HomeMy WebLinkAbout12-18-85 Council Meeting MinutesREGULAR MEETING DECEMBER 18, 1985 Be it remembered that the Common Council of the City of South Bend met in the Council Chambers of the County -City Building on Wednesday, December 18, at 4:30 p.m. The meeting was called to order and the Pledge to the Flag was given. ROLL CALL Present: Council Members Serge, Braboy, Puzzello, Taylor, Zakrzewski, Crone, Paszek, Voorde and Beck Absent: None REPORTS Council Member Voorde indicated that the Personnel and Finance Committee had met on Bill Nos. 131 and 142 -85. He indicated Bill No. 131 received no recommendation and Bill No. 142 received a favorable recommendation. Council Member Braboy made a motion to resolve into the Committee of the Whole, seconded by Council Member Zakrzewski. The motion carried. COMMITTEE OF THE WHOLE Be it remembered that the Common Council of the City of South Bend met in the Committee of the Whole on Wednesday, December 18, at 4:37 p.m., with nine members present. BILL NO. 131 -85 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT 914 S. IRONWOOD DRIVE IN THE CITY OF SOUTH BEND, INDIANA. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Larry Magliozzi, from Area Plan, gave the staff report. He indicated the lot is not wide enough for parking as proposed, and a different layout must be considered. He indicated if they planned to use the alley as ingress /egress the alley must be paved. Sara Talbot, the property owner, made the presentation for the bill. She indicated this property was formerly used as a dental office, however, it had been vacant for over a year and the zoning reverted to A Residential. She indicated the property is not suitable as a single family dwelling. She indicated she would like this property rezoned to C Commercial, in order that a jewelry store could open in this location. Council Member Zakrzewski made a motion to recommend this bill to the Council favorable, seconded by Council Member Puzzello. The motion carried. BILL NO. 142 -85 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT THE SOUTHWEST CORNER OF PROGRESS DRIVE AND KNOBLOCK STREET, IN THE CITY OF SOUTH BEND, INDIANA. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Larry Magliozzi, from Area Plan, gave the staff report, which was favorable. Kenneth Fedder, attorney for the petitioners, indicated this rezoning was previously passed by the Council, however, a final site plan was not submitted within a year and the zoning reverted, therefore, it was necessary to again rezone this property. Council Member Beck made a motion to recommend this bill to the Council favorable, seconded by Council Member Zakrzewski. The motion carried. BILL NO. 178 -85 A BILL TRANSFERRING $32,030.00 AMONG VARIOUS ACCOUNTS WITHIN THE SOUTH BEND WATER WORKS. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Carol Sanders, Deputy Controller, made the presentation for the bill. She indicated this was another year -end transfer that reflects the expenditures necessary to operate during 1985. Council Member Beck made a motion to recommend this bill to the Council favorable, seconded by Council Member Puzzello. The motion carried. There being no further business to come before the Committee of the Whole, Council Member Beck made a motion to rise and report to the Council, seconded by Council Member Taylor. The motion carried. BILLS, SECOND READING REGULAR MEETING DECEMBER 18, 1985 i L ORDINANCE NO. 7585 -85 AN ORDINANCE AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT 914 S. IRONWOOD DRIVE IN THE CITY OF SOUTH BEND, INDIANA. This bill had second reading. Council Member Serge made a motion to pass this bill, seconded by Council Member Voorde. The bill passed by a roll call vote of nine ayes. ORDINANCE NO. 7586 -85 AN ORDINANCE AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT THE SOUTHWEST CORNER OF PROGRESS DRIVE AND KNOBLOCK STREET, IN THE CITY OF SOUTH BEND, INDIANA. This bill had second reading. Council Member Serge made a motion to pass this bill, seconded by Council Member Taylor. The bill passed by a roll call vote of nine ayes. ORDINANCE NO. 7587 -85 AN ORDINANCE TRANSFERRING $32,030.00 AMONG VARIOUS ACCOUNTS WITHIN THE SOUTH BEND WATER WORKS. This bill had second reading. Council Member Serge made a motion to pass this bill, seconded by Council Member Puzzello. The bill passed by a roll call vote of nine ayes. BILLS, FIRST READING ORDINANCE NO. 7598 -85 AN ORDINANCE TRANSFERRING MONIES FROM VARIOUS ACCOUNTS TO VARIOUS ACCOUNTS WITHIN THE BUREAU OF VEHICLE MAINTENANCE WITHIN THE GENERAL FUND OF THE CITY OF SOUTH.BEND, INDIANA. This bill had first reading. Council Member Voorde made a motion to suspend the rules and have public hearing and second reading on this bill, seconded by Serge. The motion carried on a roll call vote of nine ayes. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Carol Sanders, Deputy Controller, made the presentation for the bill. She indicated it was necessary to pass this bill in order to correct the year -end transfers approved by the Council on December 2. Council Member Voorde made a motion to pass this bill, seconded by Council Member Puzzello. The bill passed by a roll call vote of nine ayes. BILL NO. 183 -85 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: THE FIRST EAST -WEST ALLEY RUNNING EAST FROM WARREN STREET TO GRANT STREET EXCEPTING THE INTERSECTING NORTH -SOUTH ALLEY FOR A TOTAL DISTANCE OF 240 FEET. ALL BEING IN SUMMIT 2ND ADDITION TO THE CITY OF SOUTH BEND, ST. JOSEPH COUNTY, INDIANA. This bill had first reading. Council Member Voorde made a motion to set this bill for second reading and public hearing January 13, and refer it to the Zoning and Vacation Committee, seconded by Council Member Zakrzewski. The motion carried. There being no further business to come before the Council, unfinished or new, Council Member Taylor made a motion to adjourn, seconded by Council Member Zakrzewski.
