Comprehensive documentation provides a complete understanding of the project. Problems often occur during a project review or during the execution of the project when the property owner, staff or commissioners are unclear as to project specifics. Applications will NOT be processed without required documentation. Photographs may be submitted in digital format or in photographic print. When a project involves blueprints and/or site plans, one (1) set shall be submitted with the Application. Any documentation submitted to this office cannot be returned to the applicant. APPLICATION FEE The application processing fee for any Application for a Certificate Of Appropriateness is $20 Payment must accompany the application at the time of submission. For an electronically submitted application, payment must reach the HPC office within 48 hours following transmission. Payment can be made by credit card by contacting Business License Administrator Michelle Adams at (574) 235-5912; by cash in person in the Department of Community Investment on the 14th floor of the County City Building; or by check made out to City of South Bend. Applications will NOT be processed without the required fee. MEETING ATTENDANCE When an Application has been scheduled for any meeting, the owner, architect or contractor(s) retained for the project shall attend the meeting where their project will be reviewed and a decision rendered. Failure by the owner, architect, or contractor to attend such meetings may result in denial of the Application due to insufficient representation. CERTIFICATE ISSUANCE Certificates of Appropriateness will be filed with the Building Department of South Bend and St. Joseph County. A copy of the Certificate will be emailed directly to the owner and/or contractor(s) listed on the application. INSPECTION AUTHORITY All projects will be inspected during and following execution for compliance with the decision(s) rendered by the Historic Preservation Commission of South Bend and St. Joseph County. 1 Owner acknowledges that while the Historic Preservation Commission only considers Certificates of Appropriateness for exterior features, under certain circumstances it may be necessary for the Commission Staff to have access to the interior of the building in order to accurately assess the condition of the exterior feature and that the lack of access to the interior may prevent the Commission Staff from making a favorable recommendation. Any work performed on a historic landmark or in an historic district which does not conform to the Certificate of Appropriateness certificate shall be immediately halted by the Historic Preservation Commission and the Building Department of South Bend and St. Joseph County. Page 2 of 2 Terms and Conditions: Limited Workmanship Warranty: Rooftech Construction, LLC (“Contractor”) warranties its workmanship to Owner on complete roof replacements only for the lifetime of each individual material under normal conditions. This warranty covers workmanship only. Materials and products installed by Contractor are not warranted by Contractor but are instead covered by their respective manufacturer warranties. All shingles, components, and materials are subject to the manufacturer’s warranty terms, which may vary by product. This workmanship warranty does not cover the following: Ice damming, wind driven rain, wind/storm damage, lack of proper maintenance, and other circumstances beyond Contractor’s control. This workmanship warranty is void if any part of the installation is altered, modified or repaired by anyone other than Contractor. To make a claim on Contractor’s warranty, Owner must provide Contractor written notice, by certified mail, describing the alleged defect. Contractor will provide the Owner a written response within 21 days of the day Contractor receives Owner’s initial written notice of alleged defect. Contractor may offer to remedy the defect, pay the cost to remedy the defect, or dispute the claim. No warranty claim will be honored unless this claim process is followed. Unless explicitly agreed to in writing, repairs are NOT covered by any workmanship warranty. Scope of work: Contractor will provide services as described in the attached estimate (the “Work”). The Work will be performed in accordance with current building codes and regulations. Contractor will provide all services, materials, labor, tools, and equipment needed for completion of the Work. Contractor expects to commence the Work by no later than December 31st, 2026, and that substantial completion of the project will be achieved within seven (7) days after Contractor commences work. If the Contractor is delayed at any time in the progress of the Work (i) by an act or neglect of the Owner, Owner’s employees, or separate contractors employed by the Owner, (ii) by changes ordered in the Work, (iii) by fire, unusual delay in deliveries, adverse weather conditions not reasonably anticipatable, unavoidable casualties or other causes beyond the Contractor’s control, (iv) by delay authorized by the Owner or (v) by other causes which reasonably justify delay, then the time for substantial completion and/or final completion of the construction shall be reasonably extended by Change Order. Payment Terms: For Contractor’s performance of the Work, Owner shall pay the Contractor the amount of the total job cost (the “Contract Sum”). If Owner resides at the address where duties are to be performed, no payment is due upon the acceptance of estimate. If Owner does not reside at the address where duties will be performed, 50% of the Contract Sum is due at the time of contract signing. The balance of the Contract Sum is due immediately upon project completion. All checks will be made payable to Rooftech Construction, LLC. In the event of nonpayment of the Contract Sum within 7 days of job completion, the customer must pay to Contractor an additional late charge of 10% of the unpaid balance for the first 45 days. Any remaining unpaid balance after 45 days will be turned over to collections. All resulting collection costs, attorney fees, and court costs will be paid by the customer. The customer further agrees that they will be charged a $50.00 fee for each dishonored bank check. Credit card payments are subject to a 3% price increase due to processing fees. Cancelation: If Owner chooses to cancel this agreement after signing, a $2,000.00 fee or 10% of the total contract, whichever is greater, is due immediately. This charge constitutes liquidated damages for the approximate loss to Contractor sustained by placing the job on the schedule and for time spent coordinating the project and is not a penalty. If any work has begun on the project prior to cancellation, Owner is also responsible for all costs incurred up to the date of cancellation. This includes, but is not limited to, labor performed, materials ordered or delivered, permits and associated fees, equipment rentals, and other project-related expenses. These charges are in addition to the cancellation fee. Disputes: In the event of a dispute or legal action arising out of this agreement, Contractor shall be entitled to recover all costs and expenses, including reasonable attorney’s fees, incurred in enforcing its rights. To avoid the time and expense of jury trials, both parties waive the right to a jury trial for any claim or legal proceeding arising from or related to this Agreement or the underlying transaction. All legal proceedings shall be filed and heard exclusively in the Superior or Circuit Courts of St. Joseph County, Indiana. Change Orders: A Change Order is a written instrument prepared by Contractor and signed by the Owner and Contractor which states their agreement upon (i) a change in the Work, (ii) the amount of the adjustment, if any, in the Contract Sum, and (iii) the extent of the adjustment, if any, in the Contract Time. Contractor shall have authority to make minor changes in the Construction Documents and construction consistent with the Construction Documents when such minor changes do not involve adjustment in the Contract Sum or extension of the Contract Time. Any duties not indicated in the plans or specifications of the above-listed contracted duties, that must be added, repaired, or replaced as a result of hidden, concealed or changed conditions, or that is required for compliance with building regulations and/or codes, will result in a Change Order. Such “performance” changes do not require a signed change order to be enforceable. Change Orders are subject to the terms and conditions of this agreement. Subcontractors. Depending upon the particular requirements of the Project, one or more subcontractors or material suppliers might perform labor or might supply materials, equipment or machinery to the Project. Conditions: This proposal is valid for 30 days. Contractor reserves the right to withdraw this proposal or re-quote the project if contract acceptance is beyond 30 days from date of original estimation. All contracts must be signed before work is commenced. Contractor reserves the right to refuse services at any time prior to commencement of the Work. Accessories: When satellites, antennas, or other unique accessories are present, they will have to be removed to correctly install new materials. During such events, Contractor is not responsible for signal loss and/or the cost re-installation of such accessories. Contractor is not liable for existing gutter damage that was present prior to the commencement of the Work. In situations where gutters need to be removed to complete contracted duties, Contractor cannot guarantee that gutters will be salvageable, but every attempt will be made to preserve their original condition. Driveway/Parking Surfaces: During the completion of the Work heavy equipment such as, but not limited to, portable cranes, boom trucks, dumpsters, and material delivery vehicles will have to utilize the property’s driveway and/or parking lots. Preventative measures will be implemented to attempt to protect driveways and/or parking lots. If cracks or damages do occur, resulting from such equipment, Contractor IS NOT LIABLE FOR THE COST OF REPAIR OR REPLACEMENT. Unforeseen Conditions: Contractor is not responsible for any improperly installed underlying construction, hidden/out of view hazards, or other related items. This includes, but is not limited to, items on interior walls, nail pops/cracks in drywall from vibrations, buried electrical lines or plumbing within nailing area, cosmetic damage resulting from the removal of old sealants and materials, and other related items.
