BE IT ORDAINED by the Common Council of the City of South Bend, Indiana: Section 1. Ordinance No. 4990 -68, as amended, which ordinance is commonly known as the Zoning Ordinance of the City of South Bend, Indiana, be and the same hereby is amended in order that the zoning classification of the following described real estate in the City of South Bend, St. Joseph County, State of Indiana: Lots 29 through 35 inclusive, Plat of Westchester, First Unit, South Bend, Indiana be and the same is hereby established as C -1 Commercial A Height and Area District. PETITION FOR REZONING TO: Common Council of the City of South Bend, Indiana Date Filed Date Area Plan Commission Received Application Number The American National Bank and Trust Company, South Bend, Indiana, makes application and petitions the Common Council of the City of South Bend, Indiana, to amend the zoning ordinance as herein requested. 1) The property sought to be rezoned are Lots 29 through 35 inclusive, Plat of Westchester First Unit, South Bend, St. Joseph County, Indiana, which is an area bounded by Bendix Drive on the West, Green Street on the North and Bonds Avenue on the East. 2) Title to the property is currently in the name of the Bendix Cor- poration, Bendix Center, Southfield, Michigan, 48076, however, as of November 22, 1978, the American National Band and Trust Company, South Bend, Indiana, had entered into an agreement to purchase said property, subject to obtaining rezoning to a commercial classifica- tion. 3) It is desired and requested that this property be rezoned from B residential to C -1 Commercial. 4) This rezoning is requested so as to allow the following use establishment and operation of a branch banking facility. 5) Attached is a copy of (a)Legal description of the property; (b) a list of names and addresses of all property owners within 300 feet of the petition property; (c) a site plan; and (d) self- addressed, stamped envelopes of all property owners within 300 feet of the petition property. JOHNSON Executive Director (219) 284 -9571 February 21, 1979 In Re: A proposed ordinance and site development plan of American National Bank and Trust Company, to zone from "B" Residential, "A" Height and Area, to "C -1" Commercial, "A" Height and Area, property bounded by Bendix Drive on the west, Green Street on the north and Bonds Avenue on the south, City of South Bend Gentlemen: The attached rezoning petition of American National Bank and Trust Company was legally advertised February 10, 1979. The Area Plan Commission gave it a public hearing on February 20, 1979, at which time the following action was taken: "Upon a motion by Joseph Serge, being seconded by Patrick McMahon and carried with June Stratton voting "Nay ", the petition of the American National Bank and Trust Company, to zone from "B" Residential, "A" Height and Area, to "C-I" Commercial, "A" Height and Area, property bounded by Bendix Drive on the west, Green Street on the north and Bonds Avenue on the south, City of South Bend, is returned to the Common Council with a favorable recommendation, subject to.the vacation of the existing alley, the dedication of the new 14 foot alley easement per Board of Public Works approval, and a final site plan." The above recommendation is made subject to a final site plan and the preliminary site plan is attached hereto. The deliberations of the Area Plan Commission and points considered in arriving at the above decision are shown in minutes of the public hearing and will be forwarded to you at a later date to be made a part of this report. Attached for your consideration in the review of this matter is a copy of the Area Plan Commission Staff Report.
