DESCRIPTION OF STRUCTURE/SITE: This is a 2 story rectangular plan gable front house on brick foun-
dation with 1/1 double hung wood windows with wood storm windows. House has wood clapboard siding covered
with aluminum and limestone on the front facade. The house has half round gutters.
DESCRIPTION OF PROPOSED PROJECT: The applicant has requested approval to:
1) Demolish the house, clear lot and create green space.
STANDARDS AND GUIDELINES:

SITE V ISIT R EPORT: Historic Preservation Administrator and Specialist Ross Van Overberghe and Kate
Himick inspected the windows siding, foundation and roof from the exterior on March 27, 2025. All visible ele-
ments accessible from the ground are in good condition. Siding shows peeled paint but little rot. Localized areas
around disconnected gutters. Foundation is brick and does not show any signs of cracking or shifting. Normal
expected wear of mortar shows and minimal pointing is required from the exterior.
The interior is full of trash. The floor is not visible except at the rear entry door. All other doors are blocked by de-
bris. All internal woodwork, trim casing, doors and windows and several built in cabinets are original and in good
condition. The floors are of unknown condition at this time. There were no signs of water damage of leaking from
the roof, no visible plaster damage to the ceilings. Minimal removal of wall plaster in several areas.
Basement was not accessible, condition of the foundation from the interior is unknown. The attic was not accessi-
ble, condition of the roof structure is unknown.
STAFF R ECOMMENDATION: The house is rated non-contributing, no interest in restoration has been shown
by any persons, the cost of relocation and rehabilitation is prohibitive and a “very poor” assessment from a struc-
tural engineer has been submitted by the owner. Based on all the information provided prior to this hearing, staff
make a FAVORABLE RECOMMENDATION.

Important Information Regarding this Request
REQUIRED DOCUMENTATION AND SITE PLANS
The Historic Preservation Commission of South Bend and St. Joseph County cannot process an Application
without required documentation. Comprehensive documentation provides a complete understanding of the
project. Problems often occur during a project review or during the execution of the project when the
property owner, staff or commissioners are unclear as to project specifics. Applications will NOT be
processed without required documentation.
Photographs may be submitted in digital format or in photographic print. When a project involves
blueprints and/or site plans, one (1) set shall be submitted with the Application. Any documentation
submitted to this office cannot be returned to the applicant.
APPLICATION FEE
The application processing fee for any Application for a Certificate Of Appropriateness is $20
Payment must accompany the application at the time of submission. For an electronically submitted
application, payment must reach the HPC office within 48 hours following transmission. Payment can be
made by credit card by contacting
Business License Administrator Michelle Adams at (574) 235-5912; by cash in person in the Department of
Community Investment on the 14th floor of the County City Building; or by check made out to City of
South Bend. Applications will NOT be processed without the required fee.
MEETING ATTENDANCE
When an Application has been scheduled for any meeting, the owner, architect or contractor(s) retained for
the project shall attend the meeting where their project will be reviewed and a decision rendered. Failure by
the owner, architect, or contractor to attend such meetings may result in denial of the Application due to
insufficient representation.
CERTIFICATE ISSUANCE
Certificates of Appropriateness will be filed with the Building Department of South Bend and St. Joseph
County. A copy of the Certificate will be emailed directly to the owner and/or contractor(s) listed on the
application.
INSPECTION AUTHORITY
All projects will be inspected during and following execution for compliance with the decision(s) rendered
by the Historic Preservation Commission of South Bend and St. Joseph County.
Owner acknowledges that while the Historic Preservation Commission only considers Certificates of
Appropriateness for exterior features, under certain circumstances it may be necessary for the Commission
Staff to have access to the interior of the building in order to accurately assess the condition of the exterior
feature and that the lack of access to the interior may prevent the Commission Staff from making a
favorable recommendation.
Any work performed on a historic landmark or in an historic district which does not conform to the
Certificate of Appropriateness certificate shall be immediately halted by the Historic Preservation

Description of Proposed Work:
The scope of work for this demolition project includes the following. All brush and trees on the site will be
cleared first, ensuring the area is prepared for demolition. Once the site is cleared, the existing house and
foundation will be completely demolished in accordance with local codes and regulations. All debris from
the demolition will be removed. After demolition, the site will be graded to ensure a level and stable
surface, preparing the area for future development or use. Finally grass will be planted to establish ground
cover.

Dear Mr. Van Overberghe:
On behalf of Career Academy of South Bend, Inc. (CASB), the owner of this property, I’m
responding to your July 28 email to explain why we wish to demolish the house on this
property.
The building on this property is in terrible condition, as described in the attached structural
engineer report from Frost Engineering and Consulting dated December 12, 2025, stating:
1. The exterior foundation and wood siding are in poor condition and exhibiting
significant cracking, movement and loss of protective coatings (moderate to
significant repair/replacement is necessary. Entrance staircases & porch are in
poor condition (extensive repairs/replacement is necessary). All windows &
doorways are in poor condition (full replacement is required).
2. All rooms in the lower/first floor space have extensive wall & ceiling cracking
(diagonal, vertical & horizontal) and exhibiting significant loss of lateral support.
Extensive repairs/replacement is required in all rooms.
3. The staircase walls and stairs are exhibiting significant deficiencies. Extensive
repairs/replacement is necessary.
4. All rooms in the upper/second floor space have extensive wall & ceiling cracking
(diagonal, vertical & horizontal) and exhibiting significant loss of lateral support.
Extensive repairs/replacement is required in all rooms.
In summary, the structural condition of this structure is very poor. It is my
professional opinion that this structure shall be demolished.
The house on the property has no value; in fact, it has negative value: the cost of demolition
of the house so that the land can be used for another purpose. The property was
purchased by Lawrence Garatoni, president and founder of CASB, for use in connection
with the adjacent school at 306 West Marion Street (see attached map).
The attached appraisal by Krause Associates LLC, states at page 4:
“[T]he house is noted in the National Register of Historic Places as a
non-contributing property within its historic district.
A non-contributing property in a historic district is a building or
structure that does not add to the historical or architectural character of
the district because it is either too new or has been signiflcantly altered
from its original appearance. These properties are outside the district’s
“period of signiflcance” and are subject to fewer preservation
restrictions compared to contributing properties.

The cost of repairs to the structural and interior properties as outlined in
the Frost Engineering and Consulting report dated December 12, 2025
would be exceedingly more than the value of the property. [Emphasis
added.]
At pages 7-8, the appraisal cites the structural report, stating: “the property is in very poor
condition, including structural integrity, interior and exterior features, and is uninhabitable
and should be demolished. In fact, … the house has a demolition order posted on the front
door by the city.” The appraisal identifles the value of the property as $19,600 (page 3) but
notes that the property was purchased by Lawrence Garatoni on January 31, 2025, for
$36,000 before being transferred to CASB (page 8). Mr. Garatoni and CASB have special
reason to value the underlying land because of its proximity to the school at 306 West
Marion. The property’s value is the value of the land minus the cost of demolition,
estimated as $20,000 (page 5).
I have reviewed the 169-page Standards and Guidelines document on the HPC website,
https://docs.southbendin.gov/WebLink/0/edoc/401719/Standards%20and%20Guidelines.pdf, but
do not flnd any reference in that document to the principle that a landowner is entitled to a
reasonable return on the subject property. Indiana law refiects that principle by statute:
Indiana Code 36-7-11-14. Purpose of section — Procedure for demolition upon denial of
issuance of certiflcate of appropriateness …
(b) If a property owner shows that a historic building is incapable of earning an economic
return on its value, as appraised by a qualifled real estate appraiser, and the commission
fails to approve the issuance of a certiflcate of appropriateness, the building may be
demolished. However, before a demolition permit is issued or demolition proceeds, notice
of proposed demolition must be given for a period flxed by the commission, based on the
commission’s classiflcation on the approved map but not less than sixty (60) days nor more
than one (1) year. Notice must be posted on the premises of the building proposed for
demolition in a location clearly visible from the street. In addition, notice must be
published in a newspaper of general local circulation at least three (3) times before
demolition, with the flrst publication not more than flfteen (15) days after the application
for a permit to demolish is flled, and the flnal publication at least flfteen (15) days before
the date of the permit.
We ask that the HPC acknowledge the applicability of the above-quoted statute.
Concerning the statute’s provision that “before a demolition permit is issued or demolition
proceeds, notice of proposed demolition must be given for a period flxed by the
commission, based on the commission’s classiflcation on the approved map but not less
than sixty (60) days nor more than one (1) year,” please advise what period has been flxed
by the commission for this purpose.
Concerning the statute’s provision that a notice of proposed demolition must be posted on
the premises in a location clearly visible from the street, we will send a picture from the
street of the posted notice, and ask that you acknowledge that the visibility requirement is
met.
To demonstrate that the house has no value, we have listed it for sale for $1 on the
condition that the buyer must move the house to a new location. We expect no one will
purchase the house on that basis because the house would fall apart if anyone attempted
to move it, and because the house would have no value even if it were located at another
site.
We do not wish to list the property for sale for $36,000 because the underlying land has
value to CASB.
We ask that the HPC act promptly to authorize demolition of this property.

51 A. EXCLUSIVE LISTING. The parties understand and agree that this is an exclusive right to sell, option, exchange or
52 lease listing, and Broker shall be entitled to the commission hereinafter established which shall be payable in U.S.
53 Dollars upon the occurrence of any of the following events:
54 1. at the time the Property is sold, optioned, exchanged or leased by any person, including the Seller, to
55 any person during the term of this contract or any renewal or extension thereof,
56 2. at the time Seller, Broker, or any other real estate licensee secures a buyer or lessee ready, willing and
57 able to purchase, option, exchange or lease the Property for such price and terms as specified, or such
58 other price or terms as Seller may accept,
59 3. at the time an agreement is entered into sell, exchange, option or lease during the term of this contract
60 or any renewal or extension thereof, and ultimately completed after the termination of this contract,

133 contaminants ("Environmental Contaminants") which might exist and affect the Property. Environmental
134 Contaminants at harmful levels may cause property damage and serious illness, including but not limited to, allergic
135 and/or respiratory problems, particularly in persons with immune system problems, young children and/or the
136 elderly.

138 Seller agrees to consult with appropriate experts and accepts all risks for Environmental Contaminants and
139 releases and holds harmless all Brokers, their companies and licensees from any and all liability, including

144 J. AGENCY DISCLOSURES

146 1. Office Policy. Seller acknowledges receipt of a copy of the written office policy relating to agency.

148 2. Agency Relationship. I.C. 25-34.1-10-9.5 provides that a Licensee has an agency relationship with, and is
149 representing, the individual with whom the Licensee is working unless (1) there is a written agreement to the
150 contrary; or (2) the Licensee is merely assisting the individual as a customer without compensation. Licensee
151 (Broker) represents the interests of the Seller as Seller's agent to sell the Property. Licensee owes duties of
152 trust, loyalty, confidentiality, accounting and disclosure to the Seller. The duties of accounting and
153 confidentiality extend beyond the agency relationship unless disclosure of confidential information is required
154 by law, becomes public or the client gives written consent to disclose. However, Licensee must deal honestly
155 with a buyer and disclose to the buyer information about the Property. All representations made by Licensee
156 about the Property are made as the agent of the Seller. Seller is advised that the Property may be sold with
157 the assistance of other Licensees working as buyer agents and that Licensee's company policy is to
158 cooperate with buyer agents. Buyer agents are Licensees who show the Property to prospective buyers,

276 5. Broker may refer Seller to other professionals, service providers or product vendors, including lenders, loan

278 companies. Broker does not guarantee the performance of any service provider. Seller is free to select providers

6. Broker is not and shall not be charged with the responsibility for the custody, management, care, maintenance,
protection or repair of the Property nor for the protection or custody of any personal property located thereon,
unless provided for in another written agreement.
