These applications received favorable recommendations regarding fire, code, and environmental compliance, also for proper maintainence of the premises, and the height and condition of the fencing. Committee Chair Warner asked if the six (6) scrap metal licenses are all renewals. Michelle Adams answered yes. Council Vice President Rachel Tomas Morgan if there were any records of complaints regarding the six (6) companies. Michelle Adams answered no. Committee Chair Warner held the public hearing and nobody spoke. Committee Vice Chair White thanked the Department of Community Investment. Committee Member Ophelia Gooden-Rodgers moved to send Bill No. 25-20 to the Full Council with a favorable recommendation, which was seconded by Citizen Member Kaine Kanczuzewski and carried by a vote of five (5) ayes with one (1) committee member absent. White -Aye Committee Member Ophelia Gooden-Rodgers -Aye Committee Member Sherry Bolden-Simpson -Absent Citizen Member Thomas Gryp -Aye Citizen Member Kaine Kanczuzewski -Aye Bill No. 25-21 -Resolution to Deny a Scrap Metal / Junk Dealers / Recycling Operations License for US Scrap and Recycling LLC Michelle Adams, Department of Community Investment, with offices on the 14th floor of the County-City Building, stated that Bill No. 25-21 requests the denial of a scrap metal dealer license renewal application for US Recycling LLC, in accordanc with Section 4-51 of the South Bend Municipal Code. US Recycling LLC, located at 1610 Circle Avenue, received favorable recommendations from the police department, the fire inspection bureau, neighborhood resources, and the zoning department. The Indiana Department of Environmental Management (IDEM) found there to be multiple hazardous waste violations at 1610 Circle A venue. Given the environmental violations found on the property, the City is requesting the denial of US Recycling LLC 's scrap metal dealer license renewal. Six (6) days after US Recycling LLC presented testimony that they were cooperating and complying with IDEM's restrictions, IDEM observed multiple violations at 1610 Circle A venue. Citizen Member Thomas Gryp asked if the City had been in negotiations with U.S. Recycling. Caleb Bauer stated that the City had not been party to any negotiations between IDEM and U.S. Recycling. Citizen Member Kanczuzewski requested information regarding U.S. Recycling's operations and the impact of a denial. Caleb Bauer stated that U.S. Recycling's focus at 1610 Circle Avenue is business to business scrap processing. If the scrap metal dealer license is denied, the property would require a new special exception before restarting operations. Committee Vice Chair White asked if IDEM will be communicating with the City regarding updates involving U.S. Recycling. Caleb Bauer stated that the stop-work order will remain in place until the City is satisfied that U.S. Recycling has come into full compliance with IDEM's expectations. Committee Vice Chair White requested information regarding penalties. Caleb Bauer stated that IDEM could move forward with a judgement against a company if that company were not to move forward with an agreed order with IDEM. Citizen Member Kanczuzewski asked ifthere was an IDEM violation from 2023. Caleb Bauer answered yes and stated that there is an agreed order regarding the 2023 violations. Councilmember Dr. Oliver Davis asked if a company were to buy U.S. Recycling would the agreed order requirements transfer to the new owner and asked how the City would typically respond to a scrap metal dealer that has relayed false information regarding their operations. Caleb Bauer answered that the agreed order requirements would transfer to any new owner and stated that the City would request that Council deny the renewal of a scrap metal license renewal in a case where the City found a scrap metal dealer to be relaying false information regarding their operations. Council President Canneth Lee asked if the whereabouts of the undisclosed removed items are known. Caleb Bauer stated that IDEM has some awareness of where some of the items might have ended up. Council President Lee stated that he is in favor of Bill No. 25-21. Committee Chair Warner opened the public hearing. White -Aye Committee Member Ophelia Gooden-Rodgers -Aye Committee Member Sherry Bolden-Simpson -Absent Citizen Member Thomas Gryp -Aye Citizen Member Kaine Kanczuzewski -Aye Bill No. 25-23 -Resolution Authorizing and Approving the Execution of a First Amendment to the Certified Technology Park Agreement Between the City of South Bend, Indiana, and the South Bend Redevelopment Commission Joseph Molnar, Assistant Director of Growth and Opportunity, with offices on the 14th floor of the County-City Building, stated that Bill No. 25-23 authorizes the First (!51) Amendment to the Certified Technology Park (CTP) Agreement for Ignition and Innovation Park. CTP is a fund that allows for the capture of property taxes that exceed the base assessed value for parcels within the park. CTP also captures taxes from retail, use taxes of businesses in the Park, and State income taxes paid by employees for wages earned for work in the Park. Bill No. 25-23 will allow Ignition and Innovation Park to become recertified as a Level Two (2) CTP. CTP funds can be used for acquisition, public works improvements, construction, environmental remediation, maintenance, and public facilities. Council Vice President Tomas Morgan requested infonnation regarding the fund's retroactive effective date. Joseph Molnar stated that he believes there will be funds accrued due to the fund's retroactive effective date. Council President Lee asked how soon this will spur investment. Joseph Molnar stated that the retroactive funds could be utilized by the Redevelopment Commission to incentivize businesses to join Ignition Park.
