East Res. * Funds are subject to the City Controller's determination of availability; if funds are unavailable, as solely determined by the City Controller, then the authorization of the expenditure of such funds shall be void and of no effect. PURPOSE OF REQUEST: Approve Resolution Accepting 105 S. Olive St (former Animal Control facility) from BPW to RDC SPECIFICS: The City of South Bend, through the entity of the Board of Public Works (BPW) is the owner of the former Animal Control facility located at 105 S. Olive St and has maintained ownership since the South Bend Animal Resource Center (SBARC) relocated to Kennedy Park. Since SBARC relocated their facility to Kennedy Park the building has been vacant. City staff believe that the Redevelopment Commission (RDC) is a more appropriate entity than BPW to own this property. If redevelopment plans ever surface for this particular property, the RDC can take the appropriate actions necessary for redevelopment. BPW approved their matching resolution authorizing the transfer of this property to RDC at their meeting on November 12, 2025 and staff recommend approval of this resolution. ______________ ___________Pres/V-Pres ATTEST: __________ ________Secretary Date: _____________ _______ APPROVED Not Approved SOUTH BEND REDEVELOPMENT COMMISSION November 24, 2025  RESOLUTION NO. 27-2025 A RESOLUTION OF THE CITY OF SOUTH BEND, ACTING THROUGH ITS BOARD OF PUBLIC WORKS APPROVING THE TRANSFER OF REAL PROPERTY TO THE SOUTH BEND REDEVELOPMENT COMMISSION WHEREAS, the City of South Bend, acting through its Board of Public Works (the “City”), is the owner of certain property identified herein; and WHEREAS, pursuant to I.C. 36-1-11-8, the City may transfer or exchange property with another governmental entity upon terms and conditions agreed upon by the two (2) entities as evidenced by the adoption of substantially identical resolutions of each entity; and WHEREAS, the South Bend Redevelopment Commission (the “Commission”), the governing body of the South Bend, Indiana, Department of Redevelopment (the “Department”), exists and operates under the provisions of I.C. 36-7-14, as amended from time to time (the “Act”), and is a body corporate and politic; and WHEREAS, the City desires to the transfer to the Commission certain real property commonly known as 105 S. Olive St., and more particularly set forth in Exhibit “A” attached (the “Property”); and WHEREAS, the Commission desires to accept the transfer of the Property from the City for purposes of redevelopment and will execute a mirroring resolution documenting such desire; and WHEREAS, the Commission is expected to adopt a corresponding resolution consistent with I.C. 36-1-11-8. NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND BOARD OF WORKS AS FOLLOWS: 1.The transfer of the following described real property situated in St. Joseph County, Indiana: See Exhibit “A” by the City to the Commission, without consideration, shall be, and hereby is, approved and authorized. 2.The Property Development Manager of Growth & Opportunity for the City of South Bend shall cause the recording of a quit claim deed conveying all the right, title and interest of the South Bend Redevelopment Commission in and to the Property, for the use and benefit of its Department of Redevelopment. 3.This Resolution shall be in full force and effect upon its adoption.
