ROLL CALL Present: Council Members Serge, Braboy, Puzzello, Taylor, Zakrzewski, Crone, Paszek, Voorde and Beck Absent: None REPORT FROM THE SUB - COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your sub - committee on the inspection and supervision of the minutes would respectfully report that it has inspected the minutes of the April 29, 1985, meeting of the Council and found them correct. The sub - committee, therefore, recommends that the same be approved. Beverlie J. Beck Ann Puzzello Thomas Zakrzewski Council Member Serge made a motion that the minutes of the April 29, meeting of the Council be accepted and placed on file, seconded by Council Member Zakrzewski. The motion carried. SPECIAL BUSINESS Council Member Serge made a motion to appoint Micki Dobski to the Mayor's Traffic Commission, seconded by Council Member Braboy. The motion carried. RESOLUTION NO. 1286 -85 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, VOICING THEIR SUPPORT FOR THE SECRETARIES OF THE SOUTH BEND SCHOOL CORPORATION. WHEREAS, the Common Council recognizes that in 1984, 90 of the 116 secretaries and clerical workers of the South Bend School Corporation voted in favor of union representation; and WHEREAS, community support in favor of the secretaries and clerical workers right to organize has gained several significant endorsements including those from: The United Religious Community, National Organization of Women, Women's International Federation, the Postal Workers, and the Labor Students Association of Indiana University at South Bend; and WHEREAS, at the last South Bend School Board meeting, the secretaries and clerical workers filed petitions bearing over 2,200 signatures supporting their position; and WHEREAS, since there is no State law addressing the right to organize for secretaries and clerical workers of the School Corporation, the Council suggests that the School Board reconsider its decision which denied the group to formally vote on joining a union. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana, as follows: SECTION I. The Common Council voices its support on behalf of the secretaries and clerical workers of the South Bend School Corporation in their continuing effort to be able to vote on joining a union. SECTION II. The Council requests that a copy of this Resolution be sent by the City Clerk's office to Loretta Jacobson, President of the School Board. SECTION III. This Resolution shall be in full force and effect from and after its adoption by the Common Council and approval by the Mayor. /s/ Joseph T. Kenneth Fedder, attorney for the Economic Development Commission, made the presentation for the bill. He indicated the purpose of this bill was to further assign this bond, which is on a current basis as to payment to bondholders, to Hoffman Brothers Auto Electric, Inc., who has assured the continuation of the business activities originally contemplated by the bond in our community. Richard Heyde, 3404 Corby, spoke on this bill. Council Member Taylor made a motion to recommend this bill to the Council favorable, seconded by Council Member Puzzello. The motion carried. BILL NO. 31 -85 A BILL AUTHORIZING THE CITY OF SOUTH BEND, INDIANA (THE "CITY "), TO ISSUE ITS "ECONOMIC DEVELOPMENT REVENUE BOND, SERIES 1985 (MURPHY MOTOR FREIGHT LINES, INC. PROJECT), IN THE AGGREGATE PRINCIPAL AMOUNT OF ONE MILLION TWO HUNDRED EIGHTY THOUSAND DOLLARS (1,280,000.00) AND APPROVING AND AUTHORIZING CERTAIN ACTIONS WITH RESPECT THERETO. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Council Member Voorde made a motion to accept the substitute bill on file with the City Clerk, seconded by Council Member Zakrzewski. The motion carried. Kenneth Fedder, attorney for the Economic Development Commission, made the presentation for the bill. He indicated this bond issued would be used to construct improvements to their present facility. He indicated they anticipated 50 -60 new jobs will be created within the next three years. Council Member Zakrzewski made a motion to recommend this bill to the Council favorable, as amended, seconded by Council Member Taylor. The motion carried. BILL NO. 32 -85 A BILL AUTHORIZING THE CITY OF SOUTH BEND, INDIANA (THE "CITY "), TO ISSUE ITS "ECONOMIC DEVELOPMENT REVENUE BOND, SERIES 1985 (3300 SAMPLE STREET ASSOCIATES PROJECT), IN THE AGGREGATE PRINCIPAL AMOUNT OF TWO MILLION DOLLARS ($2,000,000.00) AND APPROVING AND AUTHORIZING CERTAIN ACTIONS WITH RESPECT THERETO. Council Member Taylor made a motion to continue public hearing and second reading on this bill indefinitely, seconded by Council Member Zakrzewski. The motion carried. BILL NO. 13 -85 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT 1117 W. WESTERN AVE., IN THE CITY OF SOUTH BEND, INDIANA. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Larry Magliozzi, from Area Plan, gave the staff report, which was favorable. Sam Mercantini, the petitioner, made the presentation for the bill. He indicated he planned to rehab this building. He indicated that since the building had not been used in years the zoning had reverted. He indicated the building would be used for mixed use - residential on the second floor and commercial offices and businesses on the ground floor. Council Member Voorde made a motion to recommend this bill to the Council favorable, seconded by Council Member Zakrzewski. Later on in the meeting a motion to reconsider was made in order to vote on an amended version of this bill. BILL NO. 22 -85 A BILL ANNEXING AND BRINGING WITHIN THE CITY LIMITS OF SOUTH BEND, INDIANA, CERTAIN LAND LOCATED IN PENN TOWNSHIP, ST. JOSEPH COUNTY, INDIANA. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Jerry Speedy, representing Edward Rose of Indiana, made the presentation for this bill. He indicated they planned to build apartments at this site. He indicated if the property was not rezoned the owner of the property would not want it annexed. Council Member Beck made a motion to recommend this bill to the Council favorable, seconded by Council Member Puzzello. BILL NO. 24 -85 A BILL DESIGNATING AND ESTABLISHING AN HISTORIC LANDMARK UNDER ORDINANCE NO. 5565 -68, AMENDING ORDINANCE NO. 4990 -68, AS AMENDED, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND. (716 W. COLFAX) This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. John Oxian, Vice President of Historic Preservation, made the presentation for the bill. He indicated this home ranked an 11. He indicated it was built in 1880 and moved into the West Washington Historic District. BILL NO. 28 -85 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: THE FIRST ALLEY EAST OF FRANCIS STREET RUNNING NORTH FROM CORBY STREET FOR A DISTANCE OF 205 FEET TO THE SOUTH LINE OF THE VACATION RESOLUTION NO. 2998 (ALL BEING SORIN'S SECOND ADDITION TO THE TOWN OF LOWELL, NOW WITHIN AND A PART OF THE CITY OF SOUTH BEND, INDIANA). He indicated this alley was located between Goodwill and a car wash. He indicated a portion of this alley was already vacated. BILL NO. 10 -85 A BILL OF THE CITY OF SOUTH BEND, INDIANA, ESTABLISHING DEFERRED COMPENSATION PLAN (S). This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Council Member Puzzello made the presentation for the bill. Council Member Beck made a motion to accept the amended version of the bill on file with the City Clerk, seconded by Council Member Zakrzewski. The motion carried. Council Member Puzzello indicated that this deferred compensation plan was a way to save money and a tax reduction plan for City employees. Council Member Zakrzewski made a motion to recommend this bill, as amended, to the Council favorable, seconded by Council Member Braboy. The motion carried. BILL NO. 27 -85 A BILL AMENDING CHAPTER 2, ARTICLE 6, OF THE SOUTH BEND MUNICIPAL CODE, ENTITLED TAX ABATEMENT PROCEDURES. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Council Member Beck made a motion to accept the substitute bill on file with the City Clerk, seconded Council Member Zakrzewski. The motion carried. Kathy Cekanski- Farrand, Council Attorney, made the presentation for the bill. She indicated this bill would correct the legal description for the tax abatement areas, as well as make two minor amendments. She indicated the first amendment would be that the 100 new permanent jobs be created within 18 months of the adoption of the confirming resolution; the second would place a six month waiting period in effect for petitioners who were denied tax abatement and wish to repetition. Council Member Voorde made a motion to recommend this bill, as amended to the Council favorable, seconded by Council Member Zakrzewski. The motion carried. BILL NO. 33 -85 A BILL APPROPRIATING $81,000.00 FROM THE LOCAL ROAD AND STREET FUND TO PROJECT R &S 8506, SR 23 AND OLIVE STREET WIDENING AND SIGNALIZATION. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. John Leszczynski, City Engineer, made the presentation for the bill. He indicated this appropriation would be used for widening and signalization for State Road 23 and Olive Road. Marty Steinhofer, 725 Fairway, Hildy Zemlyak, 1903 Franklin, Susan Hamilton, 3429 Locust Rd., Gene Minnick, 1922 Kemble, spoke in favor of this appropriation. Council Member Zakrzewski made a motion to recommend this bill to the Council favorable, seconded by Council Member Voorde. The motion carried. BILL NO. 34 -85 A BILL APPROPRIATING $20,00.00 FROM THE LOCAL ROAD AND STREET FUND TO PROJECT R &S 8505 ISLAND REMOVAL ON SAMPLE WEST OF CHAPIN WITHIN THE LOCAL ROAD AND STREET FUND. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. John Leszczynski, City Engineer, made the presentation for the bill. He indicated this appropriation would be used for removal of the island on Sample, west of Chapin. Council Member Zakrzewski made a motion to recommend this bill to the Council favorable, seconded by Council Member Paszek. The motion carried. BILL NO. 35 -85 A BILL APPROPRIATING $21,000.00 FROM THE CUMULATIVE SEWER BUILDING AND SINKING FUND TO PROJECT CS 829 RIVERSIDE DRIVE SEWER, WITHIN THE CUMULATIVE SEWER BUILDING AND SINKING FUND. REGULAR MEETING MAY 13, 1985 This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. John Leszczynski, City Engineer, made the presentation for the bill. He indicated this appropriation would be used for engineering services for the Riverside Drive sewer. He indicated the construction of this sewer has been ordered by the Health Department. BILL NO. 36 -85 A BILL APPROPRIATING $35,000.00 FROM THE LOCAL ROAD AND STREET FUND TO PROJECT R &S 8501, JEFFERSON STREET AND EDDY STREET REALIGNMENT. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. John Leszczynski, City Engineer, made the presentation for the bill. He indicated this appropriation would be used for intersection realignment at Eddy and Jefferson. Council Member Beck made a motion to recommend this bill to the Council favorable, seconded by Council Member Puzzello. The motion carried. BILL NO. 37 -85 A BILL APPROPRIATING $400,000.00 FROM THE LOCAL ROAD AND STREET FUND TO PROJECT R &S 8502 1985 RESURFACING PROJECT, WITHIN THE LOCAL ROAD AND STREET FUND. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. John Leszczynski, City Engineer, made the presentation for the bill. He indicated this appropriation would be used for the cost of the resurfacing program for 1985. Council Member Zakrzewski made a motion to recommend this bill to the Council favorable, seconded by Council Member Taylor. The motion carried. BILL NO. 38 -85 A BILL APPROPRIATING $110,000.00 FROM THE LOCAL ROAD AND STREET FUND TO PROJECT R &S 8503 WIDENING AND RECONSTRUCTION OF TWYCKENHAM DRIVE FROM MCKINLEY AVENUE TO SR 23 WITHIN SOUTH BEND, WITHIN THE LOCAL ROAD AND STREET FUND. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. John Leszczynski, City Engineer, made the presentation for the bill. He indicated this appropriation would be used for the cost of the widening, reconstruction and possible signalization on Twyckenham from McKinley to State Road 23. Andy Toth, 3505 Springbrook Drive, spoke in favor of this bill. Council Member Beck made a motion to recommend this bill to the Council favorable, seconded by Council Member Zakrzewski. The motion carried. BILL NO. 39 -85 A BILL APPROPRIATING $150,000 FROM THE LOCAL ROAD AND STREET FUND TO PROJECT R &S 8504, CONCRETE IMPROVEMENTS, WITHIN THE LOCAL ROAD AND STREET FUND. This being the time opponents were given the presentation for cost of the concrete bill to the Council carried. BILL NO. 40 -85 heretofore set for public hearing on the above bill, proponents and an opportunity to be heard. John Leszczynski, City Engineer, made the bill. He indicated this appropriation would be used for the improvements. Council Member Beck made a motion to recommend this favorable, seconded by Council Member Zakrzewski. The motion PUBLIC HEARING ON A BILL APPROPRIATING $25,000.00 FROM THE CUMULATIVE SEWER BUILDING AND SINKING FUND TO PROJECT CS 828 INLET RECONSTRUCTION, WITHIN THE CUMULATIVE SEWER BUILDING AND SINKING FUND. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. John Leszczynski, City Engineer, made the presentation for the bill. He indicated this appropriation would be used for the cost of inlet reconstruction. Council Member Voorde made a motion to recommend this bill to the Council favorable, seconded by Council Member Zakrzewski. The motion carried. There being no further business to come before the Committee of the Whole, Council Member Beck made a motion to rise and report to the Council, and recess, seconded by Council Member Crone. RESOLUTIONS RESOLUTION NO. 1288 -85 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, URGING THE CITY ADMINISTRATION TO PROVIDE LEADERSHIP IN AMICABLY RESOLVING THE CURRENT NOISE AND ODOR PROBLEMS OF THE ETHANOL PLANT. REGULAR MEETING MAY 131 1985 WHEREAS, the Common Council of the City of South Bend, Indiana, is very much aware of the public concerns being voiced about current noise and odor problems of the ethanol plant; and WHEREAS, the Council is also very concerned that the New Energy Corporation be given adequate time to investigate and implement changes which are deemed necessary to correct their current problems; and WHEREAS, because the Council believes that the City must strike a reasonable balance between the concerns of our citizens and those of the economic and business community in order that continued progress be made in our City; and WHEREAS, the Council recognizes that the ultimate authority in this area rests with the City administration, and therefore encourages it to cooperate with the Council and the Technical Committee so that it will provide the leadership necessary to amicably resolve the current noise and odor problems of the ethanol plant in a timely manner; and WHEREAS, The Council ultimately believes that through the spirit of cooperation, the City Administration will be able to protect our high quality of life and encourage the New Energy Corporation to take all steps necessary to resolve their noise and odor problems. NOW, THEREFORE BE IT RESOLVED by the Common Council of the City of South Bend, Indiana, as follows: SECTION I. The Common Council urges the City Administration to continue to work through the Mayor's Technical Committee to timely resolve the current noise and odor problems of the ethanol plant. SECTION II. Since the Council realizes that the ultimate authority in this area rests with the City Administration, it requests that in the event that the problems are not resolved, that it investigate what legal action may be most appropriate in order to protect the high quality of life in our community.
