HomeMy WebLinkAbout02-27-84 Council Meeting MinutesREGULAR MEETING FEBRUARY 27, 1984 Be it remembered that the Common Council of the City of South Bend met in the Council Chambers of the County -City Building on Monday, February 27, 1984, at 7:00 p.m. The meeting was called to order and the Pledge to the Flag was given. ROLL CALL Present: Council Members Serge, Braboy, Puzzello, Taylor, Zakrzewski, Crone, Paszak, Voorde and Beck Absent: None REPORT FROM THE SUB - COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your sub - committee on the inspection and supervision of the minutes would res- pectfully report that it has inspected the minutes of the February 13,1984, meeting of the Council and found them correct. The sub - committee, therefore, recommends that the same be approved. /s/ Beverlie J. Beck /s/ Beverly D. Crone Council Member Serge made a motion that the minutes of the February 13, 1984, meeting of the Council be accepted and placed on file, seconded by Council Member Taylor. The motion carried. SPECIAL BUSINESS Peter Mullen was appointed to the Urban Enterprise Association. Council President Beck indicated there will be a Council meeting Friday, at 12:30 p.m., March 2. REPORTS Council Member Taylor indicated that the Public Safety Committee had met on Bill No. 6 -84 and recommended it favorable, as amended. Council Member Taylor made a motion to resolve into the Committee of the Whole, seconded by Council Member Crone. The motion carried. COMMITTEE OF THE WHOLE Be it remembered that the Common Council of the City of South Bend met in the Committee of the Whole on February 27, 1984, at 7:05 p.m., with nine members present. Chairman Serge presiding. BILL NO. 6 -84 A BILL AMENDING CHAPTER 6 OF THE SOUTH BEND MUNICIPAL CODE, ENTITLED BUILDINGS, AND DELETING CHAPTER 8, ARTICLE 1 THROUGH 6 OF THE SOUTH BEND MUNICIPAL CODE. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Katherine Barnard, Director of Code Enforcement, made the presentation for the bill. Council Member Voorde made a motion to accept the substitute bill on file with the City Clerk, seconded by Council Member Puzzello. The motion carried. Mrs. Barnard indicated that this bill had been approved by the State Administrative Building Council. She gave a review of the bill. Council Member Crone made a motion to amend the bill on page 2, Section 6 -4 -.3 (a) in the fourth sentence by striking the words "or in a closely related field ", seconded by Council Member Voorde. The motion carried. Council Member Taylor made a motion to recommend this bill to the Council favorable, as amended, seconded by Council Member Zakrzewski. The motion carried. Council Member Taylor made a motion to combine public hearing on th next three bills, seconded by Council Member Beck. The motion carried. BILL NO. 10 -84 A BILL SETTING THE ANNUAL SALARY FOR THE MAYOR FOR CALENDAR YEARS 1985, 1986, 1987, AND 1988. BILL NO. 11 -84 A BILL SETTING THE ANNUAL SALARY OF THE CITY CLERK FOR CALENDAR YEARS 1985, 1986, 1987 AND 1988. BILL NO. 12 -84 A BILL SETTING THE ANNUAL SALARY FOR THE MEMBERS OF THE COMMON COUNCIL FOR THE CALENDAR YEARS 1985, 1986, 1987 and 1988. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Council President Beck made the presentation for the bills. She indicated his bill proposed a realistic mayoral REGULAR MEETING FEBRUARY 27, 1984 salary schedule. She indicated that after a review of salaries of executive directors of community service organizations in our area, the mayor presently makes substantially less per year. She indicated this bill should help to ease another problem, that of salary compression. This effects the City's ability to hire and retain quality staff members. She indicated that City Clerk's salary ranked fourth from the bottom, out of eighty -nine reporting municipalities throughout the nation, as well as second from the bottom out of nineteen midwest cities. She indicated this proposed salary for 1985 is still more than 10% below the average salary paid to city clerks in other midwestern municipalities of our size. She indicated this bill begins the process of bringing the City Clerk's salary into parity with the salaries of other City Clerks in midwestern cities, and more importantly, with department heads within our own City. She indicated that the unrealistically low salary of the city Clerk is causing salary compression with some of the staff working under the Clerk coming very close in salary. She indicated the bill establishing the annual salary for members of the Common Council would begin to reflect the increase in the responsibilities and workload of a Council Member, as well as the cost of living since the base year 1967. She indicated that Council members find themselves in the role of "clearing house directors" dealing with problems unrelated to their ususally defined councilmanic roles. She indicated that Council work necessitates time off work, uncompensated; yet it is important that the Council continue to refect members from all walks of life. She indicated that by adequately compensating members of the Council, we are assuring that all citizens an afford to participate in City government, not just those who are independently wealthy. She asked the Council for a favorable recommendation of these bills. Michael Vance, City Controller, spoke in favor of all three salary bills. Irene Gammon, City Clerk, indicated that when the salary for the clerk was reduced in 1972, the was the only city in the State that reduced the clerk's salry, as a result of the loss of the City Court. She indicated that the amount of work and responsibility her office provides has more than doubled in the past 12 years. She indicated that according to the 1984 salary ordinance there are 135 positions which are paid over $18,500, plus many are provided a car. She indicated this is not so much a salary increase for her, as it is a salary adjustment. Irene Mutzl, 320 Parkovash, spoke in favor of Bill No. 11 -84, and against bill nos. 10 and 11 -84. Dominic DaCasta, 754 N. Cottage Grove, spoke in favor of Bill No. 11 -84; Katherine Guentert, 106 Fremont, spoke in favor of Bill No. 11 -84; Walter Szymkowiak, 719 N. Johnson, indicated the Clerk should receive an increase, but not as much as proposed. He spoke against an increase for the Mayor and Council. Gene Gundeck, 725 Clearview spoke in favor of Bill No. 11 -84. Jean Gundeck, 725 Clearview, spoke against these bills. Chuck Voreis, 2521 York Road, spoke against the bills. Dominic DaCasta, 754 N. Cottage Grove, spoke against the increases for the mayor and Council. Katherine Guentert, 1606 Fremont, spoke against the increase for the mayor and Council. E. J. Richards, 225 S. William, indicated that the mayor's salary should be cut, the City Clerk should be increased 50% and the president of the Council should be increased 50 %. Patrick Rippey, 2716 Thunderbird, spoke against these bills. Michelle Wydrzynwski, 1530 E. McKinley, spoke against these increases. Council Member Voorde made a motion to strike the 1988 salary from each of these bill, seconded by Council Member Crone. The motion failed on a roll call vote of two ayes (Council Member Crone and Voorde) and seven nays. Council Member Crone asked the Council to delay these increases until budget time. Council Member Beck made a motion to recommended Bill No. 10 -84 to the Council favorable, seconded by Council Member Taylor. The motion carried on a roll call vote of seven ayes and two nays (Council Members Crone and Voorde.) Council Member Taylor made a motion to recommend Bill No. 11 -84 to the Council favorable, seconded by Council Member Puzzello. The motion carried on a roll call vote of seven ayes and two nays (Council Members Crone and Voorde.) Council Member Puzzello made'a motion to recommend Bill No. 12 -84 to the Council favorable, seconded by Council Member Beck. The motion carried on a roll call vote of six ayes and three nays (Council members Taylor, Crone and Voorde.) There being no further business to Member Beck made a motion to rise Council Member Taylor. ORDINANCE NO. 7304 -84 AN ORDINANCE AMENDING CHAPTER 6 OF THE SOUTH BEND MUNICIPAL CODE, ENTITLED BUILDINGS, AND DELETING CHAPTER 8, ARTICLE 1 THROUGH 6 OF THE SOUTH BEND MUNICIPAL CODE. This bill had second reading. Council Member Taylor made a motion to amend this bill, as amended in the Committee of the Whole, seconded by Council Member Crone. The motion carried. Council Member Taylor made a motion to pass this bill, as amended, seconded by Council Member Puzzello. The bill passed by a roll call vote of nine ayes. REGULAR._. MEETING _ -FEBRUARY .2.7•.1984 ORDINANCE NO. 7305 -84 AN ORDINANCE SETTING THE ANNUAL SALARY FOR THE MAYOR FOR CALENDAR YEARS 1985, 1986, 1987, AND 1988. This bill had second reading. Council Member Taylor made a motion to pass this bill, seconded by Council Member Serge. The bill passed by a roll call vote of seven ayes and two nays (Council Members Crone and Voorde.) ORDINANCE NO. 7306 -84 AN ORDINANCE SETTING THE ANNUAL SALARY OF THE CITY CLERK FOR CALENDAR YEARS 1985, 1986, 1987 AND 1988. This bill had second reading. Council Member Taylor made a motion to pass this bill, seconded by Council Member Serge. The bill passed by a roll call vote of seven ayes and two nays (Council Members Crone and Voorde.) ORDINANCE NO. 7301 -84 AN ORDINANCE SETTING THE ANNUAL SALARY FOR THE MEMBERS OF G„ THE COMMON COUNCIL FOR THE CALENDAR YEARS 1985, 1986, 1987 'y and 1988. This bill had second reading. Council Member Serge made a motion to pass this bill, seconded by Council Member Puzzello. The bill passed by a roll call vote of six ayes and three nays (Council Members Taylor, Crone and Voorde.) RESOLUTIONS RESOLUTION NO. 1120 -84 AN INDUCEMENT RESOLUTION RELATING TO THE FINANCING OF ECONOMIC DEVELOPMENT FACILITIES FOR CLARK EQUIPMENT REALTY CORPORATION. WHEREAS, at the present time there are insufficient employment opportunities and insufficient diversification of business, commerce and industry in and near the City of South Bend, Indiana (the "City "); and WHEREAS, the economic welfare of the City would be benefited by the acquisition and construction of economic development facilities pursuant to the provisions of Indiana Code 36 -7 -12 (the "Act "); and WHEREA, Clark Equipment Realty Corporation (the "Company "), proposes to acquire and construct economic development facilities as defined in the Act if the City will finance costs of such economic development facilities pursuant to the Act; NOW, THEREFORE, The Common Council of the City of South Bend, Indiana resolves as follows: 1. The Project constitutes economic development facilities which may be financed by the City through the issuance of revenue bonds pursuant to the Act, and the City is willing upon compliance with all provisions of Indiana law to authorize the issuance of its revenue bonds in an amount of approximately $1,5501000 (or such lesser amount as may be agreed upon), which bonds will not be general obligations of the City but will be payable solely from the limited sources authorized and permitted by the Act. 2. The proposed financing will be of benefit to the economic welafare of the City and will comply with the purposes and provisions of the Act. 3. The Company may proceed with acquisition and construction of the economic development facilities in reliance upon this resolution. 4. The liability and obligation of the South Bend Ecnomic Development Commission, the south Bend Common Council and the City of South Bend, Indiana, shall be limited solely to the good faith efforts to consummate such proceedings and issue such bonds, and the South Bend Economic Development Commission, South Bend Common Council and the City of South Bend, Indiana, their officers or agents, shall not incur any liability if for any reason the proposed issuance of such bonds is not consummated. This Inducement Resolution shall be in full force and effect from and after its adoption by the Common Council and approval by the Mayor. /s/ Beverlie J. Beck Member of the Common Council A public hearing was held on the resolution at this time. Kenneth Fedder, attorney for the Economic Development Commission, indicated that Clark Realty proposes to develop and construct for C.I.T. a computer center in northwest South Bend, on unimproved land recently purchased by C.I.T. He indicated this center will create about twenty - five new jobs. Council Member Serge made a motion to adopt this resolution, seconded by Council Member Zakrzewski. The resolution was adopted by a roll call vote of nine ayes. BILLS, FIRST READING BILL NO. 19-84 A BILL AMENDING ORDINANCE NO. 4990 -68, AS AMENDED, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (STATE RD. 23) This bill had first reading. Council Member Serge made a motion to set this bill for public hearing and second reading March 12, and refer it to the Zoning and Vacation Committee, seconded by Council Member Taylor. The motion carried. 1 L PRIVILEGE OF THE FLOOR .__.-- ..._-FURUARY- .._Z7, ._.1H.4_ Ralph Johnson, 734 N. Cushing, asked that a letter or wire be sent to the General Assembly against the proposed local measured service. Irene Mutzl, 320 Parkovash, indicated that City employees do not get their cars off the street when a snow emergency is declared. There being no further business to come before the Council, unfinished or new, Council Member Taylor made a motion to adjourn, seconded by Council Member Puzzello.
