AMENDMENT TO OWNER-ENGINEER AGREEMENT Amendment No. __3_ 1. Background Data: a. Effective Date of Owner-Engineer Agreement: October 10, 2023 b. Owner: Board of Public Works, City of South Bend, Indiana c. Engineer: United Consulting d. Project: Edison WTP Improvements, 123-067 2. Description of Modifications: [NOTE TO USER: Include the following paragraphs that are appropriate and delete those not applicable to this amendment. Refer to paragraph numbers used in the Agreement or a previous amendment for clarity with respect to the modifications to be made. Use paragraph numbers in this document for ease of reference herein and in future correspondence or amendments.] This amendment is to expand the solids dewatering process to include a solids settling/thickening application, sludge holding tank, dewatering application, chemical addition, and estimated 4,200 square foot building addition to effectively dewater backwash sludge for landfill disposal. This is supported by two different arsenic biosolids reports conducted for the Owner by others (Impact of Arsenic in Biosolids at the WWTP, March 2009 and Arsenic Removal Study, April 2011), as well as current feedback from dewatering equipment manufacturers and recommendations from United Consulting’s preliminary design. a. Engineer shall perform or furnish the following Additional Services: 1) Coordinate on-site chemical testing by others and with Owner to determine effective treatments for the settling/thickening process as well as the dewatering application. 2) Coordinate on-site pilot test with Fournier filter press simulator to establish anticipated equipment cycle time, cake dryness, cake density, cake thickness, and cloth selection for the dewatering equipment. 3) Coordinate sample testing through the Owner for on-site testing. 4) Coordinate the collection and submission of water samples to the equipment manufacturers Parkson and Fournier for their analysis and detailed product recommendations. 5) Coordinate sample collection and delivery to EP Minerals for testing of the precoat process with pressure filtration and their analysis and detailed product recommendations. All rights reserved. 6) Coordinate sample collection with equipment manufacturers Parkson, Fournier, and EP Minerals to submit samples for analysis to outside laboratories. 7) Assemble data from testing and identify associated costs for the solids handling process to analyze and compare treatment processes based on performance and cost. 8) Present findings and discuss recommendations with the Owner for approval at a Coordination Meeting. 9) Prepare Technical Memorandum to document testing and results. 10) Perform or provide the following additional Design Phase tasks or deliverables a) Process design and construction sequencing requirement preparation relating to the WTP operation. b) Hydraulic calculations and design for the proposed pumping and piping systems related to the solids dewatering application. c) Mechanical, electrical, and plumbing (MEP) design incidental to the solids dewatering process design. d) Structural design services incidental to the solids dewatering process design. e) Design services and plan generation necessary for permitting, bidding (or GMP process), and construction. f) Coordination with equipment suppliers and manufacturers. g) Professional architectural design of the solids dewatering building addition to complement the existing facility with similar design features and materials. The building addition is anticipated to be up to 4,200 square feet with height up to twice the existing building to accommodate new equipment. h) Submit plans to the Department of Homeland Security for Construction Design Release. b. The responsibilities of Owner are modified as follows: 1) Assist with scheduling on-site chemical testing as well as aid in water sample collections for testing purposes. 2) Assist with sample collection and analysis either internally or through an outside lab. 3) Testing and lab fees from equipment vendors. 4) Geotechnical analysis including soil borings and report. 5) Local permitting including zoning and variances. 6) Permit application fees and costs. c. For the Additional Services or the modifications to services set forth above, Owner shall pay Engineer the following additional or modified compensation: 1) Solids Dewatering Process and Building Addition (Lump Sum): $309,675 d.
