DESCRIPTION OF STRUCTURE/SITE: This is a two story, rectangular plan commercial building. Walls are
brick with terra cotta detailing, and the roof features a parapet wall having an oval, terra cotta arcade and a project-
ing terra cotta cornice with brackets. On the front facade, the second story window surrounds are terra cotta with
vien and medallion motif lintels. Window openings on the south elevation have arched tops. The north eleva-
tion features two recessed openings, which originally formed two light wells between the existing building and a
now-demolished building directly to the north. Each recessed opening has three windows; based on images provid-
ed by the applicant, these windows appear to be metal 6/1 single hung windows.
DESCRIPTION OF PROPOSED PROJECT: The applicant has requested approval to:
1) Uncover and restore basement windows
2) Install new wood windows to replicate original windows
3) Install new exterior outlets
4) Install new exterior lighting on the one story rear addition
5) Install 2 new windows on the north facade of the rear addition
6) Remove concrete masonry wall and install gate
7) Install new roof deck and railing above breezeway
8) Remove CMU infill and install new windows on the south facade of the rear addition
9) Install stucco finish on walls of balconette alcoves
10) Install new sill and railing in balconette alcoves
11) Restore existing windows
12) New 1/1 window in balconette alcove
13) Replace windows with new wood exterior doors in balconette alcoves

STAFF RECOMMENDATION: Staff have reviewed the proposed projects and weighed them against the stan-
dards and guidelines. The projects have been grouped by type with corresponding recommendation.

Important Information Regarding this Request
REQUIRED DOCUMENTATION AND SITE PLANS
The Historic Preservation Commission of South Bend and St. Joseph County cannot process an Application
without required documentation. Comprehensive documentation provides a complete understanding of the
project. Problems often occur during a project review or during the execution of the project when the
property owner, staff or commissioners are unclear as to project specifics. Applications will NOT be
processed without required documentation.
Photographs may be submitted in digital format or in photographic print. When a project involves
blueprints and/or site plans, one (1) set shall be submitted with the Application. Any documentation
submitted to this office cannot be returned to the applicant.
APPLICATION FEE
The application processing fee for any Application for a Certificate Of Appropriateness is $20
Payment must accompany the application at the time of submission. For an electronically submitted
application, payment must reach the HPC office within 48 hours following transmission. Payment can be
made by credit card by contacting
Business License Administrator Michelle Adams at (574) 235-5912; by cash in person in the Department of
Community Investment on the 14th floor of the County City Building; or by check made out to City of
South Bend. Applications will NOT be processed without the required fee.
MEETING ATTENDANCE
When an Application has been scheduled for any meeting, the owner, architect or contractor(s) retained for
the project shall attend the meeting where their project will be reviewed and a decision rendered. Failure by
the owner, architect, or contractor to attend such meetings may result in denial of the Application due to
insufficient representation.
CERTIFICATE ISSUANCE
Certificates of Appropriateness will be filed with the Building Department of South Bend and St. Joseph
County. A copy of the Certificate will be emailed directly to the owner and/or contractor(s) listed on the
application.
INSPECTION AUTHORITY
All projects will be inspected during and following execution for compliance with the decision(s) rendered
by the Historic Preservation Commission of South Bend and St. Joseph County.

Owner acknowledges that while the Historic Preservation Commission only considers Certificates of
Appropriateness for exterior features, under certain circumstances it may be necessary for the Commission
Staff to have access to the interior of the building in order to accurately assess the condition of the exterior
feature and that the lack of access to the interior may prevent the Commission Staff from making a
favorable recommendation.
Any work performed on a historic landmark or in an historic district which does not conform to the
Certificate of Appropriateness certificate shall be immediately halted by the Historic Preservation
Commission and the Building Department of South Bend and St. Joseph County. Fines may be levied for
projects not in compliance.

The project focuses on restoring and enhancing the building’s original architectural character while
making minimal changes for adaptive reuse. Proposed work includes uncovering and reopening original
window and door openings, removing CMU infill, and installing new wood windows and doors designed to
replicate the original metal windows. Additional improvements include a new roof deck with parapet
extension to meet safety and firewall requirements, breezeway egress gate, stucco finish on balconette
walls, updated overhead door, new exterior lighting and outlets, and select new openings to improve
access and light.

Conditions:
Contract must be signed and a 50% deposit made. In some cases, the deposit may be waived in exchange for a signed
Purchase Order. This does not apply to residential customers.
Issuing a Purchase Order will be considered as Notice to Proceed and acceptance of all Terms and Conditions.
All dates are tentative and subject to change due to weather, underground utility locates and ETC...
Once contract is signed and materials are ordered, contract is not subject to cancellation due to date discrepancies as all
dates are tentative.
Milestone Fence takes care of obtaining all fencing permits. Generally, the price is figured into your estimate. If the cost
of permit is not figured into your estimate, the permit fee will be added to the final invoice.
Customer is responsible for getting property surveyed. If customer fails to get property surveyed, it is the customers
responsibility to stake out and sign off on the location of the fence lines. By signing, customer accepts the responsibility
for all costs incurred to have the fence materials moved due to conflict with the property lines.
Milestone Fence will call in all public underground utility locates prior to beginning the proposed work. It is required by
law to have all utility lines marked prior to digging of any type.
customer is responsible to inform Milestone Fence of any private utility lines that will not be located by a standard utility
locating company, including but not limited to, private electric, gas, cable/fiber optic, water/sewer, phone or septic. If
private utilities are present, a private locate must be done prior to starting work. If private locates need to be done, it will
be at the customers expense. If the customer declines to have private locates done, Milestone Fence will order a private
locate to be done and any fees and expenses associated with said locate will be added to the final invoice. If damage
occurs during the course of installation, the expense for repair will be borne by the customer only.
During the course of this job, any change or addition requested by the customer that is not part of the accepted proposal
but becomes part of the scope of work, will have a change order written and signed by the customer and a representative
of Milestone Fence. No additional materials or labor will be ordered until a signed change order is received. Additional
material and labor cost will be added to the final invoice.
Once contract is signed, customer is subject to a 25% restocking fee for materials in the event of cancellation for any
reason. All materials are special order.
Contract must be paid in full upon completion of work. All balances are considered delinquent after 30 days. (Unless
otherwise specified)
Customer understands there is no warranty on wood fence materials and all manufacturer warranties only cover
materials, not labor. It will be the customer's responsibility to cover labor warranty issues.
Terms:
Customer is to pay invoice in full at the time of completion unless otherwise specified in writing.
A finance charge of 1.5% per month, which is the annual percentage rate of 18%, will be applied to previous balance
due.

Milestone Fence LLC reserves the right to place a lien on the property if payment is delinquent.
Customer agrees he/she shall be liable for all court costs, attorney's fees and expenses incurred by Milestone Fence LLC
in the collection of any amount due it for work performed and materials supplied pursuant to this contract.
In the case payment is not made as specified, Milestone Fence LLC reserves the right to possess all materials used on this
job without recourse.
In the case that repossession of these materials occurs, customer agrees that he/she is responsible for all labor costs and
fees associated with said repossession.
Repossession fees will be billed separately and are subject to the same Terms and Conditions.
