ORDINANCE NO. 6613 -79
AN ORDINANCE FIXING THE ANNUAL PAY OF
POLICEMEN FOR THE CALENDAR YEAR 1980.
BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND,
INDIANA, AS FOLLOWS:
SECTION I. (a) The Common Council of the City of South Bend,
Indiana, recognizes the Wage Committee of the Fraternal Order of
Police, Lodge No. 36, as the sole bargaining unit for the annual
salaries and fringe benefits for members of the South Bend Police
Department.
(b) The Council further recognizes and designates the Police
Chief, Division Chiefs and Captains as the management members of the
department.
(c) Excepting the Police Chief, Division Chiefs and Captains,
there shall be an increase in salary of $400.00 per officer effective
January 1, 1980, and an increase of $800.00 per officer on July 1,
1980. Thus the annual pay of the officers and members of the Police
Department of the City of South Bend for the year 1980, by rank,
classification and service years shall be as follows:

Any officer in training shall remain in that status until
satisfactory completion of the mandatory law enforcement training
program.
The first service year for a police officer commences upon his
being sworn in as a police officer. The police officer shall obtain
his second service year on the next succeeding first day of January
until he attains the maximum salary for the particular rank he may
hold.
SECTION II. In addition to the foregoing annual pay, the
officers and members of the Police Department shall receive com-
pensation for extra duty and special performance and the following
benefits:
(a) Effective January 1, 1980, if an officer is subpoenaed to
court or has to go to court or is required to appear at any given
location to validate a complaint, warrant or recall, the officer
shall be paid (if off duty) at the rate of time and one -half the
officer's hourly rate of pay with minimum of two hours on the
officer's regularly scheduled work day and four hours on the officer's
regularly scheduled day off. In addition, any officers required to
work overtime shall be paid at the rate of one and a half times the
officer's normal rate of pay with a minimum of one hour for any
overtime beyond said officer's normal work day schedule.
(b). Any officers shall be entitled to receive $31.00 for each
of the holidays listed below, whether such holiday is worked or not.
Payment shall be made for each holiday during the pay period to which
the holiday falls; however, no holiday shall be paid in advance of
its occurrence. The holiday pay shall apply only to the following:
New Year's Day Fourth of July
Lincoln's Birthday Labor Day
Washington's Birthday Columbus Day
Good Friday Veteran's Day
Easter Sunday Thanksgiving Day
Memorial Day Christmas Day
(c) For night incentive and hazard pay, $300.00 per year.
SECTION III. Clothing Allowance. (a) The Common Council
recommends that with the exception of Chief, Division Chiefs and
Captains, the sworn members of the Police Department receive an
annual clothing allowance of $500.00.
(b) The Common Council recommends that the annual clothing
allowance for those individuals holding the rank of Chief, Division
Chief or Captain be in the amount of $375.00.
(c) Such clothing allowance shall be distributed one -half by
June 15, 1980, and the remaining one -half by December 15, 1980.
SECTION IV. The Common Council recommends that the advancement
of rank from Patrolman First Class to Corporal be after three complete
years upon satisfactory performance of duty and promotion by the
Board of Safety.
SECTION V. The Common Council recommends:

SECTION VI. This ordinance shall be in full force and effect
for the calendar year commencing January 1, 1980, and ending
December 31, 1980.
