAX
COUNCIL IMPOSING THE COUNTY OPTION INCOME TAX IN ST. JOSEPH COUNTY.
RESOLUTION A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND VOTING IN
FAVOR OF A PROPOSED ORDINANCE OF THE ST. JOSEPH COUNTY INCOME TAX
COUNCIL INCREASING THE PERCENTAGE CREDIT ALLOWED FOR HOMESTEADS.
Council Member Taylor indicated that since there was not support from the County or
Mishawaka to pass this tax South Bend's passage would be an exercise in futility.
He made a motion to strike these resolutions, seconded by Council Member Puzzello.
The motion carried on a roll call vote of nine ayes.
BILLS, FIRST READING
BILL NO. 11 -86 A BILL APPROPRIATING $84,940.00 FROM THE WATER WORKS DEPRECIATION
FUND TO ACCOUNT NUMBERED 399.0 WITHIN THAT FUND.
This bill had first reading. Council Member Voorde made a motion to set this bill
for second reading and public hearing February 24, seconded by Council Member
Barcome. The motion carried.
BILL NO. 12 -86 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT
721 -23 HOWARD ST., IN THE CITY OF SOUTH BEND, INDIANA.
This bill had first reading. Council Member Puzzello made a motion to refer this
bill to Area Plan, seconded by Council Member Braboy. The motion carried.
PRIVILEGE OF THE FLOOR
Irene Mutzl, 320 Parkovash, indicated that an attorney from Indianapolis presented
the City's case on the baseball stadium. She wanted to know how much he was paid.
John Voros, 1617 Inwood, spoke regarding Countywide duplication of services.
Joe Guentert, 3510 Corby, spoke regarding the increase in the City's tax rate.
There being no further business to come before the Council, unfinished or new,
Council Member Taylor made a motion to adjourn, seconded by Council Member Braboy.
The motion carried and the meeting was adjourned at 7:27 p.m.
