RESCHEDULED REGULAR MEETING
March 12, 2003

The March 12, 2003 Rescheduled Regular Meeting of the Redevelopment Authority was called
to order at 1:55 p.m. by Mr. Cleo Washington. There was a quorum present.
1. ROLL CALL

2. APPROVAL OF MINUTES
a. Approval of the minutes of January 29, 2003
Mr. Alvarez noted an error on the bottom of the page one should read 13,000sft
rather than 13,OOsft. Mrs. Hullinger said she would correct that.
Upon a motion by Jose Alvarez, seconded by Cleo Washington, the Authority
approved the Minutes of the Regular Meeting of January 29, 2003 as corrected.
3. NEW BUSINESS
a. Certification of the South Bend Redevelopment Authority concerning Insurance
and Tax Liability -Century Center Project.
Upon a motion by Mr. Alvarez, seconded by Mr. Washington, the Authority
approved the Certification of the South Bend Redevelopment Authority concerning
Insurance and Tax Liability for the Century Center Project.
b. Certification of the South Bend Redevelopment Authority concerning Insurance
and Tax Liability -College Football Hall of Fame.
Upon a motion by Mr. Alvarez, seconded by Mr. Washington, the Authority

approved the Certification of the South Bend Redevelopment Authority concerning
Insurance and Tax Liability for the College Football Hall of Fame.
Certification of the South Bend Redevelopment Authority concerning Insurance
and Tax Liability -Palais Royale Project.
Upon a motion by Mr. Alvarez, seconded by Mr. Washington, the Authority
approved the Certification of the South Bend Redevelopment Authority concerning
Insurance and Tax Liability for the Palais Royale Project.
d. Certification of the South Bend Redevelopment Authority concerning Insurance
and Tax Liability -Airport Economic Development Area Public Improvement
Project (Tax-Exempt Improvement Project).
Upon a motion by Mr. Alvarez, seconded by Mr. Washington, the Authority
approved the Certification of the South Bend Redevelopment Authority concerning
Insurance and Tax Liability for the Airport Economic Development Area Public
Improvement Project (Tax-Exempt Improvement Project).
e. Certification of the South Bend Redevelopment Authority concerning Insurance
• and Tax Liability -Blackthorn Golf Course Project.
Upon a motion by Mr. Alvarez, seconded by Mr. Washington, the Authority
approved the Certification of the South Bend Redevelopment Authority concerning
Insurance and Tax Liability for the Blackthorn Golf Course Project.
f. Certification of the. South Bend Redevelopment Authority concerning Insurance
and Tax Liability -South Bend Central Development Area Public Improvement
Project.
Upon a motion by Mr. Alvarez, seconded by Mr. Washington, the Authority
approved the Certification of the South Bend Redevelopment Authority concerning
Insurance and Tax Liability for the South Bend Central Development Area Public
Improvement Project.
g. Certification of the South Bend Redevelopment Authority concerning Insurance
and Tax Liability -Wayne Street Parking Garage.
Upon a motion by Mr. Alvarez, seconded by Mr. Washington, the Authority
approved the Certification of the South Bend Redevelopment Authority concerning
Insurance and Tax Liability for the Wayne- Street Parking Garage.

Project (Taxable Improvement Project).
Upon a motion by Mr. Alvarez, seconded by Mr. Washington, the Authority
approved the Certification of the South Bend Redevelopment Authority concerning
Insurance and Tax Liability for the Airport Economic Development Area Public
Improvement Project (Taxable Improvement Project).
i. Certification of the South Bend Redevelopment Authority concerning Insurance
and Tax Liability -Morris Performing Arts Center Project.
Upon a motion by Mr. Alvarez, seconded by Mr. Washington, the Authority
approved the Certification of the South Bend Redevelopment Authority concerning
Insurance and Tax Liability for the Morris Performing Arts Center Project.
j. Certification of the South Bend Redevelopment Authority concerning Insurance
and Tax Liability -Palais Royale.
Mr. Rock stated that we annually affirm current insurance on all of the properties
that we own. Mr. Washington asked if we are required to have separate polices for
each bond, and Mr. Rock said that was correct. Mr. Case said these are
certifications to our bond trustees that we have insurance for each bond.
Upon a motion by Mr. Alvarez, seconded by Mr. Washington, the Authority
approved the Certification of the South Bend Redevelopment Authority concerning
Insurance and Tax Liability for the Palais Royale.
4. CLAIMS
Claims previously reviewed and recommended for approval by the Director of Economic
Development on March 12, 2003.
Century Center Refunding Bonds of 2001
Century Center (reimbursement for BIG Enterprises, Inc.)
Attendant booth $12,192.50

Mr. Rock said the reimbursement to Century Center comes from the Capital
Improvement Project ($606,246.16) bonds. This money had to be spent by
December 31, 2002. There was $19,812. left. As Liz Rowe looked at some of the
claims that were already done she noticed this one, which was a capital
improvement claim that was paid by the Century Center. So, we would like to
reimburse Century Center for this.
Mr. Washington asked what budget the money would revert to if it wasn't used.
Mr. Rock said we get interest charges and fees on it. Mr. Alvarez said he would
like evidence next meeting that this has been approved by Mr. Inks.
Upon a motion by Mr. Alvarez, seconded by Mr. Washington, .the Authority
approved the claims as presented.
5. STAFF REPORT ON SOUTH BEND CHOCOLATE EXPANSION
Mr. Rock said the South Bend Chocolate. Cafe wants to expand 1,680sft to the north. The
Authority asked how this would impair our bond and Cheryl Greene asked Baker and
Daniels Law Firm. Attorney Randy Rompola said it must meet the private use test and the
private payment test. The private use test- says. the expansion would have to take over
33,600sft to go over the private use test. The additional rent that will be gained by the
expansion will be around $90./month. So, we pass both test. The Chocolate Cafe has been
a real catalyst for the whole block downtown. It has taken a lot of time to check out
easements, title work, and bond work but we have been trying to push this along. In the
end, they will be happy once they can do their expansion.
