A RESOLUTION OF THE CITY OF SOUTH BEND, ACTING THROUGH ITS BOARD OF PUBLIC WORKS APPROVING THE TRANSFER OF REAL PROPERTY TO THE SOUTH BEND REDEVELOPMENT COMMISSION
WHEREAS, the City of South Bend, acting through its Board of Public Works (the
“City”), is the owner of certain property identified herein; and
WHEREAS, pursuant to I.C. 36-1-11-8, the City may transfer or exchange property with another governmental entity upon terms and conditions agreed upon by the two (2) entities as evidenced by the adoption of substantially identical resolutions of each entity; and
WHEREAS, the South Bend Redevelopment Commission (the “Commission”), the governing body of the South Bend, Indiana, Department of Redevelopment (the “Department”), exists and operates under the provisions of I.C. 36-7-14, as amended from time to time (the “Act”), and is a body corporate and politic; and
WHEREAS, the City desires to the transfer to the Commission certain real property commonly known as 105 S. Olive St., and more particularly set forth in Exhibit “A” attached (the “Property”); and
WHEREAS, the Commission desires to accept the transfer of the Property from the City for purposes of redevelopment and will execute a mirroring resolution documenting such desire; and
WHEREAS, the Commission is expected to adopt a corresponding resolution consistent
with I.C. 36-1-11-8.
NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND BOARD OF WORKS AS FOLLOWS:
1.The transfer of the following described real property situated in St. Joseph County,
Indiana:
See Exhibit “A”
by the City to the Commission, without consideration, shall be, and hereby is, approved and
authorized.
2.The Property Development Manager of Growth & Opportunity for the City ofSouth Bend shall cause the recording of a quit claim deed conveying all the right, title and interest
of the South Bend Redevelopment Commission in and to the Property, for the use and benefit of
its Department of Redevelopment.
3.This Resolution shall be in full force and effect upon its adoption.
ADOPTED at a meeting of the South Bend Board of Public Works held on
November 12, 2025, at 215 S. Dr. Martin Luther King, Jr. Blvd., Room 301, South Bend, Indiana 46601.

its Board of Public Works (the “Grantor”) CONVEYS AND QUIT CLAIMS TO the Department of
Redevelopment of the City of South Bend, for the use and benefit of its Department of Redevelopment, by
and through its governing body, the South Bend Redevelopment Commission (the “Grantee”), for and in
consideration of One Dollar ($1.00) and other good and valuable consideration, the receipt of which is
hereby acknowledged, the real estate located in St. Joseph County, Indiana:

to complete this conveyance on Grantor’s behalf has been duly taken.
