ROLL CALL Present: Council Members Serge, Braboy, Puzzello, Taylor, Zakrzewski, Crone, Paszak, Voorde and Beck Absent: None REPORT FROM THE SUB - COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your sub - committee on the inspection and supervision of the minutes would res- pectfully report that it has inspected the minutes of the June 11, 1984, meeting of the Council and found them correct. The sub- committee, therefore, recommends that the same be approved. Isl Beverlie J. Beck 4s4Ann Puzzello /s /Thomas Zakrzewski Council Member Serge made a motion that the minutes of the June 11, 1984, meeting of the Council be accepted and placed on file, seconded by Council Member Puzzello. The motion carried. SPECIAL BUSINESS Charles Minkler, Executive Director of Macog gave a presentation on the transporation update South Bend - Mishawaka urbanized area. REPORTS Council Member Braboy indicated that the Human Resources Committee met to discuss tax abatement procedures. Council Member Voorde made a motion to combine Public Hearing on Resolutions 6A and 6B, seconded by Council Member Crone. The motioned carried. RESOLUTION NO. 1168 -84 A RESOLUTION CONFIRMING THE ADOPTION OF A DECLARATORY RESOLUTION DESIGNATING CERTAIN AREAS WITHIN THE CITY OF SOUTH BEND, COMMONLY KNOWN AS 2722 TUCKER DRIVE TO BE AN ECONOMIC REVITALIZATION AREA FOR PURPOSES OF _TAX ABATEMENT. WHEREAS, the Common Council of the City of South Bend has adopted a Declaratory Resolution designating certain areas within the City as Economic Revitalization Areas for the purpose of tax abatement consideration; and WHEREAS, a Declaratory Resolution designated the area commonly known as 2722 Tucker Drive, South Bend, Indiana, and more particularly described by a line drawn as follows: A part of the South 1/2. o:f.. th.e Nor.thwest.,1 /4 of Section 15, Township. 37. North, Range 2 East in the City of South Bend,`Indiana, described as follows: Beginning at a point on the East Line of the Southwest 1/4 of said Section 15, 580.64 feet South of the Northeast corner of said Southwest 1/4 of the Northwest 1/4, said point being 172.0 feet North of the North right -of -way line of the Indiana Northern Railway Company; thence Westerly parallel with said North right -of -way line 565 feet to the Southwest corner of a tract of land conveyed to Stanley Enterprises, Inc. by a deed recorded October 16, 1973 in Deed Record 777, Page 226; thence North along the West line of said Stanley Enterprises, Inc. tract, said line being parallel with the East line of said Southwest 1/4 of the Northwest 1/4, 323.0 feet to the South line of Tucker Drive; thence West along the South line of Tucker Drive 215.93 feet; thence South parallel with said East line of the Southwest 1/4 of the Northwest 1/4, 495.90 feet to the North right -of -way line of the Indiana Northern Railway Company; thence Easterly along said North right -of -way line, 860.23 feet to the West edge of Steel Warehouse Co. Subject to all easements of record. as an Economic Revitalization Area; and WHEREAS, notice of the adoption of a Declaratory Resolution and the public hearing before the Council has been published pursuant to Indiana Code 6-1.1- 12.1 -2- 5; and REGULAR MEETING JUNE 25, 1984 WHEREAS, the Council held a public hearing for the purposes of hearing all remonstrances and objections from interested persons; and WHEREAS, the Council has determined that the qualifications for an economic revitalization area have been met. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana, as follows: SECTION I. That the Common Council hereby confirms its Declaratory Resolution designating the area described herein as an Economic Revitalization Area for the purposes of tax abatement. Such designation is for personal property tax abatement only and is limited to five (5) calendar years from the date of adoption of a Declaratory Resolution by the Common Council. SECTION II. This Resolution shall be in full force and effect from and after its adoption by the Common Council and approval by the Mayor. RESOLUTION NO. 1169 -84 /s /Beverlie J. Beck Member of the Common Council REGULAR MEETING JUNE 25, 1984 A public hearing was held on the resolutions at this time. Gerald Lerman, of Steel Warehouse, indicated these two abatements would be used to purchase machinery that will strengthen the competitive position of this. He indicated that approximately 15 new jobs.will be created. Council Member Taylor made a motion to adopt Resolution No. 1168 -84, seconded by Council Member Serge. The resolution was adopted by a roll call vote of nine ayes. Council Member Taylor made a motion to adopt Resolution No. 1169 -84, seconded by Council Member Zakrzewski. The resolution was adopted by a roll call vote of nine ayes. RESOLUTION NO. 1170 -84 A RESOLUTION CONFIRMING THE ADOPTION OF A DECLARATORY RESOLUTION DESIGNATING CERTAIN AREAS WITHIN THE CITY OF SOUTH BEND, COMMONLY KNOWN AS 620 EAST BRONSON TO BE AN ECONOMIC REVITALIZATION AREA FOR PURPOSES OF TAX ABATEMENT. WHEREAS, the Common Council of the City of South Bend has adopted a Declaratory Resolution designating certain areas within the City as Economic Revitalization Areas for the purpose of tax abatement consideration; and WHEREAS, a Declaratory Resolution designated the area commonly known as 630 East Bronson, South Bend, Indiana, and more particularly described by a line drawn as follows: A parcel of land being a part of Lots 91 -98 and 99 -106 J. Rush's 4th Addition, and part of Lots 124, 125 and 132, E. H. Rush's Addition, City of South Bend, Indiana, and being more particularly described as follows: Beginning at the intersection of the new South right -of -way line of Bronson Street (60 feet R/W) and the centerline of the now vacated Clinton Street; thence South 890- 49100" East along the new South right -East, a measured distance of 28.35 feet to the new West right -of -way line of Marietta Street (60 feet R/W); thence South 0003'24" East along said West right -of -way line of Marietta Street, a measured distance of 359.00 feet; thence North 89049100" West, a measured distance of 269.02 feet to the centerline of the now vacated Clinton Street; thence North 0- 03' -24" Westalong said centerline of now vacated Clinton Street, a measured distance of 379.00 feet to the place of beginning containing 2.3361 acres more or less. Subject to any easements convenants, or restrictions of record. as an Economic Revitalization Area; and WHEREAS, notice of the adoption of a Declaratory Resolution and the public hearing before the Council has been published pursuant to Indiana Code 6-1.1- 12.1 -2- 5; and WHEREAS, the Council held a public hearing for the purposes of hearing all remonstrances and objections from interested persons; and WHEREAS, the Council has determined that the qualifications for an economic revitalization area have been met. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the CIty of South Bend, Indiana. as follows: SECTION I. Beck Member of the Common Council A public hearing was held on the resolution at this time. Kevin Butler, attorney, indicated this was a reaffirmation of a resolution passed earlier by the Council. He indicated they planned to construct a new facility in the Monroe /Sample area. Council Member Serge made a motion to pass this bill, seconded by Council Member Taylor. The resolution was passed by a roll call vote of nine ayes. RESOLUTION NO. 1171 -84 A RESOLUTION CONFIRMING THE ADOPTION OF A DECLARATORY RESOLUTION DESIGNATING CERTAIN AREAS WITHIN THE CITY OF SOUTH BEND, COMMONLY KNOWN AS 115 W. COLFAX TO BE AN ECONOMIC REVITALIZATION AREA FOR PURPOSES OF TAX ABATEMENT. WHEREAS, the Common Council of the City of South Bend has adopted a Declaratory Resolution designating certain areas within the City as Economic Revitalization Areas for the purpose of tax abatement consideration; and WHEREAS, a Declaratory Resolution designated the area commonly known as 115 W. Colfax, South Bend, Indiana, and more particularly described by a line .drawn as follows: REGULAR ,MEETING JUNE 25, 1984 PARCEL I. A lot or parcel of land 66 feet in width, East and West, taken off of aana--Tr-om the entire length of the East end of Lot Number 7 as shown on the Original Plat of the Town, now City, of South Bend, St. Joseph County, Indiana. PARCEL II: Part of Lot Numbered 8 in; -the Original Plat of the Town,,now City, of South Bend, St. Joseph County, Indiana, described as follows: Beginning at the Southeast corner of said Lot Numbered 8; thence West 88.33 feet along the South line of said Lot Numbered 8 to a point East 77.29 feet of the Southwest corner of Lot Numbered 8; thence North 35 feet; thence East 88.34 feet to the East line.of Lot Numbered 8; thence South 35 feet to the point of beginning. SECTION I. That the Common Council hereby confirms its Declaratory Resolution designating the area described herein as an Economic Revitalization Area for the purposes of tax abatement. Richard Morgan, attorney for the petitioner, indicated this project will involve the renovation and restoration of a downtown historic structure. He idnicated 18 new permanent jobs will be created, as well as maintaining 22 existing jobs. Council Member Zakrzewski made a motion to adopt this resolution, seconded by Council Member Puzzello. The resolution was adopted by a roll call vote of nine ayes. Council Member Taylor made a motion to combine public hearing on rsolutions 6E and F, seconded by Council Member Zakrzewski. The motion carried. RESOLUTION NO. 1172 -84 A RESOLUTION CONFIRMING THE ADOPTION OF A DECLARATORY RESOLUTION DESIGNATING CERTAIN AREAS WITHIN THE CITY OF SOUTH BEND, COMMONLY KNOWN AS SOUTHWEST CORNER OF OLD CLEVELAND ROAD AND KENMORE STREET TO BE AN ECONOMIC REVITALIZATION AREA FOR PURPOSES OF TAX ABATEMENT. Richard Morgan, attorney for the petitioner, indicated this company will be using the real and personal property tax abatement to building a facility for the manufacture of components for the electronics industry. He indicated the company will initially employ 16 to 24 people, and eventually they will probably employ 110 to 215 people. Howard Bessire, Director of the Industrial Foundation, spoke in favor of these abatements. Council Member Serge made a motion to adopt Resolution No. 1172 -84, seconded by Council Member Puzzello. The resolution was adopted by a roll call vote of nine ayes. Council Member Serge made a motion to adopt Resolution No. 1173,`seconded'by Council Member Taylor. The resolution was adopted by a roll call vote of nine ayes. Council Member Puzzello made a motion to combine public hearing on resolutions 6G and H, seconded by Council Member Taylor. The motion carried. WHEREAS, the Common Council of the City of South Bend has adopted a Declaratory Resolution designating certain areas within the City as Economic Revitalization Areas for the purpose of tax abatement consideration; and WHEREAS, a Declaratory Resolution designated the area commonly known as 3515 Boland Drive,South Bend, Indiana, and more particularly described by a line drawn as follows: Commencing at the southeast corner of said quarter section; thence South 89 degrees 58 minutes 56 seconds West 1200.00 feet; thence North 0 degrees 00 minutes 23 seconds East 120 feet to the point of beginning of this description: thence South 89 degrees 58 minutes 56 seconds West 329.55 feet along the north line of Boland Drive; thence North 0 degrees 00 minutes 23 seconds East 385.00 feet; thence North 89 degrees 58 minutes 56 seconds East 339.55 feet; thence South 0 degrees 00 minutes 23 seconds West 375.00 feet long the West line of Kenmore Street; thence South 44 degrees 59 minutes 40 seconds West 14.15 feet to the point of beginning, containing 3.000 acres, more or less. The bearing of the south line of the Southeast Quarter of Section 28 is assumed North 90 degrees 00 minutes 00 seconds West. as an Economic Revitalization Area; and WHEREAS, notice of the adoption of a Declaratory Resolution and the public hearing before the Council has been published pursuant to Indiana Code 6-1.1- 12.1 -2- 5; and WHEREAS, the Council held a public hearing for the purposes of hearing all remonstrances and objections from interested persons; and WHEREAS, the Council has determined that the qualifications for an economic revitalization area have been met. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the CIty of South Bend, Indiana, as follows: SECTION I. That the Common Council hereby confirms its Declaratory Resolution designating the area described herein as an Economic Revitalization Area for the purposes of tax abatement. Such designation is for personal property tax abatement only and is limited to five (5) calendar years from the date of adoption of a Declaratory Resolution by the Common Council. SECTION II. The Rental Rebahilitation Program is authorized by Section 17 of the Act which has enacted into law in Section 301 of the Housing and Urban -Rural Recovery Act of 1983. He indicated this $1,650,000.00 bond issue would be used to purchase land and construct a facility in the Monroe.Park Revedevlopment Area.
