GAMMON Approved and signed by me 19 Clerk ORDINANCE NO. 6629 -79 AN ORDINANCE AMENDING CHAPTER 2, ARTICLE 5, SECTION 2 -50 COMMONLY KNOWN AS BOARDS OF PUBLIC SAFETY AND OF PUBLIC WORKS. STATEMENT OF PURPOSE AND INTENT Public Law 169 would allow the Board of Public Works to enter into contracts for any real or personal property, and to contract for any services or work without approval of the Common Council where the amount does not exceed Ten Thousand ($10,000.00) Dollars. The Common Council believes that the present amount of less than $7,500.00 is a reasonable figure and wishes to retain the ratification process for all larger amounts. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana, as follows: SECTION I. Chapter 2, Article 5, Section 2 -50 of the Municipal Code of the City of South Bend, Indiana, is hereby amended by the inclusion of a new subsection (g) which shall read as follows: SEC. 2 -50 (g) All contracts concerning municipal utilities which are for the purchase of any real estate or personal property, and all contracts for any services or work where the amount to be expended shall exceed the sum of Seven Thousand Five Hundred Dollars ($7,500.00 must be approved by ordinance of the Common Council. SECTION II. Public Law 169 would allow the Board of Public Works to enter into contracts for the purchase of real and personal property, and the power to contract for any services or work without Common Council approval for amounts less than $10,000.00. Presently all such contracts of less than $2,000.00, do not require Council ratification. Since the Common Council is charged with the authority to control the city's property and finances, I believe the lower figure should be maintained. I seek your favorable support. Respectfully report that they have examined the matter and that in their opinion THIS BILL SHOULD BE RECOMMENDED TO THE COUNCIL FAVORABLE, AS AMENDED: Substitute a new Section (g) to read as follows: All contracts concerning municipal utilities which are for the purchase of any real estate or personal property, and all contracts for any services or work where the amount to be expended shall exceed the sum of Seven Thousand Five Hundred Dollars ($7,500.00) must be approved by ordinance of the Common Council.
