AN ORDINANCE AMENDING ORDINANCE NO. 4990 -68,
AS AMENDED, COMMONLY KNOWN AS THE ZONING
ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA
(Chapter 21, Municipal Code).
BE IT ORDAINED by the Common Council of the City of
South Bend, Indiana:
Section 1. Ordinance No. 4990 -68, as amended, which
ordinance is commonly known as the Zoning Ordinance of the City
of South Bend, Indiana, be and the same hereby is amended in order
that the zoning classification of the following described real
estate in the City of South Bend, St. Joseph County, State of
Indiana:
A tract of land beginning at the Northeast corner
of the Northwest Quarter of Section Twenty -seven
(27) Township Thirty -eight (38) North, Range Two
(2) East; thence South along the East line of said
Northwest Quarter of Section 27, 1254.9 feet to the
center line of Portage Highway; thence North 25 00'
West along said center line 1370.0 feet to the North
line of said Section 27; thence East along the North
line of said Section 27, 555.5 feet to the place of
beginning, containing 8.00 acres.
Except and excluding therefrom a parcel approximately
4.1 acres in size heretofore sold off of the North
end thereof for the Indiana East -West Toll Road.
be and the same is hereby established as C- Commercial - A- Height and
Area.
Section 2. This Ordinance shall be in full force and
effect from and after its passage by the Common Council, approval
by the Mayor and legal publication.

The undersigned make application and petition the Common
Council of the City of South Bend, Indiana, to amend the Zoning
Ordiance as herein requested.
1) The property sought to be rezoned is located at:
Southeast corner of the intersection of
Portage Avenue and the Indiana Toll Road.
2) Name of property owner:
William Edwin Kizer, individually, and
William Edwin Kizer, as Trustee of the Trust
created by the Last Will and Testament of
Amy M. Kizer, deceased

South Bend, Indiana 46628
3) It is desired and requested that this property be rezoned from
A- Residential - A- Height and Area to C- Commercial - A- Height and Area.
4) This rezoning is requested so as to allow the following use:
Retail stores and permit uses under C- Commercial.
5) Attached is a copy of (a) legal description of the property;
(b) a list of names and addresses of all property owners
within 300 feet of the petition property; (c) a site plan;
and (d) self - addressed, stamped envelopes of all property
owners within 300 feet of the petition property.
