ORDINANCE NO.(, _ 7 AN ORDINANCE OF DETERMINATION FOR SALE OF CERTAIN REAL ESTATE OWNED BY THE CITY OF SOUTH BEND FOR PARK PURPOSES STATEMENT OF PURPOSE AND INTENT: After due consideration and deliberation, the Board of Park Commissioners of the City of South Bend, Indiana does determine that the real estate hereinafter described is no longer suitable or required for park purposes and is an excess of real property and available for disposition. The Board of Park Commissioners of said city deems advisable that the real estate hereinafter described be sold and disposed of to the advantage and best interest of the City of South Bend, Indiana and the proceeds of such sale shall be credited to the Department of Public Parks pursuant to State Statute. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of South Bend, Indiana: Section 1. That the City of South Bend, Indiana sell and convey the following real estate in Saint Joseph County, Indiana, to wit: A parcel of land being part of the Southeast Quarter of Section 11, Township 37 North, Range 2 East, in the City of South Bend, St. Joseph County, Indiana and being more particularly described as follows, viz: Beginning at the Southeast corner of Lot Numbered 72 in Samuel Martin's Addition to the Original Plat of the Town, now City, of South Bend, Indiana as recorded in the Office of the Recorder of St. Joseph County, Indiana in Plat Book 3, Page 28; thence West (Bearing assumed for this description) along the North line of South Street, a distance of 607.18 feet to the Southwest corner of Lot Numbered 16 in Block 9 of Vail's Addition, thence North 00- 05' -20" West along the East line of William Street, a distance of 99.13 feet to the Northwest corner of Lot Numbered 15 in said Block 9; thence South 890- 58' -20" East, along the North line of said Lot 15 and its projection, a distance of 129.96 feet, to the Northwest corner of Lot Numbered 7 in said Block 9; thence North 00- 07' -58" West a distance of 311.54 feet to the Northwest corner of Lot Numbered 1 in said Block 9; thence South 890- 59' -18" East along the South line of Monroe Street, a distance of 297.34 feet to the Northeast corner of Lot Numbered 32 of Vail's Addition; thence South 00- 16' -40" East, a distance of 311.63 feet to the Northeast corner of Lot Numbered 38 of said Vail's Addition; thence South 890- 58' -20" East, a distance of 179.06 feet to the West line of Lafayette Boulevard; thence South 00- 13' -45" East, along said West line of Lafayette Boulevard a distance of 98.83 feet to the place of beginning containing 3.51 acres, more or less, and being commonly known as Lots 1 through 8, 15 and 16 inclusive of Block 9, Vail's Addition; Lots 32 through 39 inclusive of Vail's Addition; Part of Lot 71 and all of Lot 72 Samuel Martin's Addition, along and together with the vacated 14' alley between Lots 15, 16 and 7, 8 in Block 9 Vail's Addition, the vacated 14' alley between Lots 4 and 5 in Block 9, Vail's Addition, vacated Franklin Street from the South line of Monroe Street to the North line of South Street, the vacated 14' alley between Lots 35 and 36 in Vail's Addition and the vacated 14' alley between Lots 38 and 39 Vail's Additon and Lot 72 and part of 71 Samuel Martin's Addition. Subject to any easements, covenants or restrictions of record. Section 2. The Park Department is proposing to sell the park owned land known as Plaza Park located across the street from the old Union train station on South Street. Plaza Park is approximate has been used very little the past few yeasrand unfortunately has attracted some undesireable users. The Park Board passed a resolution at its November 20th meeting stat- ing that Plaza Park is no longer needed for park purposes and is now submitting an ordinance to the Council for aroval of of land. If the Common Council approves the ordinance thenhtheaBoard of Public Works would sell the land as other city owned real estate is sold. The Park Board has thus I am confident received inquiries about the sale of Plaza Park that we will have persons bidding on the land. The proceeds from the sale of land could be used as the cities share for the Land and Water Conservation Grant (river bank paths) just approved by B. 0.
