Dear Honorable Council Members: Renewal applications for the operation of Scrap Metal/Junk Dealers/Recycling Operations have been received. In accordance with the procedure for the renewal of city business licenses these applications were submitted to the Police Department, Fire Inspection Bureau, Neighborhood Resources, and the Zoning Department for their review and recommendation. The relevant departments conduct the following reviews: SBPD - Reviews the following criteria: • Criminal history and the likelihood that granting the license will endanger the health, safety. or welfare of the public. • Ensures applicant does not have any warrants and is not involved in any criminal investigations. • Verify that applicants enter electronic transaction report to SBPD daily and utilize video surveillance. NSE - Reviews the following ordinance criteria in addition to overall municipal code compliance: • Fencing is in good condition: verified by Code &Zoning. • Is there litter or debris around the exterior part of the business. • Are there improperly parked vehicles. • Are there any environmental issues. SBFD - Reviews the following ordinance criteria in addition to overall municipal code, fire code, and NFPA requirements: • Ensures there are no combustible materials,and all inflammable materials must not be stored on premises. • Storerooms & garages must be free from rubbish,waste materials, old rags & paper. • Oil, gasoline, oily waste and other greasy material must be stored in metal waste cans. • Proper number of fire extinguishers must be near areas within such scrap or junkyards...wherein trash, metal or other waste materials may be burned • Has an unobstructed fire truck lane of at least 10 feet in width into such yard from the main entrance. Zoning - Verifies the use of the property is allowed and whether there is applicable legal non-conforming use. Resolution for Approval: The following applicants were inspected and received favorable recommendations from City departments: • OmniSource LLC - 1305 Prairie Ave. • Paul's Auto Yard - 3300 S. Main St. • Stevie's Enterprises - 3109 S. Gertrude Because the above applicants have met all the requirements of the ordinance,the attached resolution approving licenses is respectfully submitted for your consideration. Resolution for Interim Grant: The following applicants were inspected and reviewing departments identified deficiencies: • LKQ Pick Your Part Midwest, LLC - 1602 S. Lafayette Blvd. • Big Bulldog Auto Parts - 3700 S. Gertrude St. • Alternative Two, LLC - 700 W. Chippewa Ave. • Republic Services - 2500 Green Tech Dr. The deficiencies referenced above either do not rise to a level that would necessitate denial of the license at this time, and/or that it is appropriate for the City to grant additional time for compliance. The deficiencies needing to be corrected are as follows: • LKQ Pick Your Part Midwest, LLC: Compliance with required LeadsOnline electronic reporting to SBPD. • Big Bulldog Auto Parts: Compliance with required LeadsOnline electronic reporting to SBPD. • Alternative Two, LLC: Demonstration of compliance with the Indiana Department of Environmental Management (IDEM) for active violations of Indiana and Federal environmental law and continued compliance with the South Bend Fire Department to complete work on their Fire suppression system. • Republic Services:Continued compliance with the South Bend Fire Department to complete work on their Fire suppression system. Under Sections 4-6, 4-16, and 4-51 of the South Bend Municipal Code, the Common Council is authorized to condition the issuance of a business license to ensure that operations do not pose a nuisance or hazard and are conducted in compliance with all applicable fire, health, environmental, and public safety laws. Section 4-51 further contemplates the issuance of interim licenses, including time-limited licenses and extensions, as a regulatory tool. Accordingly,the enclosed Resolution proposes issuance of an interim license,subject to clearly defined,objective compliance requirements and a fixed duration.This approach allows the Applicants an opportunity to achieve full compliance while preserving the City's enforcement authority and protecting public health, safety, and welfare. The Resolution further provides that, upon written certification by the Business License Administrator that all conditions have been satisfied, the interim license shall automatically convert to a full scrap metal dealer license for the remainder of the applicable license term, without the need for additional Council action. This certification function is ministerial in nature and does not delegate licensing discretion from the Common Council. Failure to satisfy the conditions within the specified timeframe constitute grounds for revocation of this interim license without further Council action. This interim licensing approach reflects a measured exercise of the City's Ilk, City of South Bend Community Investment police power to protect public health and safety while affording the Applicant a reasonable opportunity to achieve compliance. We ask that Council please place these resolutions on the agenda for its May 11, 2026 meeting. Please note that the applicants receiving a recommendation for an interim license have received notice that their matter is expected to be heard on May 11th. City Clerk, South Bend, IN A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, RECOMMENDING ISSUANCE OF CONDITIONAL SCRAP METAL/JUNK DEALERS/RECYCLING OPERATIONS LICENSES PURSUANT TO SECTION 4-51 OF THE SOUTH BEND MUNICIPAL CODE WHEREAS, Section 4-51 of the South Bend Municipal Code establishes licensing requirements for scrap metal dealers, junk dealers, and recycling operations, and expressly provides for the issuance of interim licenses and extensions thereof; and WHEREAS, Section 4-6 of the South Bend Municipal Code requires every licensee to conduct business in such a manner as not to create a nuisance or hazard to the public; and WHEREAS, Section 4-16 of the South Bend Municipal Code authorizes the refusal, suspension,or revocation of a business license where business activities constitute a menace to the health, safety,or welfare of the public; and WHEREAS,Section 4-51(1)(1) requires scrap metal dealers to be maintained and operated in compliance with all applicable fire, health, environmental, and public safety laws of the State and the ordinances of the City; and WHEREAS, the Business License Administrator has reviewed the license applications of: LKQ Pick Your Part Midwest, LLC — 1602 S. Lafayette Blvd. Big Bulldog Auto Parts—3700 S. Gertrude St. Alternative Two,LLC—700 W. Chippewa Avenue Republic Services—2500 Green Tech Dr. and received departmental reviews identifying outstanding compliance issues requiring remediation; and WHEREAS, the Common Council is authorized under Section 4-51(f)(1) to consider the effect and appropriateness of a scrap metal or junkyard operation upon the surrounding area; and WHEREAS, the Common Council finds that issuance of an interim, time-limited license is appropriate to allow the Applicant an opportunity to achieve full compliance while protecting the public health, safety,and welfare; NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend,Indiana, as follows: SECTION I. Interim License Granted. The Common Council hereby grants an interim scrap metal / junk dealer / recycling operations license to: LKQ Pick Your Part Midwest, LLC— 1602 S. Lafayette Blvd. Big Bulldog Auto Parts—3700 S. Gertrude St. Alternative Two, LLC—700 W. Chippewa Avenue Republic Services—2500 Green Tech Dr. The interim license is granted pursuant to Section 4-51 of the South Bend Municipal Code. This license is conditional and interim in nature and shall be valid for a period of 60 days from the effective date of this Resolution, unless earlier expired, suspended,or revoked as provided herein. SECTION II. Conditions of Operation. Issuance of these interim licenses is expressly subject to the Applicant(s) obtaining compliance with specific conditions. The following applicants must register and report daily transactions to the SBPD through LeadsOnline and demonstrate consistent reporting during the interim period: LKQ Pick Your Part Midwest, LLC — 1602 S. Lafayette Blvd. and Big Bulldog Auto Parts—3700 S. Gertrude St. The following applicant must demonstrate compliance with the Indiana Department of Environmental Management (IDEM) to remedy active hazardous waste violations of Indiana and Federal environmental law, failures to report to IDEM, and must continue to comply with the South Bend Fire Department concerning required repairs to their fire suppression system: Alternative Two, LLC—700 W. Chippewa Avenue The following applicant must continue to comply with the South Bend Fire Department concerning required repairs to their fire suppression system: Republic Services—2500 Green Tech Dr. Failure to satisfy any condition identified above shall constitute grounds for revocation of this interim license without further Council action. SECTION III. No Waiver of Enforcement. Issuance of this interim license: 1. Does not waive any enforcement authority of the City; 2. Does not preclude the issuance of citations, penalties, or corrective orders; and 3. Does not guarantee renewal or issuance of a full annual license. SECTION IV. Extension. Upon a showing of substantial progress toward compliance, the Common Council may, by further resolution,grant a sixty-day extension of this interim license consistent with Section 4-51. SECTION V. Conversion to Full License Upon Certification. Upon written notice to the Common Council from the Business License Administrator that the conditions set forth in Section II of this Resolution have been fully satisfied for an applicant, the interim license granted herein shall automatically convert to a full scrap metal /junk dealer/ recycling operations license for the remainder of the applicable license term, without further Council action. The Business License Administrator's notice shall be limited to verification of objective compliance with the conditions imposed by this Resolution and shall not constitute an independent exercise of licensing discretion. Nothing in this Section shall be construed to: . Limit the authority of the Common Council under Sections 4-6,4-16,or 4-51 of the South Bend Municipal Code; or 2. Preclude Council review or action if new violations, enforcement actions, or material changes in circumstances arise prior to conversion. SECTION VI.Effective Date. It was discovered that Big Bulldog Auto Parts does not have an account for Leads Online,violating Number 4: "Pursuant to Sec. 4051(k)(1)" It was also discovered that LKQ does a lot of business and transactions but has ZERO submissions of transactions. i then spoke with Det. Timothy Taylor about property crimes and the lack of these submissions, and he recommended that the business be held accountable to submit as it can aid in his detectives' investigations. So even though LKQ has an account, they are not fulfilling the requirement or send via electronic forms of transmission to SBPD via Leads Online. violating Number 4: "Pursuant to Sec. 4051(k)(1)" Finally, Republic Service has the same concern as LKQ. Chippewa Ave, South Bend. In the past,waste tires were,in general. processed into TDF(tire-derived fuel). The facility's prior storage registration specified that 12,500 passenger tire equivalents (PTEs) were allowed to be stored on the property at any given time; however, inspections going back to December 19, 2011, indicated that the facility had gone above that number, and in many instances, exceeded it by hundreds of thousands of tires. After the February 13, 2012 inspection,the facility was referred to the Office of Land Quality, Land Enforcement Section, due to this exceedance of waste tires on the property. An Agreed Order was adopted with an effective date of March 4. 2014 (Case No. 2012-20771-H). The facility was referred to the Attorney Generals Office for failure to comply with the Agreed Order Additionally Court actions occurred including an Amended Agreed Judgement,that was filed on October 5, 2021. To date,the facility's waste tire storage, processing and transporting registrations have expired. FACILITY LAYOUT The facility stores waste tires in varying stages of processing. The facility stores whole tires(passenger and semi), halved, quartered, rough shreds, baled,and OTRs waste tires. The facility consists of three main buildings.The largest,an L-shaped building,contains the main office at the front and grinding area at the rear. To the east of this building are a small storage barn and a larger building where the mulch operation was previously located. This area was recently converted to scrap metal storage. Piles of shreds, chips, and tires are spread throughout the rest of the property. INSPECTION SUMMARY On December 12, 2025, IDEM staff conducted another enforcement follow-up inspection at Alternative Two, LLC. Notice about the inspection was provided that morning. Upon arrival, a note on the office door indicated that staff would need to go to the garage. Staff then proceeded around back to garage. Staff briefly met with a facility employee and learned that Mr Schumacher had just left and that he would be back in an hour or so. Staff requested authorization to go ahead begin the inspection of the waste tire storage area and was allowed to proceed. Although the grounds and waste tire piles were coated with snow, overall conclusions could be made. There appeared to be no changes made to the majority of the Piles noted in the September 22, 2025 inspection report. {See attached Photo Log, Page 3 of 10 Alternative Two LLC 12/122025 Photos f through 5, 9 through 12) There also appeared to be identical amounts of bailed tires staged for loading. These bailed tires also appeared to be stacked identical to those depicted in the photographs taken during the September 22 inspection, indicating that potentially no waste tires had left the site since just prior to the last inspection{See attached Photo 9 for comparison) 'Since the last inspection,the facility also moved the bailing machine. At the time of this inspection,it was being stored on the drive right next to south wall of the garage. In its former location,there appeared to be several more whole passenger waste tires. Those waste tires have been identified on the attached Site Map the table above as Pile F'(Note. This Pile was named Pile F'since the tires were somewhat connected to Pile F. See attached Photo 7) Staff then returned to the state vehicle and waited for Mr. Schumacher to return to the site. Upon his arrival. staff conducted an exit interview that included a discussion regarding a registration application IDEM received listing Alternative Two as a disposal site for their waste tires during closure. Staff inquired about whether Mr. Schumacher had knowledge of the facility or suggested including them as the disposal facility. Mr. Schumacher indicated that he was aware of the facility and that his business was fabricating a waste tire bailer for them. Staff also discuss the appearance that more tires were present on-site that during the September 22 inspection. Mr. Schumacher indicated that people show up at his gate and drive back to the storage area and dump their tires back there. (See Photo 13, which appears to contain vehicle tire tracks in the recently fallen now.) CONCLUSION The total amount of waste tires on-site was approximately 118,448 PTEs. Information is being forwarded to the Office of Land Quality Enforcement Section. Please see the Description of Violations section for more additional information. Note: The facility's waste tire storage, processing, and transporting registrations have expired. The Annual Tire Summary Waste Tire Storage Site/Waste Tire Processing Operation and the Annual Waste Tire Report and Closure Cost Estimate has not been submitted for 2024. Upon arrival,Mr. Shupryt observed that new signs containing all facility information had been posted at the intersection of West Ewing Avenue and Green Tech Drive.As Mr. Shupryt drove along Green Tech Drive toward the facility gate,litter was observed along both sides of the roadway.Additional litter was observed inside of the facility north of the transfer building.The area around the dumpsters for public drop off was observed to be well maintained. Mr.Shupryt then proceeded to Mr.Havemann's office,where he met with Mr. Havemann and Mr. Spalding.Mr.Shupryt mentioned to Mr. Havemann the litter observed while entering the facility.Mr. Havemann stated that multiple recent wind events had caused issues with blowing litter.He had a litter picker scheduled to clean everything up that morning. Mr. Havemann called the litter picker,who stated that he was less than 20 minutes away. Mr. Havemann stated that additional quotes for repairing the tipping floor had been obtained,and the company had recently made the decision to resurface the entire tipping floor through a company based in DeMotte, IN.Until this project can be scheduled and completed,Mr. Havemann is filling the hole in the tipping floor with rock and sand. Mr. Havemann and Mr. Spalding stated that they are filling the hole at least once a day and most days more than that. Mr.Haveman stated that he is keeping a supply of rock and sand on site so that the filling can be conducted as soon as the hole reforms(photo 6).Mr.Shupryt reviewed the quarterly reports for all four quarters of 2025 and waste oversight records for December 2025 and January 2026.Two random load inspections are being conducted and documented daily to fulfill incoming waste oversight requirements.Mr. Shupryt asked about other maintenance at the facility.Mr.Spalding stated that on December 28,2025,someone drove through the front gate of the facility and destroyed it.A temporary gate has been installed to secure the facility. Mr. Havemann stated that he spoke with a company earlier in the week to have the gate replaced,but it will take 10 weeks for the replacement to be completed.In September 2025, INSERV blew out the drain lines. Fire extinguishers in the office were observed to have recent inspection tags.The first aid kit in the office is being regularly maintained by Cintas and was observed to be fully stocked. Mr. Havemann and Mr.Shupryt then proceeded to inspect the site.The litter pickers were observed to already be on site and cleaning up the fenceline north of the transfer building.No damage was observed to the rolldown doors on the transfer building.Mr. Havemann stated that all doors are operating properly.The damage to the tipping floor was then observed (photos 1-2). Mr. Havemann stated that he would have a new load of rock and sand brought in immediately to refill the hole in the tipping floor. Floor drains in the tipping floor were observed to be blocked with mud(photos 3-4).A small hole was observed in the wall of the transfer building next to door 3(photo 5).Mr.Havemann stated that he would have these issues addressed immediately. Mr. Havemann stated that a small spill kit is maintained on the front loader and additional materials are stored in the facility's maintenance garage. Mr. Havemann and Mr. Shupryt then returned to Mr. Havemann's office.Mr. Havemann called Mr.Spalding to have the hole in the transfer building patched.Mr. Havemann emailed pictures of the temporary patch on the wall and the temporary repair to the tipping floor to Mr.Shupryt later in the day(photos 7-8).Mr. Havemann also stated in the email that the drains on the tipping floor had been cleared and an employee has been specifically tasked with clearing them daily (attachment A).
